Demonstrate that the proposed location and site are appropriate for the use. The two parcels included in this request are located east of the existing facility at 1646 Highway 441 N. This special exception request is for an expansion of an existing facility. This is a perfect location for this proposed expansion. 2. Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent Uses and the neighborhood, or explain why no specific design efforts are needed. The site and proposed buildings and site layout will be designed to make access to, around, and from the site as accessible as possible. The applicant wishes to remove and impediment to access to this property. 3. Demonstrate any landscaping techniques to visually screen the use from adjacent uses; or explain why no Visual screening is necessary. The proposed landscaping will be in compliance with the City's Landscaping Code. Visually screening from adjacent uses should not be required as the Raulerson Hospital is to the north and that portion of their property is undeveloped as are the parcels to the east and south of the property and to the west is the existing facility which requires no screening. 4. Demonstrate what is proposed to reduce the impact of any potential hazards, problems or public nuisance enerated by the use; or explain how the nature of the use creates no such potential problems. The nature of the business does not create any potential hazards, problems or public nuisances to surrounding properties as 95% of the facilities activities are performed indoors. The only functions performed outside are sitting and smoking areas for the patients and staff The Assisted Living aspect of the facility will basically be the same other than residents coming and going on their own, which is different from the nursing home standard practice. 5. Demonstrate how the utilities and other service requirements of the use can be met. All services and utilities required are already onsite serving the existing facility. Services will only have to be extended to the planned expansion. 6. Demonstrate how the impact of traffic generated will be handled, off site and on site. Currently, there is an access to FDOT to the west of the existing facility that not only serves this facility, but it is a joint access between this facility and Raulerson Hospital to the north. This access serves as the main access for the emergency vehicles that use the Hospital. The use is appropriate for the proposed location, is reasonably compatible with adjacent uses and is not detrimental to urbanizing land use patterns. Yes, these parcels are adjacent to the main facility and Raulerson Hospital which is compatible with either use. As the other parcels are undeveloped around the facility, there is not detriment to any of those parcels. 5. The use will not adversely affect property values or living conditions, nor be a deterrent to the development of 4djacent property. This change will not negatively impact property values or living conditions, nor deter development of adjacent property. 6. The use may be required to be screened from the surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. APRIL 16, 2015 - PLANNING BOARD - PAGE 11 OF 14 CUSSION Chairperson Hoover yielded the floor to City Planning Consultant Brisson, who explained the matter before them is a Special Exception to allow the expansion of the existing nursing home located at 1650 U.S. Highway 441, North. This expansion will include the possibility of being used as either a nursing home or an assisted living facility. The subject properties are being annexed into the City and are also the same two vacant parcels as previously considered and recommended by the Board, Comprehensive Plan Amendment Application No. 15-001-SSA and Rezoning Petition No. 15- 002 -R. With the approvals, the subject parcels will carry a FLU designation of Commercial and be zoned CHV. Planning Staffs recommendation for approval is based on two sets of criteria. One being the site's consistency with the current LDR's, and the other, findings required to consider a Special Exception. Planning Staff's responses to the applicant's presentation on consistency with the LDR's are, the location and specific site are appropriate for the proposed uses, no preliminary site layout has been provided although, the expansion located east of the existing facility is logical, and adjacent properties are afforded adequate spatial buffers. Even thought the City Limits Ditch may prove an acceptable spatial buffer, some landscape buffering may be necessary along the southern boundary adjacent to the single family zoned property. There will be no significant effects upon the surrounding properties, although such uses sometimes require emergency ambulance services, and the lighting from parking areas, which can be a nuisance to adjacent residential areas. The site plan should locate the entrance for the ambulances and parking areas expected to be used during nighttime hours as far as possible from the residentially zoned properties to the south. Since the proposed expansion is for only 18 beds, any increase in the demand upon utilities, sanitary sewer, solid waste, or traffic, will be minor. Planning Staffs responses to the applicant's presentation on the required findings to consider the Special Exception are, the proposed use is not contrary to the Comprehensive Plan. Nursing homes and assisted living facilities are specifically listed as Special Exception uses in the CHV Zoning District. The proposed uses will be directly associated with the existing use to the west and not be expected to have an adverse effect upon the public interest. The particular uses requested are appropriate for the proposed location, compatible with adjacent uses and not detrimental to urbanizing land use patterns. The uses are not believed to adversely affect property values or living conditions. There may be a need for some landscape buffering along the southern boundary adjacent to the single family zoned property. The uses will not create a density pattern that will overburden public facilities such as streets, schools, and utility services. The expansion is not expected to significantly increase traffic and should have no effect on public safety. Mr. Brisson is recommending approval with the following stipulations: the TRC consider during the site plan review, the need for landscape buffering along the southern boundary adjacent to the single family zoned properties, and consider the need to locate the entrance for ambulances, and parking areas expected to be used during nighttime hours, as far as possible from the residentially zoned properties to the south.
