AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA; AMENDING
THE OFFICIAL ZONING MAP OF THE CITY OF OKEECHOBEE BY
REZONING A CERTAIN TRACT OF LAND MORE PARTICULARLY
DESCRIBED HEREIN, FROM COMMERCIAL PROFESSIONAL OFFICE
TO HEAVY COMMERCIAL ZONING DISTRICT; AMENDING THE ZONING
MAP ACCORDINGLY; PROVIDING FOR CONFLICTS, SEVERABILITY,
AND AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Okeechobee, Florida has adopted Ordinance
No. 402 in which a revised Official Zoning Map was adopted for said City; and
WHERAS, Jennifer Williamson, Esquire, as Agent for the property owner(s), Seniors "R"
Able, Inc., has heretofore filed Petition No. 15- 001 -R, pursuant to the Land
Development Regulations of the City of Okeechobee for the purpose of rezoning a
,ertain tract of land consisting of 1.68 acres from Commercial Professional Office
(CPO) to Heavy Commercial (CHV) Zoning Districts, and that this request be
removed from the boundaries of the above mentioned zoning district to allow for the
processing of the rezoning petition; and
WHEROAS, said petition was reviewed by the City's Planning Consultant who determined,
based on initial findings and review provided by the applicant, that such petition is
consistent with the Comprehensive Plan; and
WHEREAS, said petition being reviewed by the City's Planning Board at a duly advertised
Public Hearing held on April 16, 2015, determined that such petition is consistent
with the Comprehensive Plan; and
WHEReAS, the City Council agreed with the recommendation of the Planning Board and
hereby finds such rezoning petition to be consistent with the City's Comprehensive
Plan and deems it in the best interest of the inhabitants of said City to amend
aforesaid revised Zoning Map as hereinafter set forth.
NOW, THEREFORE, be it ordained before the City Council of the City of Okeechobee,
Florida; presented at a duly advertised public meeting; and passed by majority vote
of the City Council; and properly executed by the Mayor or designee, as Chief
Presiding Officer for the City; that:
SECTION 1: LEGAL DESCRIPTION.
The following described land consisting of approximately 1.628 acres, as the subject
property, located in the City of Okeechobee, to -wit:

SECTION 2: ZONING MAP AMENDMENT.
That the aforesaid Revised Zoning Map of the City of Okeechobee be amended to
reflect the subject property to be changed from Commercial Professional Office
(CPO) to Heavy Commercial (CHV).
SECTION 3: CONFLICT.
All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 4: SEVERABILITY.
If any provision or portion of this ordinance is declared by any court of competent
jurisdiction to be void, unconstitutional, or unenforceable, then all remaining
provisions and portions of this ordinance shall remain in full force and effect.
SECTION 5: EFFECTIVE DATE.
This Ordinance shall take effect immediately upon its passage.

THIS PARKING AGREEMENT ( "Agreement ") is made this h day of March, 2015 by
and between Seniors "R" Able, Inc., a Florida Corporation, whose address is
P.O. Box 759, Okeechobee, FL 34973, (hereinafter referred to as "SRA "), Lifestyles & Healthcare,
Ltd., a Florida limited partnership, whose address is P.O. Box 759, Okeechobee, FL 34973
(hereinafter referred to as "Ltd ") and OHCF Properties, LLC, a Florida limited liability company,
whose address is P.O. Box 759, Okeechobee, FL 34973 (hereinafter referred to as "LLC").
WITNESSETH:
WHEREAS, Ltd owns real property located at 1646 Hwy 441 N., Okeechobee, FL 34972,
legally described in Exhibit A attached hereto and incorporated herein (hereinafter referred to as
the "Nursing Home "), which is due east and adjacent to real property owned by SRA, legally
described in Exhibit B attached hereto and incorporated herein (hereinafter referred to as the
"Parking Lot "); and
WHEREAS, the Parking Lot is used by the Nursing Home for employee and visitor parking;
and
WHEREAS, LLC owns real property due east and north of and adjacent to the Nursing
Home, legally described in Exhibit C attached hereto and incorporated herein (hereinafter referred
to as the "East Parcel" and "North Parcel" respectively); and
WHEREAS, SRA is in the process of rezoning the Parking Lot from CPO to CHV to allow
construction of a formal parking lot on the property; and
WHEREAS, LLC is in the process of petitioning to annex the East and North Parcels into
the City of Okeechobee, Florida (hereinafter the "City ") to allow for expansion of the Nursing Home
operations; and
WHEREAS, the parties have determined it is in their best interest to have an agreement
of record regarding the designated parking for all parcels noted above.
NOW, THEREFORE, in consideration of the sum of TEN ($10.00) DOLLARS and other
good and valuable consideration, including the mutual promises and covenants made herein, the
parties hereto do agree as follows:
1. RECITATIONS: The above recitations are true and correct and are incorporated herein
by reference.
2. PARKING RESERVATION: SRA hereby covenants and agrees that the Parking Lot shall
be permanently reserved for the parking needs of Ltd and LLC as related to the Nursing Home,
the East Parcel and the North Parcel. This shall constitute a covenant running with the land of
the Parking Lot.
3. SEVERABILITY. If any provision of this Agreement shall be determined to be invalid or
unenforceable for any reason, the remaining provisions of this Agreement shall be unaffected
thereby and shall remain in full force and effect to the fullest extent permitted by law and in
accordance with other provisions of this Agreement.
4. SUCCESSORS AND ASSIGNS. All references in this Agreement to the parties shall be
deemed to also refer to their respective successors and assigns, as the circumstances require.

set forth hereinabove.

The District offers the following in response to your request for a determination of
wetland boundaries located within the subject property. A site visit was conducted by
District staff on April 8, 2015. Based on the site visit, and other site - specific information,
this site contains wetlands as defined by Chapter 62 -340 Florida Administrative Code
(FAC). The approximate project boundaries are identified on the attached aerial
photograph. The area considered wetlands are in yellow crosshatching.
This correspondence is an informal wetland determination pursuant to Chapter 373,
Florida Statutes. It does not bind the District, its agents or employees, nor does it
convey any legal rights, expressed or implied. Persons obtaining this informal wetland
determination are not entitled to rely upon it for purposes of compliance with provision of
law or District rules. A binding wetland determination may be obtained by petitioning
the South Florida Water Management District for a wetland declaratory statement
pursuant to FAC Rule 62 -340 or by applying for an Environmental Resource permit.
The identified wetlands and, potentially other areas of the property not jurisdictional
under State rules, may be wetlands and /or other waters of the United States under
federal rules. Dredging or filling in such areas may require a Department of Army (DA)
permit. Receipt of a state or local government permit does not obviate the need to
obtain a DA permit prior to commencing work. For more information about the DA
