1967-11-07 Regular 1075 Councilman Walker moved to rezone from Residential (R-2) to Commercial Lots 14 and 15, Block 27, Northwest Addition, presenting the following Ordinance and moved its adoption and upon being seconded by Councilman Watford was put to a vote and unanimously adopted: ORDINANCE NO. 271 -(48) ORDINANCE AMENDING ORDINANCE NO. 271, BEING AN ORDINANCE ESTABLISHING ZONING REGULATIONS FOR THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDING FOR THE ADMINISTRATION, ENFORCEMENT AND AMENDMENT THEREOF PURSUANT TO THE PROVISIONS OF CHAPTER 176, FLORIDA STATUTES, 1953. WHEREAS, application has been made by David Allgood requesting this Council to rezone fr~m Residential (R-2) to Commercial Lots 14 and 15, Block 27, North- west Addtion, and WHEREAS, notice of intention to amend City Zoning Ordinance No. 271 regarding said application was duly published according to law, and WHEREAS, on the 31st day of October, 1967, a public hearing was held in the City Council room pursuant to said notice, and WHEREAS, it is deemed to the best interest of the City of Okeechobee to grant said application; now therefore BE IT 0HDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. Councilman Watford moved %o pay $128.30 fe~ Police uniform emblems and that the Policemen would not be required to reimburse the City this time for emblems, seconded by Councilman Walker an~ unanimously carried. A request from Hubert Harden for water line extension on West llth Street for two ho~ses and possibley three more, also in Cypress Quarters to supply four houses. Supt. Fortner requested to investigate distance and cost and report to Council. Supt. Fortner reported the condition of the Water Department 1962 Ford truck. The Council agreed to investigate further when the budget is set. Councilman Walker moved to execute Agreement between the City of Okeechobee and Board of ~Ablic Instruction, seconded by Councilman Watford and unanimously carried: AGREEMENT This Agreement made and entered into this 21st day of November, 1967, by and between the Board of Public Instruction of Okeechobee County, Florida, here- inafter referred to as "School Board" and City of Okeechobee, Florida, a municipal corporation, hereinafter referred to as "Cit~' WITNESSETH: Whereas, School Board has undertaken a program of construction of a public school facility approximately three-quarter mile North of the City of Okeechobee, and Whereas the said construction will require the extension of the City's municipal water distribution line; and Whereas City has expressed its willingness to contract for and supervise the installation of said water line extension to conform with and meet the current re- quiremente of the Florida State Board of Health and through its proper of f icier has requested tha~ a sum of money equal to the said installation cost be paid to City in return for all responsibility and liability for or in connection with said water line extension-which responsibility and liability City has expressed a willingness to assume; and Whereas School Board agrees to pay for the following items of constructionl (1) Complete cost of extension of a 8" water distribution main. (2) Ail engineering fees (3) Ail legal advertising (4) Ail inspection fees. (5) Ail cost of fire hydrants in front of or located on said School premises NOW, THEREFORE, in consideration of the premises and of the promise by School Board to pay installation cost in return for City's contracting for and supervising the extension of said water distribution line, the parties hereto agree as follows: 1. City agrees to forthwith proceed with the extension of City's 8" water distribution line to serve the new public school facility now under construction and to conform with and meet the requirements of the State Board of Health, and shall disignate a registered engineer, prepare specifications and call for and award bids according to ].aw. 2. School Board agrees to pay the actual cost incurred in the extension of the I I 1079 subject water line including fire hydrants as hereinbefore set forth in this Agreement 3. City agrees that payment to City by School Board shall be based on actual bid prices and final quantities together with statements of cost for engineering services and legal advertising expenses, and that a tabulation of bids received by City for. said work be submitted to School Board prior to the award of a contract for this work. 4. When all work has been completed as contemplated by this contrac~ City agrees to purchase said water line extension and s~all pay to School Board by way of credit for water consumed by School Board on the premises served by said water line extension. 5. School Board will be credited with 50% of the monthly statement for water con- sumed at the new public school facility served by said water line extension until such time as the total cost of said water line extension has been repaid to School Board by way of said credits. 6. City agrees that water rates charged to School Board shall be standard and uniform to all consumers of like quantities.
