SECOND REGULAR MEETING TUESDAY~ JUNE 28, 1977
The City Council of the City of 0keechobee, Florida, convened in regular
session in the Council Chambers at the City Hall, 0keechobee, Florida, at 7:00 -~
P.M., on Tuesday, June 28, 1977.
President Pro~Tem Edward N. Douglas presiding.
Councilmen Jim Knight and Lytle Raulerson were present.
Councilman Lavon Bass and President Russell V. Domer were absent. ~
Others present were: Sandra Bennett, City Clerk; L. C. Fortner, Jr., Dir-
ector of Public Works; David Conlon, City Attorney; 01on Godwin, Fire Chief;
Richard Spray, Building Official; and Sylvia Christian, Deputy Clerk.
The Invocation was offered by President Pro-Tom Edward W. Douglas.
PUBLIC HEARING
BONING ORDINANCE - LIGHTSEY - FINAL HEARING
President Pro-Tom Edward W. Douglas presented the final reading on re-
zoning of Lots 9 and 10, block 126, Original Town of 0keechobee, from Res-
idential (R-2~ to Commercial.
P~esident Pro-Tom Edward W. Douglas adked if there were any objections to ~he
requested rezoning.
No objections were heard or filed.
Councilman Knight moved to r~zone the above described property as requested
and to amend Ordinance No. 271, seconded by Councilman Raulerson and passed.
PUBLIC HEARING
B~D TABULATIONS - GUYED TOWER AND ANTENNAS
Two bids were received opened and read for the purchase of a radio tower and
antennas. Prices a~ follows:
George Sweatt $7,729.00
Audio Craft $8,927.00
Councilman Knight moved to accept low bid from George Sweatt for $7,729.00,
seconded by Councilman Raulerson and motion carried.
ORDINANCE NJJMBERi 398 SUBDIVISION - FINAL HEARINC
Pursuant to a notice published June 16th and 23rd, 1977, a public hearing
was held to consider the adoption of Ordinance Number 3~8, being An Ordinance
Governing and regulating the Subdivision of land in the City of 0keechobee, ii' /
Florida; stating the purpose and intent of the regulations; defining certain terms
providing for preapplication procedure; providing for conditional approval of
preliminary plats and for approval of construction plans for required improvements
providing procedures for approval of final plats; setting design standards for '--~i
Subdivision; setting data required for submis~i~n,~at the various stages of the
subdivision process; providing methods for assurance of completion of required
improvements; provides penalties for violation of these regulations; prividing a
severability clause; repealing Ordinances or parts of Ordinances in conflict
herewith; and setting an effective date. 1

Attorney Conlon read Ordinance Number 398.
President Pro-Tem Edward W. Douglas asked if there were any objections, coF-
recti~ns or discussion to said Ordinance Number 398.
Attorney Hendry questioned the land area and pointed out ~that there weren't
too many acreas of land in the City that could be divided into lots. He also
questioned the street size in the Ordinance.
Following discussion Councilman Knight moved to adopt Ordinance Number 398,
seconded by Councilman Raulerson and carried.
R$SQLUTION - BLOCK 2.1~
Attorney Hendry submitted a plat of First Addition to 0keechobee, Florida,
showing an error on the face of the plat which has two blocks of 218. He pre-
sented a Resolution for the Councils approval.
Attorney Conlon stated that he has reviewed all the materials pertaining to
Block ~19 and recommended thab the City Co~uucil adopt said Resolution.
It was moved by Councilman Raulerson, seconded by Councilman Knight to
adopt Resolution.
FIRE DEPARTMENT
1. EMPLOYEE APPLICATION
Chief Godwin submitted applibation for Louis Keith Tomey, II for
emp~oy~mnt in the Fire Department a~ Fire Chief Assistant.
It wasn~oved by Councilman Raulerson to hire Tomey at $10,500.00 dollar~
per year, seconded by Councilman Knight and carried.
2. NORTH SHORE SHOPPING PLAZA
Chief Godwin reported Fire Hazard at parking in North Shore Plaza.
Council requested Director For~ner to discuss this matter with Mr.
Royal.
WATER~ SENER AND STREET DEPARTMENTS
Director Fortner submitted the following for discussion or approval:
1. DEPARTMENT OF ENVIROMENTAL REGULATIONS
Director Fortner informed the Council that the Department of Enviro-
mental Regulations requires a turbidiSy test run on the City, s drinking water
effective June 24th. He stated that the City does not have an instrument suit-
able to run these tests.
Director Fortner reported that the instrument to run this test would
cost approximately $595.00 dollars.
It was moved by Councilman Raulerson, seconded by Councilman Knight
and carried to purchase turbidity instrument.
2. DENTRAL FLORIDA R~GIONAL PLANNING COUNCIl,
Director Fortner submitted a special announcement from Central Florida
Regional Planning Council informing the City Council of a meeting to be held July
7th with several EPA Officials.
5. 24 - INCH FINISH WATER MAIN
Director Fortner submitted a letter from Donald M. Shepherd, City
Engineer, concerning the 2S-inch Water Main from Water Plant to South City
Limits.
Director Fortner to make application for additional funds, and meet

4. BEACH WATER ASSOCIATION
Meeting scheduled for July 7th at 6:30 P.M.
5. CENTRAL AIR AND HEAT - CITY HALL
Director Fortner informed the Council that it would cost approximately
$100.00 dollars to lower ceiling in Clerk's office before the Central Air and
Heat System could be installed.
He stated that there would be 5 ways to go for hooking up electricity:
(1) 100 amp service additional to service we already have which would
be two meters, at $900.00 dollar~.
(2) 200 amp service with two meters and run both meters off new service
at $997.00 dollars or
(5) eliminate the existing meter and service and put in one meter and
one 400 amp service to serve the new air conditioners and the existing load now
there for a total of $1,600.00 dollars.
Following discussion Councilman Ramlerson moved to m~d contract to Emory
Walker for the GOO amp service at $997.00 dollars and labor to lower ceiling
approve cost of $100.00 dollars, seconded by Councilman Knight and passed.
6. 24 INCH WATER MAIN
Director Fortner submitted a Department of Transporta~nn Utility
Permit for President Domer's signature.
In his absense Councilman Raulerson moved to authorize President Pro-
Tem ~dward W. Douglas to sign Utility Permit, seconded by Councilman Knight and
carried.
CITY CLERK
1. REZONING APPLICATION
Clerk Bennett presented a rezoning application from Frank H. Finley,
requesting the Council to rezone lots I and 7, Block 46, First Addition to South
Okeechobee, Original Town of 0keecho~ee,. from Residential (R-l) to Commercial.
Councilman Raulerson moved to in~ruct the Clerk to proceed with not-
ffication to the owner and to advertise public hearings, seconded by Council-
man Knight and passed.
It was pointed out by Councilman Raulerson that the building was cur-
rently being used as Commercial.
Attorney Conlon stated that this is violating the City's Zoning Ordin-
ance and that the owner should be notified of this situation.
Councilman Raulerson moved to withdraw his motion.

Councilman Knight moved to notify the owner of the violation and that
the City will not consider the zoning application as long as the zoning laws are
being violated, seconded by Councilman Raulerson and carried.
2. SEMINAR
Clerk Bennett requested permission to attend Seminar on July 22nd in
Georgia.
Councilman Raulerson moved to grant Clerk Bennett two day leave to
attend Seminar, seconded by Councilman Knight and passed.
CO-SIGNERS
President Pro-Tem Edward W. Douglas appointed Councilman Lytle Raulerson as
co-signer to President Russell V. Domer in his absense.
LANDSCAPING AROUND CITY HALL
Councilman Knight moved to authorize the purchase of box wood plants for dis-
tribution around City Hall, seconded by Councilman Raulerson and carried.
ADJOURNMENT
There being no further business, Presidem~ Pro-Tem Edward W. Douglas dec-
lared the meeting recessed at 9:35 P.M., until July 7, 1977 at 6:30 P.M.
