SECOND REGULAR MEETING TUESDAY~ MARCH 22~ 1977
The City Council of the City of 0keechobee, Florida, convened in regular
session in the Council Chambers at the City Hall, 0keechobee, Florida, at 7:00
P.M., on Tuesday, March 22, 1977. President Russell V. Domer presiding. Council
men Lytle Raulerson, Jim Knight, Edward Douglas, and Lavon Bass were present.
Others present were: Audley Dunham, Mayor; Sandra Bennett, City Clerk; Sylvia
Christian, Deputy Clerk; L. C. Fortner, Director of Public Works; Larry Mobley,
Acting Chief of Police; and Johnny Bennett, Water Supervisor.
The invocation was offered by Pastor Chuck Davis of the Grace Brethern
Church.
PUBLIC HEARING
REZONING ORDINANCE - FIRST HEARING - D00NAN
President Domer presented on first reading amended Ordinance rezoning from
Residential (R-i) to Residential (R-2) for property described as "Lots 10 and 11,
Block 118, Original Town of 0keechobee" by T. C. and Elizabeth Doonan. No one
appeared in opposition.
It was moved by Councilman Bass seconded by Councilman Douglas and vote
carried that the first reading of the Ordinance be_approved.
PUBLIC HEARING
ORDINANCE NUMBER 596 - ALCOHOLIC BEVERAGES - FINAL HEARING
Pursuant to a notice published March 5rd and 10th, a public hearing was held
to consider the adoption of Ordinance Number 596, being an Ordinance amending
Section one of Ordinance Number 280, which prohibits the sale of alcoholic bev-
erages within the limits of the City of 0keechobee, Florida, between twelve o'
clock midnight Saturday and seven o'clock A.M. Monday, by changing the hours pro-
hibiting the sale of beer and wine beverages to between twelve Q'clock midnight
Saturday and one o'clock P.M., on Sunday.
President Domer stated that the Council would allow the opponents and pro-
ponents five minutes to be heard.
The following persons spoke in opposition to the 0rdRnance: Reverend C. R.
Kilgore, Pastor of the Church of God; Reverend Kevin McGushin; Reverend Chuck
Davis, Pastor of the Grace Brethern Church; Reverend Morris Hanley, Pastor of the
First United Methodist Church; Donald Burk; Harley Kemp; Neva Spann; Sam Cooley;
Ken McDuffie; Reverend William L. Spann, Pastor of the Trinity Assembly of God;
Lynn Nasr; Millie Davis; Elizabeth Hair; Norris Schaeffer; Juanita Burk; Juanita
Schaeffer; Mose Joiner; James Gillman; Virginia Gillman and Doris Atkins.
The following persons spoke in favor of the Ordinance: Frank Ballastine;
Ben Smith; B. G. Lancaster; Betty Everette; Dorcia Storey; Linda Hunt and Frank
Worthen.
Mayor Dunham spoke in opposition to the Ordinance and recommended that the
Council put the vote before the people.

Four petitions were submitted to the Council requesting to restrict further
extension of hours and sale of alcoholic beverages on Sunday and two petitions
were submitted requesting local businesses'be allowed to operate in competition
with similar businesses in ~he county of 0keechobee.
Following further discussion and comments, Councilman Knight moved to reject
Ordinance Number 396, seconded by Councilman Bass. Councilman Douglas and
Raulerson voted "Nay"; President Domer voted "Nay" to break the tie vote.
Councilman Raulerson moved to hold a refrendum election and have the people
vote on the issue, seconded by Councilman Douglas. Councilmen Bass and Knight
voted "Nay". President Domer voted "Nay" to break the tie vote.
Councilman Douglas then moved to adopt Ordinance Number 396, which was
seconded by Councilman Raulerson. Councilman Bass and Knight voted "Nay". Pres-
ident Domer voted "Yay" to break the tie vote motion carried.
CITY CLERK
City Clerk, Sandra Bennett, presented the following for discussion or
approval:
1. 0KEECHOBEE BEACHWATER ASSOCIATION
President Domer presented an agreement between the City and Beachwater
Association. Agreement as follows:
"The City of 0keechobee hereby gives its permission and consent to allow the
0keechobee Beach Water Association to install altitude valves and necessary
pumps to supply said valves into the City water system upon the consideratio:
that the 0keechobee BeachWater Association will also install switching
equipment which shall be controlled at the descretion of the City to divert
0keechobee Beachwater Association's water to the City when the City det-
ermines that it's clear well is low.
"That the improvements made to City property shall be the property of the
City, but will be maintained and kept in good working order by the 0keechob-
ee Beachwater Association.
"That the 0keechobee Beachwater Association will pay for the water used by
it at a rate of $0.45 per 1000 gallons.
"That the above rate shall be in effect until the City and the 0keechobee --~
Beachwater Association enter into a new contract or for sixty (60) days
after the date of this agreement shall take effect.
"That in the event a contract shall not be entered into by April 20th, 1975,
then in such event, the 0keechobee Beachwater Association shall, in good
faith, agree to negotiate a new price for water." Approved and signed.
2. WATERW0~/MPROVEMENTS
City Clerk Bennett, presented a statement from Layne - Atlantic Company re-
questing Estimate #2 payment in the amount of $62,987.95.
Councilman Raulerson moved to authorize payment, seconded by Councilman
Douglas and passed.

5. 701 PLANNING SYSTEM
A letter was read from John Sidor, Director of the Department of Community
Affairs informing the City that because of the limited funds available and the
large number of applicants, the City will not be able to receive funds unless
supplemental "701" funds from the Department of Housing are allocated.
DRAINAGE - DOUGLAS PARK
Councilman Knight reported that he and County Commissioner Lashley had
investigated the drainage problem in Douglas Park and they decided to request
each person to purchase their own culvert.
ADJOURNMENT
There being no further business, President Domer declared the meeting rec-
essed at 10:O0 P.M., until 7:00 P.M., Thursday, March 31, 1977.

The City Council of the City of 0keechobee, Florida convened in a recessed
workshop session in the Council Chambers at the City Hall, 0keechobee, Florida,
on Thursday, March 31, 1977 at 7:00 P.M. President Russell V. Domer presiding.
Councilmen Lytle Raulerson, Jim Knight, and Edward W. Douglas were present.
Councilman Lavon Bass was absent. Others present were: Sandra Bennett, City
Clerk; Richard Spray, Building Official; and Ernest R. Bartley, Planning Con-
sultant
LOCAL GOVERNMENT COMPREHENSIVE PLANNING ACT - ZONING
Dr. Ernest R. Bartley, A.I.P., appeared before the Council to review the
draft text of the new zoning Ordinance.
ADJOURNMENT
There being no further business, President Domer declared the meeting ad-
journed at 10:00 P.M.
