Fortner reported on sewer line investigation at Markham Brothers Canning Pla~t. After discussion and consideration Councilman Walker moved that the sewer line contrellimg the iadustrial was~ from t~e cannimg plant be discontinued but to leave all domestic lines connected to sewer, seconded by Councilman Padgett and ~ously carried. Attorney Hendry explained the injunction filed by the State ~oard of Health against the City of Okeechobee. The Council instructed Atty. Hendry to reply to the State ~oard of Health during the time specified in regards to the injunction. Councilman Walker reported a request for signal light at the corner of Meredith Street and State Road 70. No action taken at this time. Supt. Williams instructed to contact the State Road Department regarding the erection of No truck parking signs on State Road. 70 between Cherokee Street and Tallahassee Street on North side of highway (post office area) and north on State Road 441 between Ninth and Tenth street on east side of highway (Seven Day Adventist School area) and request a school crossing for Seven Day Adventist School. Mayer Dunham reported on condition of Zollie Aldridge property. It was agreed by the Council that Ordinance No. 324 be enforced. The Council agreed to add Mullis' name to the list of requested street lights. A copy of a letter was read fro~ ~rockway, Anderson and Srockway, Engineers to the State Boar~ of Health relating to the temporay installation of booster pumping facilities to provide additonal pressure for water system. Ernest Evans representing the Okeechobee Library ~oard was present requesting additional funds to help furnish the new library. The Council informed Mr. Evans that the City had budgeted $1,OOO.00 for the library and they did net feel at this time the city could donate any additional funds but assured Mr. Evans that if matters proved different the City would cooperate. T. E. Nipper appeared before the Council in regards to a Taxi Franchise. The Council felt they were not well enough informed on this matter and requested Attorney Hendry to check into details of such a franchise. The Council agreed that the City would not issue any mQre taxi license until all I. C. ¢. papers are presented. Attorney Hendry requested te check Taxi OrAinance. Pursuant to notice published in the Okeechobee News bids for the purchase of gas and diesel were received, opened and read. Only one big was received this being from Pure Oil Company as 94 Octane gas, fellows: Posted Consu~mer Tankwagon price, Okeechobee, Florida, time and place of delivery less $.O41 per gallon. A request for two new street markers was received also it was reported that a ~umber of street markers were missing. Street Supt. Williams requested to make survey of street markers needed te replace missing signs. Marvin Wherrell was present discussing a sewer situation at his property on west SKD #70, Bleck 195. The Council agreed to have the matter checked into. Councilman Watferd moved, seconded by Councilman Padgett and unanLmously carried te furnish and install septic tank at the new library building. ~uilding Inspector White requested te contact the local septic tank companies for prices. Councilmaa Walker moved to sell one eld Junked truck b~y to L. C. D. avis for $1.O0, seconded by Councilman Watford and carried. A letter was read frsm the Okeecho~ee County Tax Payers League, Inc. and ordered filed. An application request to rezone Lots 9, 10, 11, 12 and 13, Block 131 from Residential (R-2) te Residential (R-3) to permit a trailer park was received. Councilman Walker moved, seconded by Ceuncil ma~ Padgett and unanimously carried t~ reject request. A letter from Joh~ E. ~ur~eshaw was read relative te the sewer situation at Markham ~rothers Canning Plant. The Council ordered letter filed. The Clerk was requested to contact Haynes E. Williams in regards te i~suram~e an~ tag on county tru¢~ being used by the Dog-catcher. The Clerk was instructed to post notice that bids will be accepted for sale of junked 1~53 Chevrolet pickup truck on April ~th at 7:30 P. March 26, 1~68 The City Council of the City of Okeechobee, Florida, met in regular adjourned session at the City Hall on the above date at 5:30 P. Councilman Walker presented the following Ordinance and moved its adoption and upon being seconded by Ceuncilm~m Watford was put to a veto and unanimously adopted: ORDINANCE NO. 327 AN O~DINANCE OF THE CITY OF OKEECHO~EE, FLORIDA, REI.ATING TO TAX ON CIGARETTES: FIXING ~ATES, F~Q¥IgINII FOR COLLECTION AND USE OF P~OCEEDS; AN~ OT~SE PEr- TAINING TO THE LEVY OF SUCH TAX. ~E IT ORDAINED ~! THE CITY COUNCIL OF THE CITY OF OKEECHO~EE, FLORIDA: Section 1. Tax imposed; Amount (1) An excise or privilege tax, in addition to all other taxes ef every kind imposed by law, is impoSed upon the sale, receipt, purchase, possession, consumption, handling, distribution and use of cigarettes sold er to be sold at retail within the territorial limits of the city (or town if the municipality is so designated) in the fellewing amounts, except as otherwise provided by general law, for cigarettes of standard dimensions: (a) Upon all cigarettes, as herein defined, four inches long or less, five an~ one-half mills on each cigarette. (b) Upon all cigarettes, as herein defined, more than four inches long and not more than six inches long, eleven mills on each cigarette. (c) Upon all cigarettes, as herein defined, more than six inches long, twenty two mills on each cigarette. (2) The description of cigarettes contained in paragraphs (a), (b) and (c) of subsection (1) are hereby declared to be standard as to dimensions for taxing purposes as provided in this ordinance and should any cigarette be received, purchased, possessed, sold, offered for sale, given away or use~ efa size other than of standard dimensions, the same shall be taxe~ at the rate of one cent on each such cigarette. (3) Where cigarettes as described in subsection (1) (a) above, are packed in vary- ing quantities of twenty (20) cigarettes or less, the following rate shall govern: (a) Packages containing ten (10) cigarettes or less require a five and one-half cent <5½ > tax; and (b) Packages containing mere than ten (10) but not more than twenty (20) cigarettes require an eleven cent (ll¢) tax. (4) Where cigarettes, as described in subsection (1) (b) above, are packed in varying quantities of twenty (20) cigarettes er less, the following rates shall govern: (a) Packages containing ten (10) cigarettes or less require an eleven cent (115) tax; and
