Adjourned919 Councilman Warlord moved, seconded by Councilman Gardner and carried to appoint the following Electin Officials for December 1, 1964, City Election @ $1.00 per hour: Willa Minehan, Clerk, Inspectors, Eugenia Bowden, Wilma Chandler and Carrie Peterman, Machine Operators, June Boromei and Gladys Lows, J. H. Beard, Deputy and Frank Havely Machine overseer. Councilman Walker moved to close Absentee Ballot voting Friday, November 27, 1964 at 5:00 P. M. seconded by Councilman Gardner and unanimously carried. Upon metion the Council adjourned to meet Tuesday, November 17, 1964 at 5:15 P. M. Councilman Hunt moved to award the Garbage Franchise to M.! F' Kinsaul, seconded by Councilman Walker and unanimously carried. The Council agreed that Attorney Hendry notify all interested persons regarding this a~ion. GARBAGE FRANCHISE TLs Agreement made and executed in duplicate this 17th day of November, 1964, by and ~etween THE CITY OF OKEECHOBEE, acting by and through its City Council, herein called ~e City, and M. F. K~NSA~, ef Okeechobee, Florida, herein called The Franchise Holder~ ~ WITNESSETH: F~ and in consideration of the payments hereinafter provided for~ the City does hereby grant to the Franchise Holder an exclusive franchise for the collection, removal and di~sal of garbage and trash within the corporate limits of the City of O.keechobee, Florid~ I~ consideration of the granting of this franchise, .The Franchise Holder covenants and ag~es to furnish service and to comply with and abide by the provisions of this Agree~ ~nt. T~$ parties hereto covenant and agree with each other as follows: 1~ This franchise shall be for a term of fice (5) years beginning on the 1st day of Dec~ber~ 1~6~ unless terminated by the City as hereinafter provided. ~J~ This franchise is granted subject to such rules and regulations as the City has or may hereafter promulgate and adopt pursuant to the City Charter and Laws of the State o~ Florida. 3. Franchise Holder covenants and agrees that at all times during the term of said franc?~e he will provide and have in full force and effect property damage and public liabi~y insurance coverage on motor vehicles and equipment used in the performance of this fr~nchise. The minimum coverage limits of said insurance shall be prescr, tbed and designed by the city. 920 4. The FranChise Holder before commencing any work under this franchise shall execute or furnish a bon~ to be approved by the City with surety in the penal sum of $1,000.00 con- ditioned for the faithful performance of the provisions of this franchise. 5. The City is to be paid by the Franchise Holder each and every month a sum equal to 2% of the gross receipts of the Franchise Holder collected during the preceding month. Said sum shall be paid on or before the ~Sth day of each month and such payment shall be accompanied by a ~signed statement from the Franchise Holder certifying that the amount paid is the pro~r amount due under the terms of this agreement. The submission by the Franchise Holder of a false statement regarding payment shall be grounds for the cancel- lation of this ?~anchise. 6. The Framchise Holder shall collect garbage and trash at least one each week from each house, place of business or institution for which the Franchise Holder is paid. ?. The rates to be charged by the Franchise Holder shall be established as follows; subject, however~ to revision or modification from time to time by the City: CLASS 1. S~GLE FAMILy RESIDENCES The rate for single family residences shall be bne pick-up per week with maximum of ~o 30 gal. receptacles - $1.50 per month. CLASS 11. ~LEX FAMILY RES ~E~CES. The rate fo~ duplex family residences (excluding apartment houses) shall be 'two pickups Per week with maximum of two 30 gal. receptacles - $2.5~ per month. in. ,C0 RC The rate to all apartment houses, hotels, churches, inns, lodging and rooming houses, to~st and motor courts, and all other places of public accomodations, store rooms~ offices, resturants, garages, service stations, manufacturing plants, tra~er courts, office buildings, and all other classes of users in the City of keechobee, not named in CLASS 1 and CLASg 1~' shall~ be determined by the number of pick-ups per week and the quantity involved. Collections shall be for Just one month in advance. 8. The Fra~hise Holder shall furnish the services described above and shall comply with the ~ollowing rules and regulations in addition to any others which may be promulgated s~i adopted by the City of the County Health Department. A. Each tr~k collecting garbage or trash shall be equipped with solid sides~ bottom and tailgate of wood or metal and with a canvas, wood or metal cover o~er the top to prevent trash or garbage from blowing over or falling off of the truck. Ail equip- ment used in con~ction with this franchise shall be subject to the approval of the City. B. Each tr~Ck shall have the name of the Franchise Holder displayed o~ each d~or of the truck or i~ a conspicuous place on the side of said truck in letters of such size to be easily rea~ble and subject, however, to the approval of the City. C. Only the County Dump located off the Air Port road shall be used'by the Franchise Holder for the disposal of garbage and trash unless otherwise designated by th~ City. 9. This Fra.~chise may be cancelled by the City for failure of the Franchise Holder to comply with an~ abide by the covenants and agreements of this franchise or failure and refusal of th~ franchise holder to comply with and abide by the rules and regulations adopted and promulgated by the City or the County Health Department. Reasonable notice and opportunity to comply shall first be given to the Franchise Holder before cancellation. 10. This Franchise is not transferrable and shall not be sold, l~ased or assigned without the writtsn approval of the City. l!. It is fully understood by the parties to this contract that the Franchise Holder ~ at all times during the term of this Franchise an indeptendent contractor - and is i~ no way an employee of the City of Okeechobee. The CounCil agreed on the following increase in salaries: Street Supt. $15.00 per, week, $5.00 per week for laborers in Street Department; Police Chief $10.00 per week, Assistants and Radio Operators $5.00 per week; Fire Chef $10.00 per week; City Clerk $10.00 per week, City Clerk Assistant (Cassel) $5.00 per week, and Buildin$ Inspector Expense $5.00 per week.
