1965-04-06 Regular April 6, 1965 The City Council of the City of Okeechobee, Florida, met in regular session at the City Hall ~'~ on the above date at 7:00 P. M. with the following p~esent: Mayor Mack, President McCrocklin, Council- man Gardner, Hunt~ Walker and Watford with Attorney Hendry and Clerk Spivey. F. J. Locklear, Dist~t Manager of Professional Insurance Company was present discussing a group insurance policy for city~ e~pleyees. After discussion Councilman Hunt suggested that this matter be i taken up with the mploye~ The Council suggested that the company contact again in about two months. Leland Pearce, President of the AsSociation discussed with the Council several changes in the contract as request- ed by the Farmers Home Admilzistration, requesting that the City grant a 40 year contract in lieu of the 7 ~ear contract as granted, that a mixdmum amount be entered in contract for cost of relocating an~ install. lng Association equipment iS City Treatment Plant, that the Association be allowed to approve contract on relocating and installin& aSsociation equi~ent in City Treatment Plant and that the water rates would not be increased to association, unless city rates are increased accordingly. After consideration and 4iscussio~ Councilman Watford moved 'to grant a 10 year contract in lieu of 7 year previously granted, to sell water in.icontract to the association for a period of 10 years at a cost of 265 per thousand gallons, enter $5,O00.O0/as maximum amount for relocating and installing association equipment in city treatment pl~t and agree that association be allowed to~ a~prove contract on reloacting and installing equipment im city treatment plant, seconded by Councilman Ga~d~er. Councilman Watford moved to withdraw motion, Councilman Gardner moved to withdraw second. Councilmaa Gardner moved not to enter into 40 year contract and to enter into no contract binding city more than 10 YSars, seconded by Councilman Watford and unanimously carriede Councilman Watford moved to grant a 10 year contract in lieu of 7 year contract previously granted, to sell water to to the association for a period of l0 years at a cost of 265 per thousand gallons, enter in contract $5,000.00 as maximmm amount for relocatin~ And~inStalli~g.~ association equipment in city treatment plant and agree that association be allowed to approve contract on relocating and installing equipment in city treatment plant, sOconded by Councilman Gardner and unanimously carried. Supt. Williams reported that J'. N. Clements would dig approximately 9000 yards of fill and s.tock pile' _on Wolff prooer.ty for 155 a yard from .e~ canal/and Wolff haagiven permission to let it remain on their property for one year. It was agreed that the City determine number of yards du~ and if Clements is not satisfied with figure to produce kis figure at no expense to City. Councilman Gardner moved to enter into contract with J. N. Clements subject to contract to be prepared by Attorney Hendry seconded by Councilman Walker and carrie CONTRACT This Contract made and entered into this 9th day of April, 1965, by and between THE CITY OF OKEE- CHOBEE, hereim called First Party, and J. N. CLEMENTS, P. O. Box 38h, Indiantown, Florida, herein called Second Party; WITNESSETH: That for and ~n-oonsideration of the covenants contained herein, the parties hereto agree as follows: 1. The Secon~ party agrees to excavate and stock pile shell and top soil from property owned by J. O. Wolff and Jack D. Wolff and located in Section 29, Township 37 South, Range 35 East. 2. The. Williams reporte~ that the Florida Power and Light Compan~ had installed a light pole on a sewer line breaking said se~er line which caused the City extra expense to repair. The Council agreed to submit a bill to the Fl~da Power and Light Compan~ for sewer line repair and to request the company in the future to contact wa~er or sewer department when installing poles. Prices were received o~ portable welder for the water department. After discussion~' Councilman Gardner moved to accept bis from Mixon's Machine Shop & Manufacturing in the amount of $675.00 for self starter portable welder seCSnded by Councilman Walker and carried. Councilman Walker stated that Supt. Fortner had requested permission to use old air conditioner removed from Clerk's office at the sewer plant office. The Council agreed for it to be used providing their is no expense to city for repair. Councilman Walker repo~ted again a water line extension request on West 12th Street from Harry Elliott, requiring.approx~tely 300 feet of pipe. After consideration the Council denied request due to distance and their being only. one consumer at present time. Councilman Walker stated that Water Supt. Fortner had requested permission to attend a short course onSewerage Treatment at Gaimesville April 26 to 30. Councilman Gardner moved to grant request and expense and per diem to be as set f~rth in minutes of April 2, 1963, seconded by Councilman Walker and carried. P~suant .to notice bidS were received, opened and read for the purchase of 1 - Hydrated Lime Feeder as per specifications in February 16 minutes from the following: Wallace and Tiernan, I~c. $1'418.00 The Taulman Compan~ 1,066.00 After consideration CouncilSan Gardner moved to accept the bid from Wallace & Tiernan, Inc. in the amount of $1,418.00, seconded by ~uncilman Walker and carried. Councilman Walker discussed with the Council a complaint on water bill at Okeechobee Laundromat, reporting that the meter ha~ been removed and a test had been made and found to be correct stating that more test would be ma~e ~if i~ ~proves incorrect an adjustment would be in order. The Clerk advised to notify owner of this and request payment of bill. The matter of the City using the old County Jail was discussed briefly and postponed for further discussion at next worka~e~meeti~g. Councilman Hunt report~ that Fire Chief Godwin did not take his vacation in 1964, due %o circumstance: known by all Councilmen, ststing that Godwin had requested compensation for the two weeks. Councilman Walker moved due to circums~nce, to compensate Fire Chief Godwin for 1964 two weeks vacation, seconded by Councilman Hunt and carried, Councilman Gardner moved to purchase 18 inch real type lawn mower from Clyde Mc Crocklin at $80.00 seconded by Councilman Hun~and carried. President Mc Crocklin ~eported complain+~ of flowers and shrubs on sidewalk at Ben Franklin Store, activity in local business ~here pool tables are located, trucks parking in street parkways, stating that I~ , ~': ' &' ~m some property owners requested permission to beautify parkway in front of residences, at no expense to city. It was reported that the State Road Department was to erect signs and possibly concrete post in parkways. Pursurant to notice published in the Okeechobee News-Mirror on public hearing for rezoning from Agricultural to Commercial the following described property: Lots 1, 2 and 3 Taylor Creek Manor. President Mc Crocklin asked if there were any objections. No objection was heard or filed. Councilman Gardner moved Go rezone the abov~ described property from Agricultural to Commercial, presen~ting the following Amendment to Ordinance #271 and moved its adoption and upon being seconded by~ Councilman Walker was put to a vote and unanimously ad~pted: ORDINANCE NO. 271- (34) ORDINAN0~ AMENDING ORDINANCE NO. 271, BEING AN ORDINANCE ESTABLISHING ZONING REGULATIONS FOR THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDING FOR THE ADMINSTRATION, ~NFORCEMENT AND ADM~DMENT THEREOF PURSUANT TO THE PROVISIONS OF CHAPTER 176, FLORIDA STATUTES, 1953. WHEREAS, application has been made by J. H. Ward, requesting this Council to rezone from Agricultural to Commercial Lots 1, 2 and 3 Taylor Creek Manor, and WHEREAS, notice of intention to amend City Zoning Ordinance No. 271 regarding said application ~as duly published according to law, and WHEREAS, on the 6th day of April, 1965, a public hearing was held in the City Council room pursuan~ to said notice, and WHEREAS, it is deemed to the best interest of the City of Okeechobee to grant said application; now therefore BE IT OSAINED BY THE CITY COUNCIL OF THE CITY OF 0KEECHOBEE, FLORIDA: SECTION 1. Councilman Hunt repor$ed that the parking spaces needed to be marked off at Methodist Church. It was reported that new street was not quite complete. Councilman Walker rePOrted a complaint of cars being repaired on Kissimmee Street right of way at corner of North Park Stree$. Upon motion the Council adjourned.
