New Business Item B.2, was added, Engagement Letter for Appraisal. Council Member Watford called attention to a
letter ft Mayor and Coanck were copied on, that was sent#o Public Works employees, Director Alien, Mr. Cleveland
Lamb, Mr. Jeffrey Treece and Mr. Eric Ward, and read it into the record as follows: "On behalf of the Veterans
Memorial Park Huey Committee, thank you very much for your assistance and hard work in completing the
Huey installation by installing the mast and rotor blades. Your knowledge and expertise were invaluable. As
you know, this has been a long, arduous task, but the honor it brings to our Veterans is well worth the hours
and hours of work it required. This will be a lasting memorial and tribute to them, and you should be veryproud
of your involvement in the project."

A. Present a Certificate of Appreciation to John Creasman for service on the
Planning Board.

Mayor Kirk presented Chief Davis with the State of Florida Life Saving Medal, Mayor Kirk then read an excerpt relaying
the cause of this heroic honor as follows: "shortly before 4:00 P.M., on Tuesday, March 17, 2015, five year old Brody
McGee, a resident at Real Life Children's Ranch had an accident in his backyard pool, he had no pulse, had quit
breathing, and was turning blue. Chief Davis and his wife Margo, who are house parents at the ranch, and luckily in
the area, quickly intervened and performed lifesaving Cardiac Pulmonary Resuscitation (CPR), breathing life back into
Brody. Thanks to the Chief's quick response and prior training, Brody is alive and well today." The audience responded
in a standing ovation, which included the majority of the Police Department employees and Mrs. Davis. Chief Davis
gave the credit to his Lord and Saviour, for His divine intervention, and to his wife Margo, who also played an important
role in saving Brody's life.
The Certificate of Appreciation will be forwarded to Mr. John Creasman, as he was unable to attend this meeting. His
certificate read as follows: "The City of Okeechobee recognizes the Valuable Contribution of Community
Involvement and Hereby Extends this Expression of Grateful Appreciation to John Creasman for his Faithful
Service as a dedicated Member appointed to the Planning Board, Board of Adjustments, and Design Review
Board, Decembers, 2012 to February 27, 2015."Mr. Creasman is now serving as the County's appointed member
to the Okeechobee Utility Authority Board of Directors.
Mayor Kirk proclaimed April 7, 2015 as National Service Recognition. For the record, the proclamation was read in
its entirety as follows: "WHEREAS, service to others is a hallmark of the American character, and central to how
we meet our challenges; and WHEREAS, the nation's mayors are increasingly turning to national service and
volunteers as a cost-effective strategy to meet city needs; and WHEREAS, AmeriCorps and Senior Corps
address the most pressing challenges facing our cities and nation, from educating students for the jobs of
the 21" century and supporting veterans and military families to preserving the environment and helping
communities recover from natural disasters; and WHEREAS, national service expands economic opportunity
by creating more sustainable, resilient communities and providing education, career skills, and leadership
abilities for those who serve; and WHEREAS, national service participants increase the impact of the
organizations they serve with, both through their direct service and by recruiting and managing millions of
additional volunteers. NOW THEREFORE,1, James E. Kirk, by virtue of the authority vested in me as Mayor
ofthe _City _of Okeechobee, Florida, do hereby proclaim April-7, 2014 as National Service Recognition Day in
the City of Okeechobee and encourage residents to recognize the positive impact of national service in our
city, to thank those who serve; and to find ways to give back to their communities." City Clerk Gamiotea will
forward the proclamation to Ms. Jenna Stinnett, Director of Americorps Programs of Big Brothers Big Sisters.
Mr. Al Jacks, of the Child Abuse Services Training and Life Enrichment (CASTLE) thanked the City for their annual
support and keeping this matter on the forefront. Mayor Kirk read the decree in its entirety as follows:

D. Proclaim the month of April 2015 as "Guardian ad Litem Month". Mayor Kirk proclaimed April 2015 as Guardian Ad Litem Month and presented the document to Ms. Kathleen
McGowan. The decree was read as follows: "WHEREAS, the City of Okeechobee prides itself on giving back to
the community, contributing to the quality of life among our citizens; and WHEREAS, the Guardian Ad Litem
Program speaks for the best interests of abused, abandoned and neglected children who are involved in the
court system; and WHEREAS, more than 150 children in the community suffer from some form of abuse or
neglect each year, and WHEREAS, Okeechobee community members are encouraged to join together,
throughout the month of April to raise awareness for those children fallen victim to abuse, neglect and
abandonment; and WHEREAS, this effort will give abused, neglected, and abandoned children in our
community an improved chance for a safe permanent home and positive future. NOW, THEREFORE,1, James
E. Kirk, by virtue of the authority vested in me as Mayor of the City of Okeechobee, Florida, do hereby proclaim
the month of April 2015 as "Guardian Ad Litem Month" and urge all citizens to give of their time to make a

A. Motion to approve an amendment to the Pre -Annexation Agreement with
OHCF Properties, LLC - City Attorney (Exhibit 1).
The Historical Bus Tour tickets are selling well. As previously reported, the April 11 tour is sold out. The next tour dates
are June 20, September 19, and October 17. Anyone hoping to acquire a Commemorative Post Card Book should
note there are only two methods to do this; one is by purchasing a sponsorship, the second is by purchasing a bus
tourticket. The Centennial Commemorative City Hall Front Walkway Brick Paver Capital Improvement Project is finally
underway. Individuals can purchase their pavers through the City's website.To date there has not been any progress
on the Commemorative Centennial Park. The GFWC Monthly Centennial Monthly Movie in the Park will feature Big
Hero 6 on April 11, Monsters University on May 9, and the newest remake of Annie on June 13, with show times
beginning at 8:00 P.M.
The Mayors Centennial Gala, being held on April 18, has only 12 tickets available, through the purchase of
Sponsorships, or individually at $100.00 each. The entree' to be served is Prime Rib or Chicken Florentine, music
entertainment being provided by The Street Talk Orchestra, complimentary valet parking provided and each attendant
will receive two complimentary beverage vouchers.
These Centennial Events are still in the planning stages. The Birthday Bash to be held on June 13. The location has
been confirmed for the Sacred Heart Catholic Church facilities and fields. The Heritage Festival to be held October
10, with a unique performance by the Okeechobee Community Theater group. The annual Tree Lighting Celebration
in connection with the Centennial Time Capsule closing ceremony, as well as the Okeechobee Main Street (OKMS)
Top of the Lake Christmas Festival and Lighted Parade has changed the dates to all be held on December 4 and 5.
The Frolic (Street Dance and Barbeque) will be held Friday, December 11 at the First United Methodist Church
grounds and Historic Court House.
The CCAHC is partnering with existing events throughout 2015, with some featuring contests. These include but are
not limited to participation at the July 4 FOR Okeechobee, Inc., Independence Day Celebration, a Centennial Float
in the OKMS Labor Day Festival and Parade, September 51h to 71h. A Centennial Paddle Decorating Contest on
October Vat the Adam Bryant Minimal Regatta, and a Centennial Float in the December 5th OKMS Lighted Christmas
Parade. The Centennial flag and banners are available for use at rodeos, parades and festivals. Public Works Director
Allen has advised that the Centennial banners should be on display soon throughout downtown and in the parks. No
official- action was necessary-. The -Council thanked the -CCAH C for their tremendous undertaking with the Celebration.

IX. NEW BUSINESS
A. Consider a request submitted by the Kiwanis Club of Okeechobee for preliminary
approval of construction of a special needs playground in Flagler Park - J.D.
Mixon (Exhibit 2).
The Pre -Annexation Agreement was approved on March 17, 2015. However, after adoption there was a scriveners
error found in the acreage amounts. The acreage for the first parcel, identified as the "East Parcel," located east of
and contiguous to the existing Okeechobee Health Care Facility and west of Taylor Creek, is being corrected from
1.250± to 2.04±. The acreage for the second parcel is identified as the "North Parcel," located to the northeast of the
existing Health Care Facility, east of Raulerson Hospital, and west of Taylor Creek, is beign corrected from 2.960±
to 2.97±. The metes and bounds legal description is correct as presented. Mayor Kirk asked whether there were any
comments. There were none from the public. Council Member Watford clarified, this amendment is only to correct the
acreage amounts, as the legal description contained in the original agreement is correct. Attorney Cook responded
correct, and neither does this interfere with the adoption time -line.

Mr. J.D. Mixon made a presentation on behalf of the Kiwanis Club, to obtain preliminary approval of a 40-foot by 50-
foot special needs playground area to be located on the East -half of Park F of FLAGLER PARK, City of Okeechobee
subdivision. Park F is bound by North and South Park Streets and Southeast 61' and 71h Avenues. The project was
offered to serve as an attraction for the downtown area and attract those driving through. Mr. Mixon relayed his
personal experience as a parent, regarding the safety in Flagler Park where a child can be without total supervision
at any time. Provisions of this project will give children a safe area as well as rest and peace of mind for parents. All
funds have been raised by multiple sources to construct the playground and fencing. The Exhibit contained two
potential site plans as well as a photograph of the decorative black -iron fencing and cost breakdowns. Mr. Mixon
explained, safety will be of the utmost importance, the four -foot tall commercial grade fencing would be around the
perimeterof the playground. The equipment has a lifetime guarantee, easily maintained, and requires annual pressure
washing. Should this project be approved, the City would essentially undertake the maintenance, adding further, that
the Kiwanis Club is offering to assist the City with the maintenance.
Mr. Brian Sell, Government Operations Consultant II, of the Okeechobee Health Department, was then asked to
present health factors for consideration as Okeechobee's citizens obesity rate far exceeds the state average with the
diabetes rate being high in the eightieth percentile. Parks are recommended to be a great provision for exercise and
activity opportunities, combating against obesity and other health issues.

A. Consider a request submitted by the Kiwanis Club of Okeechobee for Mr. Mixon presented letters of support for the project from business owners along South Park Street, between
preliminary approval of construction of a special needs playground in Park L Southeast 51h to 71h Avenues. Three owners were not available for comment, the others had no objections. One of the
of Flagler Park continued. owners who submitted a letter in support, Mr. Curtis Tyson, owner of Serenity Coffee Shop, located at 601 Southwest
Park Street, addressed the Council stating the festivals and activities in the park do not bring customers to frequent
his business as they are there to purchase the food and beverages being sold within the festival area. However, they
do request to use his restroom facilities, and he obliges even when they are not his patrons. However, he firmly
believes the playground would impact his business in a positive manner.
Mr. Mixon also provided research he conducted throughout the area over a two -week span in regards to parking. A
small County recreation area with swings and a few playground items are located at Northwest 2°d Street and 7th
Avenue. His research found that there was one to six cars during 'prime' playground hours (lunchtime and 6:00 P.M.).
Council Members Watford and Ritter disclosed they are active members of the Kiwanis Club. Council Member Watford
further disclosed he was in attendance at the meeting when the playground project was discussed, but did not vote
on the matter. He was pleased the business owners are in favor of the project and admitted at first he was not keen
on the idea but the proposal holds merit. He clarified that the City will have ownership and the maintenance. He added
that it was his understanding that the Kiwanis Club was also requesting signage to recognize and identify it as the
"Kiwanis Playground Park." Council Member Ritter disclosed he was not present at the Kiwanis meeting, but has since
discussed the project with Mr. Mixon. He is in favor of the park as it promotes community involvement and agrees it
will be an aesthetic improvement for our downtown area. There were some valid points mentioned from the Health
Department and more playgrounds are necessary for a better quality of life. His concern was maintenance and
advised staff to be sure this would be something that can be maintained. Council Member O'Connor noted his
concerns regarding parking and restroom facilities.
During the discussion, Administrator Whitehall explained there was some confusion with the information provided to
the Mayor and Council in regards to where the playground was proposed to be located. Further, that City Staff would
like an opportunity to review the specifics of the project from a technical standpoint prior to a final approval being
considered. Mavor Kirk instructed Citv Staff to review the Droiect in a timelv manner and report their findings
back to Mr. Mixon to provide him the opportunity to address them. The item will be reconsidered at the

an independent City-wide parking study to offer a strategic plan of solutions for immediate remedies of parking issues
as well as alternatives for future needs of the area. Offering that the study, with an estimated cost of $25,000.00 to
$35,000.00, should be considered an investment for the business community,

ITEM ADDED TO AGENDA: B. 2. Potential Parking Lot at Southwest 4'h Avenue
and Park Street - City Administrator (Exhibit ).
Council Member Watford began the discussion stating a parking study will not fix the situation since most of the
parking issues are when older businesses are converted for new uses and are trying to be in compliance with current
codes. It is not our responsibility to provide parking for businesses, and the Council has made exceptions for many
already. Council Member Ritter noted his appreciation on the focus of looking towards future growth. This is the time
to be proactive rather than reactive. Council Member Chandler's analogy of the situation was "we only have a box this
big and you can only put so much in it." Council Member O'Connor agreed with Council Member Ritter and noted that
this is not the first time the City has discussed parking and is very much aware of the situation. The Council pointed
out the next item on the agenda relates to the City working toward adding parking within the downtown area.
Mrs. Dawn Hoover addressed the Council as the City's Planning Board Chairperson and explained parking has been
the topic of discussion at the last three meetings, and she encouraged the Council to do something. Senior Planner,
Bill Brisson of LaRue Planning and Management Services had advised the Board he could not start looking for
solutions without direction from the City Council.
Council Member Ritter moved to authorize the expenditure of an independent parking study for the City of
Okeechobee, not only to be for existing inventory, but for future growth as well; seconded for discussion by Council
Member Chandler. During discussion, Administrator Whitehall interjected, the City's Planning Consultant, LaRue
Planning and Management Services, which the City already has a contract with, has the expertise to accomplish this
study, and is aware of the City's situations and codes.

noting that this includes any direction or authorization to LaRue Planning.
Administrator Whitehall presented a proposal for the City to determine a fair market price of a vacant lot located on
South Park Street, at Southeast 4'h Avenue, to purchase as a public parking lot. The site could provide up to 20 parking
spaces, with two designated as handicapped. The first step will be to award a quote to a Commercial Appraiser. After
solicitation of requests for qualifications, two were received. A ranking committee consisting of Mayor Kirk,
Administrator Whitehall and General Services Coordinator Burnette offered the following ranking for approval and
negotiations:1. DR Wilson Land Company. 2. Glades Appraisal Company. Council Member Watford noted the project
has merit and while he appreciates the City being proactive to finding parking solutions, he was not optimistic patrons
would be willing to utilize this parking.

Administrator Whitehall, explained this addendum incorporates the indemnification and E-verification language as
required by the Florida Department of Transportation (FDOT) for funding of the Small County Outreach Program
(SCOP) project. This grant funding has been a learning experience, as Administrator Whitehall is still awaiting the
agreement since February. FDOT's timeline is to begin construction by March 1, 2016, but does not anticipate any
other issues.

The item presented before the Council is a request for a parking reduction, as recommended by the Technical Review
Committee (TRC). The Iglesia Bautista LaCosecha Church petitioned and obtained a Special Exception for a 6,000
square foot church to be constructed in a Residential Single Family -One zoning District on a parcel less than 5-acres.
Code of Ordinances Section 90-484 offers a provision to allow up to a 75 percent reduction in paved parking for places
of public assembly or worship. The parking spaces still must be met, only the number of spaces to be paved are the
subject at hand.

Administrator Whitehall reviewed the information in Exhibit 7, and explained the recommendation further offers a
stipulation that the City reserves the right to require the applicant to install additional paved spaces in the future, based
on evidence that the reduction was inappropriate, triggered by such issues as site deterioration, safety issues and
parking demand. The TRC recommendation is based on their action for Site Plan Review No. 15-002-TRC, taken at
their meeting of March 19, 2015. Council Member Watford noted his concern of approving the reduction without a valid
reason offered by the applicant. Administrator Whitehall offered that it was his understanding to be an economic impact
assumed for all places of worship as opposed to a for -profit facility. Further, that this is consistent with previous
requests for places of worship.

The pre -annexation agreement was approved at the March 17, 2015 meeting. The amendment is to correct the acreage amounts of two
unplatted parcels within the unincorporated area of Okeechobee County, adjacent and contiguous to the limits of the City, for the expansion
of the current nursing home/assisted living facility. The first parcel identified as the "East Parcel," located east of and contiguous to the existing
Okeechobee Health Care Facility and west of Taylor Creek consists of acres instead of . The second is identified as the "North
Parcel," located to the northeast of the existing Health Care Facility, east of Raulerson Hospital, and west of Taylor Creek, consisting of

Flagler Park F is the proposed location. A special needs playground area. Not a massive area. Safety is of the upmost important. Equipment

All funds have been donated by multiple sources.
Sufficient funds have already been raised to construct the playground and fencing as preesented.
Entire playground would be funced with four feet commerical grade funcing.

We have known this was coming, thought it would go with where the county current parks are.
This is a much better location than the other parks. Know parking was a concern, this elievates park of that concern. Council going to have

Ritter, too a member of Kiwanis, was not at meeting when the playgroudn was discussed. I have talked with JD abou the project in detail. The
Today Show this morning was on playgrounds on a small town in New Jersey a project similar to what you are doing. It brought the community
together. A number of people will probably wantn to join in and help now.
Goign one step further it makes somethign a little more unquie to make it more eye catching. It will make it a place some people might night
otherwise enjoy the area. It could be a an anchor to allow us to do additional things witj don't knwo if we want to make a decision tonight. I
woudl Iiek staff to really look at this and be sure its something we have the capability to maintain. I don't know its up to the mayor whether he
wants to make a decision tonight.
Kirk only concern I have, until late this evening. Thought the idea was to have ti over at the skate park. The traffic counts were there.

Whitehall, definition of a passiveor active park. The centennial park still don't really understand. The flagler parks have always been looked
at as a passive park as well. Was under the impression that th ecouncil didn't want the park iwhtin th e. estically this does look a lot better.
Appreicate whate council watford said with giving staff time to vet the project. We know we have a problem with parking downtown. Building
offiical needs an opportunity to have review it as well.

O'Connor when we decided to build the centennial park. Restroom facilities issues. Need to think a little bit more about all of this, thought out

Mr. Curtis owner of Serenity Coffee, during anything for the park does not always help my business, they use my restrooms. This I believe
would actually help my business. Where the festivals do not actually help me. Really wont mind them coming from the park and beign a patron
of mine and would not mind that at all.
O'Connor appreciate your parking study. City always has a problem with the hamrick trust and want to hear what they would say about this.

Worley, Economic Council of Okeechobee (Exhibit 3). Request the city council authorize an independent parkign study to be completed for the city. Think if we can get the parking it will able a benefit
for the business and the city charging stations within the city to recharge the electric cars. Think of a long term investment. We have some
problems that were created a long time ago. Request the city invest some money to do a comprehensive parking study. Several members of
the economic council and Kimley Horne in attendance.
Watford, don't think we need to spend funds for a parking study because the situation we run into is when we try to take a older builder and
make it fit with current codes. Don't think we should provide parking for businesses, that is not our responsibility. Hoot we have businesses
that cannot put parking on their property because there is not enough room on the property. We do not have enough parking in our town and
think it does fall on the councils burden to provide the parking if you want the town to thrive and grow. Watford when I built a business I had
to provide many parking spaces, why doesn't the next one have to provide it. Hoot, were here to ask you to come to our rescue.
Def need to look at parking for existing structures. Think we have bent over backwards on many of them.
Don't mistake what i am asking you to do here, not asking you to change your regulations. Asking you to fund a study to see exactly what our
inventory is, and see what our parking needs are.

OKEECHOOEE, Fla. -
A police chief's quick actions brought a 5-year-old boy back to life.
Brody McGee had been swimming Tuesday with other children in an above -ground pool at the Real Life
Children's Ranch where his family lives.
The boy's mptiher was supervising the group of children when she lost track of Brody and discovered him
floating face7down in the pool.
Okeechobee] Police Chief Denny Davis, who also lives at the ranch, had just arrived home from work and
was chattind with his wife when he heard Brody's mother scream.
i
Davis took Brody out of his mother's arms, put him on a picnic table and started performing chest
compressions while his wife gave rescue breaths.
"I checked f�r', a pulse, and he had none," Davis said.
After about four minutes, Davis said Brody coughed up water and started breathing again.
"I don't need any recognition," Davis said. "My reward came that day when that little boy got his breath
back.'
Brody only spent one day in the hospital and is already back to his normal self just two days after his near
drowning.
When they called and said your son drowned, there's no worse feeling," said Brent McGee, Brody's
father.
Brent McGee said he's eternally grateful to Davis and his wife, but he's a God-fearing man, and he truly
believes there was a higher power looking over his son.
"It's just an absolute miracle all the way around for everyone to be where they were at that time," Brent
McGee said.

Mayor Dirk — Would you be so kind as to present a medal to Chief Davis at the
Council meeting tomorrow night? I've asked Bob to prepare some info and he
sent the, below info as a preface to presenting the medal, which 1 have here in my
office.
Shortly before 4pm, on Tuesday march 17th, 5 year old Brodee Magee, a resident
at the Real Life Children's Ranch had an accident in his backyard pool, he had no
pulse, hod quit breathing, and was turning blue. Chief Davis and his wife Margo,
who are house parents at the ranch, and luckily in the area, quickly intervened
and preformed lifesaving CPR, breathing life back into Brodee. Thanks to the
Chief's quick response, and prior training Brodee is alive and well today.

AMENDMENT TO PRE -ANNEXATION AGREEMENT
WHEREAS, the City Council for the City of Okeechobee, Florida, approved a Pre -Annexation Agreement for
certain real property within the unincorporated area of Okeechobee County, Florida, with
r, OHCF Properties, LLC, at a duly advertised Public Hearing held March 17, 2015; and
WHEREAS, once approved, the petitioner retained services of an engineering/surveying firm to perform a boundary
surveyof the property to be annexed, which survey revealed that the two parcels comprised of a total of 5.01
acres, With the North Parcel actually being 2.97 acres, and the East Parcel actually being 2.04 acres; and
WHEREAS, the Pre -Annexation Agreement approved by the City incorrectly designated the North Parcel as
consisif ing of 2.960 acres, and the East Parcel as consisting of 1.250 acres; however, the legal descriptions
for theitwo parcels in Exhibit "A" attached to the Pre -Annexation Agreement did in fact set forth the correct
meets i and bounds legal description; as the description was correct and only the acreage misstated, all that is
is for the parties to approve an amendment to the original Pre -Annexation Agreement at a duly
Public Hearing.
NOW, THEREFORE, the City of Okeechobee, Florida, hereby approves this amendment to the Pre -Annexation
Agreerent as follows:
THAT, the correct acreage of the parcels to be annexed into the City of Okeechobee is as follows:
North Parcel: 2.97 acres
East Parcel: 2.04 acres
THAT,', in all other respects, the Pre -Annexation Agreement agreed to by the parties on March 17, 2015, is
ratified in its entirety, incorporated herein by reference, and each agreement binding on the parties.

Important Points
• Sufficient funds have already been raised to construct the playground and fencing as
presented.
• Entire playground would be fenced with 4' commercial grade fencing.
• Playground equipment is constructed from high quality commercial grade steel that has a
lifetime guarantee. Only requires pressure washing approximately annually.
• City of Okeechobee asked to adopt and maintain playground after construction.

ASTM F2075-10a Standard Specification for Engineered Wood Fiber for Use as a Playground Safety Surface Under and Around Playground Equipment.
Drainage is extremely iI portant to the long term performance of your playground surfacing. Consult a Landscape Architect, Engineer or qualified contractor
for information on how o achieve proper drainage on your site and beneath the play surfacing. Geotextile fabric is required as a separation layer between the
wood material and the �ree draining subsurface. The geotextile fabric separating the wood material from the subsurface should be free of standing water
within 30 minutes after the rain ceases. A minimum of a 12" depth of surfacing material must be maintained at all times.
**' This is a natural product. Particle size, texture and color may vary from a tan to a dark brown due to the natural conditions of the environment

Installation Charges or this proposal are based on NO UNFORESEEN conditions in the area, above or below the surface. If unforeseen conditions arise, the
installation charges wil change to reflect additional costs associated with dealing with those circumstances. Examples of this include, but are not limited
to: site not ready uponinstaller's arrival, underground utilities, or difficulties with footers due to coral rock or ground water in the holes.
Orders are shipped wil hin our manufacturer's standard lead times. Requests for delayed shipping may result in additional costs due to increases
in freight, material costs or other factors. To secure the prices on this proposal, the offer must be accepted prior to the expiration date noted.
The undersigned warran s that he/she is an authorized representative of the company noted and has the requisite authority to bind said company and/or
principal. If any particul r billing is not paid when due, all outstanding balances, regardless of prior terms, will become immediately due and owing upon

Should it become necessary for either party to this contract to institute legal action for enforcement of any provisions of this contract, the prevailing party

Specification for Engineered Wood Fiber for Use as a Playground Safety Surface Under and Around Playground Equipment.
Drainage is extremely important to the long term performance of your playground surfacing. Consult a Landscape Architect, Engineer or qualified contractor
for information on how t achieve proper drainage on your site and beneath the play surfacing. Geotextile fabric is required as a separation layer between the
wood material and the f ee draining subsurface. The geotextile fabric separating the wood material from the subsurface should be free of standing water
within 30 minutes after a rain ceases. A minimum of a 12" depth of surfacing material must be maintained at all times.

This is a natural product. Particle size, texture and color may vary from a tan to a dark brown due to the natural conditions of the environment.
This proposal is for Eng neered Wood Fiber playground surfacing delivered to the site.

During a recent Council meeting, the matter of downtown parking congestion was
discussed. We quickly reviewed the Code's parking criteria and the possibility of
adding public parking.
Sinc that time, the City has collected information on the development of a
pote tial parking lot at the corner of SW 4th Av & SW Park St.
1. i The Site
The attached rough depiction indicates a parking lot that provides for up to 20
spac s. Admittedly, we need to adjust for probably 2 handicapped spaces and
pote tially additional landscaping, albeit there are six green -space areas in the
diagram. As to the cost of the installation, site prep, asphalt (incl base course),
striping, curb/gutter, sidewalk, paver decor, landscaping & irrigation, and
bencipes/amenities add up to about $40,000 +/-.
2. The Value/Appraisal
In or er to transact a potential purchase, the City is obligated to determine what
the a praised value is. To that end I arranged an RFQ (due 3/31/15) for
commercial appraising services to which the City rec'd two (2) responses, copied
and attached at the end of this report. The ranking committee consisting of
Mayor Kirk, Gen Services Coord Burnette and Administrator Whitehall used the
ranking criteria sheet attached and a summary of those findings is also
attached.
Please consider a motion that directs the City Administrator to proceed with
negotiating and entering into an Engagement Letter w/ D R Willson Land Co for
the purpose of providing a commercial appraisal of Lot 6, Block 167, at the
corner of SW 4tn Av & SW Park St. If unable to arrive at suitable terms w/ D R
Willson, then enter into the same Engagement negotiation process with the
secorhd receipted RFQ, Glades Appraisal Co. LLC.

ulti-family (non -single family homes) appraisals in Okeechobee County and City full time
since 1995. Part time from 1990 to 1995. 1 estimate that I have provided more than 1,000
appraisals in this County, with a broad property type and broad client base. Please see

4. Task Approach including costs: This is difficult to adequately address, as the request is broad.
I Will address as best I can by breaking this item down into four (4) parts. Again, please see
attached qualifications.
a Scope: I work with the client to determine the scope. Many times the client is unsure
of the scope, however, still has an idea why the report is being ordered. I work with the
client to determine an accurate scope for the assignment. Sometimes this issue alone can
take time, however, it is done prior to submitting a bid to perform the services.
b. Property Type: I am fortunate in that I have appraised everything from a small office
building in Okeechobee City limits, to the local bowling alley, to the new Sheriffs property
in Glades County, to a prison, to a post office, to a major industrial park subdivision in
Indiantown, to the largest hanger at the St. Lucie County Airport. The scope is always
different. That is why "a" above is so critical.
c. City Contact: All that is needed. is a main contact person that engages our services.
My clients always know where I am with an assignment. I am rarely late, unless the scope
changes or data is not forthcoming as promised.
d. Fees: My fees typically run from $1,200 to over $5,000 for the initial report
depending on the property and the scope of services requested, typically followed by an
hourly rate for post appraisal services. I have found that it is less expensive for my Client
to bid on the assignment at a set price, then bill hourly after the report is complete. My
standard hourly rate is $225 per hour due to my qualifications, efficiency, and knowledge
of this market. I have been known to negotiate that rate lower depending on the
complexity of the assignment. I am not known for over -charging, ever. My fees are
usually all inclusive. I typically do not budget for high dollar exhibits used during a trial, as
the attorney generally covers that expense. Again, all fees are negotiated on a case by
case basis, based on the scope of the services required/requested.

The Economic Council of Okeechobee asks the City to support the commission of
an independent, city-wide parking study that would result in a strategic action plan to
alleviate parking issues impacting our local business community with increasing
frequency. A study would determine the supply and demand of parking within the City,
using current occupancy levels and existing land uses, as well as outline strategies to
prepare the City for future development needs.
Data collection is an important part of the study and would include an inventory
of parking spaces, occupancy and turnover. Existing land use type, intensity and usage
for the area would be recorded and underutilized areas would be identified. It is important
that community outreach is included through stakeholder interviews and a community
workshop. Specific recommendations would then be developed to focus on shared
parking opportunities, possible reductions in parking requirements, and policies that
support growth and development in keeping with our community's vision.
A study of this sort is estimated to cost in the range of $25,000 to $35,000, an
expense that is a worthy investment for our current and future businesses to ensure the
best possible plan is put into action.
The mission of the Economic Council of Okeechobee is to create an environment that promotes
prudent economic growth and improves the quality of life in Okeechobee County, Florida.
Please invest in our businesses, citizens and visitors by authorizing an
independent parking study to address the long-term parking needs of the City of
Okeechobee.

I. PURPOSE
This is an addendum to Project Authorization No. 3, FPID 437239-1 to provide Florida Department of
Transportation (FDOT) required contract language as required for a FDOT Small County Outreach
Program SCOP project. The following shall be made part of the original contract.
II. INDEMNIFICATION
"To the fullest extent permitted by law the Recipient's contractor shall indemnify and hold harmless the
Recipient, the State of Florida, Department of Transportation, and its officers and employees, from
liabilities, damages, losses and costs, including, but not limited to, reasonable attorney's fees, to the extent
caused by the negligence, recklessness or intentional wrongful misconduct of contractor and persons
employed or utilized by contractor in the performance of this Contract.
This indemnification shall survive the termination of this Agreement. Nothing contained in this
paragraph is intended to nor shall it constitute a waiver of the State of Florida and die Recipient's
sovereign immunity.
To the fullest extent permitted by law, the Recipient's consultant shall indemnify and hold harmless the
Recipient, the State of Florida, Department of Transportation, and its officers and employees from

The Church previously rec'd a Special exception for a 6000 sq
ft church in a residential area w/ a parcel of less than five (5)
acres.
As part of the 3/19/15 Tech review a sidewalk along SW 4th St
was added w/ the provision of installation w/in five (5) years.
Among other contingencies is a TRC recommendation to the
Council for a parking reduction (Code 90-484, up to 75%).
Please see the attached memo, along with plat and part of the
Planner's report. The report indicated 34 paved parking spaces
are required. The site plan indicated 8 spaces to be paved, but
was modified to 11 spaces (34 X 75%=26; 34-26=8, this differs
slightly from Brisson's calc due to rounding).
Consider motion:
That the applicant, Iglesia Bautista La Cosecha, 1007 SW 4tn
St, be granted a 75% reduction in the required paved parking
as provided for in City Code sections 90-511(e)(1) and 90-484
(a) & (b). Further, that a stipulation be added that the City
reserves the right to require the applicant to install additional
paved spaces in the future based on evidence that the
reduction was inappropriate triggered by such issues as site
deterioration, safety issues and parking demand.

Subject: Explanation of Sections 90-484 and 90-511(e)(1)
Per our recent telephone discussion, I offer the following explanation regarding the provision in
the LDRs allowing for a reduction in the number of paved parking spaces for places of public
assembly or worship:
1. Sec, 90-511(e)(1) establishes the fact that places of public assembly or worship are
afforded an exception to the requirement that all required parking spaces are to be paved.
2. Sec. 90-484 provides the vehicle by which the City Council may determine the total
number of required spaces that must be paved.
a. A parking study must show that the use of all required parking spaces is necessary
only one or two days a week.
b. The number of paved spaces may be reduced by no more than 75%.
To the best of my knowledge, in the case of a house of worship, we have not required a
formal parking study. Rather, the Applicant has typically submitted a statement explaining
how often the major worship services are held and the likely number of attendees. The
overall parking requirement is based on the seating capacity, and the number of paved
spaces is determined by the number of spaces likely needed at other times, but not less than
25% of the total parking requirement.
4. The City Council could, if circumstance indicate sometime in the future, that more paved
parking is needed, require more spaces to be paved.. Therefore, we have usually required
that the Applicant submit, as part of the site plan, proof that the site has the capability of
accommodating a paved parking area that provides for 100% of the required parking in a
manner that meets all of the requirements of the LDRs.
Finally, I would suggest that when the City Council approves a request for a paved parking
reduction, the approval include stipulations that the Council reserves the right to require the
Applicant to pave more spaces if it becomes evident that the unpaved parking area is insufficient
to handle the parking demand, becomes unsafe, or results in deterioration of the site because of
the lack of paving.

The Applicant proposes to build a new church on a vacant, 1.64 acre parcel at 1007 SW
4th Street. The church will be housed in a new 6,000 square foot (60' x 100') metal
building. The property will be developed with associated parking and water management
facilities. Primary access will be afforded from SW 11th Avenue and SW 4th Street. The
lot is designated Residential on the Future Land Use Map and zoned RSF1.
The sanctuary (main assembly area) encompasses 1,968 square feet plus about 270
square feet for the raised stage indicates a total of 2,238 square feet plus four 156
square foot classrooms. Discussion with Pastor Perez indicated that the services in the
sanctuary will be held at 1:00 pm on Sundays with attendance up to 100 persons being
expected. Services are also held at 7:00 pm on Tuesdays and Wednesdays during
which about 70 persons may be expected. The four classrooms will be used at the same
general times of the services on Sundays and Tuesdays. Up to 20 children and 12-15
youths or adults can be expected in each classroom. The children, youths and adults in
the classrooms are included in the 100 persons expecting to be attending services in the
sanctuary.

• Downtown destination ideas — I sent an email rec'd from Toni Doyle's
boutique, 123 SW Park St that had an attachment that I'm enclosing in
your Council packets. I think some of the ideas are sound but there's only
so much the City can do. We've relaxed the code to allow residence in
the CBD, relaxed our interpretation of the parking, allowed more and more
intrusion into the sidewalk area, added plants at the islands and are
working on the possibility of a small, well landscaped parking area. We
plan to start installation of new blue signage in the near future.
Much of the "ingredients" rest with the businesses themselves, such as
storefront curb appeal. I haven't spoken to Main St/Chamber, but perhaps
a positive beginning step might be a session, with them leading the way,
on what improvements the City might play a role. Sent the following email:

While we have experienced significant budget constraints over the last several years, we've seen

downtown more attractive to shoppers, etc. The attached main Street flyer has some great ideas,
most of which would fall to the shop owner, but still there may be intervention points to discuss
with Main St and the Chamber.
Having said all that, what do you think of have a get together, perhaps just a few of your Board
members or just you folks to brainstorm an approach? Once we get the FDOT improvement mess
out of the- way, it might be timely to re-examine a plan for the downtown. Let me know what you
think.

Spratt, Joe Spratt, Richard Coates and Noreen Fenner to assist them in
Tallahassee.
• Impact fees repeal anticipated schedule:

The City moratorium on fees collection expires 6130115, we have no monies left
in the Fund.
The School District (Nov '14) and the County (Dec '14) adopted ordinances that
terminated the impact fee process.
• FDOT Signal Maint Agreement — The City reed a 3'd rendition of an FDOT
Agreement and will be presenting it to the Council in the near future. The City
approved the annual Agreement in June 2014. In Oct, we passed a modified
Agreement that described the State's and the City's responsibilities more
thoroughly... we felt it was not too intrusive. In Aug we reed $9000 in
reimbursement. For comparative purposes, the City reed — 2007 - $7200, 2011 -
$8300.

• Railroad xing at NW 9th Av — Atty Cook reed the attached 3/10/15 CSX
response to his inquiry about the new RR crossing at NW 9th Av and the
price tag-$38,000+/- (100% City payable). John and I have discussed
what might separate the City from the commitment is that in '92 the City

is looking for a smoother surface and perhaps agreed to pay a premium
that, hence the "rubber" surface. CSX did not reinstall a rubber surface

Fire/Code Enforcement:
• Smoke Alarm Initiative — Chief Smith along w/ Fire Rescue have gathered
my approval to seek a $68k grant w/ a 5% match ($1700-City) to purchase
some 2000, 10-yr battery operated smoke/CO detectors. The grant ap is
$250 for ea entity and, according to Smith, is pretty much a'slam dunk'.
There's some administrative detail to work on, participant agreements/hold
harmless, installation processes. Chief is investigating other communities'
methodology, but it sounds promising and is certainly a great cause for
our people to involve themselves in.
• Nuisance house at NW 9t' Ay and 2"d St — house demolished. Waste
Management afforded the garbage & hauling and the City Pub Wks
demolished the house.
Police:
• 911 services — Karl Holtkamp, Okee Fire/Rescue, Co Adm Chartier, Chief Smith,
Chief Davis, Maj Peterson and I met 1115115 to discuss financial constraints
facing the County and the 911 dispatching services within the next several
months. Will supply additional information as it becomes available.
Public Works:
• 2014-15 Asphalt Program — The next phase will be SW 5th Av. David is
investigating a striping contractor through the County via 'piggybacking'.
• 441 median landscaping (Grant funded -Main SO — FDOT Maintenance Dept
is conducting a completion survey prior to reimbursement, as per communication
last week. FDOT for grant- $96,492.71. 1 found that my prior FDOT contact
has a position w/ AECOM, but still contracts w/ FDOT. He indicated last
week that there may be an extension form necessary, which he acted was
just a formality, and that the District 1 office was being non -responsive.

• CANAL CLEANING PROJECT:
A. GRANT APPROVED - Canals - Legislative Grant $100k - Agreement w/
DEP — Executed the Grant Agreement for the water conveyance project. The
grant expires Nov 5th. The City requested $450k but was only funded to the
$100k. For the 2015 legislative requests, the City again requested $450k.
B. GRANT — Canals — SFWMD grant — On 11/18114 submitted a grant
("cooperative funding Program CFP') application for additional funding
($185k) to assist the City in completing the canal cleaning project.
The Part I applications/projects will be presented to our Governing Board to
determine which projects should be further considered for FY2016 cost sharing in
Part 2. Applicants reaching Part 2 will be requested via a second application to
submit detailed project information, timelines, and funding commitments and
benefit quantifications.
• TAYLOR CREEK/CENTENNIAL PARK PROJECT: from 3125/15 email

Completely understood. I will have a bank -grading plan done ASAP for
submittal to the FWC (This will show the amount of bank removal and
stabilization they will be paying for). While that is being done we will complete

the master plan of the site and show how the bioswale/water quality
improvements will work for an enhanced submittal to the FDEP.
As soon as the master plan is done, we can provide phased improvements that can

Dear Mr.
I aml in receipt of your letter in response to my January 7, 2015 email regarding the costs
of the NW 0th Avenue crossing rebuild. Your letter raises questions about the obligations of the
City and CS with respect to this project.
As y u describe in your letter, the City and CSX entered into an agreement dated
January 21,1992. The Agreement provided for the installation by CSX of a full depth rubber
crossing su ace at NW 9th Avenue at the expense of the City. Section 4 of the Agreement
provides th t:
After the full depth rubber crossing surface material has been installed at the subject
locations, it shall hereafter be maintained in good condition by the Railroad through the
useful life of such crossing surface material, and when it becomes necessary to replace
or rebuild the crossing surface, Railroad will replace and maintain the crossing surface,
but ot the expense of the City.
The rubber crossing surface has reached the end of its useful life and is in need of
replacement. The City has a contractual obligation to bear the expense of that replacement.
F.S. Section 335.141(c) does not take precedence over that obligation, for two reasons. First,
the City is assuming that this crossing is not one for which maintenance has been "provided for
in another manner by contractual agreement entered into prior to October 1, 1982." The
presence of such an agreement would make the statute inapplicable. Second, and more
importantly, even if Section 335.141(c) does apply, nothing in the statute prevents parties from
entering into contracts that alter the responsibilities set out in that section.

In 1992, the City requested the installation of a crossing surface which differs from CSX's
standard (full depth rubber vs. timber and asphalt). It was reasonable for the parties to
contract for both the installation and future replacement of this non-standard crossing surface
type. As the time for replacement has now arrived, CSX expects that the City will adhere to its
obligations under the agreement.

Application to Extend the Zoning Exception Permits
To Whom It May Concern:
I am writing this letter is to state my current situation about the tire sale and auto repair
and ask whether the -Board of Adjustments can extend my zoning exception
permits 14-003-SE and 14-004-SE) for.six month until September 1, 2015 and the
site address is 1127 SW Park Street, Okeechobee, FL 34972. I was told that the
zoning exception permits only valid for 180 days to February. I want to open the store as
soon as possible but now I feel great pressure for opening the store to public in February.
There * some reasons for me to request to extend the zoning exception permits:
1) Vnfamiliar with policies and license process in USA. I am not the U.S citizen
currently I still hold the business visa. I came here four years ago for MBA
and graduated with four MBA degrees in June of 2014. I just started the
iness and do not have much experience in tire sales industry and has not hire
people to help me to run the tire store. Everything for me is new. I
more difficulty in running the business at the beginning. As famous Chinese
says: The first step is always the hardest and well begun is half done. We
Want to sufficiently prepared and make -everything in order and then open the
store.
2) Renovation takes a longer time than it is expected. I spent 3 months to deal
with the renovation. I have no experience for renovation. The renovation proposal
is quite different from it is in China. So it takes a little longer time for me to learn
the process and find the local contractors. The contractor providing proposal for
renovation also takes nearly one month and I got initial renovation proposal in
November. We want to add a showroom inside of building. I leant to how to find
the renovation contractor and told them city improvements about the property,
such as improving driveway, landscaping, and parking improvements and want to
add a tire display show room.
3) One more month for renovation completion. By now, outside driveway
concrete work and parking places has not completed. The contractor said the total
renovation will take at least one and half month. So the renovation is supposed to
complete in beginning of February. However, now the inside painting and floor
are almost finished except little electric part. The outside driveway and parking
place pavement has not completed. The landscaping work is finished (eight oak
trees is planted along the store front and side of driveway).
4) Half month for business license and one month for inventory prepared. From
my knowledge, the business license can be given only after the renovation
complete. The total renovation and improvement is supposed to finish in the
middle of March. After renovation completion is inspected, I will go for getting
the business license in March. So the earlier time for business license is at the end
of March. After getting license, the tire import and container ship from China will
take at least 20 days. I do not know whether I can order tires container and get
before I get the license. Suppose I get license and then let the tire
ship from China in end of March, I will get tire inventory in end of
This is the fast time I can get the inventory. Plus, all the tire factories are
because of the Chinese New Year holiday. The Chinese New year will last
days from February 18, 2014. So I cannot order the tire container until
6, 2015.
5) One month for people training process. In terms of hiring people, I want to hire
people to run the business because they are more easily to contact local
and familiar local customer needs and wants. I also need to get quality
is people and polite salespeople to better service the local people
we cannot survive in this competing tire industry. Therefore, after
the people hiring and training will also take at least one month. I have
started the hiring work and gave job position description to
and they have referred me two bookkeeper candidates.
6) �usiness visa extension concerns. Currently, I hold business visa. However,
USCIS only give six month maximum business visa and then applicants
apply for another six month maximum extension. I have applied for the
visa in November for six month extension to May 31, 2015 and now the
extension application is pending now. If business visa expires before I get store
open, I must go back China for a while and then come back USA again. That will
delay the store open at least to September. My company has not hired people yet
and I try to hire local experienced people to help me to operate tire store, such as
mechanic, office assistant, and store manager. I must hire experienced people to
operate my tire store before I going back China before my business visa expires.
Recently I am busy to work with contractors to make some renovations for my
tire stores and make the improvements for property to meet the city requirements.
The maximum length of business visa is six month until 5/31/ 2015, but I should
wait USCIS's results in March (pending now).
Therefore, I hope City Board of Adjustments can consider my particular situation and
possibly consider whether can extend my zoning exception permits for six month until
September 1, 2015. So I can have sufficient time in completing renovation work, hiring
people and training, and ordering and shipping tire container.
