Council Member Watford called attention to a letter ft Mayor and Coanck were copied on, that was sent#o Public Works employees, Director Alien, Mr. Cleveland Lamb, Mr. Jeffrey Treece and Mr. Eric Ward, and read it into the record as follows: "On behalf of the Veterans Memorial Park Huey Committee, thank you very much for your assistance and hard work in completing the Huey installation by installing the mast and rotor blades. Your knowledge and expertise were invaluable. As you know, this has been a long, arduous task, but the honor it brings to our Veterans is well worth the hours and hours of work it required. PRESENTATIONS AND PROCLAMATIONS - Mayor Item added: Special surprise presentation to Police Chief Davis. A. Present a Certificate of Appreciation to John Creasman for service on the Planning Board. B. Proclaim April 7, 2015 as "National Service Recognition Day." C. Proclaim the month of April 2015 as "Child Abuse Prevention Month." Mayor Kirk presented Chief Davis with the State of Florida Life Saving Medal, Mayor Kirk then read an excerpt relaying the cause of this heroic honor as follows: "shortly before 4:00 P.M., on Tuesday, March 17, 2015, five year old Brody McGee, a resident at Real Life Children's Ranch had an accident in his backyard pool, he had no pulse, had quit breathing, and was turning blue. Chief Davis and his wife Margo, who are house parents at the ranch, and luckily in the area, quickly intervened and performed lifesaving Cardiac Pulmonary Resuscitation (CPR), breathing life back into Brody. Thanks to the Chief's quick response and prior training, Brody is alive and well today." The audience responded in a standing ovation, which included the majority of the Police Department employees and Mrs. Davis. Chief Davis gave the credit to his Lord and Saviour, for His divine intervention, and to his wife Margo, who also played an important role in saving Brody's life. The Certificate of Appreciation will be forwarded to Mr. John Creasman, as he was unable to attend this meeting. His certificate read as follows: "The City of Okeechobee recognizes the Valuable Contribution of Community Involvement and Hereby Extends this Expression of Grateful Appreciation to John Creasman for his Faithful Service as a dedicated Member appointed to the Planning Board, Board of Adjustments, and Design Review Board, Decembers, 2012 to February 27, 2015."Mr. Creasman is now serving as the County's appointed member to the Okeechobee Utility Authority Board of Directors. Mayor Kirk proclaimed April 7, 2015 as National Service Recognition. For the record, the proclamation was read in its entirety as follows: "WHEREAS, service to others is a hallmark of the American character, and central to how we meet our challenges; and WHEREAS, the nation's mayors are increasingly turning to national service and volunteers as a cost-effective strategy to meet city needs; and WHEREAS, AmeriCorps and Senior Corps address the most pressing challenges facing our cities and nation, from educating students for the jobs of the 21" century and supporting veterans and military families to preserving the environment and helping communities recover from natural disasters; and WHEREAS, national service expands economic opportunity by creating more sustainable, resilient communities and providing education, career skills, and leadership abilities for those who serve; and WHEREAS, national service participants increase the impact of the organizations they serve with, both through their direct service and by recruiting and managing millions of additional volunteers. Mr. Al Jacks, of the Child Abuse Services Training and Life Enrichment (CASTLE) thanked the City for their annual support and keeping this matter on the forefront. D. Proclaim the month of April 2015 as "Guardian ad Litem Month". Mayor Kirk proclaimed April 2015 as Guardian Ad Litem Month and presented the document to Ms. Kathleen McGowan. The decree was read as follows: "WHEREAS, the City of Okeechobee prides itself on giving back to the community, contributing to the quality of life among our citizens; and WHEREAS, the Guardian Ad Litem Program speaks for the best interests of abused, abandoned and neglected children who are involved in the court system; and WHEREAS, more than 150 children in the community suffer from some form of abuse or neglect each year, and WHEREAS, Okeechobee community members are encouraged to join together, throughout the month of April to raise awareness for those children fallen victim to abuse, neglect and abandonment; and WHEREAS, this effort will give abused, neglected, and abandoned children in our community an improved chance for a safe permanent home and positive future. Monthly update from the Centennial Celebration Ad Hoc Committee Chair - Centennial Celebration Ad Hoc Committee (CCAHC) Chairperson J.D. Mixon, distributed at the meeting a written J.D. Mixon. update to the Council as outlined in the exhibit: The two quotes for a Photographer to take the posed portraits at the Gala were rejected, and will be readdressed at the April 13 meeting on a revised form. APRIL 7, 2015 - REGULAR MEETING - PAGE 4 OF 10 377 VII. CENTENNIAL UPDATE CONTINUED A. Monthly update from the Centennial Celebration Ad Hoc Committee continued Vill. OPEN PUBLIC HEARING - Mayor Kirk A. Motion to approve an amendment to the Pre -Annexation Agreement with OHCF Properties, LLC - City Attorney (Exhibit 1). The Historical Bus Tour tickets are selling well. As previously reported, the April 11 tour is sold out. The next tour dates are June 20, September 19, and October 17. Anyone hoping to acquire a Commemorative Post Card Book should note there are only two methods to do this; one is by purchasing a sponsorship, the second is by purchasing a bus tourticket. The Centennial Commemorative City Hall Front Walkway Brick Paver Capital Improvement Project is finally underway. Individuals can purchase their pavers through the City's website.To date there has not been any progress on the Commemorative Centennial Park. The GFWC Monthly Centennial Monthly Movie in the Park will feature Big Hero 6 on April 11, Monsters University on May 9, and the newest remake of Annie on June 13, with show times beginning at 8:00 P.M. The Mayors Centennial Gala, being held on April 18, has only 12 tickets available, through the purchase of Sponsorships, or individually at $100.00 each. The entree' to be served is Prime Rib or Chicken Florentine, music entertainment being provided by The Street Talk Orchestra, complimentary valet parking provided and each attendant will receive two complimentary beverage vouchers. These Centennial Events are still in the planning stages. The Birthday Bash to be held on June 13. The location has been confirmed for the Sacred Heart Catholic Church facilities and fields. The Heritage Festival to be held October 10, with a unique performance by the Okeechobee Community Theater group. The annual Tree Lighting Celebration in connection with the Centennial Time Capsule closing ceremony, as well as the Okeechobee Main Street (OKMS) Top of the Lake Christmas Festival and Lighted Parade has changed the dates to all be held on December 4 and 5. The Frolic (Street Dance and Barbeque) will be held Friday, December 11 at the First United Methodist Church grounds and Historic Court House. The CCAHC is partnering with existing events throughout 2015, with some featuring contests. These include but are not limited to participation at the July 4 FOR Okeechobee, Inc., Independence Day Celebration, a Centennial Float in the OKMS Labor Day Festival and Parade, September 51h to 71h. A Centennial Paddle Decorating Contest on October Vat the Adam Bryant Minimal Regatta, and a Centennial Float in the December 5th OKMS Lighted Christmas Parade. The Centennial flag and banners are available for use at rodeos, parades and festivals. Public Works Director Allen has advised that the Centennial banners should be on display soon throughout downtown and in the parks. No official- action was necessary-. The -Council thanked the -CCAH C for their tremendous undertaking with the Celebration. MAYOR KIRK OPENED THE PUBLIC HEARING AT 6:20 P.M. Motion and second by Council Members Watford and O'Connor to approve an amendment to the Pre -Annexation Agreement with OHCF Properties, LLC. 378 APRIL 7, 2015 - REGULAR MEETING - PAGE 5 OF 10 Vill. PUBLIC HEARING CONTINUED A. Motion to approve an amendment to the Pre -Annexation Agreement with OHCF Properties, LLC continued. CLOSE PUBLIC HEARING - Mayor IX. NEW BUSINESS A. Consider a request submitted by the Kiwanis Club of Okeechobee for preliminary approval of construction of a special needs playground in Flagler Park - J.D. Mixon (Exhibit 2). The Pre -Annexation Agreement was approved on March 17, 2015. However, after adoption there was a scriveners error found in the acreage amounts. The acreage for the first parcel, identified as the "East Parcel," located east of and contiguous to the existing Okeechobee Health Care Facility and west of Taylor Creek, is being corrected from 1.250± to 2.04±. The acreage for the second parcel is identified as the "North Parcel," located to the northeast of the existing Health Care Facility, east of Raulerson Hospital, and west of Taylor Creek, is beign corrected from 2.960± to 2.97±. The metes and bounds legal description is correct as presented. Mayor Kirk asked whether there were any comments. There were none from the public. Council Member Watford clarified, this amendment is only to correct the acreage amounts, as the legal description contained in the original agreement is correct. Attorney Cook responded correct, and neither does this interfere with the adoption time -line. KIRK - YEA RITTER - YEA CHANDLER - YEA WATFORD - YEA MAYOR KIRK CLOSED THE PUBLIC HEARING AT 6:21 P.M. O'CONNOR - YEA MOTION CARRIED. Mr. J.D. Mixon made a presentation on behalf of the Kiwanis Club, to obtain preliminary approval of a 40-foot by 50- foot special needs playground area to be located on the East -half of Park F of FLAGLER PARK, City of Okeechobee subdivision. Park F is bound by North and South Park Streets and Southeast 61' and 71h Avenues. The project was offered to serve as an attraction for the downtown area and attract those driving through. Mr. Mixon relayed his personal experience as a parent, regarding the safety in Flagler Park where a child can be without total supervision at any time. Provisions of this project will give children a safe area as well as rest and peace of mind for parents. All funds have been raised by multiple sources to construct the playground and fencing. The Exhibit contained two potential site plans as well as a photograph of the decorative black -iron fencing and cost breakdowns. Mr. Mixon explained, safety will be of the utmost importance, the four -foot tall commercial grade fencing would be around the perimeterof the playground. The equipment has a lifetime guarantee, easily maintained, and requires annual pressure washing. Should this project be approved, the City would essentially undertake the maintenance, adding further, that the Kiwanis Club is offering to assist the City with the maintenance. Mr. Brian Sell, Government Operations Consultant II, of the Okeechobee Health Department, was then asked to present health factors for consideration as Okeechobee's citizens obesity rate far exceeds the state average with the diabetes rate being high in the eightieth percentile. Parks are recommended to be a great provision for exercise and activity opportunities, combating against obesity and other health issues. APRIL 7, 2015 - REGULAR MEETING - PAGE 6 OF 10 J fl IX. NEW BUSINESS CONTINUED A. Consider a request submitted by the Kiwanis Club of Okeechobee for Mr. Mixon presented letters of support for the project from business owners along South Park Street, between preliminary approval of construction of a special needs playground in Park L Southeast 51h to 71h Avenues. Three owners were not available for comment, the others had no objections. One of the of Flagler Park continued. owners who submitted a letter in support, Mr. Curtis Tyson, owner of Serenity Coffee Shop, located at 601 Southwest Park Street, addressed the Council stating the festivals and activities in the park do not bring customers to frequent his business as they are there to purchase the food and beverages being sold within the festival area. However, they do request to use his restroom facilities, and he obliges even when they are not his patrons. However, he firmly believes the playground would impact his business in a positive manner. Mr. Mixon also provided research he conducted throughout the area over a two -week span in regards to parking. A small County recreation area with swings and a few playground items are located at Northwest 2°d Street and 7th Avenue. His research found that there was one to six cars during 'prime' playground hours (lunchtime and 6:00 P.M.). Council Members Watford and Ritter disclosed they are active members of the Kiwanis Club. Council Member Watford further disclosed he was in attendance at the meeting when the playground project was discussed, but did not vote on the matter. He was pleased the business owners are in favor of the project and admitted at first he was not keen on the idea but the proposal holds merit. He clarified that the City will have ownership and the maintenance. He added that it was his understanding that the Kiwanis Club was also requesting signage to recognize and identify it as the "Kiwanis Playground Park." Council Member Ritter disclosed he was not present at the Kiwanis meeting, but has since discussed the project with Mr. Mixon. He is in favor of the park as it promotes community involvement and agrees it will be an aesthetic improvement for our downtown area. There were some valid points mentioned from the Health Department and more playgrounds are necessary for a better quality of life. His concern was maintenance and advised staff to be sure this would be something that can be maintained. Council Member O'Connor noted his concerns regarding parking and restroom facilities. During the discussion, Administrator Whitehall explained there was some confusion with the information provided to the Mayor and Council in regards to where the playground was proposed to be located. Further, that City Staff would like an opportunity to review the specifics of the project from a technical standpoint prior to a final approval being considered. Mavor Kirk instructed Citv Staff to review the Droiect in a timelv manner and report their findings back to Mr. Mixon to provide him the opportunity to address them. The item will be reconsidered at the B. Consider a request to authorize an independent parking study for the City of Mr. Mack (Hoot) Worley, as Director/Chairman for the Government Committee of the Economic Council of Okeechobee - Hoot Worley, Economic Council of Okeechobee (Exhibit 3). Okeechobee, made a presentation regarding parking challenges within the City, and asking the Council to authorize an independent City-wide parking study to offer a strategic plan of solutions for immediate remedies of parking issues as well as alternatives for future needs of the area. Offering that the study, with an estimated cost of $25,000.00 to $35,000.00, should be considered an investment for the business community, � ?d APRIL 7, 2015 - REGULAR MEETING - PAGE 7 OF 10 IX. NEW BUSINESS CONTINUED B. Consider a request to authorize an independent parking study for the City of Okeechobee continued. ITEM ADDED TO AGENDA: B. 2. Potential Parking Lot at Southwest 4'h Avenue and Park Street - City Administrator (Exhibit ). Council Member Watford began the discussion stating a parking study will not fix the situation since most of the parking issues are when older businesses are converted for new uses and are trying to be in compliance with current codes. It is not our responsibility to provide parking for businesses, and the Council has made exceptions for many already. Council Member Ritter noted his appreciation on the focus of looking towards future growth. This is the time to be proactive rather than reactive. Council Member Chandler's analogy of the situation was "we only have a box this big and you can only put so much in it." Council Member O'Connor agreed with Council Member Ritter and noted that this is not the first time the City has discussed parking and is very much aware of the situation. The Council pointed out the next item on the agenda relates to the City working toward adding parking within the downtown area. Mrs. Dawn Hoover addressed the Council as the City's Planning Board Chairperson and explained parking has been the topic of discussion at the last three meetings, and she encouraged the Council to do something. Senior Planner, Bill Brisson of LaRue Planning and Management Services had advised the Board he could not start looking for solutions without direction from the City Council. Council Member Ritter moved to authorize the expenditure of an independent parking study for the City of Okeechobee, not only to be for existing inventory, but for future growth as well; seconded for discussion by Council Member Chandler. During discussion, Administrator Whitehall interjected, the City's Planning Consultant, LaRue Planning and Management Services, which the City already has a contract with, has the expertise to accomplish this study, and is aware of the City's situations and codes. KIRK - No RITTER - YEA CHANDLER - NO WATFORD - NO O'CONNOR - NO MOTION DENIED. No further action or discussion was asked of, nor offered from the Mayor and Council. For clarification the record is noting that this includes any direction or authorization to LaRue Planning. Administrator Whitehall presented a proposal for the City to determine a fair market price of a vacant lot located on South Park Street, at Southeast 4'h Avenue, to purchase as a public parking lot. The site could provide up to 20 parking spaces, with two designated as handicapped. The first step will be to award a quote to a Commercial Appraiser. After solicitation of requests for qualifications, two were received. A ranking committee consisting of Mayor Kirk, Administrator Whitehall and General Services Coordinator Burnette offered the following ranking for approval and negotiations:1. DR Wilson Land Company. 2. Glades Appraisal Company. Council Member Watford noted the project has merit and while he appreciates the City being proactive to finding parking solutions, he was not optimistic patrons would be willing to utilize this parking. Administrator Whitehall, explained this addendum incorporates the indemnification and E-verification language as required by the Florida Department of Transportation (FDOT) for funding of the Small County Outreach Program (SCOP) project. This grant funding has been a learning experience, as Administrator Whitehall is still awaiting the agreement since February. The item presented before the Council is a request for a parking reduction, as recommended by the Technical Review Committee (TRC). The Iglesia Bautista LaCosecha Church petitioned and obtained a Special Exception for a 6,000 square foot church to be constructed in a Residential Single Family -One zoning District on a parcel less than 5-acres. Code of Ordinances Section 90-484 offers a provision to allow up to a 75 percent reduction in paved parking for places of public assembly or worship. Think if we can get the parking it will able a benefit for the business and the city charging stations within the city to recharge the electric cars. Think of a long term investment. We have some problems that were created a long time ago. Request the city invest some money to do a comprehensive parking study. Watford, don't think we need to spend funds for a parking study because the situation we run into is when we try to take a older builder and make it fit with current codes. Don't think we should provide parking for businesses, that is not our responsibility. We do not have enough parking in our town and think it does fall on the councils burden to provide the parking if you want the town to thrive and grow. Brody McGee had been swimming Tuesday with other children in an above -ground pool at the Real Life Children's Ranch where his family lives. The boy's mptiher was supervising the group of children when she lost track of Brody and discovered him floating face7down in the pool. Okeechobee] Police Chief Denny Davis, who also lives at the ranch, had just arrived home from work and was chattind with his wife when he heard Brody's mother scream. i Davis took Brody out of his mother's arms, put him on a picnic table and started performing chest compressions while his wife gave rescue breaths. "I checked f�r', a pulse, and he had none," Davis said. After about four minutes, Davis said Brody coughed up water and started breathing again. "I don't need any recognition," Davis said. "My reward came that day when that little boy got his breath back.' Brody only spent one day in the hospital and is already back to his normal self just two days after his near drowning. When they called and said your son drowned, there's no worse feeling," said Brent McGee, Brody's father. Brent McGee said he's eternally grateful to Davis and his wife, but he's a God-fearing man, and he truly believes there was a higher power looking over his son. A study would determine the supply and demand of parking within the City, using current occupancy levels and existing land uses, as well as outline strategies to prepare the City for future development needs. Data collection is an important part of the study and would include an inventory of parking spaces, occupancy and turnover. Existing land use type, intensity and usage for the area would be recorded and underutilized areas would be identified. It is important that community outreach is included through stakeholder interviews and a community workshop. Specific recommendations would then be developed to focus on shared parking opportunities, possible reductions in parking requirements, and policies that support growth and development in keeping with our community's vision. A study of this sort is estimated to cost in the range of $25,000 to $35,000, an expense that is a worthy investment for our current and future businesses to ensure the best possible plan is put into action. Sec, 90-511(e)(1) establishes the fact that places of public assembly or worship are afforded an exception to the requirement that all required parking spaces are to be paved. 2. Sec. 90-484 provides the vehicle by which the City Council may determine the total number of required spaces that must be paved. a. A parking study must show that the use of all required parking spaces is necessary only one or two days a week. b. The number of paved spaces may be reduced by no more than 75%. To the best of my knowledge, in the case of a house of worship, we have not required a formal parking study. Rather, the Applicant has typically submitted a statement explaining how often the major worship services are held and the likely number of attendees. The overall parking requirement is based on the seating capacity, and the number of paved spaces is determined by the number of spaces likely needed at other times, but not less than 25% of the total parking requirement. 4. The City Council could, if circumstance indicate sometime in the future, that more paved parking is needed, require more spaces to be paved.. Therefore, we have usually required that the Applicant submit, as part of the site plan, proof that the site has the capability of accommodating a paved parking area that provides for 100% of the required parking in a manner that meets all of the requirements of the LDRs. We've relaxed the code to allow residence in the CBD, relaxed our interpretation of the parking, allowed more and more intrusion into the sidewalk area, added plants at the islands and are working on the possibility of a small, well landscaped parking area. We plan to start installation of new blue signage in the near future. Much of the "ingredients" rest with the businesses themselves, such as storefront curb appeal. Your letter raises questions about the obligations of the City and CS with respect to this project. As y u describe in your letter, the City and CSX entered into an agreement dated January 21,1992. The Agreement provided for the installation by CSX of a full depth rubber crossing su ace at NW 9th Avenue at the expense of the City. Section 4 of the Agreement provides th t: After the full depth rubber crossing surface material has been installed at the subject locations, it shall hereafter be maintained in good condition by the Railroad through the useful life of such crossing surface material, and when it becomes necessary to replace or rebuild the crossing surface, Railroad will replace and maintain the crossing surface, but ot the expense of the City. The rubber crossing surface has reached the end of its useful life and is in need of replacement. The City has a contractual obligation to bear the expense of that replacement. F.S. Section 335.141(c) does not take precedence over that obligation, for two reasons. First, the City is assuming that this crossing is not one for which maintenance has been "provided for in another manner by contractual agreement entered into prior to October 1, 1982." The presence of such an agreement would make the statute inapplicable. Second, and more importantly, even if Section 335.141(c) does apply, nothing in the statute prevents parties from entering into contracts that alter the responsibilities set out in that section. DOT 628055B 2 - March 10, 2015 In 1992, the City requested the installation of a crossing surface which differs from CSX's standard (full depth rubber vs. timber and asphalt). It was reasonable for the parties to contract for both the installation and future replacement of this non-standard crossing surface type. I was told that the zoning exception permits only valid for 180 days to February. I want to open the store as soon as possible but now I feel great pressure for opening the store to public in February. There * some reasons for me to request to extend the zoning exception permits: 1) Vnfamiliar with policies and license process in USA. I am not the U.S citizen currently I still hold the business visa. I came here four years ago for MBA and graduated with four MBA degrees in June of 2014. I just started the iness and do not have much experience in tire sales industry and has not hire people to help me to run the tire store. Everything for me is new. I more difficulty in running the business at the beginning. As famous Chinese says: The first step is always the hardest and well begun is half done. We Want to sufficiently prepared and make -everything in order and then open the store. 2) Renovation takes a longer time than it is expected. I spent 3 months to deal with the renovation. I have no experience for renovation. The renovation proposal is quite different from it is in China. So it takes a little longer time for me to learn the process and find the local contractors. The contractor providing proposal for renovation also takes nearly one month and I got initial renovation proposal in November. We want to add a showroom inside of building. I leant to how to find the renovation contractor and told them city improvements about the property, such as improving driveway, landscaping, and parking improvements and want to add a tire display show room. 3) One more month for renovation completion. By now, outside driveway concrete work and parking places has not completed. The contractor said the total renovation will take at least one and half month. So the renovation is supposed to complete in beginning of February. However, now the inside painting and floor are almost finished except little electric part. The outside driveway and parking place pavement has not completed. The landscaping work is finished (eight oak trees is planted along the store front and side of driveway). 4) Half month for business license and one month for inventory prepared. From my knowledge, the business license can be given only after the renovation complete. The total renovation and improvement is supposed to finish in the middle of March. After renovation completion is inspected, I will go for getting the business license in March. So the earlier time for business license is at the end of March. After getting license, the tire import and container ship from China will take at least 20 days. I do not know whether I can order tires container and get before I get the license. Suppose I get license and then let the tire ship from China in end of March, I will get tire inventory in end of This is the fast time I can get the inventory. Plus, all the tire factories are because of the Chinese New Year holiday. The Chinese New year will last days from February 18, 2014. So I cannot order the tire container until 6, 2015. 5) One month for people training process. In terms of hiring people, I want to hire people to run the business because they are more easily to contact local and familiar local customer needs and wants. I also need to get quality is people and polite salespeople to better service the local people we cannot survive in this competing tire industry. Therefore, after the people hiring and training will also take at least one month. I have started the hiring work and gave job position description to and they have referred me two bookkeeper candidates. 6) �usiness visa extension concerns. Currently, I hold business visa. However, USCIS only give six month maximum business visa and then applicants apply for another six month maximum extension. I have applied for the visa in November for six month extension to May 31, 2015 and now the extension application is pending now. If business visa expires before I get store open, I must go back China for a while and then come back USA again. That will delay the store open at least to September. My company has not hired people yet and I try to hire local experienced people to help me to operate tire store, such as mechanic, office assistant, and store manager. I must hire experienced people to operate my tire store before I going back China before my business visa expires. Recently I am busy to work with contractors to make some renovations for my tire stores and make the improvements for property to meet the city requirements. The maximum length of business visa is six month until 5/31/ 2015, but I should wait USCIS's results in March (pending now). Therefore, I hope City Board of Adjustments can consider my particular situation and possibly consider whether can extend my zoning exception permits for six month until September 1, 2015. So I can have sufficient time in completing renovation work, hiring people and training, and ordering and shipping tire container.
