SECOND REGULAR MEETING TUES~AY.~ OCTOBER 25, 1977
The City Council of the City of 0keechobee, Florida convened in a Regular
Meeting in the Council Chambers at the City Hall, 0keechobee, Florida, at
7:00 ~.M., October 25, 1977.
President Russell V. Domer presiding.
Councilman Edward W. Douglas, La, on Bass and Lytle Raulerson were present.
Councilman Jim Knight was absent.
Others present were: Audley Dunham, Mayor; Sandra Bennett, City Clerk;
Larry Mobley, Chief of Police; L. C. Fortner, Director of Public Works; David
Conlon, City Attorney; 01en Godwin, Fire Chief; Richard Spray, Building Official;
and Sylvia ChriStian, Deputy Cle~Jk.

PUBLIC HEARING
BID TABULATION - 1978 AUTOMOBILE - POLICE DEPARTMENT
It being the hour of seven o'clock and pursuant to a notice published
October 14th and 21st, 1977, sealed bids were received opened and read f~r the
purchase of one 1978 Police Automobile with trade-in of 1974 Plymouth.
Bids were as follows with trade-in:
0keechbbee Motor Company $5,739.00
Gilbert Chevrolet Company $5,800.00
Councilman Bass moved to award contract to lowest bidder, which was
0keechobee Motor Company in the amount of $5,739.00 with trade-in, seconded by
Councilman Raulerson motion carried.
TAYLOR ESTATES SUBDIVISION
Mr. Joseph Porten, appeared before the Council requesting a conditional
approval o~ the preliminary plat for the proposed Taylor Estates S~bdivision.
President Domer questioned if Mr. Spray had reviewed the plans. Mr. Spray
stated that if Mr. Po~ten would change his lot sizes he would approve the ~lans.
President Domer advised Mr. Porten of Department of T~ansportat~ons plan~
to remove culvert that he was planning to use on State Road 70 to drain in that
direction, He stated that drainage plans might have to be revised.

Director Fortner and Attorney Conlon stated that they had no further ob-
jections to approval of plat.
Mr. Porten requested authorization to construct two model homes for
viewing to start sales program before Water & Sewer was constructed.
Following discussion the Council stated that they could not approve the
construction of two homes.
Councilman Douglas moved to authorize the ~lerk th advertise a phblic
hearing to receive reports and review preliminary plat and construction plans as
required by City Ordinance and to give the developer, joining property owners
and other persons interested the right to be heard in person, seconded by
Councilman Bass motion carried.
Mr. Porten reported that the engineer suggested that the Council adopt a
ResOlution authorizing him to work on the plans for the sewer lift station.
Authorize Director Fortner to tell the engineer to start on plans within two
days provided that Within that time the engineer gives Director Fortner or the
Clerk an estimate of what it is going to cost and make a deposit and get receipt.
Following a lengthy discussion Councilman Douglas moved to authorize ~he
Engineer to enter into an agree~ with Mr. Porten to complete the plans on lift
stations, seconded by Councilman Raulerson motion carried.
APPROVAL OF MINUTES
It was moved by Councilman Bass, seconded by Councilman Rmulerson and vote
carried that the minutes of June 14, 28; July 7, 12, 19, 26, August 4, 9, 16, 25,
25 and September 1, 6, 8, 15, 20 and 27, 1977 be approved as recorded except for
a correction to AuguSt 25, 1977 minutes whereby Acting Chief, Larry Mobley, had
not been prom~ted to Chief.
1. RESIGNATION
A letter of resignation was submitted from Clinton Fiore, effective October
7, 1977.
Councilman Bass moved to accept Fiore's resignation, seconded by Councilman
Raulerson motion aarried.
2. HUMANE DERA~TMENT TRUCK REPAIRS
Acting Chief of Police~ Larry Mobley reported that the Humane Department
Truck was in need ,of rep~ir~,gnd,~submitted two prices fr~m Gilbert Chevrolet in
the amount of $~51 dollars and from Tin Shed II in the amount of $~4 dollars.
Following discussion the Comncil postponed action and requested Acting Chief
Mobley to try and get a lower bid.
~. MEM~BRSHIP
Acting Chief Mobley requested authorization %o apply for membership to the
Police Chief's Aseoeiation for $~0 d&llar-,fee.

Councilman Bass moved to authorize Acting Chief Mobley to join Association
and pay $~0 dollar membership fee, seconded by Councilman Raulerson mo~ion carried
ADRIAN'S GROCERY
Attorney Conlon brought to the attention of the Council that Adrian's Store
had been reopened. The license application was submitted.
Attorney Conlon advised Building Official Spray to inspect the building and
if it does not pass inspection, license can not be issued.
Following a lengthy discussion the Council agreed to withhold license until
clarification of injuction.
FIRE D~ARTMENT
1. COUNTY FIRE DEPARTMENT
Chief Godwin reported that the County Fire Chief informed h~m that the
County would take over the County fires November 1, 1977.
2. FIRE RESISTAN~f BLANKETS
Chief Godwin requested authorization to purchase two fire resistant blankets
for $100 dollars.
Councilman Raulerson moved to authorize Chief Godwin to purchase blankets,
seconded by Councilman Bass motion carried.
3. PUMPER
Ch~f Godwin informed the Council that the pumper on the fire truck was t
rep~ired but, he didn't know the cost.
Following discussion Councilman Bass moved to use Ant~-Recession Funds to
pay for having pumper fixed, seconded by Councilman Raulerson- motion carried.
CITY - COUNTY FIRE AGREEMENT
President Domer read letter from 0keechobee County Commissioners which
states as follows: As per your letter regarding the City-County Fire Protection
Agreemmnt, I would like to clarify the County's position. In our Regular
Meeting of August 25, 1977, the Board elected to establish a County Fire Depart-
ment. At that time the Board directed the Clerk, Mr. Clif Betts, to inform the
City of that intention. He was al~o to state, on our behalf, the County wished
to continue the arrangement with the City on a month to m~nth basis with the
County paying its proportionate share of costs according to the number of fires
in the unincorporated areas each month. We felt at the time that within 30 to
60 days wa could have a Pire Department ready to assume the job. We had no
notification from the Countil that this arrangement was not satisfactory. We,
therefore, assumed these were the terms we were operating under. We do want to -'~
thank and commend the City for its help and cooperation and pledge our cooperation
with you in the sa~e spirit in the future. Signed Clyde R. Durrance, Chairman

WATER~ SEWER AND STREET DEPARTMENTS
1. HIGHWAY SAFETY
Director Fortner submitted a letter from the Department of Highway Safety
informing the City of the availability of funds for Highway Safety.
Council agreed to authorize Director Fortner to contact a firm to come,'
before the Council to answer any questions concerning the funds availabile. More
discussion at next regular meeting.
2. CETA EMPLOYEES
Director Fortner reported on the availability of CETA Employees. He stated
that he had spoken with a man in B~rtow and he informed Mr. Fo~tner that he
would have to make application.
Councilman Douglas moved to request five permanent CETA Employees, seconded
by Councilman Raulerson motion carried.
5. DEPARTMENT OF TRANSPORTATION
Director Fortner stated that himself, Presdient Domer and Clerk Bennett had
met with Department of Transportation concerning the four lantn~ of State Road
70.
He stated that with the four lan in~ it involved the CitY,'s Water & Sewer
Lines. He a~ked the Councils thoughts on having Engineer Don Shepherd, survey
Department of Transportaiions plans as to what they proposed to do and coming
up with some alternative ~ither lower the main thats there or replace it in a
location where it will be acceptable to new development and maintenance. Con-
struction is p~m~ned for January of 1979.
Councilman Bass moved to authorize Engineer, Bon Shepherd~ to begin study
of State Road 70 and to meet with the representatives of the Telephone Company
and Department of Transportation 0fficials~ seconded by Councilman Douglas motion
carried.
CITY CLERK
1. DEPARTMENT OF TRANSPORTATION - TRAFFIC STUDY
Clerk Bennett, submitted a letter from John Wilson, District Traffic Operation
Engineer of the Florida Department of Transportation advising the CounCil that a
traffic study of State Road 70 and North East ~th Avenue had been conducted and
it was determined that the minimum warrants for signalization, as set forth by
the American Association of State Highway Officials, the National Conference on
Street and Highway Safety, and the Florida Manual on Uniform Traffic Control
Devices, were not met at this time, but, will upon request by the City, restudy
this location at the end ~f a 12 month period.
2. REZONING APPLICATION
Clerk Bennett, presented a rezoning application from John Roy Ard and Philip
Y. Berger, requesting the Council to rezone Lots 11, 12, 1~ and 1~, Block 2,
Original Town of 0keechobee, from the present classification to Commercial.

Councilman Bass moved to instruct the Clerk to proceed with notification
to the ownsr and to advertise public hearings, seconded by Councilman Douglas --~
motion carried.
NOTICE OF RENTAL HOUSES
President Domer requested the Council authorize the Clerk to have a notice
published in the 0keechobee News. Council approved. No,ice is as follows:
Due to several incidents of the following nature~ we wieh to remind owners of
rental property that City of 0keechobee Ordinance Chapter 20, Sevtion 20-11
enacted September 2, 1958, states that when any water or sewer bill becomes de-
liquent the services shall be disconnected and can not be re-connected until
said bill is paid. Section 20-9 states that owners of rental houses are re-
sponsible for the water and sewer bills that are left unpaid by the renters.
CORRECTION ~N MINUTES
Minutes of the meeting held July 12~ 1977 pertaining to opening Okeechobee
Avenue which authorized Attorney Conlon to have an abstract document on the piece
of p~operty back to 1964 but Attorney Conlon requested authorization to have the
abstract document drawn back to approximately 1946.
Council approved correction,
