The City Council of the City of 0keechobee, Florida co~rvened in a
Recessed Session in the Council Chambers at the City Hall, 0keechobee,
Florida, at 7:00 P.M., Thursday, March 2, 1978.
President Russell V. Domer presiding.
Councilmen Edward W. Douglas, Jim Knight and Lytle Raulerson were
present. Councilman Lavon Bass was absent.
Others present were: Sandra Bennett, City Clerk; L. C. Fortner,
Director of Public Works; David Conlon, City Attorney; Ernest R. Bartley,
Planning Consultant, Sylvia Christian, Deputy Clerk; and Shirley Williams,
Deputy Clerk.
LOCAL GOVERNMENT COMPREHENSIVE PLANNING ACT - ZONING - FIRST HEARINC
Dr. Ernest R. Bartley, A.I.P., appea~ed before the Council for the
First Hearing on the Local Government Comprehensive Planning Act - Zoning.
He stated that no part of the new zoning map would be accepted at this
time.
The following persons appea~d with their request:
(1) Philip Y. Berger and Virginia Berger. Mr. Berger requested that
Item #2 on t:~he new zoning map, south City limits, presently zoned Res-
idential (R-D) on the old zoning map which allows a multi-family density
of nine units per acre. He stated that he and his mother had gone to some
expense to plan a project for R-3 zoning there. Berger stated the present

designations for Multi-family are RG-2 and RG-1; RG-2 allows eight units
per acre and RG-1 allows five and one-half units per acre. He stated that
his property would be reduced from nine units per acre to five and one-
half units per acre. He requested their property be increased from RG-1
to the maximum density of RG-2.
President Domer questioned how much land was involved? Mr. Berger
stated that it was five acres.
Mr, Berger stated that for City Planning, Dr. Bartley had stated it
is normally not desirable to bring ingress and egress through populous
areas, but South West 22nd Street is open and so is a permanent county
easement on the South. Ingress and egress should be no problem. At this
point the only delay in building was the availability of sewer.
(2) William D. Newell. The property owned by Mr. Newell is Block
3, Lots 5 through 20; South West Edition. The old zoning map shows Lots
5, 6, 7, 8, 9, 10, 11, 12 and 13 to appear to be Commercial .and Lots 14,
15, 16, 17, 18, 19, and 20 to be Residential (R-i). The new zoning map'
would zone the property RG-2.
Mr. Newell requests the property be zoned Commercial for a Community
Social Activity.
(3) Ann Clearwaters - visiting from Glades County Planning and
Zoning.
(4) Alton Gillen - Wayne H. Fulford Trustee. Mr. Gillen stated
that the property he wanted to discuss was Block D Code #4 according to
the new zoning map. When the property was purchased it was zoned multi-
family. He requested that it stay multi-family or possibly RG-2. Twenty
lots are involved.
· (5) W. I. Rooks. Mr. Rooks had a question of density of RG-2? Def-
inition of Multi-Row of town houses? Do the town houses have a common
wall?
Dr. Bartley stated that according to regulations you can have a common
· wall.
Mr. Rooks questioned what the 100 feet frontage meant?
Dr. Bartley Stated that~iit means in a situation where you have a sixty
f0ot wide lot, that size lot would not qualify for the construction of
town houses if you had a hundred foot lot depending upon the area of the
-~ lot you could possibly get four town houses, that is what the one hundred
fee~ refers to.
(6) Clarence Arnold. Mr. Arnold stated the property he wanted to
discuss was Block 37 Lots 23, 24, 25, and 26. According to the new zoning
map the property would be zoned Residential, and he needed it zoned ~om-
mercial.
Mr. Arnold questioned if ~here was any reason why the property could
not be zoned Commercial. Mr. Domer stated that any zoning could be cha~ged.
(7) Frank Fitzpatrick. Mr. Fitzpatrick discussed Lots 10, ll and 12,
Block 137. The new zoning would m~e the property RG-2. The former zoning
is some form of Residential. Mr. Fitzpatrick stated he would like to put
some tyrol business on the property such as a law office.
Dr. Bartley stated that in the RG District by special exceptions
Number 4 on the present list professional ~d business offices are permitted.
He stated that so far as this property is concerned were the new zoning
map to be adopted that by Special Exception an Attorney's OffiCe could be
located in that particular zone.
(8) Mr. Phil Berger mentioned some warehouses on property zoned RSF.
Dr. Bart~ey stated that what the records show in the case of Lot 26,
Block 3, located on north 13th street approximately 142½ feet west of
Parrott Avenue that in the drawing of the line to their error a piece of
property was broken.
