Request submitted by Aaron Feng, to extend the nonuse time limit, to September 1, 2015, on Special Exception Petitions No. 14 -003 -SE (wholesale, warehouse not including bulk storage of flammable liquids) and No. 14 -004 -SE (mechanical and repair services) for Lots 9,10,12,13, and a portion of 7 and 11 of Block 3, Southwest Addition, 1127 SW Park Street - City Planning Consultant. Chairperson Hoover yielded the floor to City Planning Consultant Brisson, who xplained the matter before them is a request to extend two Special Exceptions that were approved on August21, 201According to the City's LDR's, should a Special Exception use granted by the board of adjustment fail to exist or fail to be used for a continuous period of 180 days, then such use shall lapse and the current owner be required to reapply. The Special Exception approvals expired on February 17, 2015. There is a provision in the LDR's that allow the Board to consider a hardship when reviewing a request to extend a Special Exception approval that has lapsed. The Applicant, Mr. Feng, submitted a letter dated February 23, 2015, in which he explains his hardship and difficulties with understanding the procedures and licensing required to open a business here in the United States. Mr. Feng is currently in the United States on a business visa. The visa is only valid for a maximum of six months and then an extension must be applied for. He applied for an extension and is waiting to hear whether it has been approved or not. Should his application be denied, he would need to retum to China for awhile. The renovation process and hiring a contractor took a little longer than he planned and extra time is needed for his inventory to be shipped from China. He is requesting extra time to be able to hire locally and be able to train his employees, as well as have extra time to order and receive his inventory. He provided pictures of the substantial progress he has made with the building and the property. Mr. Brisson further stated he believes these efforts have met the intent of the provisions in the City LDR's and allow the Board to renew the Special Exception approvals. While Mr. Feng has requested an extension to September 1, 2015, Mr. Brisson is suggesting the extension should not exceed the term of the original approval of 180 days. Therefore, Mr. Brisson suggested the renewal be granted only for a period of 180 days beginning on February 17, 2015. Board Members Hoover, Brass, and Baughman expressed concern over what to do should Mr. Feng need additional time since the LDR's do not state whether a person could extend more than 180 days and he was requesting an extension until September 1, 2015. After a lengthy discussion, Member Keefe made a motion to approve the extensions for Special Exception Petitions No. 14 -003 -SE (wholesale, warehouse not including bulk storage of flammable liquids) and No. 14 -004 -SE (mechanical and repair services) for Lots 9, 10, 12, 13, and a portion of 7 and 11 of Block 3, Southwest Addition, 1127 SW Park Street until August 15, 2015, with instruction to the Board Secretary to contact Mr. Feng, before August 15, 2015, and inquire as to whether an additional extension would be needed, seconded by Member Baughman. Due to city's requiremnt for the building on 1127 Park street, I plant 8 trees in the front building by contracot Mark Brandel. Last month, there are three trees fall down and they come to stake but Today it is the second time the other three trees fall down and I call Mark Brandel and they said it is becasue wind and do not care about that. If all the trees or have other trees on the 70 street fall down, I can accept the reason is because the wind. But the reality is no trees on neighbor on 70 road are fall down today. On 70 road in okeechobee city, only my trees they planted are fall down. I do not believe it is only by wind. I paid to them and they should make sure the trees planted are straignt and not like a paper to fall down. That is ridiculous. From pictures you can see they plant very shallow not deep in soil for trees. Does city have any peroson can help me to resolve the problems and regulate the contracot's work and ask them to stake the trees? MODILI INTERNATIONAL USA, INC AARON Sages have no selfish desires. Back in August last year the BOA approved a Special Exception (14 -003 -SE) for wholesale, warehouse not including bulk storage of flammable liquids for 1127 SW Park Street. The applicant had stated in his application that he wished to retail and wholesale tires as well as install and warehouse them. He hasn't opened his business yet and if you recall this is the gentleman that is requesting the extension from the Board that will be on the April 16th Agenda. Anyways, he has come into the City to apply for his Business License and has indicated that at the present time he is wishing to retail and wholesale tile, faucets and plumbing supplies. He may do tires later on. My question is does it matter that he has deviated from what his application said and now he is wanting to wholesale other products? I am not sure what kind of business that this may turn into because a few days after the meeting in August he had sent me an email inquiring about whether he could wholesale other products such as garden supplies, hoes, rakes, trowels. I had checked with you and you had replied, believe that if the owner wishes to wholesale the types of items as he has noted, he would be allowed to. He would need to make sure his BTR covers this type of wholesaling if the BTRs are that detailed. HOWEVER, he should be aware that if any of items were of a nature that would create noise, odor or some other effect that could potentially cause a nuisan for example, wholesaling macaws, roosters, or maybe fertilizer), he would need to obtain another spe ial exception. Memorandum To: Board of Adjustment (BOA) From: Bill Brisson, AICP Sr. Planner, LaRue Planning & Management Date: April 8, 2015 Subject: Requested extension of Special Exception Approvals On August 21, 2014 the BOA approved Applications for the following Special Exceptions for the property located at 1127 SW Park Street: 1. 14 -003 -SE, to allow wholesale/warehouse use 2. 14 -004 -SE, to allow mechanical and repair services The LDRs require that an approved Special Exception must be put to use within 180 -days. That period expired on February 17, 2015. The LDRs allow the Board of Adjustment to consider a hardship when reviewing a request to renew/extend a Special Exception approval that has lapsed. The Applicant, Mr. Aaron Feng, has requested an extension/renewal of the above Special Exceptions. He has submitted a detailed explanation as to why the business has not yet opened and why the extension/renewal is necessary. After reviewing the information provided by Mr. Feng, it is clear that he has made substantial and concrete progress towards improving the property and opening the business. I believe that that these efforts meet the intent of the provision allowing the Board to renew the Special Exception approvals. While Mr. Feng's request is for an extension/renewal to September 1, 2015, should the Board be favorably disposed towards granting the extension/renewal, I suggest that it should not exceed the term of the original approval, i.e., 180 days. This would indicate that the extension/ renewal should be granted only for a period of 180 days beginning on February 17, 2015. Providing Planning and Management Solutions for Local Governments Since 1988 1375 Jackson Street, Suite 206 Fort Myers, FL 33901 239-334-3366 www.larueplanning.com FEB 2 3 2015 February 23, 2015 XUEHAI FENG (AARON) MODILI INTERNATIONAL USA, INC 863-582-5668 3509 NW 38TH AVE Okeechobee, FL, 34972 Application to Extend the Zoning Exception Permits To Whom It May Concern: I am writing this letter is to state my current situation about the tire sale and auto repair business and ask whether the Board of Adjustments can extend my zoning exception permits (14 -003 -SE and 14 -004 -SE) for six month until September 1, 2015 and the property site address is 1127 SW Park Street, Okeechobee, FL 34972. I was told that the zoning exception permits only valid for 180 days to February. I want to open the store as soon as possible but now I feel great pressure for opening the store to public in February. There are some reasons for me to request to extend the zoning exception permits: 1) Unfamiliar with policies and license process in USA. I am not the U.S citizen and currently I still hold the business visa. I came here four years ago for MBA study and graduated with four MBA degrees in June of 2014. I just started the business and do not have much experience in tire sales industry and has not hire experience people to help me to run the tire store. Everything for me is new. I have more difficulty in running the business at the beginning. As famous Chinese proverb says: The first step is always the hardest and well begun is half done. We want to sufficiently prepared and make everything in order and then open the store. 2) Renovation takes a longer time than it is expected. I spent 3 months to deal with the renovation. I have no experience for renovation. The renovation proposal is quite different from it is in China. So it takes a little longer time for me to learn the process and find the local contractors. The contractor providing proposal for renovation also takes nearly one month and I got initial renovation proposal in November. We want to add a showroom inside of building. I leant to how to find the renovation contractor and told them city improvements about the property, such as improving driveway, landscaping, and parking improvements and want to add a tire display show room. 3) One more month for renovation completion. By now, outside driveway concrete work and parking places has not completed. The contractor said the total renovation will take at least one and half month. So the renovation is supposed to complete in beginning of February. However, now the inside painting and floor are almost finished except little electric part. The outside driveway and parking place pavement has not completed. The landscaping work is finished (eight oak trees is planted along the store front and side of driveway). 4) Half month for business license and one month for inventory prepared. From my knowledge, the business license can be given only after the renovation complete. The total renovation and improvement is supposed to finish in the middle of March. After renovation completion is inspected, I will go for getting the business license in March. So the earlier time for business license is at the end of March. After getting license, the tire import and container ship from China will take at least 20 days. I do not know whether I can order tires container and get inventory before I get the license. Suppose I get license and then let the tire container ship from China in end of March, I will get tire inventory in end of April. This is the fast time I can get the inventory. Plus, all the tire factories are closed because of the Chinese New Year holiday. The Chinese New year will last fifteen days from February 18, 2014. So I cannot order the tire container until March 6, 2015. 5) One month for people training process. In terms of hiring people, I want to hire local people to run the business because they are more easily to contact local people and familiar local customer needs and wants. I also need to get quality mechanic people and polite salespeople to better service the local people otherwise we cannot survive in this competing tire industry. Therefore, after renovation, the people hiring and training will also take at least one month. I have already started the hiring work and gave job position description to CareerSource and they have referred me two bookkeeper candidates. 6) Business visa extension concerns. Currently, I hold business visa. However, normally USCIS only give six month maximum business visa and then applicants can apply for another six month maximum extension. I have applied for the business visa in November for six month extension to May 31, 2015 and now the extension application is pending now. If business visa expires before I get store open, I must go back China for a while and then come back USA again. That will delay the store open at least to September. My company has not hired people yet and I try to hire local experienced people to help me to operate tire store, such as mechanic, office assistant, and store manager. I must hire experienced people to operate my tire store before I going back China before my business visa expires. Recently I am busy to work with contractors to make some renovations for my tire stores and make the improvements for property to meet the city requirements. The maximum length of business visa is six month until 5/31/ 2015, but I should wait USCIS's results in March (pending now). Therefore, I hope City Board of Adjustments can consider my particular situation and possibly consider whether can extend my zoning exception permits for six month until September 1, 2015. So I can have sufficient time in completing renovation work, hiring people and training, and ordering and shipping tire container. I was told that the zoning exception permits only valid for 180 days to February. I want to open the store as soon as possible but now I feel great pressure for opening the store to public in February. There are some reasons for me to request extend the zoning exception permits: 1) I am not the U.S citizen and currently I still hold the business visa. 2) I spent 3 months to deal with the renovation. I have no experience for renovation. The renovation proposal is quite different from it is in China. So it takes a little longer time for me to learn the process. The contractor providing proposal for renovation also takes nearly one month and I got proposal in November. We want to add a showroom inside of building. I leant to how to find the renovation contractor and told them city improvements about the property, such as improving driveway, landscaping, and parking improvements and want to add a tire display show room. 3) The contractor said the total renovation will take at least one and half month. So the renovation is supposed to complete in beginning of February. Now the renovation terms almost settled will soon start. 4) From my knowledge, the business license can be given only after the renovation complete. Suppose renovation complete in February, and get the business license in Middle of February, the tire import and container ship from China will take at least 20 days. I do not know whether I can order tires container and get inventory before I get the license. Suppose I get license and then let the tire container shipping from China in middle of February, I will get tire inventory in middle of March. This is the fast time I can get the inventory. Plus, all the tire manufacturers will close in the February Chinese New Year. If I order later in February, I need to wait until March to order the tire when Chinese New Year holiday ends. 5) In terms of hiring people, I want to hire local people to run the business because they are more easily to contact local people and familiar local customer needs and wants. I also need to get quality mechanic people and polite salespeople to better service the local people otherwise we cannot survive in this competing tire industry. Therefore, after renovation, the people hiring and training will also take at least one month. 6) In terms of my business visa, the maximum of business visa is six months. The zoning exception permit expires in end of February. But how long the USCIS will give the business visa to me is pending now. Suppose USCIS only give me three months until March. Even though I reapply zoning exception permit in February, I must go back China for a while and then come back again for tire business. The reapply for zoning exception in February will delay the store open at least three months, if my business visa expire in March in this matter. My company has not hired people yet and I try to hire local experienced people to help me to operate tire store, such as mechanic, office assistant, and store manager. I must hire experienced people to operate my tire store before I going back China before my business visa expires. Recently I am busy to work with contractors to make some renovations for my tire stores and make the improvements for the warehouse to meet the city requirements. The maximum length of business visa is six month until 5/31/ 2015, but I should wait USCIS's results in February (pending now). Therefore, I hope City Board can consider my particular situation and possibly consider whether can extend my zoning exception permits so I can have sufficient time in completing renovation work, hiring people and training and ordering and shipping tire container. I have two questions in regards to the meeting last night. I received this email from one of the applicants, Petition 14 -003 -SE . Last night, the property in located at 1127 SW Park Street get the permission for Special Exception Petitions 14 -003 -SE & 14 -004 -SE. In terms of 14-0003 SE, I want to ask: is my business only permitted to wholesale tire or tire related products, I cannot wholesale and sell other products such as garden supplies 1 hoe, leaf rack, trowel. If future my business want to wholesale other garden tools such as trowel and leaf rack, we need to apply special exception again? The application was submitted for wholesale of tires so can he do this? 2nd question is for Petition No. 14 -005 -SE for the daycare center, do you know what conditions were attached? The Staff Report says the deteriorating portion of the driveway on the northern portion of the property and the unpaved part of the southern driveway should be paved. Also, parking spaces for employees should be marked and handicapped spaces should be identified and meet state standards. The Board had some discussion because of the previous application and I have written down that the motion was approved with the condition of the driveway and parking being brought up to City code. So not sure if it would just be dustless surface or is paving required. Thanks as always for your assistance, Patty Patty Wt. Thank you, Patty 1 et Planning Management Services, Inc Memorandum To: Mark Brandel From: Bill Brisson Date: October 29, 2014 Subject: Landscaping requirement for 1127 SW Park Street Mark, Per our previous discussion, following are my calculations for the number of trees and shrubs needed at 1127 SW Park Street. Per §90-534, I have calculated that a total of 8 trees and 22 shrubs are required for street front buffers along SW Park Street and SW 12`h Avenue, and the interior property line buffer along the eastern boundary of the property. The street front buffer calculations excludes areas of the frontage devoted to driveways. Also, the calculation does not include any of the area of lots 7, 12 or 13 which are not proposed for use at this time. In the event improvements are made in these areas in the future, landscaping will be needed in accordance with §90-534. The areas used in the calculations, and where trees and shrubs should preferably be located, are shown in on the attached excerpt from the survey of the property. Our calculations area as follow: SW 12th Avenue street front, 10 -foot buffer = 15'+50'+32" = 107' X 10' = 1,070 sf. At one tree and three shrubs per 300 square feet, three trees and 11 shrubs are indicated. SW Park Street front, 10 -foot buffer = 56' + 24' = 80' X 10' = 800 sf. At one tree and three shrubs per 300 square feet, three trees and eight shrubs are indicated. Interior, 2 -foot buffer along eastern property line = 167.5' X 2' = 335 sf. At one tree and three shrubs per 300 square feet, one tree and three shrubs are indicated. Because the property is a nonconforming property, the foregoing landscaping requirements must be met only to the extent that it is possible to do so. These requirements are relatively modest and we suspect that all of the shrubs can be placed in the areas indicated. For example, along the eastern property line the shrubs could probably be placed at the top of the slope of the swale. If it is not possible to place a tree along the eastern property line, it can be placed elsewhere. I hope this information is helpful to you. Below is information that will need to be followed in regards to a wholesale tire business located at the address above. The parcel is zoned Heavy Commercial with a Commercial Future Land Use. Under this Zoning District, Wholesale use would only be permitted by Special Exception. The application for this along with the fee information and submission and hearing dates are attached. All of the required documents that are listed on page 2 of the application are needed when submitted. Your business would not be permitted to operate until such time as the Special Exception is granted, should this use be approved by the Board of Adjustments. As well as applying for a Special Exception for the business the following would also need to be done and you will find the different Sections in our Code that are referred to also attached: The smaller, Front part of the building contains about 1.,320 square feet of heated area, which is usually the square footage we use ivt calculating the gross floor area for parking space calculation purposes. The back "garage" encompasses about 3,000 square feet. The original 1,320 square foot structure conforms to all setback requirements. It is difficult to tell without a survey, but tete 3,000 square foot garage appears to be nonconforming with respect to the required street side yard setback of 1-5 feet. The new owner will vtot be required to address these nonconForwtities. However, the combined structure is also nonconforming as to landscaping and parking requirements. a With regard to landscaping, there are no shade trees or shrubs as required under Sections 90-532 and 90-534 of the Land Development Code (LDC). Subsection 90-35(d) sets forth the regulations governing how a nonconforw.ing structure is treated when the underlying land is sold. Per this section, the landscaping requirements be wet "to the extent reasonably possible." • While the property is nonconforming as to the off-street parking requirements, Subsection 90-35(d) exempts a new owner from having to bring the parking into compliance unless the structure is expanded. Therefore, the new owner will not be required to provide additional parking. However, the owner must address the requirements of subsection 9o - 35(d)(1). This subsection requires portions of the property that have been used for off-street parking, but do not meet the city's design requirements, to be improved. This means that the Four (4) unpaved parking spaces and the driveway should be improved with pavers or other dustless surface acceptable to the City. The owner must also make one of the four parking spaces suitable For handi- capped parking, including appropriate marking and signage. A site plan should be drawn up to show the required parking improvements, driveway improvements and the landscaping so that the City can look at it. This should be coordinated with the Public Works Director, David Allen. A building permit will need to be applied for in regards to the driveway and parking area. You can speak with the Building Official, Jeff Newell in regards to this. Should you decide in the future to do auto repair, again this would be a permitted use by Special Exception only and you would need to submit an application for approval. You may refer to our website, www.cityofokeechobee.com for the Zoning Information for Heavy Commercial by choosing Code of Ordinances and LDR's and then Chapter 90. This will provide all the Permitted and Special Exception Uses so you will know what is permitted in regards to the vacant parcel. After applying and being granted the Special Exception, a Business License application would then be submitted. There may be other requirements that are not mentioned in this email. I am hoping this information helps you get started in your new endeavor. Patty Patty _M. I have another question on this property that we have looked at I believe three times now....it's like a bad penny 1 guess. The last time we spoke about this property was a request that I received from Steve Dobbs regarding someone who was interested in selling tires and installing them. We concluded that this would be a retail use and that one would probably expect balancing and alignments as part of installing tires, but nothing like doing oil changes, brake work and those types of services as this would fall more under service garage which I believe falls under Mechanical and Repair Services. Anyways and 1 don't know if this is the same person or not, but a gentleman came into the office and said he is purchasing this property as well as the vacant parcel to the South. He is wanting to wholesale tires that are imported from China, He is talking about 12,000 —14,000 tires. The largest building will be a warehouse for the tires and he will use the smaller building for an office area, reception and small showroom. He will sell to individual customers as well. Looking at the Permitted uses and Special Exception uses under the CHV Zoning District, there is listed under Special Exception uses, Wholesale, warehouse not including bulk storage of flammable liquids and then also Enclosed warehouse and storage. I know he would need to apply for a Special Exception though wasn't sure if he would only need to do the first one or both of them? In my opinion, he would apply for a wholesale use; the big building would be for the storage of the wholesale goods. Currently there is a Special Exception on the property for Mechanical and Repair Services. This was granted by the BOA on 12/19013 so it would expire on 6019/14 if a BTR for this use was not applied for. He told me that should the wholesale tire business not be as successful as he was hoping for, that he wanted to do some simple auto repairs. I am thinking he would then need to reapply for the Special Exception use of Mechanical and repair services. Yes, if he wanted to undertake auto repairs he would need to apply for the Special Exception for Mechanical and repair services. 1 know he will also need to comply with the improvement of the parking spaces and driveway that we have already spoken about as well as the landscaping. Correct again. As for the vacant lot, I will give him copies of the Code so that he is aware of the Permitted and Special Exception uses for CHV as well as the lot and structure requirements. Just wanted to verify everything with you and am hoping this will be the last inquiry on this property. Thanks, Patty Patty M. I maybe import 6-7 container each time if the tire wholesale growing well in the first two year, I pan to wholesale the imported tires in the Florida at the first and then wholesale to other states if I find other tires buyers company in other states. Because the 1127 buidiing is in the good location, so I can also retailer tires buy tires in my store. I intend to display some tires in the reception areas. So my business plan is tire import, tire wholesale and retail. If tire sale goes repair services in the future. If the tire sale goes not well, I maybe add some year later. I have been researching this parcel for you that we were speaking about yesterday. I have a couple of questions that will help with my research. 1. You referred to the business as "wholesale tile". I need to clarify exactly what you mean by "wholesale". Do you mean you will be importing the tile from china to sell in large quantities to someone to sell to other people? Or does a contractor or just a regular customer come into the showroom and pick out a type of tile you can import and they purchase that product only for a certain job? I need to clarify this so can determine if you are more retail like walking into a carpet store and ordering flooring for your living room or if you mean wholesale in that a tile store would order from you to sell to the general public in their place of business. We have different definitions for retail and wholesale and these uses are permitted differently in different zoning districts. Thank you for your help and I will be back in touch after you answer the above questions. Patty Patty M. He said there are already guidelines in the City's Code for properties located in the Central Business District that helped protect and preserve historical buildings. MemberJonassaint offered a citizen board should be established with a group of citizens that could analyze properties to see what could be done to preserve them. A letter was emailed to the Board Secretary from Member McCreary, which expressed his opposition to moving the proposed historic preservation regulations forward to the City Council. After much discussion, the following motion was made. Board Member Keefe made a motion to recommend the City Council create a historical preservation commission charged with identifying criteria and locating areas to be considered historical and to provide a vehicle for preservation on a voluntary basis, seconded by Board Member Jonassaint. Chairperson Hoover asked whether there was any further discussion. Previously this Board approved Special Exceptions No 14 -003 -SE to allow wholesale, warehouse not including bulk storage of flammable liquids, and No. 14 -004 -SE to allow mechanical and repair services. The business intended to warehouse tires and operate a retail and wholesale tire sales business in combination with general auto repair. The applicant had indicated all of the above activities were to be conducted within the buildings. The applicant and owner of the business now requests to construct a tire cage to store used tires outside of the buildings. Clarification on prior approval for Special Exception Petition No 14- 003 -SE to allow wholesale, warehouse not including bulk storage of flammable liquids, and No. 14 -004 -SE to allow mechanical and repair services continued. requires a special exception approval. The prior application that was submitted did not give the impression that the tires would be stored outside, though one would recognize that it is common practice fora business that sells and installs tires to temporarily store the old tires outside until they are picked up for disposal. Administrator Whitehall determined the appropriate approach to make sure an additional special exception approval for outdoor storage was not needed was to bring the matter before the Board for clarification. After a brief discussion among the Board, the consensus was they envisioned there would be outdoor storage of the used tires. Attomey Cook ask the Board to keep in mind there is another location in the City Limits that stores used tires from their business outdoors. At times there are quite a few tires piled up on the lot and the appearance is unsightly. A suggestion was made to cover the chain link fencing material with slats so as to block the view from the surrounding areas. Board Member Baughman made a motion to clarify that the previous Board action approving Special Exception No. 14- 003 -SE to allow wholesale, warehouse not including bulk storage of flammable liquids, and No. 14 -004 -SE to allow mechanical and repair services, granted to the applicant, Mr. Aaron Feng, for the business located at 1127 SW Park Street, Lots 9 and 10, West 100 feet of Lot 11, Block 3, Southwest Addition, to permit activites typically found attire sales business, specifically permitting outdoor storage of used tires. The structure for the outdoor storage must be enclosed, or if a chain link enclosure, covered with plastic slats so as to be not visible tot he public; seconded by Board Member McCoy. Chairperson Hoover asked whether there was any further discussion. There was none. [emphasis added] The owner/operator of the proposed business now wishes to construct a 15 -foot by 10 -foot "tire cage" on a 28 -foot by 16 -foot concrete slab. This cage will be located outside of the principal structure and therefore must be considered outdoor storage. Outdoor storage requires approval of a special exception. The owner/operator of the proposed business has proposed the following justification for the tire cage being allowed: "SPECIAL EXCEPTION STATED THAT THE LAND ENVISIONS A WIDE VARIETY OF RETAIL AND WHOLESALE, STORAGE USES. THE BACK TIRE CAGE IS ALLOWED BY THIS SENTENCE." While nothing in the Application gave me the impression that tires would be stored outside, I recognize that it is common practice for business that sell and install tires to temporarily store the old tires outside until they are picked up for disposal. Therefore, the City Administrator has determine that the most appropriate approach would be to bring the matter before the BOAA. The question is, when the Board approved the Special Exception, was it under the impression that tires would be stored outside of the building? Providing Planning and Management Solutions for Local Governments Since 1988 1375 Jackson Street, Suite 206 Fort Myers, FL 33901 239-334-3366 info©larueplanning.com 1 If so, we believe that it would be within the Boards prerogative to clarify the approval and state that the approval was intended to allow such use. If such is the case, we suggest that the Board consider requiring the chain link fence to include slats intertwined in a manner that would block the view of the tires from all sides. If you determine that the approval did not envision such outdoor storage of the used tires, then the owner should apply for a special exception for outdoor storage as required in the CHV District. I look forward to discussing this with you at the upcoming Planning Board/BOAA meeting on Thursday. My office assistant this week for family move and leave until Friday come back. Because I have no experience with the tire cage, Kevin worked in Walmart and know the tire cage. In terms of tire cage picture, I can confirm that will be similar to walmart's tire cage. The tire cage is used to storage used tires when future customer come here change tires and leave tire and we help to disposal them but the disposal that normally is by a certain time depends on how many customers future but we do need that for carry a few and facilitate to future disposal company come to pick up by certain time like the dumpster come weekly or monthly. No drug or alcohol rehabilitation patient shall be allowed to leave the building unless accompanied by a friend or relative picking up the patient upon release from the facility, or accompanied by an employee of the facility for the purpose of taking the released patient to public transportation for retum to his/her home. AUGUST 21, 2014 - PLANNING BOARD - PAGE 5 OF 12% ACTION - DISCUSSION - VOTE This being a quasi-judicial proceeding, Notary Public Patty Bumette administered an oath to those intending to offer testimony, all responded affirmatively, and stated their names and addresses for the record: Bill Brisson, Senior Planner, LaRue Planning and Management,1375 Jackson Street, Suite 206, Fort Myers, Florida, and Mr. Elvie Posey, Berger Real Estate, 425 Southwest Park Street, Okeechobee, FL. Chairperson Hoover yielded the floor to Planner Brisson to present the Planning Staff Report, who explained the proposed activities of the business will include wholesale and retail sales and installation of automobile tires, and warehousing of the tires. The site was previously operated under the name of John's Auto Electric and Auto Service. The 1,320 square foot northernmost office/storage building was constructed in 1986 and the 3,000 square foot garage building adjacent to it was built in 1997. The 3,000 square -foot building appears to be nonconforming with respect to the required street side setback of 15 feet. This non -conformity will be permitted to continue without any adjustments. However, landscaping will be required to be brought up to code as reasonably as possible, together with improving four parking spaces on the East side and the driveway is to be improved with concrete or asphalt. Planning Staffs recommendation for approval is based on two sets of criteria. One being the site's consistency with the current LDR's, and the other, findings required to consider a Special Exception. Planning Staffs responses to the applicants presentation on consistency with the LDR's are that the location and site are appropriate for the use. The use will occur entirely within the property and should not have significant effects upon the surrounding properties, and no special visual screening should be necessary, although the new owner will be required to provide landscape buffers in conformance with City Codes. Assuming there will be no outside storage of materials, there will be no significant effects upon the surrounding properties, there is not expected to be any increase in the demand upon utilities, sanitary sewer, or solid waste as the proposed activities are not expected to place any greater demand on the public services from the previous use. Traffic may modestly increase though that increase can be accommodated within the capacity of the property and access roads. The new owner is not required to provide additional parking, though existing four un -paved parking and driveway needs to be improved to City standards. • Planning Staffs responses to the applicant's presentation on the required findings to consider the Special Exception, are that the proposed use is not contrary to the Comprehensive Plan. Wholesale, warehouse not including bulk storage of flammable liquids is specifically listed as a Special Exception use in the CHV District Regulations. The use, its operation, and impacts will not significantly differ from those associated with the former use of the property and will have no adverse effect upon the public interest. This particular use is appropriate for the proposed location, compatible with adjacent uses and not detrimental to urbanizing land use pattems. The proposed use should not adversely affect property values or living conditions. No special visual screening will be necessary. AGENDA V. PUBLIC HEARING QUASI-JUDICIAL ITEM CONTINUED. B. 2. AUGUST 21, 2014 - PLANNING BOARD - PAGE 6 OF 12 ACTION - DISCUSSION - VOTE However, as a result of the impending transfer in ownership, the new owner will be required to provide landscape buffers in conformance with the requirements of the City's Code. Density is not an issue with a commercial use and no significant increase in commercial intensity is envisioned that would have a negative effect upon public services or facilities. Traffic congestion will not be increased nor will traffic safety be compromised by location of the proposed use. There should be little or no change in the drainage situation since there is no physical change to the structures or other improvements except for the paving of the four parking spaces and repaving of the driveway. Mr. Brisson is recommending approval with the following stipulations: the four parking spaces on the East side of the office are improved to City standards with pavers or other dustless surface, the driveway is improved to City standards with a dustless surface and landscape buffers are provided in conformance with requirements of Sections 90-532 and 90-534 of the LDR's. Mr. Posey, Agent representing the property owner addressed the Board by explaining there is a pending sale on the property and the buyer was fully aware of the requirements that are needed to bring the property into compliance, adding further, its anticipated the new use will create up to ten jobs. Chairperson Hoover asked whether there were any comments or questions from those in attendance. There were none. Chairperson Hoover asked Board Members to disclose for the record whether they had spoken to the applicant or anyone else regarding the application, or visited the site. Board Member Baughman disclosed he helped the contractor figure out a cost and Board Member Burroughs, in his capacity of President of the Chamber of Commerce, received an email from the prospective buyer of the property, Mr. Aaron Feng, and had conversations with Mr. Posey in locating a property for the proposed business. Ociepka Petition No. 14 -003 -SE & 14 -004 -SE Item Before the Board of Adjustment The matter for consideration by the City of Okeechobee Board of Adjustment includes two Special Exceptions for the property at 1127 S.W. Park Street. The first Special Exception is for wholesale tire sales and warehousing. The second is for mechanical and repairs services. These two Special Exception Applications have been combined into this one Staff Report because all of the activities associated with these Special Exceptions will be undertaken as one business on the property. This property had previously received approval of Special Exception (13 -004 -SE) for repair and welding in December of 2013. Description of the Situation The parcel carries a Future Land Use designation of Commercial and is zoned CHV, Heavy Commercial. The site was previously operated under the name of John's Auto Electric & Auto Service. The 1,320 square foot northernmost office/storage building was constructed in 1986 and the 3,000 square foot garage building adjacent to it was built in 1997. According to the applications, the activities to be undertaken will include wholesale and retail sales and installation of automobile tires, warehousing of the tires, and general auto repairs including a/c repair, tune-ups and minor engine repair with all of the above activities to be conducted within the buildings. The proposed use will start with three employees and the business will operate Monday through Saturday between the hours of 9:00 AM and 5:00 PM. It should be noted that the existing use is housed in a nonconforming structure as defined in the LDRs as follows: "Nonconforming structure means a lawful building or structure existing on the date of enactment or amendment of these regulations, but which does not conform to the yard, setback, coverage, height, parking, landscaping or supplementary regulations of the district in which it is located." The original 1,320 square foot structure conforms to all setback requirements. It is difficult to tell without a survey, but the 3,000 square foot garage appears to be noncon- forming with respect to the required street side yard setback of 15 feet. The new owner will not be required to address these nonconformities. However, the combined structure is also nonconforming as to landscaping and parking requirements. Specifically there are no shade trees or shrubs provided as required under Sections 90-532 and 90-534. In addition, the four parking spaces along the east side of the office are not paved or lined. Section 90-35(d) sets forth the regulations governing how a nonconforming structure is treated when the underlying land is sold. In this case, Section 90-35(d) Serving Florida Local Governments Since 1988 Staff Report Applicant's Name: Peggy M. Ociepka Special Exception Request Petition No. 14 -003 -SE & 14 -004 -SE requires that the landscaping requirements be met "to the extent reasonably possible." Further, Section 90-35(d)(1) requires that those portions of the property that have been used for off-street parking but are unpaved or unmarked or otherwise do not meet the City's design standards should be improved to City standards for off-street parking and vehicular use areas. Ociepka Special Exception Request Petition No. 14 -003 -SE & 14 -004 -SE (1) Demonstrate that the proposed location and site are appropriate for the use. "The property is located on a major 4 lane SR with a corner on SW 12th Ave. Ingress & egress and parking are more than adequate with access from SR 70 and SW 12th Ave." We agree that the location and site are appropriate for the use. The prop- erty is located within the Commercial Corridor and is zoned CHV and is generally surrounded by nonresidential zoning and uses except for the single-family use immediately to the south of the vacant parcel also being purchased by the Applicant. (2) Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent uses and the neighborhood, or explain why no specific design efforts are needed. (3) "The present building has overhead roll up doors so that all work can be done inside. It is the intention that the only work done outside will be unloading tires from containers." We agree. The activities to be undertaken will be wholesale and retail sale and storage/warehousing of tires as well as general auto repair, tire instal- lation, a/c repair, tune-ups and minor engine repairs which are not significantly different from the John's Auto Electric and Repair Service or the welding and repair services contemplated when the prior Special Exception was approved in December of 2013. We recognize that the Applicant is making no changes to the property that would indicate intensi- fication of the use and see no need for any specific design efforts. Demonstrate any landscaping techniques to visually screen the use from adjacent uses; or explain why no visual screening is necessary. "All work will be done inside, only unloading of tires from container outside." We agree that no special visual screening will be necessary. However as a result of the impending transfer in ownership, the new owner will be required to provide landscaped buffers in conformance with the require- ments of Sections 90-532 and 90-534. The compliance with this requirement will be assessed during the site plan review by the Technical Review Committee (TRC). Serving Florida Local Governments Since 1988 Staff Report Applicant's Name: Peggy M. Ociepka Special Exception Request Petition No. 14 -003 -SE & 14 -004 -SE (4) Demonstrate what is proposed to reduce the impacts of any potential hazards, problems or public nuisance generated by the use or explain how the nature of the use creates no such potential problems. (5) "The usage will not be much different from what has been done since 1987. There will probably not be any welding done, and tire sales and auto repair will be only slightly different from what has formerly been done." We agree, assuming there will be neither outside storage of materials or customer property prior to or awaiting repair nor any repair or installation activity conducted outside the building. Demonstrate how the utilities and other service requirements of the use can be met. "Utilities are presently in place and have been in use since 1987." We are unaware of any problems with utility services to the site in the past, and would not expect the proposed activities to place any greater demand on public services than the previous operations. (6) Demonstrate how the impact of traffic generation will be handled off site and on- site. "There is plenty of room on site for vehicles to enter building through garage doors. Parking is more than adequate" Traffic generation should be similar to, but could be slightly greater than, that previously occurring under the former operation. Any modest increase can be accommodated within the capacity of the property and access roads. However, based on the requirement for one space for each 150 square feet of floor area in the 3,000 square foot garage and one space for each 300 square feet of non -storage space in the original 1,320 square foot office, the parking requirement would be 23 spaces. While the new owner is not required to provide additional parking, he/she must address the require- ments of Section 90-35(d)(1). This means that the four (4) unpaved parking spaces should be improved to city standards with pavers or other dustless surface and the driveway should also be similarly improved. Compliance with this requirement will be assessed during the TRC review of the site plan. Serving Florida Local Governments Since 1988 Staff Report Special Exception Request Applicant's Name: Peggy M. Ociepka Petition No. 14 -003 -SE & 14 -004 -SE Section 70-373(c) (1) — (8) When reaching a conclusion on a Special Exception request, the Board of Adjustment shall consider and show in its record the following findings as set forth in Section 70- 373(c)(1)-(8). The required findings are listed below followed by the Applicant's statements in Times Roman typeface. Staff comments follow and are shown in bold Arial typeface. (1) The use is not contrary to the Comprehensive Plan requirements. "The property has had a commercial usage since 1987 and is recognized as commercial on the comp plan. The property has been used for repairs and welding. We agree. The Commercial Future Land Use Category envisions a wide variety of commercial uses and retail and wholesale sales and storage and auto repair services are considered allowable uses. (2) The use is specifically authorized as a special exception use in the zoning district. (3) "Yes it is." We agree. §90-283(7) specifically lists "Wholesale, warehouse not including bulk storage of flammable liquids" and "Mechanical and repair services" as a Special Exception uses in the CHV District . The use will not have an adverse effect on the public interest. "No, no more than it has previously." We agree. The use, its operation and impacts will not significantly differ from those associated with the former use of the property and will have no adverse impact upon the public interest. (4) The use is appropriate for the proposed location, is reasonably compatible with adjacent uses and is not detrimental to urbanizing land use pattems. "There has been no detrimental effect since 1987." We agree that the location and site are appropriate for the use. The prop- erty is located within the Commercial Corridor and is zoned CHV and is generally surrounded by nonresidential zoning and uses except for the single-family use immediately to the south of the vacant parcel also being purchased by the Applicant. Serving Florida Local Governments Since 1988 6 Staff Report Applicant's Name: Peggy M. Ociepka Special Exception Request Petition No. 14 -003 -SE & 14 -004 -SE (5) The use will not adversely affect property values or living conditions, nor be a deterrent to the development of adjacent property. "The property is located on a 4 lane SR with SW 12th Ave along its entire west boundary. The area is primarily developed. The retail and wholesaling, storage and installation of tires and auto repair services on the site, should have no significantly greater impact than that previously undertaken or approved for the site. As such the proposed uses should not be expected to adversely affect property values or living conditions in the area. Its characteristics and impacts are similar to previously approved uses and the former use. (6) The use may be required to be screened from surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. (7) "There should not be any difference from the usage it has had since 1987." We agree that no special visual screening will be necessary. However as a result of the impending transfer in ownership, the new owner will be required to provide landscaped buffers in conformance with the require- ments of Sections 90-532 and 90-534. The compliance with this requirement will be assessed during the site plan review by the Technical Review Committee (TRC). The use will not create a density pattern that will overburden public facilities such as schools, streets, and utility services. "Ingress and egress is more than adequate with SR 70 to the north and SW 12th Ave to the west. The size and the design of the property is more than adequate. Density is not an issue with a commercial use and no significant increase in commercial intensity is envisioned that would have a negative effect upon public services or facilities. Serving Florida Local Governments Since 1988 Staff Report Applicant's Name: Peggy M. Ociepka Special Exception Request Petition No. 14 -003 -SE & 14 -004 -SE (8) The use will not create traffic congestion, flooding or drainage problems, or otherwise affect public safety. "The retention and drainage are in place. Flooding or drainage has not been an issue since 1987." We agree that neither will traffic congestion be increased nor traffic safety be compromised by location of the proposed uses of the property. Since there is no physical change to the structures or other improvements except for the paving of the four parking spaces and repaving of the driveway, there should be little, if any, change in the drainage situation. Recommendation Staff recommends approval based upon the foregoing analysis and findings with the following stipulations: 1. Is my special exception equals zoning application? or I need to apply for other items for zoning application for warehouse? 1 Xuehai Feng(AARON) Sages have no selfish desires. They cultivate virture instead of amassing wealth for themselves. With virtuous disposition, they teach the ignorant, and with the money they have, they give to the needy. They reserve nothing for themselves. It appears that the more they give to others, the more they receive in return. The law of nature is naturally beneficial and never does any harm to anything;the conduct of sages will benefit people naturally and does not struggle to control along the way.
