President Russell V. Domer presidiig. Councilmen Lytle Raulers~, Edward W. Douglas and Jim Knight were present. Councilman Lavnn Bass was absent. Others present were: Sandra Bennett, City Clerk; Larry Mobley, Chief of Police; Olen Godwin, Fire 6hief; Louis Keith Tomey, Assistance Fire Chief; L. C. Fortner, Director of Public Works and Sylvia Christian, Deputy Clerk. 1977 - 1978 WATER, SEWER AND GENERAL BUDGET The Council entered into Budget Session for the 1977-1978 Water, Sewer and General Budget. Councilman Douglas moved to accept the 1977-1978 Water, Sewer and General Budget, seconded by Councilman Raulerson motion carried. ADJOURNMENT There being no further business, the Cuuncil adjourned. President Russell V. Domer presiding. Councilmen Edward W. Douglas, Lavon Bass and Lytle Raulerson ~ere present. Councilman Jim Knight was absent. The Invocation was offered by Councilman Edward W. Douglas. 2153 PUBLIC HEARING ORDINANCE NUMBER #400 - LEVYING AND COLLECTING OF TAXES - FIRST READING President Domer submitted for first reading Ordinance Number #400 which is "An Ordinance providing for the levying and collecting of taxes for the City of Okeechobee, Florida, for the fiscal year beginning October 1, 1977 and ending September 30, 1978." It was m~ved by Councilman Bass seconded by Councilman Douglas and vote carried that the first reading of the Ordinance be.approved. PUBLIC HEARING ORDINANCE NUMBER #401 - ADOPTION OF BUDGET - FIRST READING President Domer submitted for first reading Ordinance Number ~401 which is "An Ordinance adopting a budget for the City of 0keechobee, Florida, for the fiscal year beginning October 1, 1977, and ending September 30, 1978, and pro- riding for the effective date hereof." It was moved by Councilman Douglas seconded by Councilman Bass and vote carried that the first reading of the Ordinance be approved. PUBLIC HEARING ORDINANCE NUMBER. #399 - EXEMPT PAYMENT OF PENALTY ON WATER BILLS - SECOND READING President Domer submitted for second~ reading Ordinance Number #399 which is "An Ordinance amending Section 6 of Ordinance Number 355, Code of Ordinance which provides for a 10 peroent penalty on any monthly Bill for ~ater service t hat is unpaid on or after 15 days from the date of submission, to provide a ~aiver fmm any customer 65 years ,or older." It was moved by Councilman Bass seco~ed by Comncilman Raulerson and vote carried that the second reading of the Ordinance be approved. FENCING ALLEYWAY Mr. DQUg CasselS appeared before the Council requesting the authorization to fence and h~&o~ top the Utility alleyway running north and south in block 49. He submitted letters from Marvin Arrants, District Manager of Florida Power and Light Company and Steve Kohn, District Engineer of United Telephone Company, stating that they had no objections to fenc~L~ off the alleyway. Following a lengthy discussion, Comcilman Bass moved to authorize Attorney Conlon to draw up a lease nn said alleyway to Doug Cassels, secnnded by Councilman Raulerson motion carried. DRAINAGE DITCH Mr. Lowry Markham appeared before the Council stating that he would be willing to deed easement for dmainage ditch on his property boundary line if the Council would agree to change the ditch from its ori~inal area. Com~cilma~reed to authorime Attorney Conlon to contact Commercial Bank and Frank Altobello regarding their permission to hire the services of a surveyor and to draw up easements if approved. 2154 OPENING 0KEECHOBEE AVENUE Attorney Conlon gave a progress report on opening that part of 0keechobee Avenue lying west of block 164 south of south park street and north of seventh street which is owned by James Nemec. Following discussion, the Council requested Attorney Conlon to again contact Mr. Nemec. POLICE-DEPARTMENT Sergeant Phillip Purvis of the Police Department submitted the following: MONTHLY REPOR~ Sergeant Purvis submitted the Police Departm~t activity report for the month of August, 1977. 2. RESIGNATION A letter of resignation was submitted from Michael D. McCann, effective September 15, 1977. Councilman Bass moved to accept McCann's resignation, seconded by Councilman Douglas motion carried. 3. HUMANE DEP ARTM~/~T David Hunter requested a two weeks leave of absense for surgery, from September 20, to October 3, inclusive. The Council discussed that David Hunter Could take it off his sid&. leave time. Conncil authorized Sergeant Purvis to contact a replacement Et $15.00 per day. FIRE ~EPARTMENT Fire Chief, 01en Godwin, submitted the following items for discussion or approval: 1. MONTHLY REPORT Fire Chief Godwin, submitted the Fire Department Report for the month of August, 1977. 2. GENERATOR Chief Godwin reported that Monroe Arnold had a~vieed that the magnito in the G~erator at the Fire Station be replaced with battery ignition. Councilman Raulerson moved to authorize the Chief ~ hire Monroe Arnold to make changes, seconded by Conncilman Bass motion carried. 3. TELEPHONE SYSTEM Chief Godwin requested authorization to convert the telephone system from a single phone to a push button system, at a cost of $63.50 for installation and $8.80 for local service. Councilman Raulerson moved to authorize the change over, seconded by Council- man Bass motion carried. BUILDING DEPARTMENT Building Official Spray reported a request from Jack Albritton for a variance on property at his home which is zoned Residential to have a lsJgn mower repair shop in his home for a period of approximately 6 months. Foll~ing discussion, Councilman Bass moved to authorize a variance allowing Mr. Albritton to run a repair shop for six months, and to authorize the clerk to issue a license for six months, seconded by Councilman Raulerson motion carried. WATER~ SEWER AND STREET DEPARTMENT Director Fortner su~mitted the following i~ems for discussion or approval: 1. MONTHLY REPORT Director Fortner submitted the Water, Sewer and Street Departments report for the month of August, 1977. 2. DUMP TRUCK REPAIR Director Fortner reported on the dump truck needing repairs. Councilman Bass moved to authorize Director Fortner to ~ve motor rebuilt in dump truck and to use anti-recession funds which have already been allocated. 3. GENERATOR AT WATER PLANT Director Fortner reported that the Generator at the Water Plant is complete. CITY CLERK 1. PUBLIC WORKS EMPLOYMENT ACT President Domer read a letter from the United States Department of Commerce Economic Development Administration informing the City of an offer of Grant issued pursuant to our application for Federal Assist anc~ under the provisions of the Local Public Works Capital Development and Investment Act of 1976, as amended by the Public Works Employment Act of 1977. The letter stated that~he Cit~s ° acceptance of the offer of grant will be indicated by the iignature of ou~ principal officer. 2. CITY COUNCIL MEETINGS SCHEDULED Clerk Bennett presented the sehedule for the regular Conncil meeting dates to be as follows: October ll and 25, 1977 November 8 and 22, 1977 December 13, 1977 ~-- 3. HOSPITAL CORPORATION 0F AMERICA The Sever Line Agreement has been executed by Hospital Corporation of America. STREE~ LIGHT REQUEST President Domer informed the Council that Florida Power and Light Company will install a light at Dr. Cadan's home on 9th Avenue right away instead of waiting until the Council has a full list. Foll~ing discussion, Councilman Bass moved to approve the authorization for Florida Power and Light to install light, seconded by Councilman Douglas vo~e carried. FIRE FIGHTING RGREEMENT President Domer reported that the had been informed that the County had not budgeted an amount in their budget fo~ Fire Protection. --~ Following a lengthy discussion the Council agreed to authorize President Domer to contact the Couney Commissioners by letter requesting a contract. DEPARTMENT OF TRANSPORTATION - TRAFFIC HAZZARD IN FRONT OF McDONALD'S President Domer reported on a traffic and parking hazzard on State Road ~ 70 in front of McDonald's. President Domer suggested contacting Department of Transportation by letter requesting an emergency survey. Councilman Bass moved that ih the intent of emergency safety to authorize Director Fortner to p~Rce "No Parking" signs at the entrance corner of McDonald's and to authorize President Domer to write letter to Department of Transportation of traffic hazzard, seconded by Councilman Raulerson vote carried. DRAINAGE DITCH Councilman Raulers~n questioned the possibility of getting the chemicals for spraying City ditches. Following a lengthy discussion the Council authorized Director Fortner to investigate equipment and spray and to report back. SEWER ~URVEY Director Fortner gave a progress report on the Sewer Survey. He stated that the Survey was b~ing done and inspection was in process.
