Chairperson Hoover yielded the floor to City Planning Consultant Brisson, who xplained the matter before them is a request to extend two Special Exceptions that were approved on August21, 201.g. According to the City's LDR's, should a Special Exception use granted by the board of adjustment fail to exist or fail to be used for a continuous period of 180 days, then such use shall lapse and the current owner be required to reapply. The Special Exception approvals expired on February 17, 2015. There is a provision in the LDR's that allow the Board to consider a hardship when reviewing a request to extend a Special Exception approval that has lapsed. The Applicant, Mr. Feng, submitted a letter dated February 23, 2015, in which he explains his hardship and difficulties with understanding the procedures and licensing required to open a business here in the United States. Mr. Feng is currently in the United States on a business visa. The visa is only valid for a maximum of six months and then an extension must be applied for. He applied for an extension and is waiting to hear whether it has been approved or not. Should his application be denied, he would need to retum to China for awhile. The renovation process and hiring a contractor took a little longer than he planned and extra time is needed for his inventory to be shipped from China. He is requesting extra time to be able to hire locally and be able to train his employees, as well as have extra time to order and receive his inventory. He provided pictures of the substantial progress he has made with the building and the property. Mr. Brisson further stated he believes these efforts have met the intent of the provisions in the City LDR's and allow the Board to renew the Special Exception approvals. While Mr. Feng has requested an extension to September 1, 2015, Mr. Brisson is suggesting the extension should not exceed the term of the original approval of 180 days. Therefore, Mr. Brisson suggested the renewal be granted only for a period of 180 days beginning on February 17, 2015. Board Members Hoover, Brass, and Baughman expressed concem over what to do should Mr. Feng need additional time since the LDR's do not state whether a person could extend more than 180 days and he was requesting an extension until September 1, 2015. He may do fires later on. My question is does it matter that he has deviated from what his application said and now he is wanting to wholesale other products? I am not sure what kind of business that this may turn into because a few days after the meeting in August he had sent me an email inquiring about whether he could wholesale other products such as garden supplies, hoes, rakes, trowels. I had checked with you and you had replied, l believe that if the owner wishes to wholesale the types of items as he has noted, he would be allowed to. He would need to make sure his BTR covers this type of wholesaling if the BTRs are that detailed. HOWEVER, he should be aware that if any of items were of a nature that would create noise, odor or some other effect that could potentially cause a nuisan for example, wholesaling macaws, roosters, or maybe fertilizer), he would need to obtain another spe ial exception. I was told that the zoning exception permits only valid for 180 days to February. I want to open the store as soon as possible but now I feel great pressure for opening the store to public in February. There are some reasons for me to request to extend the zoning exception permits: 1) Unfamiliar with policies and license process in USA. I am not the U.S citizen and currently I still hold the business visa. I came here four years ago for MBA study and graduated with four MBA degrees in June of 2014. I just started the business and do not have much experience in tire sales industry and has not hire experience people to help me to run the tire store. Everything for me is new. I have more difficulty in running the business at the beginning. As famous Chinese proverb says: The first step is always the hardest and well begun is half done. We want to sufficiently prepared and make everything in order and then open the store. P 2) Renovation takes a longer time than it is expected. I spent 3 months to deal with the renovation. I have no experience for renovation. The renovation proposal is quite different from it is in China. So it takes a little longer time for me to learn the process and find the local contractors. The contractor providing proposal for renovation also takes nearly one month and I got initial renovation proposal in November. We want to add a showroom inside of building. I leant to how to find the renovation contractor and told them city improvements about the property, such as improving driveway, landscaping, and parking improvements and want to add a tire display show room. 3) One more month for renovation completion. By now, outside driveway concrete work and parking places has not completed. The contractor said the total renovation will take at least one and half month. So the renovation is supposed to complete in beginning of February. However, now the inside painting and floor are almost finished except little electric part. The outside driveway and parking place pavement has not completed. The landscaping work is finished (eight oak trees is planted along the store front and side of driveway). 4) Half month for business license and one month for inventory prepared. From my knowledge, the business license can be given only after the renovation complete. The total renovation and improvement is supposed to finish in the middle of March. After renovation completion is inspected, I will go for getting the business license in March. So the earlier time for business license is at the end of March. After getting license, the tire import and container ship from China will take at least 20 days. I do not know whether I can order tires container and get 44, inventory before I get the license. Suppose I get license and then let the tire container ship from China in end of March, I will get tire inventory in end of April. This is the fast time I can get the inventory. Plus, all the tire factories are closed because of the Chinese New Year holiday. The Chinese New year will last fifteen days from February 18, 2014. So I cannot order the tire container until March 6, 2015. 5) One month for people training process. In terms of hiring people, I want to hire local people to run the business because they are more easily to contact local people and familiar local customer needs and wants. I also need to get quality mechanic people and polite salespeople to better service the local people otherwise we cannot survive in this competing tire industry. Therefore, after renovation, the people hiring and training will also take at least one month. I have already started the hiring work and gave job position description to CareerSource and they have referred me two bookkeeper candidates. 6) Business visa extension concerns. Currently, I hold business visa. However, normally USCIS only give six month maximum business visa and then applicants can apply for another six month maximum extension. I have applied for the business visa in November for six month extension to May 31, 2015 and now the extension application is pending now. If business visa expires before I get store open, I must go back China for a while and then come back USA again. That will delay the store open at least to September. My company has not hired people yet and I try to hire local experienced people to help me to operate tire store, such as mechanic, office assistant, and store manager. I must hire experienced people to operate my tire store before I going back China before my business visa expires. Recently I am busy to work with contractors to make some renovations for my tire stores and make the improvements for property to meet the city requirements. The maximum length of business visa is six month until 5/31/ 2015, but I should wait USCIS's results in March (pending now). I was told that the zoning exception permits only valid for 180 days to February. I want to open the store as soon as possible but now I feel great pressure for opening the store to public in February. There are some reasons for me to request extend the zoning exception permits: 1) I am not the U.S citizen and currently I still hold the business visa. I came here four years ago for MBA study and graduated with four MBA degrees in June of 2014. I just started the business and do not have much experience in tire sales industry and has not hire experience people to help me to run the tire store. Everything for me is new. We want to sufficiently prepared and make everything in order and then open the store. 2) I spent 3 months to deal with the renovation. I have no experience for renovation. The contractor providing proposal for renovation also takes nearly one month and I got proposal in November. We want to add a showroom inside of building. I leant to how to find the renovation contractor and told them city improvements about the property, such as improving driveway, landscaping, and parking improvements and want to add a tire display show room. 3) The contractor said the total renovation will take at least one and half month. So the renovation is supposed to complete in beginning of February. Now the renovation terms almost settled will soon start. 4) From my knowledge, the business license can be given only after the renovation complete. Suppose renovation complete in • February, and get the business license in Middle of February, the tire import and container ship from China will take at least 20 days. I do not know whether I can order tires container and get inventory before I get the license. Suppose I get license and then let the tire container shipping from China in middle of February, I will get tire inventory in middle of March. This is the fast time I can get the inventory. Plus, all the tire manufacturers will close in the February Chinese New Year. If I order later in February, I need to wait until March to order the tire when Chinese New Year holiday ends. 5) In terms of hiring people, I want to hire local people to run the business because they are more easily to contact local people and familiar local customer needs and wants. I also need to get quality mechanic people and polite salespeople to better service the local people otherwise we cannot survive in this competing tire industry. HOWEVER, he should be aware that if any of items were of a nature that would create noise, odor or some other effect that could potentially cause a nuisance (for example, wholesaling macaws, roosters, or maybe fertilizer), he would need to obtain another special exception. Regarding question number 2: The Applicant's attorney brought up the point that the LDC refers to a dustless surface for parking areas, not specifically paving. I agreed at the meeting and hat should be the stipulation. I would assume Brian or the Building Official would make the determination as to what constitutes a "dustless" surface. I'm not sure what specifically the City had in mind, but, in my opinion it would not include gravel or crushed shell. Call if you have any questions. Per §90-534, 1 have calculated that a total of 8 trees and 22 shrubs are required for street front buffers along SW Park Street and SW 12`h Avenue, and the interior property line buffer along the eastem boundary of the property. The street front buffer calculations excludes areas of the frontage devoted to driveways. Also, the calculation does not include any of the area of lots 7, 12 or 13 which are not proposed for use at this time. In the event improvements are made in these areas in the future, landscaping will be needed in accordance with §90-534. The areas used in the calculations, and where trees and shrubs should preferably be located, are shown in green on the attached excerpt from the survey of the property. Our calculations area as follow SW 12th Avenue street front, 10 -foot buffer = 15'+50'+32" = 107' X 10' = 1,070 sf. At one tree and three shrubs per 300 square feet, three trees and 11 shrubs are indicated. SW Park Street front, 10 -foot buffer = 56' + 24' = 80' X 10' = 800 sf. At one tree and three shrubs per 300 square feet, three trees and eight shrubs are indicated. Interior, 2 -foot buffer along eastern property line =167.5' X 2' = 335 sf. At one tree and three shrubs per 300 square feet, one tree and three shrubs are indicated. Because the property is a nonconforming property, the foregoing landscaping requirements must be met only to the extent that it is possible to do so. These requirements are relatively modest and we suspect that all of the shrubs can be placed in the areas indicated. For example, along the eastern property line the shrubs could probably be placed at the top of the slope of the swale. If it is not possible to place a tree along the eastern property line, it can be placed elsewhere. 1 hope this information is helpful to you. Following are requirements for the planting of trees and shrubs associated with development undertaken throughout the city. Landscaping ma- terial required under this section may be used to satisfy the requirements for landscaping in park- ing and vehicular use areas (section 90-533) and in landscape buffer areas (section 90-534). Except for those associated with an individual single-family or duplex structure, all vehicular Supp. No. 10 use areas containing eight or more parking spaces, or containing an area greater than 2,400 square feet, shall provide perimeter and interior land- scaping as follows: (1) At least 18 square feet of landscaped area for each required parking space. (2) At least one tree for each 72 square feet of required landscaped area. (3) Shade trees shall be planted at no more than 20 feet on centers (4) A minimum two feet of landscaping shall be required between vehicular use areas and on-site buildings and structures, ex- cept at points of ingress and egress. (5) The minimum dimension for any required landscaped area within a parking or ve- hicular use area shall be four feet except for that adjacent to on-site buildings and structures. (6) A landscaped island, • minimum five feet by 15 feet and containing at least one tree, shall be required for every ten parking spaces with a maximum of 12 uninter- rupted parking spaces in a row. (7) The remainder of a parking landscape area shall be landscaped with grass, ground cover, or other landscape material. (LDR 1998, § 502; Ord. No. 1010, § 4, 2-19-2008) Sec. 90-534. Required residential and non- residential buffer areas. For all development undertaken throughout the city, except for construction of an individual single-family or duplex structure, landscaped buf- fer areas shall be required within required set- backs and landscaped as follows: (1) Minimum width of buffer along street frontage shall be ten feet and on other property lines, two feet. CD90:38.2 ZONING § 90-541 (2) At least one tree and three shrubs for each 300 square feet of required land scaped buffer. (3) Trees may be planted in clusters, but shall not exceed 50 feet on centers abut- ting the street. (4) .The remainder of a landscape buffer shall be landscaped with grass, ground cover, or other landscape material. (LDR 1998, § 503; Ord. No. 1010, § 4, 2-19-2008; Ord. Former § 90-534 title pertained to required landscaped buffer areas. Sec. 90-535. Reserved. Editor's note—Ord. No. 1079, § 11, adopted Jan. 17, 2012, repealed former § 90-535, and enacted a new § 90-535 as set out herein. Former § 90-535 pertained to nonresidential buffer regulations and derived from LDR 1998, § 504. Sec. 90-536. Planting in dry retention areas. Slopes of dry retention areas may be used to satisfy landscape requirements, provided that the landscape materials used are not adversely sus- ceptible to periodic inundation. (LDR 1998, § 505) Sec. 90-537. Protection of native vegetative communities and wetlands. (a) Native vegetative communities shall be pro- tected from adverse impacts of development. (b) Wetland buffers shall be at least 25 feet wide and shall be supplemented only with native trees, shrubs and ground cover. (LDR 1998, § 506) Sec. 90-538. Landscape design and plan. (a) Proposed development, vehicular and pe- destrian circulation systems, and site drainage shall be integrated into the landscaping plan. (b) Existing native vegetation shall be pre- served where feasible, and may be used in calcu- lations to meet these landscaping requirements. (c) When more than ten trees are required to be planted, two or more species shall be used. (d) Trees and shrubs shall not be planted in a location where at their maturity they would in- terfere with utility services. (e) Trees should maximize the shading of pe- destrian walks and parking spaces. (f) Landscaping ground covers should be used to aid soil stabilization and prevent erosion. (g) Landscaping shall be protected from vehic- ular encroachment by means of curbs, wheel stops, walks or similar barriers. (LDR 1998, § 510) Sec. 90-539. Alternative landscape design and plan. (a) An applicant shall be entitled to demon- strate that the landscape and buffer requirements can be more effectively met by an alternative landscape plan. (b) Upon review and recommendation, the tech- nical review committee may approve an alterna- tive landscape plan. (LDR 1998, § 511) Sec. 90-540. Native drought tolerant plant materials required. (a) Plants required to be installed shall be elected. from the South Florida Water Manage- ment District's Xeriscape Plant Guide. (b) . At least 75 percent of the total number of plants required shall be state native very drought tolerant species as listed in the South Florida Water Management District Xeriscape Plant Guide. However, when a landscape irrigation system is installed, at least 75 percent or the total number of plants required shall be state native moderate or very drought tolerant species. (c) Trees shall be at least ten feet high and two inches in diameter measured four feet above ground level at the time of planting. (LDR 1998, § 512) Sec. 90-541. Maintenance. (a) Sufficient topsoil and water shall be pro- vided during the plants' establishment periods to sustain healthy growth. Supp. No. 10 CD90:38.3 § 90-34 OKEECHOBEE CODE continued for 90 consecutive days or more for any reason, the nonconforming use shall .be deemed abandoned, and the fu- ture use of the premises or site shall revert only to those uses permitted on the site on which the establishment is lo- cated. (LDR 1998, § 753) Sec. 90-35. Change or transfer of' noncon- forming use or structure. (a) Change. A nonconforming use or structure may be changed to a conforming use or structure for the district in which it is located. Once changed to a conforming use or structure, no building, structure or land use shall be permitted to revert to a nonconforming use. (b) Transfer of nonconforming commercial use. In the event the underlying lands on which exists a nonconforming use in a commercial, commercial business district, commercial professional office, or industrial zoning category within the city is sold, assigned, or in any manner transferred from the record title holder of said lands, as such ownership is reflected in the records of the Clerk of Court or Property Appraiser for Okeechobee County, such nonconforming use shall cease, and not be permitted to likewise be transferred, and the nonconforming use shall extinguish. Any such future use of said lands subsequent to transfer shall be in compliance with all current City Codes, and land use regulations applicable to such zon- ing or land use designation. Excluded from this prohibition is the transfer of ownership of said lands to a corporation, professional association or limited liability company recognized under Flor- ida law whose majority stockholder is the same person as the previous record owner. (c) Transfer of a nonconforming residential use. In the event the underlying lands on which exists a nonconforming use in a residentially zoned category within the city is sold, assigned, or in any manner transferred from the record title holder of said lands, as such ownership is re- flected in the records of the Clerk of Court or Property Appraiser for Okeechobee County, such nonconforming use may continue thereafter in such use, so long as such use is residential in nature. However, such nonconforming residential use shall not thereafter be expanded, enlarged or increase in intensity of use, so long as the use remains nonconforming under City Codes. Addi- tionally, such nonconforming residential use shall not be permitted to continue if the structure does not conform to fire safety code; health codes; Florida Building Codes; or fails to comply with F.S. ch. 381 regarding migrant housing. (d) 1}-ansfer of a nonconforming structure. In the event of the underlying land on which exists a nonconforming structure is sold, assigned or in any manner transferred from the record title holder of said lands, as such ownership is re- flected in the records of the Clerk of Court, and Property Appraiser for Okeechobee County, such nonconforming structure may continue in the new owner, so long as the land is not a nonconforming use, and the nonconforming structure is not ex- panded or repaired except as authorized in these regulations. The transfer of such nonconforming structure is further subject to the requirement that the new owner must comply, to the extent reasonably possible, considering the nature and configuration of the structure, with all current codes, land use and zoning requirements, except off-street parking requirements, of the district regulations applicable to the structure. Below is information that will need to be followed in regards to a wholesale tire business located at the address above. The parcel is zoned Heavy Commercial with a Commercial Future Land Use. Under this Zoning District, Wholesale use would only be permitted by Special Exception. The application for this along with the fee information and submission and hearing dates are attached. All of the required documents that are listed on page 2 of the application are needed when submitted. Your business would not be permitted to operate until such time as the Special Exception is granted, should this use be approved by the Board of Adjustments. As well as applying for a Special Exception for the business the following would also need to be done and you will find the different Sections in our Code that are referred to also attached: The smaller, front part of the building contains about 1.,320 square feet of heated area, which is usually the square footage we use in calculating the gross Floor area for parking space calculation purposes. The back "garage" encompasses about 3,000 square feet. The original 1,320 square foot structure conforms to all setback requirements. It is difficult to tell without a survey, but the 3,000 square foot garage appears to be nonconforming with respect to the required street side yard setback of 1-5 feet. The new owner will not be required to address these nonconforvvtities. However, tete combined structure is also nonconforming as to landscaping and parking requ i rewents. • With regard to landscaping, there are no shade trees or shrubs as required under Sections 90-532 and 90-534 of the Land Development Code (LDC). Subsection 90-35(d) sets forth the regulations governing how a nonconforming structure is treated when the underlying land is sold. Per this section, the landscaping requirevvtents be met "to the extent reasonably possible." • While the property is nonconforming as to the off-street parking requirements, Subsection 90-35(d) exempts a new owner From having to bring the parkin into compliance unless the structure is expanded. Therefore, the new owner will vtot be required to provide additional parking. However, the owner must address the requirements of subsection go - 35(d)(1). This subsection requires portions of the property that have been used for off-street parking, but do not meet the city's design requirements, to be improved. This means that the Four (4) unpaved parking spaces and tete driveway should be improved with pavers or other dustless surface acceptable to the City. The owner must also make one of the Four parking spaces suitable for handi- capped parking, including appropriate marking and signage. A site plan should be drawn up to show the required parking improvements, driveway improvements and the landscaping so that the City can look at it. This should be coordinated with the Public Works Director, David Allen. A building permit will need to be applied for in regards to the driveway and parking area. You can speak with the Building Official, Jeff Newell in regards to this. Should you decide in the future to do auto repair, again this would be a permitted use by Special Exception only and you would need to submit an application for approval. He is wanting to wholesale tires that are imported from China. He is talking about 12,000 —14,000 tires. The largest building will be a warehouse for the tires and he will use the smaller building for an office area, reception and small showroom. He will sell to individual customers as well. Looking at the Permitted uses and Special Exception uses under the CHV Zoning District, there is listed under Special Exception uses, Wholesale, warehouse not including bulk storage of flammable liquids and then also Enclosed warehouse and storage. I know he would need to apply for a Special Exception though I wasn't sure if he would only need to do the first one or both of them? In my opinion, he would apply for a wholesale use; the big building would be for the storage of the wholesale goods. Currently there is a Special Exception on the property for Mechanical and Repair Services. This was granted by the BOA on 12/19/13 so it would expire on 6/19/14 if a BTR for this use was not applied for. He told me that should the wholesale tire business not be as successful as he was hoping for, that he wanted to do some simple auto repairs. I am thinking he would then need to reapply for the Special Exception use of Mechanical and repair services. Yes, if he wanted to undertake auto repairs he would need to apply for the Special Exception for Mechanical and repair services. I know he will also need to comply with the improvement of the parking spaces and driveway that we have already spoken about as well as the landscaping. Correct again. Planning Staffs responses to the applicant's presentation on the required findings to consider the Special Exception, are that the proposed use is not contrary to the Comprehensive Plan. Mechanical and repair service is specifically listed as a Special Exception use in the CHV Zoning District. The use its operation and impacts will not significantly differ from those associated with the former use of the property and will have no adverse effect upon the public interest. This particular use is appropriate for the proposed location, compatible with adjacent uses and not detrimental to urbanizing land use patterns. The proposed use should not adversely affect property values or living conditions. No special visual screening will be necessary. However, as a result of the impending transfer in ownership, the new owner will be required to provide landscape buffers in conformance with the requirements of the City's Code. Density is not an issue with a commercial use and no significant increase in commercial intensity is envisioned that would have a negative effect upon public services or facilities. Traffic congestion will not be increased nor will traffic safety be compromised by location of the proposed use. (5) We agree, assuming there will be neither outside storage of materials or customer property prior to or awaiting repair nor any repair or installation activity conducted outside the building. Demonstrate how the utilities and other service requirements of the use can be met. "Utilities are presently in place and have been in use since 1987." We are unaware of any problems with utility services to the site in the past, and would not expect the proposed activities to place any greater demand on public services than the previous operations. (6) Demonstrate how the impact of traffic generation will be handled off site and on- site. "There is plenty of room on site for vehicles to enter building through garage doors. Parking is more than adequate" Traffic generation should be similar to, but could be slightly greater than, that previously occurring under the former operation. Any modest increase can be accommodated within the capacity of the property and access roads. However, based on the requirement for one space for each 150 square feet of floor area in the 3,000 square foot garage and one space for each 300 square feet of non -storage space in the original 1,320 square foot office, the parking requirement would be 23 spaces. While the new owner is not required to provide additional parking, he/she must address the require- ments of Section 90-35(d)(1). (1) The use is not contrary to the Comprehensive Plan requirements. "The property has had a commercial usage since 1987 and is recognized as commercial on the comp plan. The property has been used for repairs and welding. We agree. The Commercial Future Land Use Category envisions a wide variety of commercial uses and retail and wholesale sales and storage and auto repair services are considered allowable uses. (2) The use is specifically authorized as a special exception use in the zoning district. (3) "Yes it is." We agree. §90-283(7) specifically lists "Wholesale, warehouse not including bulk storage of flammable liquids" and "Mechanical and repair services" as a Special Exception uses in the CHV District . The use will not have an adverse effect on the public interest. "No, no more than it has previously." We agree. (4) The use is appropriate for the proposed location, is reasonably compatible with adjacent uses and is not detrimental to urbanizing land use patterns. The prop- erty is located within the Commercial Corridor and is zoned CHV and is generally surrounded by nonresidential zoning and uses except for the single-family use immediately to the south of the vacant parcel also being purchased by the Applicant. "The property is located on a 4 lane SR with SW 12th Ave along its entire west boundary. The area is primarily developed. The retail and wholesaling, storage and installation of tires and auto repair services on the site, should have no significantly greater impact than that previously undertaken or approved for the site. As such the proposed uses should not be expected to adversely affect property values or living conditions in the area. Its characteristics and impacts are similar to previously approved uses and the former use. (6) The use may be required to be screened from surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. (7) "There should not be any difference from the usage it has had since 1987." We agree that no special visual screening will be necessary. However as a result of the impending transfer in ownership, the new owner will be required to provide landscaped buffers in conformance with the require- ments of Sections 90-532 and 90-534. The compliance with this requirement will be assessed during the site plan review by the Technical Review Committee (TRC). The use will not create a density pattern that will overburden public facilities such as schools, streets, and utility services. "Ingress and egress is more than adequate with SR 70 to the north and SW 12th Ave to the west. The size and the design of the property is more than adequate. Density is not an issue with a commercial use and no significant increase in commercial intensity is envisioned that would have a negative effect upon public services or facilities.
