1968-10-22 Regular Adjourned 1127 PRESIDENT CITY COUNCIL October 22, 1968 The City Council of the City of Okeechobee, Florida, met in regular adjourned session at the City Hall on the above date at 5:30 P. M. with the following present: Mayor Dunham, President Gardner, Councilmen Hunt, Padgett, Walker and Watford with Attorney Hendry and Clerk Spivey. Councilman Watford presented the following Ordinance and moved its adoption and upon being seconded by Councilman Hunt was put to a vote and unanimously adopted: ORDINANCE NO. 331 AN ORDINANCE PROVIDING FOR THE ELECTION OF A CHIEF OF POLICE AND PROVIDING THAT WHEN SAID CHIEF OF POLICE IS REMOVED F~OM OFFICE BY THE MAYOR, HE CAN ONLY BE REINSTATED AFTER TRIAL BY THE COUNCIL AND UPON THE UNANIMOUS VOTE OF SAID CITY COUNCIL. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. The Chief of Police of the City of Okeechobee shall be elected by the qualified electors of the City of Okeechobee. SECTION 2. The Chief of Police of the City of Okeechobee shall be elected at the same time that other City Officials are elected, beginning December, 1968. SECTION 3. The term of office of the Chief of Police shall be for a period of four (4) years, beginning on the first (lst) Monday of January following said election. SECTION 4. The Chief of Police of the City of Okeechobee shall be subject to re- moval from office by the Mayor of the City of Okeechobee, in accordance with the Charter of the City of Okeechobee, and shall not be reinstated except after trial by the City CityCouncil, when said Council, by unanimous vote authorizes his reinstatement. Audle~ Dunham MAYOR Attorney Hendry reported a reply from State Road Department regarding the additional spur track requested by Hughes Teed and Grain Company, stating they saw no objection to this proposed siding being installed on the road dedication. Councilman Watford moved to grant Hughes Feed and Grain Company permission to install additional spur track on 14th Street to their building, seconded by Councilman Hunt and unanimously carried. PERMIT This Agreement, made this 22nd day of October, 1968, between the City of Okeechobee, Florida, a municipal corporation organized and existing under the laws of the State of ~-~,~ Florida, party of the first part and Seaboard Coast Line Railroad Company, a corporation organized and existing under the laws of the State of Virginia, having its principal place of business at Richmond, Virginia, party of the second part, Witnesseth: For and in consideration of the sum of One Dollar in hand paid by the second party to the first party, the receipt whereof is hereby acknowledged, and the following covenants, the first party has agreed and does hereby agree to permit the second party, their successors and assigns, to construct, maintain, and operate a spur track along Fourteenth Street, OKEECHOBEE, according to the plat thereof recorded in Plat Book 2, page 17, public records of St. Lucie County, Florida, between the East boundary of Hicpochee Street and the West boundary of Kissimmee Street. For a more particular description, and as explanatory hereof, reference is made to the attached plat, which is hereby made a part of this instrument. This permit is given by the said first party to the second party upon the express condition that the second party indemnify and save harmless the said first party from all claims, demands, suits, and judgements, and the costs and expenses incident thereto which may arise, or be made, brought or recovered against the first party by reason of any such injury or damage done or caused by the construction, maintenance or operation of said spur track. In Witness Whereof, the municipality has caused these presents to be signed by its Mayor and attested by its Clerk and its Corporate seal to be hereto affixed this 22nd day of October, 1968.
