RECESSED MEETING THURSD~. MARCH 16~ 1978
The City Council of the City of Okeechobee, Florida, convened india
Recessed Session in the Council Chambers at the City Hall, 0keechobee,
Florida, at 7:00 P.M., Thursday, March 16, 1978.
President Russell V. Domer presiding.
Councilmen Jim Knight, Edward W. Douglas and Lavon Bass were present.
Councilman Lytle Raulerson was absent.
Others present were: David Conlon, City Attorney; Ernest R. Bartley,
Planning Consultant; Carter McDowell, Planning Consultant. Assistant and
Sylvia Christian, Acting City Clerk.
LOCAL GOVERNMENT COMPREHENSIVE PLANNING ACT - ZONING - SECOND HEARING
Dr. Ernest R. Bartley, A.I.P., appeared before the Council for the
Second Hearing on the Local Gov~rmsmnt Comprehensive Ptanning Act-Zoning.
The following persons appeared with their request:
1. John Louthan. Mr. Louthan questioned if the property located
between 7th and 8~h Street on the East side of Parrott Avenue would be
taxed on use or potential use?
Attorney Conlon stated that Bill Sherman, Tax Assessor, would be the
one to answer this question.
Dr. Bartley also stated he felt Mr. Louthan should speak with Mr.
Sherman.
2. Mrs. C. L. Walk. Mrs. Walk requested that Block 67 which is
now Holding be Single Family Dwelling.
3. Mr. Altnn Gillen. Mr. Gillen appeared to hear what action had
been taken on his request at the First Hearing.
4. Mr. Phil BerBer. Mr. Berger appeared to hear what action had
been taken on his request at the First Hearing.
5. Mr. Clarence Arnold. Mr. Arnold appeared to hear what action had
been taken on his reqmest at the First Hearing.
It being the hour of 8:00 o'clock P.M. President Domer called.~ith~
hearing to a close and the Council went into a Workshop Meeting. The
Meeting was turned over to Dr. Bartley who stated that each of these
items has been coded in his notes and the properties have been outlined and
coded on the map which has been used for the purpose of the Public Hearings.
1. Charles Robertson. Blocks 11, 12, 21, 22, 4, 13, 20 and 29, North
West Section of the City bounded on the East by 3rd Street and the West
by 7th Avenue and on'the North by 13th Street. Land proposed for Federal
Housing Project. Mr. Robertson propoees that ~B~o~k'21,'I2, ll~8ndq22:,be
zoned sidle family and Block 4, 13, 20 and 29 be zoned multi-family, or

rental property. The new zoning map shows this area to be Holding.
Dr. Bartley stated that as far as his recommendation~is concerned ~his
would not in any way unfairly prejud~¢e~ other property in the area.
Dr. Bartley stated ~hat Blocks ll and 22 and Lots 12 and 13 of Block
20 are zoned Industrial. The rest of the property is zoned single
family. Dr. Bartley informed the Council that his conversation on
Tuesday, February 28, 1978 with Mr. Robertson proposed that Blocks
4, 13, 20 and 29 be utilized for multiple family and that Blocks 21,
12, ll and 22 be utilized for single family purposes because it differs
from the rezoning application.
Following discussion Councilman Douglas moved to designate for
RG-2 Blocks 4, 13, 20 and 29 and for RSF Blocks 21, 12, ll and 22,
seconded by Councilman Bass and vote carried.
2. Philli~ Ber~e~. Tract on the southerly City Limits. Which
has been alienated on the propesed map for RG-1 the request is~'~or
RG-2. ~en Mr. Berger made the request there was discussion involving
access to this particular piece of property, that one of these lots to
the north under his control, might be used for aecess into developing
single family areas to the north, but he does have access to the east
and there is a County Road along the south side of the property.
It was maved by Councilman Knight to change from RG-1 to RG-2,
acreage, not platted land, southern boundary of the property is City
Line 3½ blocks west of Parrott Avenue, containing 7 acres,~ seconded by
Councilman Bass and vote carried.
3. Relates to Block 3 Lot 26 located near the north City Limits
and west of Parrott Avenue. T~is particular line which was drawn
originally on the map did not include lot 26 as a part of the ownership
which includes lots 4, 5 and 6 of Blocks 3 it simply represents a cor-
rection in line to pick up an entire ownership.
Councilman Douglas moved to correct map, seconded by Councilman
Knight and vote carried.
4. Wa.¥ne H. Fulford Trustee. Lots 7, 8, 9, 16, 17, 18, 21, 22, 23
and eas~ half of Lot 20 in Block D on South 4th Street to the west of
Marina on Taylor Creek south of Mobile Home Park across the Street to
the north. There are presently in this area 4 duplex and 7 available
areas for duplex. The RG-1 of the proposed Ordinance would cover duplex
construction. Request change from RSF to RG-1.
Councilman Bass moved to change the proposed property from RSF to
RG-1, seconded by Councilman Knight and vote carried.
5- Hubert Harden. Block 71 which is bounded by west 6th Avenue,
north 7th Street, west 7th Avenue and north 6th Street. Use for this
property for a Church. It does not contain the 5 acres as required. ---
There is a provision for special exception for a church in this area
where less than 5 acres of land is involved. Request the use efa
mobile home for temporary church purposes. Dr. Bartley pointed out
that this was not covered under the present Ordinance. No action necessary.
6. Hubert Harden. Block 145, Lots 10, ll and 12. Property zoned
RG-2. Mr. Harden was interested in what could and could not be done
with this property. Dr. Bart~ey stated that he informed Mr. H~rden
the property}was zoned RG-2. Mr. Harden had in mind to build duplex
or tz~plex on the property. No Action Necess~y.
7. Mrs. Fred Kramer. Talked with Dr. Bartley about City-County
Consolidation.
8. Frank Fitzpatrick. Block 137 located immediately west of the
Courthouse, lot 10, ll and 12. All surrounding property shows businesses.
Mr. Fitzpatrick requested the property be zoned Commercial instead of
RG-2. Dr. Bartley informed Mr. Fitzpatrick that a business can be located
in RG-2 zoning. Confermation~of lines as presently shown on lots 10,
11 and 12 Block 137.
Councilman Douglas moved to retain lines as is, on lots 10, 11 and
12, Block 137, seconded by Councilman Bass and vote carried.
9. Gil Culbreth. Block 207, Lots 9, l0 and ll. Presently used for
Commercial purposes. Wants line drawn to include Lots l, 2 a~d 3 and
change from RG-2 to Commercial. In Commercial zoned property existing
Residential use is permitted under New Ordinance.
Following discussion Councilman Knight moved to change from RG-2
to Commercial Lot 9, l0 and ll, Block 207, seconded by Councilman Bass
and vote carried.
9A. Gil Culbreth. Lots 3 and l0 in Block 216 immediately to the
south of the above approved property. Mr. Culbreth request the Commercial
line simply be brought back on lot west of the comM~ss said lots 3 and/I
lO of Block 216. At the present one of the lots is being used for
parking.
President Domer questioned if Commercial zoning was necessary for
a parking lot? Dr. Bartley said not if this group adds one thing, that
he recommends as a result of this particular circumstance. It would
permit as a special exception, in Residential Districts, the use of Re-
sidentially zoned property for the purpose of parking and access to Com-
mercially zoned property. He stated at the present time it would need
to be Commercial zoned. It is presently zoned RSF.
Dr. Bartley informed the Council he had a few minor changes that

he was going to propose to the schedule of the text of the Ordinance
and one of them did deal with the use of Residential property for off
street parking and access to CommerciAl Activity by special exception.
President Domer stated he felt it should be left Residential if
the Council intends to make the change recommended for the chart.
Councilman Bass moved to leave Lots 3 and l0 Block 216 zoned
RSF, seconded by Councilman Knight and vote carried.
10. Charles Robertson, A~e~t. Block 238, eastern frontage on
Parrott Avenue. The property ownership shows Block 238, Lots l, 2,
3 and 4 which represent the north hal~ of a triangle then a peculiar
Block 3 which has lots 1 and 2. The entire BRock 238 which lies bet-
ween Parrott Avenue and the School property to the west was rezoned
to Commercial about 3 years ago. This area which lies between Parrott
Avenue and ~he school there being two blocks, Block 236 and Block 238
part of Block 3.
Councilman Douglas moved to change, Lots 7, 8, 9, 10, ll and 12,
Block 230 and Lots 2, 3, 4 and 6 Block 238 and unplatted property lying
to the South of Lot 6 in Block 238, from RSF to Commercial, seconded by
Councilman Knight suzd carried.
ll. Cleo Richard. talked with Dr. Bartley on problems with some
property he owns in the County.
Code Number ll was the last of the conferences held on Tuesday,
February 28, 1978, when the Public Hearing of March 2, 1978 was held
the Consultant lost tract of number 12 and started with number 13.
12. None.
13. William D. Newell. Block 3, West side of town located on the
west City Limits fronting on South Park and inculde~ Lots 5 through 20
of Block 3. Present zoning from the alley northward to Park on Lots
5, 6, 7, 8, 9, 10, ll, 12 and 13 is CommerciAl. The present zoning on
Lots 14 thorugh 20 inclusive is single family. Dr. Bartley reeommended
to retain the present zoning of Commercial on Lots 5 through 13 and re-
tain the present zoning of sidle family on Lots 14 through 20.
Following discussion Councilman Bass moved to classify Lots 5 through
13 as Commercial and 14 through 20 remain RSF, seconded by Councilman
Douglas and vote carried.
14. Clarence Arnold. Block 37, Lots 23, 24, 25 and 26. Presently
indicated as RG-1, request it be ~ommercial. Presently zoned Industrial,
Mr. Arnold has not star~d-constru~tion, yet. , One hundred forty two
feet back from Parrott Avenue and front on North West 9th Street.
Councilman Knight moved to change the map from RG~i to Commercial
on Lots 23, 24, 25 and 26~ Block 37, seconded ~y Councilman Bass and
vote carried.
Completes the hearing night of March 2, 1978.
15. Wilburn Lawson. Block 153, Lots 5 and 6 North of the Post
Office. In block 154 immediately to West of the subject property lots
1, 2, and 3 have started to be developed to Commercial. Proper treat-
ment would be for Lots i through 6 of Block 153 and Lots l, 2 and 3 of
Block ~S4 to be changed from RG-2 to Commercial.
Councilman Bass moved to zone Lots 1 through 6 Block 153 and Lots
l, 2 and 3 Block 154, as Commercial, seconde4 by Councilman Douglas and
vote carried.
16. Doug Cassels. Wilcox Shores Area. Lots 12, ll, 10, 7, 6 and
9, Block 4 and unplatted property approximately one acre to the East.
To the South is a small section of RG-1. Mr. Cassels home is on lot 12.
Mr. Cassels would like to have some type of multiple family as he hopes
to develop townhouses. Proposed zening is RSF.
Following discussion Councilman Bass moved to leave as proposed on
map as RSF, seconded by Councilman Douglas and vote carried.
17. John Louthan. Possible tax conquences. Commercial to both
north and south. Question of what it will do to taxes? Front part of
property is proposed for Commercial and the back part is proposed for
single family. It is not plain what it is now zoned.
Following discussion Councilman Bass moved to change the map to
show that piece of property described as delinated on the map and coded
17 to RSF, seconded by Councilman Douglas and vote carried.
18. Mrs. C. L. Walk. Block 67, City of 0keechobee. Change from
Holding to RSF. The north part bounds on north 8th street the south
boundary is north 7th street and lies between 10th avenue and 9th Drive.
Located next to RSF property.
Councilman Bass moved to change Block 67 from Holding to RSF, sec-
onded by Councilman Knight and vote carried.
Completes the Hearing of March 14, 1978.
Dr. Bartley informed the Council on the schedules of district re-
gulations one of the special exceptions under RSF for off street parking
and/or access to property zoned Commercial on which Commercial Activity
is conducted. This would permit some off, the lots to the rear running
on Parrott Avenue by special exception to be used for off street parking.
Councilman Douglas moved to change the special exceptions on Res-
idential zones to include off street parki~ for Commercial Activities,
seconded by Councilman Bass and vote carried.
Dr. Bartley stated there was a number of editorial~changes to be
made immediately. Attorney to handle publication. New hearings to be
set up. Meeting will be set up at next meeting to be held March 28, 1978.

in Regular Session in the Council Chambers at the City Hall, 0keechobee,
Florida, on Tuesday, March 28, 1978 at 7:00 P.M.
President Russell V. Domer presiding.
Councilmen Lytle Raulerson, Edward W. Douglas and Jim Knight were
present. Councilman Lavon Bass was absent.
Others present were: L. C. Fortner, Director of Public Works;
Larry Mobley, Chief of Police; Sylvia Christian, Acting City Clerk and
Shirley Williams, Deputy Clerk.
The Invocation was offered by Councilman Jim Knight.
APPROVAL OF MINUTES
It was moved by COuncilman Douglas, seconded by Councilman Raulerson
and vote carried that the minutes of March 14, 1978 be approved as re-
corded.
PUBLIC HEARING
BID TABUL~ION - SURPLUS EQUIPMENT -. SAVIN 220 COPIER
It being the hour of seven o'clock and pursuant to a notice published
March 16th and 23rd, 1978 the Acting City Clerk reported that no bids had
been received for the Savin 220 Copier Machine.
Following discussion it was moved by Councilman Knight and seconded
by Councilman Raulerson to authorize Max Davis Associates to sell the
Savin Copier for $750 dollars.
