A. Petition No. 15- 005 -SE, to allow a drive - through service within a
Heavy Commercial Zoning District (Ref. Sec. 90 -283 (1)) for property
located at 500 North Parrott Avenue, containing approximately 1.08
acres. The proposed use is for a freestanding Automated Teller
Machine (Exhibit 1).

VICE CHAIRPERSON MCCOY OPENED THE QUASI- JUDICIAL PUBLIC HEARING AT 6:02 P.M.
Special Exception Petition No. 15- 005 -SE, to allow a drive - through service within a Heavy Commercial (CHV) Zoning
District (Ref. Sec. 90 -283 (1)) for property located at 500 North Parrott Avenue, containing approximately 1.08 acres.
The proposed use is for a freestanding Automated Teller Machine (ATM).
This being a quasi - judicial proceeding, Notary Public Patty Burnette administered an oath to those intending to offer
testimony, all responded affirmatively, and stated their names and addresses for the record: Bill Brisson, Senior Planner,
LaRue Planning and Management,1375 Jackson Street, Suite 206, Fort Myers, Florida, and Mr. Steven Dobbs, P.E. with
SLD Engineering of 1062 Jakes Way, Okeechobee, Florida.
Vice Chairperson McCoy yielded the floor to Planner Brisson, who explained Seacoast National Bank owns Lots 1 to
12 of Block 90, City of Okeechobee, Plat Book 5, Page 5. They have built and operate a financial institution on the north
half of the block. They are proposing to sell or lease Lots 1 to 5 and a portion of Lot 6, which has the existing building.
However, they would like to continue providing services to their customers by an ATM on the remainder of the property.
In light of this Board and the City Council's recent action, the Land Development Regulation's (LDR's) are being
amended to provide for an ATM, as a special exception use.
Planning Staff's recommendation for approval with stipulations is based on two sets of criteria. One being the site's
consistency with the current LDR's, and the other is "Findings Required to consider a Special Exception ". Planning Staff's
responses to the applicant's presentation on consistency with the LDR's are, there is nothing about the site that would
indicate the proposed use is not suitable for a drive -up or drive -thru facility, although the site can only be considered
appropriate for the use should the City Council amends the LDR's to allow this as either a principal or accessory use.
The property is located within an area designated on both the Future Land Use Map and the Zoning Map for commercial
uses. No specific design efforts are needed as the proposed use should require no more landscaping than would be the
case for the former parking area. This will be addressed during the site plan review process. No potential hazards
associated with the proposed use are foreseen and there are existing utilities available to the site. It is expected that the
traffic generation expected from the drive -thru ATM and the conversion of the existing bank building on the north parcel
to medical offices, would be less than that associated with the existing banking facility.
Planning Staff's responses to the applicant's presentation on the required findings are, the proposed use is not contrary
to the Comprehensive Plan. While drive -thru service is a specific Special Exception use identified in the CHV Zoning

District, it is also necessary that the drive -thru service in and of itself, be associated with a use that is allowed. It is for
this reason that the Board of Adjustment and the City Council need to consider how to allow a drive -up ATM in the
various commercial districts and why any approval of the requested Special Exception must be conditioned upon the
City Council's decision on the proposed Text Amendment change regarding whether a drive -up ATM will be a principal
use or an accessory use. The proposed use will not have an adverse effect on the public interest, is appropriate for the
proposed location, compatible with adjacent uses, and not detrimental to urbanizing land use patterns. The use will not
affect property values or living conditions, nor be a deterrent to the development of adjacent property as they are
already developed commercial or residential multiple family properties. There should be no potential hazards or
nuisance associated with the proposed drive -up ATM and no need for specific screening will be required. The use will
not create a density pattern that will overburden public facilities such as streets, schools, and utility services. The
proposed use is not expected to significantly increase traffic congestion, traffic safety will not be compromised, flooding
and drainage problems are not expected.
Planner Brisson recommends the following stipulations, the City Council approves the Text Amendment change
regarding whether a drive -up ATM will be a principal use or an accessory use and the Technical Review Committee
(TRC) approves a site plan consistent with the Text Amendment change regarding whether a drive -up ATM will be a
principal use or an accessory use as it is adopted by the City Council and that meets all other requirements of the
LDR's.
Member Batton questioned as to whether the applicant's request was for a drive -thru only or to include a walk -up as
well? Mr. Brisson replied, according to the site plan only a drive -thru is shown with no provisions for a walk -up. Member
Brass expressed some concern with what mechanism would be in place to ensure the related financial institution
continued to operate in the City or County and prevent the ATM from becoming an unsupported accessory service. Mr.
Brisson explained there really is no mechanism in place that would prevent this except that businesses are required
to obtain a Business Tax Receipt from the City prior to opening a business. In addition, should someone like the Code
Enforcement Officer, observe a business operating an ATM that was not associated to a bank or other financial
institution with an office located in the City or County of Okeechobee, the ATM would be required to shut down.
Mr. Dobbs was present to respond to questions. There were none.

Commercial Zoning District (Ref. Sec. 90 -283 (1)) for property located at 500 North Parrott Avenue, Lots 7 to 12 and a
portion of Lot 6, Block 90, City of Okeechobee, Plat Book 5, Page 5, containing approximately 1.08 acres for the
proposed use of a freestanding ATM with the following stipulations: the City Council adopts Ordinance 1127 in a manner
that allows for a drive -thru ATM either as a principal use or accessary use, and the TRC approves a site plan consistent
with Ordinance 1127 as it is adopted by the City Council and that meets all other requirements of the LDR's, seconded
by Board Member Batton.

Standards for granting a special exception:
1. Demonstrate that the proposed location and site are appropriate for the use.
The site is located at 500 NE 5`" Street a little north of town where this freestanding ATM will service
the existing band customers that used the brand on the north parcel. The existing bank branch
currently offers Drive -Thru ATM Service, this location is perfect for this use since the existing
customers would be displaced by the closing of the bank branch. This project will offer almost
everything a branch would offer the bank's clients.
2. Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent
uses and the neighborhood, or explain why no specific design efforts are needed.
The site and proposed buildings and site layout will be designed to make access to, around, and from
the site as accessible as possible. The applicant wishes to remove any impediment to access to this
property.
3. Demonstrate any landscaping techniques to visually screen the use from adjacent uses; or explain why no
visual screening is necessary.
The proposed landscaping will be in compliance with the City's Landscaping Code. The site is
currently landscaped, which will be reviewed with City staff and law enforcement if changes are
required, they will be completed as required.
4. Demonstrate what is proposed to reduce the impact of any potential hazards, problems or public nuisance
generated by the use; or explain how the nature of the use creates no such potential problems.
The nature of the business is all service will be provides at the free standing ATM drive thru. There
should be no potential hazards or public nuisances generated by the use. Since this use is on the
north parcel and it is simply being moved to the south parcel, this use will cause no more public
nuisance that is currently experienced.
5. Demonstrate how the utilities and other service requirements of the use can be met.
There are existing water and sewer service to the site as well as power, so there are no utility or
service requirements that cannot be met currently

6. Demonstrate how the impact of traffic generated will be handled, off site and on site.
Since there are no changes to access to the site and there will be a reciprocal easement agreement
between the north and south parcels for access and drainage there will be no impact to current traffic
patterns.
Findings required for granting a special exception:
1. The use is not contrary to the Comprehensive Plan requirements.
The parcels along Highway 441 are perfect for business such as the one proposed and is absolutely
within the spirit of the Comprehensive Plan.
2. The use is specifically authorized as a special exception use in the zoning district.
According to the City of Okeechobee, Code of Ordinances Section 90- 283(1), Drive- through services
is permissible in this zoning district.
3. The use will not have an adverse effect on the public interest.
Since this is replacing an existing function from the north parcel, there should be no adverse impact
on neighboring businesses.
4. The use is appropriate for the proposed location, is reasonably compatible with adjacent uses and is not
detrimental to urbanizing land use patterns.
Yes, this parcel is developed and a stand -alone ATM will be added to the existing parking area and it
is compatible with all adjacent uses.
5. The use will not adversely affect property values or living conditions, nor be a deterrent to the development of
adjacent property.
This change will not negatively impact property values or living conditions, nor deter development of
adjacent property as all adjacent property is already developed.
6. The use may be required to be screened from the surrounding uses to reduce the impact of any nuisance or
hazard to adjacent uses.
No hazards or impacts are anticipated by this use to adjacent uses.
7. The use will not create a density pattern that will overburden public facilities such as schools, streets, and
utility services.
This use will not overburden public facilities including streets and as stated previously the utilities
already servicing this site are sufficient for the proposed use.
8. The use will not create traffic congestion, flooding or drainage problems, or otherwise affect public safety.
There are no adverse impacts anticipated to the above mentioned categories for this proposed use.

Item Before the Board of Adjustment
The matter for consideration by the City of Okeechobee Board of Adjustment is an
application for a Special Exception to allow a free - standing, drive -up Automated Teller
Machine (ATM) on the southern half of the Seacoast National Bank Building property
located at 500 North Parrott Avenue.
Description of the Situation
The property is currently the subject of a lot split, dividing the Seacoast National Bank
Building property roughly in half, creating a north parcel and a south parcel. The
property on which the proposed drive -up ATM will be located is the south parcel.
Whether the drive -up ATM will be a principal use or an accessory is dependent upon
the City Council's action on Ord. 1127. This is the text amendment to the LDRs that
was recently reviewed by the Planning Board and for which the Planning Board
recommended to the City Council approval for a drive -up ATM as an accessory use to
any commercial use allowable in the CPO, CLT, CHV, and CBD Zoning Districts.
If the City Council approves an ATM as only allowable an accessory use, the Applicant
is proposing to create a commercial parking lot to which the drive -up ATM will be an
accessory use.

Furthermore, the site plan for the location of the drive -up ATM, or drive -up ATM and
commercial parking lot, on the south parcel will have been reviewed by the TRC on the
morning of September 17th. Therefore any approval by the TRC will be conditioned
upon the Board of Adjustment's approval of the Special Exception, which will in turn be
conditioned upon the decision of the City Council with respect to Ord. 1127.
Section 70- 373(b) requires that the Applicant address the following standards for
granting a Special Exception, during his /her presentation to the Board of Adjustment.
The Applicant has submitted, as part of the submission, brief statements and informa-
tion addressing these standards. The Applicant's statements are shown in Times Roman
typeface. Staff comments follow and are shown in bold Arial typeface.

Demonstrate that the proposed location and site are appropriate for the use.
"The site is located at 500 NE 5th Street a little north of town where this freestanding

There is nothing about the site that would indicate that it is not suitable for
a drive -up or drive -thru facility; it is large enough and, if a reciprocal
access agreement, is entered into, vehicular access will be afforded from
both NE 5th and NE 6th Streets. Of course, the site can only be considered
appropriate for the use if the City Council amends the LDRs to allow a
drive -thru ATM as either a principal use or as an accessory use.

The relocation of the existing drive - through ATM from the north parcel to
the western side of the south parcel should have no significant effect upon
the compatibility of the use with adjacent uses or the surrounding
neighborhood. Access and egress should be generally the same as was
the case in its former location. The new drive -thru location replaces the
existing parking fronting on US 441 and will be locate in the center of the
original driveway with the new one -way drives located on either side of the
drive -thru ATM.
Demonstrate any landscaping techniques to visually screen the use from
adjacent uses; or explain why no visual screening is necessary.

The drive -thru ATM should require no more landscaping than would be the
case for the former parking; but, nevertheless will need to be reviewed by
the TRC at the time of Site Plan Review.

the use creates no such potential problems.

We agree. We did a quick check of the traffic generation, using trip
generation rates from the 8t" Edition of the ITE Trip Generation Report. We
expect that the total traffic generation likely to be expected from the drive -
thru ATM and conversion of the existing bank building on the north parcel
to medical offices would be less than that associated with the existing
banking facility.
Section 70- 373(c) (1) — (8)
When reaching a conclusion on a Special Exception request, the Board of Adjustment
shall consider and show in its record the following findings as set forth in Section 70-
373(c)(1) — (8). The required findings are listed below followed by the Applicant's
statements in Times Roman typeface after which are the Staff comments in bold Arial
typeface.

While drive thru services is a specific use identified in Section 90- 283(1), it
is necessary that the drive -thru services be associated with a use that is
allowed in the CHV District. Drive -thru service in and of itself is not a use;
therefore, the use which is offered by the drive -thru service must be an
allowable use in the district. For example, if one wished to offer drive -thru
service associated with an adult book or video store the special exception
would not be appropriate.
It is for this reason that the BOAA and City Council needed to consider how
to allow a drive -up ATM in the various commercial districts and why any
approval of the requested Special Exception must be conditioned upon the
City Council's decision on Ordinance 1127
The use will not have an adverse effect on the public interest.
"Since this is replacing an existing function from the north parcel, there should be no

The nature and scale of the proposed drive -thru ATM is not appreciably
different from that already in existence and should not have an adverse
impact on the public interest.

The relocation of the existing drive - through ATM from the north parcel to

We agree that the nature and scale of the proposed improvements are not
significantly different from that already in existence and should not appre-
ciably adversely affect property values, living conditions or development
potential of adjacent properties.

impact of any nuisance or hazard to adjacent uses.

Based upon the foregoing analysis and findings, Staff recommends that Petition
Number 15- 005 -SE be approved with the stipulation that:

either as a principal use or accessory use and,
2, The TRC approves a site plan consistent with Ord. 1127 as it is adopted by the City
Council and that meets all other requirements of the LDRs.
