Murphy Okeechobee News A drive-through Sonic Restaurant at 501 N.E. Park Street (State Road 70) was _ap- proved by the Okeechobee City Planning Board Thursday. Okeeland, LLC gained approval of the project on a .976 acre site. The Sonic drive-through.was deemed an appropriate use for this property by the city planning staff. City Planner Bill Brisson said the appear- ance would not be out of order with other uses as it is surrounded by commercial uses. He saw no significant traffic impacts. He pre- •dicted the entrance would not be on State Road 70 but on Northeast Fifth Avenue. "The parking is almost 90 feet away from residential uses. We do intend to keep loud speakers pointed away from the residential area to the north," he added. He suggested some landscaping on the north side of the, property to limit impacts from lights. Kimberly Ferrell said lights and loud mu- sic from McDonalds impact her home. She said landscaping will help assist her family. "I don't have a problem with Okeecho- bee growing and who doesn't like Sonic? I want a tall barrier so lights don't come in my window," she added. This item goes before the City Technical Review Committee next. In other business, Donna Wildes on be- half of Courthouse Plaza Realty gained ap- proval for a health and fitness center at 210 N.W. "He's friends with my grandson, but he likes to hang out with my husband, Pat. Trey thinks he's (Pat) cool." Mrs. Campbell explained Trey thinks her husband "is cool" because he gardens, shoots a bow and makes fishing lures. She went on to say everyone knows each other in the neighborhood and both Trey and Tristen pretty much have free reign of the area. It's not uncommon for them "to run all over out there." As for the electrical wire, Mrs. Campbell said no one knew it was there. And, accord- ing to Trey, it's probably been lying just under the ground's surface for at least five years. "It looked like somebody took it off, cut it and laid it on the ground," said Trey. "Our neighbor who moved in there had no club It was there. We think it might have come centers in these zoning districts on Oct. 21. There was also an applicajion for a parking agreement to accommodate this project. He said this use was appropriate for the neigh- borhood. All activities will be indoors and no changes to the building are required. "It will increase traffic, about 13 trips for peak hour, but should cause no problems," he added. He suggested windows and doors be closed during early morning, evening and night hours due to the potential of loud mu- sic. The fitness center plans to be open 24 hours per day. In other action the board voted 5-2 to recommend approval of a future land use change and a zoning change for 12 lots in the 600-700 block between Northeast Third Street and Northeast Fourth Street and an unplanted parcel of .49 acres. The single- family designation would be changed from residential to commercial. This recommen- dation will be considered by the City Council .on Nov. 18. It is a total of 2.5 acres. Mr. Brisson said it could result in a 56,000 square foot commercial project. Traffic would impact a residential neighborhood. "You have more and more commercial development here and I have a serious prob- lem with the level of appropriateness of this traffic," he said. He said there is more commercial than is needed right now. He suggested there is enough commercial on the major roads. He recommended denial. Engineer Steve Dobbs said his clients, Rick and Bonita Lightsey, wanted to build one office to accommodate a taxidermy business. They would like light commercial use in the future. The current land use is residential and non -conforming. Mr. Dobbs said they want 4o consider future planning of the 12 lots. from an old water numo that was sitting Board member Les McCreary said he had a concern about expanding commercial use along Taylor Creek.. The zoning application would change the property from residential single family to commercial professional office and from holding to heavy commercial. • Mr. Brisson said the closest use to a taxi- dermy shop is a funeral home. Taxidermy is not mentioned in any city land use, zon- ing district or special exception. He recom- mended the zoning be commercial light and commercial professional office. "This will limit impacts on the area and the applicant will be allowed to continue the taxidermy use," he added. Mr. Dobbs said commercial light is the designation his client wants and noted they had considered heavy commercial. Mr. Brisson declared a buffer zone would be needed for residences on the south side of Northeast Sixth Avenue. Planning Board member Terry Burroughs said he is pro-business and would like to as- sist the owners bring jobs and business to the community. Board member Karyne Brass said this is a residential area and was concerned about paying too high a price for growth. "I don't have to embrace noxi -conforming uses, I have concern about these chemicals used near Taylor Creek," she said. The board voted 5-2 to recommend com- mercial light zoning. The city council will vote on Nov 18. Ms. Brass said most people she spoke to feel their opposition falls on deaf ears when they attend meetings. When the 70 -foot right-of-way is added, the closest residence is over 200 -feet from any point of significant activity on the site. (3) Landscaping techniques to visually screen the use from adjacent uses is not necessary as there are commercial type uses to the East and West. The residential area is separated as stated previously by an undeveloped right-of-way. (4) There should not be impacts of any potential hazards, problems, or public nuisance generated by the restaurant as previously noted, the physical locations of the structure will reduce or eliminate any potential impacts. (5) Utilities appear to be adequate and should not result in more than an incremental demand. AGENDA V. PUBLIC HEARING CONTINUED. C. 2. OCTOBER 16, 2014 - PLANNING BOARD - PAGE 12 OF 13 4 y r ACTION - DISCUSSION - VOTE (6) Demonstrating how the impact of traffic generation will be handled was addressed by explaining there will be a right -in and right -out onto North Park Street (State Road 70 East) and full access to the site from Northeast 5th Avenue. In addressing the level of traffic, based on the Institute of Traffic Engineers Trip Generation 81h Edition, the proposed use is expected to generate an estimated 74 trips in the evening peak hours. Although State Road 70 is operating over capacity, it is believed the development is not likely to seriously degrade the existing situation. Further, Planning Staff agreed a traffic study is not required. Mr. Dobbs was in attendance on behalf of the applicant and stated that there are no objections to Planning Staff's conditions for approval noted in the Report. No questions were asked of Mr. Dobbs at this time. Chairperson Hoover asked whether there were any comments or questions from the public. The matter was advertised as a Public Hearing in the Okeechobee News on September28 and October 8. Twenty-four letters were mailed to surrounding property owners. On October 1, a sign was posted on the property giving notice of the matter. Ms. Ferrell addressed the Board explaining her home was located at Northeast 5" Avenue and 2nd Street (an unimproved right-of-way), and would be the closest to the proposed restaurant. She expressed concerns of increased loud music and headlights shining into her home from customers vehicles, and questioned whether buffering could be readdressed. It was explained that specific buffering would be addressed during site plan review by the TRC. Mrs. Ferrell requested to be notified when the meeting is scheduled. Chairperson Hoover asked Members to disclose for the record any conversations they were privy to regarding this petition, or whether they had visited the site. None were offered. The BOA is required to show their consideration of the following items within Code of Ordinances Section 70-373(c)(1.8), as recommended and based on findings presented by Planning Staff: (1) The use is not contrary to the Comprehensive Plan requirements. (2) The particular use is specifically authorized as a Special Exception Use in the Zoning District. (3) The use will not have an adverse effect on the public interest provided the final site plan is deemed to provide for safe and convenient ingress and egress. "The nature of the business is all service will be provided at the drive thru, drive in areas, or tables out in front of the restaurant. Since this use is in Heavy Commercial District and there are other drive thru restaurants in the area, this use will cause no more public nuisance that the other uses in the area. (5) Demonstrate how the utilities and other service requirements of the use can be met. "There are existing water and sewer service to the site as well as power, so there are no utility or service requirements that cannot be met currently" We agree that utilities are available and the specifics will be addressed during the site plan review stage. Drive thru customers entering the site from NE 5`h Avenue will be required to enter the drive thru window from the same location, they will not be allowed to enter the drive thru from NE 5`h Avenue." The Applicant also included in the submittal letter, the following statement "I have also attached a traffic generation model distributed by FDOT, which show[s] the peak traffic expected is below the 100 peak trips per hour that triggers a traffic study. " According to the 8th Edition of the ITE Trip Generation Report, a fast-food restaurant with drive-through service (ITE Code 934) generates 33.48 trips per 1,000 square feet during the PM peak hour. Assuming a 2,200 square foot facility (building interior plus outside table seating area could be expected to generate just under 74 trips during weekday PM peak. We agree that a traffic study is not required. We also recognize that SR 70 is operating over capacity but believe that the level of traffic generation associated with this proposal is not likely to seriously degrade the existing situation.
