Thence continue southerly along said Section line for a distance of 150.00 feet, thence run West parallel with the north boundary line of said Section 28, for a distance of 361.O0 feet more or less to a point on the east R/W line of State Road 441; thence run northerly along said East R/W line of State Road 441, for a distance of 150.OO feet, thence run east 361.OO feet more or less to POB. No obj~$ion was }~eard or filed, therefore Councilman Padgett moved to rezone the above described property, presenting the following Ordinance and moved its adoption and upon being sec6ned by Councilman Walker was put to a vote and umanimouat~ adopted. ORDINANCE NO. 271- (59) ORDINANCE AM~4DING ORDINANCE NO. 271, BEING ~N ORDINANCE ESTABLISHING ZONING REGULATIONS FOR THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDING FOR THE ADMINSTRATION, ENFORCEMENT AND AMENDMENT THEREOF PURSUANT TO THE PROVISIONS OF CHAPTER 176, FLORIDA STATUTES, 1953, WHEREAS, apT~lication has been made by W.R. Tomlinson requesting this Council to rezone from Residential (R-l) to Commercial Commencing at the Northeast Corner of Section 28, Township 37 South, Range 35 East, run thence southerly along the Section line lOP.P0 feet to POB. Thence continue southerly alon~ said Section line for a distance of 150.00 feet, thence run West parallel with the north boundary line of said Section 28, ~or a distance of 361.O0 feet more or less to a point on the east R/W line of State Road ~41; thence run northerly along said East R/W line of State Road ~l, for a distatnce of 150.00 feet, thence run east 361.O0 feet more or less to POB. Madray, ewner of Twin Lakes Subdivision was present, presenting blue prints of his proposed subdivision deVelepment in an effort to acquaint the Council with his tenative plans. Councilman Breland reported the need of a new police car before the first of the year. The Council agreed to discuss matter further at workshop budget meeting. Coum~ilman Walker reported a request for street light on Hillcrest Street also President Gardner reported a request from Betty Stevenson for street light on east Fourth Street. The Council agreed to have these lights installed. Councilman Hunt discussed information he had received from County Tax Assessor and Collecter regarding the county assessing and collecting city taxes. Attorney Curren requested to prepare necessary resolution governing same. Councilman Walker reported a request from Robert Joiner for water line extension to new house on Wright Street which would require approximately 300 feet of 1½ inch pipe. Upon recommendation of Councilman Walker the Council agreed to approve water line extension. Chief Thomas reported a hole in the street right of way at Seventh Street and Kissimmee Street. Supt. Williams requested to notify Department of Transportation regarding matter. A petition from Attaway Lumber Comoany, by James O. Attaway, requesting the abandoment of that portion of Fourteenth Street located North of an adjacent to Block 57, City of Okeechobee, extending from the East right of way line of N. Parrott Avenue, or U. S. #441 highway, to a Northerly extension of the West boundary line of Block 56 - That portion of Tallahassee Street located between the East boundary line of lots 1 through 3, inclusive, of Block 57, and the West boundary of lots 11 through 13, inclusive, of Block 56 - That portion of the Alleyway located between the West boundary line of lots 1 through 3, inclusive, of Block 57, and the East boundary line of lots 11 through 13, inclusive, of Block 57, subject to a reservation of utility easement by the City of Okeechobee along said Alleyway. The Council authorized the Clerk to publish in the Okeechobee News notice of public hearing to consider request. NOTICE NOTICE IS HEREBY GIVEN that the City Council of the City of Okeecho~ee, Florida, has received a Petition requesting that the City Council officially close - That portion of Fourteenth Street located North of an adjacent to Block 57, City of Okeechobee, extending from the East right of way line of N. Parrott Avenue, or U. S. #441 highway, to a Northerly extension of the West boundary line of Block 56 - That portion of Tallahassee Street located between the East boundary line of lots 1 through 3, inclusive, of Block 57, and the West boundary of lots 11 through 13, inclusive, of Block 56 - That portion of the Alleyway located be- ii tween the West boundary line of lots 1 through 3, inclusive, of Block 57, and the East boundary line of lots 11 through 13, inclusive, of Block 57. The Clerk explaimed a Sewer Tap Fee collected from C. L. Box. Due to the circumstance the Council agreed no charge should be made, therefore, the Clerk was authorized to refund $20.00 Sewer Tap Fee to Mr. Box. Councilman Walker moved to paY curtis Phelps $90.00 per week, seconded by Councilman Padgett and unanimously carried. It was reported that the signal light at Osceola Street and Third Street had been turned school back on due to summer/classes. Due to the number of fires in the county, the Council authorized Councilman Hunt to meet with the County Commissioners to discuss the Fire Department expense and request the County to share the expense. Attorney Curren advised the Council that no Agreement was necessary between Meline and City as per minutes of June 9, 1970, due to plans uot materializing.
