FIRST REGULAR MEETING TUESDAy., AUGUST 9, 1977
The City Council of the City of 0keechobee, Florida, convened in a regular
meeting ~n the Council Chambers at the City Hall, 0keechobee, Florida, on
Tuesday, August 9, 1977 at 7:00 P.M.
President Russell V. Domer presiding.
Councilmen Lytle Raulerson and Lavon Bass were present. Councilmen Edward
W. Douglas and Jim Knight were absent.
Others present were: Sandra Bennett, City Clerk; David Conlon, City Attor-
ney; Larry Mobley, Acting Chief of Police; 01en Godwin, Fire Chief; Keith Tomey,
Assistant Fire Chief; and Sylvia Christian, Deputy Clerk.
The Invocation was offered by President of Council, Russell V. Domer.
REQUEST FOR ALLEY CLOSING
Frank Miller appeRred before the Council requesting alleyway running East
and West in front of Block 15 South West Addition be closed.
President Domer informed Mr. Miller that in the event the alle)rway was
closed the ownership would revert back to the original owners, that a search
would have to be made to see who the ow~rs were and to get clear title.
Mr. Miller requested fill dirt be put on the alleyway as it is a low area.
Following a lengthy discussion Mr. Miller agreed to come back for further
discussion with a full Council and Attorney Conlon to proceed with the drawing
of a ten year lease.
STREET LIGHT REQUEST
Dr. Cadan appeared before the Council informing them of his setting up his
office in his home on 9th Avenue. He also requested a street light at his
home.
President Domer informed Dr. Cadan that his re.quest would be placed on the
list to be considered.
POLICE DEPARTMENT
Acting Chief of Police, Larry Mobley, appeared before the Council with the
following items for discussion or approval:
1. MONTHLY REPORT
Acting Chief Mobley submitted the Police Department Activity Report for the
month of J~ly, 1977.
2. RESIGNATION
A letter of resignation was submitted from Marion Stafford, effective
July 31, 1977.
Councilman Bass moved to accept Staffordls resignation, seconded by Council-
man Raulerson motion carried.
BEACH WATER ASSOCIATION
President Domer stated that the Cities and Beachwaters Engineers had drawn
up a satisfactory change on the agreement. He stated that the statement was to
read as follows:

'To provide the Association a water supply of 500,000 gallons per average
day f~r a period of ten years.'
Attorney Conlon stated that if and when the City has a dry spell the City
dosen't want to sell to much water. That is when the Cities c~pacity has rea-
ched that point the City just wants to sell 500,000 gallons. Then when its a
wet season the average for the month is 350,000. That would mean then in a peak
fund they could demand 650,000 every day. Or on a thirty day average some days
they would be do~n to 400,000 and other days they would want 750,000, and if

FIRE DEPARTMENT
Fire 8hief, 01eh Godwin, submitted the following items for ~iscussion or
approval:
1. MONTHLY REPORT
Fire ~hief Godwin, submitted the Fire Department Report for the month of
July, 1977.
2. PAINT~,NG OF SIGNS ON FIRE T~UCKS
Fire Chief Godwin requested authorization to paint signs on the two fire
trucks at approximately $100 dollars.
Councilman Raulerson recommended Chief Godwin to get more prices from sign
painters and moved to authorize Chief Godwin to have signs painted on the fire
trucks at lowest cost, seconded by Councilman Bass motion carried.
~. COUNTY FIRE AGREEMENT
Chief Godwin questioned if anything had been heard concerning the County
Fire Agreemeni.
President Domer stated that he had talked with a few of the County Commis-
sioners and they had budgeted $20,000 dollars for the 77-78 year for the Fire
Department. He stated that he felt they would sign the Agreement for one year
and build a Fire Department in the County. He also stated that when the County
builds a Fire Department the Water Tanker Fire Truck will have to be returned to
the Division of Forestery.
Following a lengthy discussion the Council agreed to follow up discussion
on the Agreement at a later date.
4. WALKIE TALKIES
Chief Godwin requested authorization to purchase a walkie talkie which cost
approximately $600 dollars for the Assistant Fire Chief, to replace one of the
walkie talkies which is inadequate.
President Domer questioned Attorney Conlon if the Anti-Recession Funds
could be used to purchase this walkie talkie. Attorney Conlon stated yes
because it would be a continuation of a basic service. He also stated that for
the Auditor: 'That one of the Motorola walkie talkies is inadequate and broken
down, and to continue to provide the necessary fire protection the Assistant
Chief has to be in communication and we therefore have to buy a new walkie talkie.
Also that in order to maintain the present fire protection that we have we have to
replace a damaged piece ~'f equipment and that the cheapest and most fle~sible way
to do it is to buy a brand new Motorola walkie talkie.'
Councilman Raulerson moved to purchase walkie talkie through state purchasing
with anti-recession funds to replace one that is inadequate, seconded by
Councilman Bass motion carried.
WATER~_SEWER AND STREET DEPARTMENT
1. NEW WATER MAIN EXTENSION
Director Fortner submitted a plat showing proposal of four new houses to be
built at Subdivision south of Brasher Ard, which is outside City Limits and in-
formed the Council that one of the customers had put down a well and the other
three were requesting City water. He stated that the existing two inch water line
in the area should be replaced by a four inch line for better water pressure at
the time the line is extended south of Palm Street and Palmetto Avenue which has
been requested at an approximate cost of $600 dollars to the City.
Following discussion, the Council authorized Director Fortner to check with
owners and report back.
2. EMPLOYEE APPLICATION - WATER
Director Fortner submitted an employment application from Kimberely Marshall
for empleyment in the Water Department, at a salary of $7,500 per year.
Councilman Bass moved to employ Marshall at $7,500 per year, seconded by
Councilman Raulerson motion carried.
CITY CLERK
1. REZONING APPLICATION
Clerk Bennett submitted a rezoning application from James Nemec, requesting
the Council to rezone "Ail that property lying 210 feet west of the west line of
0keechobee Avenue bounded on the north by the north line of 5th street extended
west said 210 feet and bounded on the south by the south line of 3rd Street ex-
tended west said 210 feet which property includes but not limited to all of
Blocks 190 and 191 all in the City of 0keechobee, 0keechobee County, Florida.
Further Less and except the following described lands: A certain parcel of land
deeded to Robert M. Matthews, Jr. by deed dated February 14, 1957 and recorded
in Record Book 14, Page 121, in the public records of 0keechobee County~ Florida,
described as follows: Beginning at the NW corner of the intersection of 0keechobe
Avenue and fifth avenue according to the plat of Town of 0keechobee, recorded in
Plat Book 2, Page 17, public records of St Lucie County, Florida, for POINT OF
BEGINNING; thence west on the north line of fifth avenue for a distance of 210
feet, more or less, to a point, said point being located 20 feet easterly of the
present center line of the former Florida east Coast Railway East Team Track
Number 5 (as shown on railway right of way blue prints now on file in the office
of Clerk of Circuit Court of 0keechobee County, Florida); thence northerly on
said East line for a distance of 50 feet, more or less; thence Easterly on a line

north of and parallel to the North line of Fifth Avenue for a distance of 210
feet, more or less, to the West line of 0keechobee Avenue; thence South to POINT
OF BEGINNING from Residential (R-l) to Residential (R-3) '-~,
Following discussion on the description, Councilman Bass moved to have ~
Attorney Conlon contact Mr. Nemec to clarify description leaving out streets,
seconded by Councilman Raulerson motion carried.
HUMANE DEPARTMENT
President Domer informed the Council of the County hiring a dog catcher and
they are no longer in need of the City dog catcher picking up dogs in the County.
He stated that the County is collecting dogs and putting them in the City pound
and then not caring for them or notifying Mr. Hunter. He also made the state-
ment of building a dog pound behind the Water Plant. Further discussion to be
held at a Meeting with a full Council.
RIGHT OF WAY SOUTH 441
President Domer questioned who owned the Right of Way on South 441 in front
of Car Wash.
Director Fortner Stated that it was the State Right of Way and that the
ditches were being cleared.
President Domer questioned if the City could install a culvert across the
Right of Way. He requested Director Fortner to research the matter.
ACTING CHIEF OF POLICE
Councilman Bass recommended the Council promote Acting Chief of Police
Larry Mobley to Chief of Police and increase his salary.
Action postponed for full Council.
DISBURSEMENTS
Vouchers on the following funds were approved:

Water & Sewer Operation & Maintenance Fund 47,114.27

Anti-Recession Fund 1,644.57
ADJOURNMENT
There being no further business the Council adjourned at 9:30 P.M.
