Daniel M. ,Mc, Carth~, Adminstrater Estate of D. B. Mc Carthy, was present to discuss closing detail:
in regards to giving the CitF of Okeechobee Mc Carthy Water Company water line. After discussion Councilmar
Gardner moved to accept'Mc C~rthy Water Company water line and instructed Attorney Hendry to prepare
necessary documents to transfer water li~e, assets and easements, effective as of August 1, 1964, seconded
by Councilman Watford and u~usly carried.
The Council authorized the Water Department to cut ditch and make Water tap for Ernest Evans in
Okeechobee Estates.~
Upon motion the C~ncil adjourned.

and notify Council seconded by Councilman Watford and carried.
NOTICE TO CONTRACTORS
SeaLed bids will be received by the City of Okeechobee, Florida, in the
City Codicil Chamber, City Hall, City of Okeechobee, Florida, on October 6, 1964,
at 7:00]~. M., Eastern Standard Time, for relocation of raw water intake main for
the Cit~' of Okeechobee, Florida.
BidS shall be made out on the proposal form prepared by the City, enclosed
in a sewed envelope, bearing the name and address of the bidder and marked, "Bid
for ReloCation of Raw Water Intake Main, for the City of Okeechobee, Florida".
Bids shall be accompained by a Bid Bond or certified check, drawn upon any
State or National Bank in Florida, made payable to the City of Okeechobee~ Florida,
in the a$ount of 5% of the price bid as a guarantee that the Contractor will enter
into a ~tten co~tract with the City to perfor~ the contract bid upon. The deposit
will be retained by the City as liquidated damages in the event the successful bidder
fails toi enter into a contract.
= The deposits of the unduccessful bidders will be returned promptly, and the

deposit of the successful bidder will be returned upon execution of the contract and
delivery of insurance policies.

The City of Okeec~obee, Florida, reserves the right to reject'any or all bids, to waive
technicalities; a~d the award, if made, will be to the lowest and most satisfactory

Mike Olsen, representative of Burnip & Sims, Inc. was present and discussed a franchise for
a Community Antenna TelevistOn Cable Ihstallation fer the City of Okeechobee. ~atter to be %akin under
consideration by the Council.
G. T. Rucks and M~. Ford, re~resenting the Catholic Church, were present requesting a water line
extension to Catholic Church. Councilman Walker reported that the distance had been surveyed and it would
require approximately 1350 ~eet of 2 ihch pipe. After discussion Councilman Gardner moved to grant request
and make water line extensien to said C~urch, seconded by Councilman Watford and carried.
T. T. Coleman appeared befor~ the Council and expressed a complaint of g~as fumes from trucks
parking in front of his restdence on PArrott Avenue and requested NO TRUCK PARKING'.~signs be erected.
After consideration matter reffered to Councilman Gardner and Watford.
The Council authorized the p~blication of notice of public hearing to rezone Lots 5 and 6, Block
219, First Addidtion to City of Okeech~bee from Residential (R-I) to Commercial as per application from
T. T. Coleman.
NOTICE is hereby given ~hat the City Council of the City of Okeechobee, Florida,
a municipal corporation will~ consider rezoning from Resid~ntiai (R-I) to Commercial
and to amend accordingly the~ Comprehensive Zoning Ordinance #271 adopted November 21,
1955, the followi~g described~ real property, situate, lying and being within the
corporate limits ef the City of Okeechobee, Florida, to-wit:

Mayor Mack discus~d complaints on Garbage Service rate increase. Afterwhich the Council re-
quested the Mayor to notify ~ranchise Holders to meet with Council regarding matter.
Attorney Hendry D~sented .Agreement between Central and Southern Florida Flood Control District
and City. Councilman Hunt ~oved to accept Agreement, seconded by Councilman Watford and unanimously
carried.
AGREEMENT
THIS AGRE~E~, Made and entered into this the 6th .day of October A. D. 1964, by
and between CENT~ AND SOUTHER~ FLORIDA FLOOD CONTROL DISTRICT, & public corporation,
hereinafter referred to as "DISTRICT", and CITY OF OKEECHOBEE, FLORIDA, a municipal
corporation, hereinafter referred to as "CITY".
WITNESSETH:
WHEREAS, "DISTRICT" has undertaken a program of construction relating to the
improvement of that certain section of Lake Okeechobee levee designated as Levee D-4,
in OkeeShobee County, Florida; and
WH~AS, the said construction will necessitate the relocation of "CITY'S" 14- inch
raw watSr intake line where that line crosses the Levee D-4 borrow ditch; and
WHSREAS, "CITY" has expressed its willingness to contract for and supervise the
relocation of its iL inch raw water intake line to conform to and meet the current
requirelents of the flood control program for the improvement of said Levee D-4 and
through its proper officers has requested that a sum of money equal to the said re-
locatiol cost be paid to "CITY" in retu~m for full, final and complete discharge of
any and all respomsibility and liability for or in connection with the said relocation,
which rSsponsibility and liability "CITY" has expressed a willingness to assume; and
W~REAS, ,DISTRICT" agrees to pay for the following items of constrmction:
(~. Oomplete cost of alterations and relocation of water line;
(25. Required excavation:
(~. Engineering Fees;
(~. InspeCtion fees.
NO~ THEREFORE, in consideration of the premises and of the promise by "DISTRICT"
t~ pay ~elocatiem costs in return for ~CITY'S" contracting for and supervising the
said re~ocation, the parties hereto agree as follows:
1. "CITY" agrees to forthwith proceed with the alteration and relocation of
"CITY'S~ 14-inch raw water in'ko line to conform to and meet the current requirements
of the ~ood control program for the improvement of Levee D-4.
2. "CITY" further agrees to remise, release, and forever discharge totally and
complet$1y "DISTRICT", its successors or assigns, of and from any and all reepemsibility,
liability, loss, injuries, damages, expenses, claims or demands whatso.wer, director or
indirect, arising from or in anywise pertaining to the contemplated alteration and re-
locatio~ of "CITY'S" iL-inch raw water intake line as contemplated herein and "CITY'S"
subsequSnt maintenance or operation of the said line crossim~ Levee D-~ borrow ditch
in Okee~hobee County, Florida.
3. i "DISTRICT" agrees to pay the actmal relocation costs incurred in the alteration
and rel$cation of the subject line as hereinbefore set forth in this Agreement.
4.~ "CITY" agrees that payment ~e "CITY" by "DISTRICT,' shall be based on actual bid
prices ~nd Einal quantities and that a tabulation of bids received by "CITY" by submitted
to "DISTRICT" prior to the award of a contract for this work.

A request frSm Marvin F Mosley for employment was read by Clerk and ordered filed

A letter of appreciation to Olen Godwin, Fire Chief from Daniel W. Delagall was read
and ordered filed.
Councilman ~alker presented several prices on various sizes of pipe. Industrial Supply
Company quoted the lowest p~ice. Councilman Gardner moved to accept the price offered by Industrial
Supply Company and purchase the following pipe:
500 feet of ~/4 inch
500 feet of X inch
2000 feet of ~ inch
seconded by Councilmam Wal~r and unanimously carried.
The Council crated that the City womld not purchase meters from persons on Mc Carthy Water
CompemF line,- said ~ persons ~ad purchased the meter from Mc Carthy.
Councilman ~ant reported complaints on trailers being parked in City, this being in con-
flict with City Ordinance. Mayor Mack offered seVeral recommendations for Ordinance Amendment. Matter
to be studied further.
