The September 17, 2015, Technical Review Committee meeting was called to order at 10:00 a.m. by Building Official Newell. II. STAFF ATTENDANCE — Secretary. AGENDA — Chairperson. Building Official Newell asked whether there were any requests for the deferral or withdrawal of items on today's agenda. There being none the Agenda stands as published. IV. MINUTES — Secretary. Chief Davis moved to reconsider the approval of the July 16, 2015 minutes until the next meeting; seconded by Public Works Director Allen. Motion carried unanimously. V. NEW BUSINESS — Chairperson. Site Plan Review Application No. 15- 006 -TRC, regarding the construction of a free standing drive -thru Automated Teller Machine (ATM) on an approximate 1.1 acre parcel, Lots 7 to 12 and a portion of Lot 6, Block 90, City of Okeechobee, and located at 500 North Parrott Avenue, Okeechobee, FL. - Senior Planner. Planning Staff Report: Planner Brisson explained Seacoast National Bank owns Lots 1 to 12 of Block 90, City of Okeechobee, Plat Book 5, Page 5. They have built and operate a financial institution on the north half of the block. They are proposing to sell or lease Lots 1 to 5 and a portion of Lot 6, which has the existing building. However, they would like to continue providing services to their customers by an ATM on the remainder of the property. In Tight of the Planning Board and the City Council's recent action, the Land Development Regulation's (LDR's) are being amended to provide for an ATM, as a special exception use. Once the City Council determines whether the drive -thru ATM will be a principal use or an accessory use, the applicant's site plan must be consistent with any requirements associated with the use. TRC - September 17, 2015 - Page 2 of 3 V. NEW BUSINESS CONTINUED. Site Plan Review Application No. 15- 006 -TRC continued. Adequacy of public facilities appear to have been or will be met. Sidewalks presently exist along all street frontages except Northeast 2nd Avenue and when the property is developed in the future, would be required. Lighting for the drive -thru ATM should be shown and no dumpster location is needed. While the Applicant did not specifically address traffic in the site plan submission, comments were offered on the associated Special Exception Application indicating there are no changes to access to the site and there will be a reciprocal easement agreement between the north and south parcels for access and drainage. A reciprocal agreement is necessary if the two parcels are to accommodate the expected patterns of vehicular circulation. The total traffic generation likely to be expected from the drive -thru ATM and conversion of the existing bank building on the north parcel to medical offices would be less than that associated with the existing banking facility. The dimensional standards review appears to meet the requirements with the exception of no landscaping plan shown and should the drive -thru ATM be an accessory use to a commercial pay parking lot, the commercial parking lot must be the principal use and comprise the greater part of improvements to the property. The plans need to show the location and number of spaces in the pay parking lot to which the ATM is proposed to be accessory. County Environmental Health Department: No issues were received. OUA: No issues were received. Building Official: Building Official Newell inquired as to the public safety while utilizing the ATM services. Mr. Steven Dobbs, Engineer for the project, responded the applicant had concerns as well thus no landscaping was shown as they wanted to make sure the ATM was visible. Public Works: No issues were received. Police Department: Chief Davis commented about proper lighting as a safety /security issue. Fire Department: No issues were received. Building Official Newell asked whether there were any comments or questions from those in attendance. There were none. Building Official Newell asked Committee Members to disclose for the record whether they had spoken to anyone else regarding the application or visited the site. He in turn disclosed he had conversations with Mr. Dobbs. Motion and second offered by Director Allen and Chief Davis to approve the site plan review for construction of a free standing drive -thru ATM on an approximate 1.1 acre parcel, Lots 7 to 12 and a portion of Lot 6, Block 90, City of Okeechobee, Plat Book 5, Page 5, and located at 500 North Parrott Avenue with the following conditions: 1. A landscaping plan is submitted meeting all requirements of the LDRs. 2. The location and type of lighting for the drive -thru ATM is shown. TRC - September 17, 2015 - Page 3 of 3 V. NEW BUSINESS CONTINUED. Site Plan Review Application No. 15- 006 -TRC continued. 3. The Applicant has referred, in the Engineer's Report, to this being a modification to "the existing approval of this parcel for the existing 4,000 square foot bank on the north side of this parcel and the previously approved and proposed 24,000 square foot expansion on the south side of this parcel, to include a Freestanding ATM on this parcel." However, this is not merely a modification to an existing site plan. The application showed no information as to the actual site plan for the 24,000 square foot expansion that was approved in 2003. In fact, a new parcel has been created and the parking on the south parcel has been replaced with an ATM and two one- way drives, thus significantly changing the "approved plan ". Therefore, we suggest that when the above referenced 24,000 square foot expansion is undertaken, it should be subject to another site plan review. Motion carried unanimously. VI. ADJOURNMENT— Chairperson. Dobbs Engineering, LLC Florida Certificate of Authorization No. 29206 1062 Jakes Way Okeechobee, FL 34974 1 Purpose: The purpose of this report is to provide the City of Okeechobee with the calculations and documentation to demonstrate that the surface water management system for the proposed Freestanding ATM complies with applicable state and local water resource requirements. Project Description: This project will modify the existing approval for this parcel for the existing 4,000 sf bank on the north side of this parcel and the previously approved and proposed 24,000 sf expansion on the south side of this parcel to include a Freestanding ATM on this parcel. To achieve this approval, the existing parcel will be subdivided into two independent parcels, but since the parking and drainage are tied together a reciprocal easement agreement tying the drainage and parking together will be prepared, reviewed and approved by the City and recorded in the public record (this will take place under separate cover). This use is a not explicitly approved by the City Code, however, according to John Cook, the following argument could be made: The argument in favor of approval would be that sec. 90 -282 of the code states that "The following principal uses and structures are permitted within the CHV district" (12) commercial parking, garage or lot, taxi stand, bus terminal. And Sec. 90 -283 of the code states "The following uses and structures are permitted in the CHV district after issuance of special exception use petition..." (1) Drive - through service It could be said a freestanding ATM is certainly a permanent structure; and as such would be considered a "business" with a principal use of drive through service located on a permitted use of commercial parking lot. As examples of course, it is mentioned that the unmanned freestanding windmill water service on NW 6th avenue, and unmanned drive through car wash services, are "structures ", permanent in nature, and permitted and located on commercially zoned parcels within the city. This project will end up after the proposed split of the parcel being a 1.0 acre in size and is located in Section 3, Township 37 South, Range 35 East. It is located in the City of Okeechobee, on the east side of SR 441N, north of NE 5th Street Right of Way, on the following parcel (Parcel ID 3- 15 -37 -35 -0010- 00900 -0010) (This is the current parcel number, a subsequent parcel number would be assigned with the proposed lot split. The site is currently partially developed. There is a vehicular drive and parking on the south lot. The remainder of the lot is currently undeveloped, but approved for a 3 story, 24,000 sf building. This request is to construct a Freestanding ATM in the existing parking area on the west side of the parcel where there is good visibility of the proposed structure, which provides additional security for this proposed use. The existing drainage system will not be changed due to the limited change in site plan. Most of this site was planned to be impervious, while it is largely undeveloped. In order to not impact the site in the future, impervious parking area will be removed that will exceed the pervious area being removed to provide adequate access for the Freestanding ATMs. Off -Site Drainaze: There is no off -site drainage anticipated onto the property. The existing perimeter berm will prevent any off -site runoff from draining onto the project site. Construction Recommendations: Runoff and/or any water generated by short-term dewatering during construction will be contained on -site. However, there is some potential for transport of sediment to off -site areas should heavy rainfall occur. In order to reduce the potential of any off-site transport of sediment or turbidity we recommend installation and maintenance of temporary silt fence inside the southerly property line in the area of the proposed paving of the existing rock road and upstream of the existing control structure until site work has been completed and the site has been stabilized. (The existing perimeter berm should prevent any potential off -site transport of sediment from other areas of the site during construction.) 2 Conclusions: In my professional opinion, the proposed construction should have no impact to existing drainage patterns off -site and should have no impact on off -site areas. The recommendations above should be followed during and after the site work until such time as the ground surface has been adequately stabilized to prevent the off-site transport of any soil or suspended solids.
