RECESSED WORKSHOP MEETING ~HURSDAY~ FEBRUARy 17, 1977
The City Council of the City of 0keechobee, Florida, convened in a recessed
workshop session at 7:00 P.M. on Thrusday, February 17, 1977. President Russell
V. Domer presiding. Councilman Edward W. Douglas and Jim Knight were present.
Councilman Lavon Bass and Lytle Raulerson were absent. Others present were:
Sandra Bennett, City Clerk; Ernest R. Bartley, Planning Consultant; and Richard
B. Spray, Building Official.
LOCAL GOVERNMENT COMPREHENSIVE PLANNING ACT - ZONING
Dr. Ernest R. Bartley, A. I. P., appeared before the Council to go over the
draft text of the new zoning Ordinance.
ADJOURNMENT
There being no further business, President Domer declared the meeting adjour-
ned.

SECOND REGULAR MEETING TUESDAY~ FEBRUARY 227 1977
The City Council of the City of 0keechobee~ Florida, convened in regular
session in the Council Chambers at the City Hall, 0keechobee, Florida, at 7:00
P.M. on Tuesday, February 22, 1977. President Russell V. Domer presiding.
Councilm®n Edward W. Douglas and Lytle Raulerson were present. Councilmen Lavon
Bass and Jim Knight were absent. Others present were: Sandra Bennett, City Clerk:
David Conlon, City Attorney; L. C. Fortner, Director of Public Works; John Bennett
Water Supervisor; Olen Godwin, Fire Chief; Sylvia Christian, Deputy Clerk.
The Invocation was offered by Councilman Edward Douglas.
APPROVAL OF JANUARY MINUTES
Minutes of the meetings held January 6, 11, 13, 20, 25 and 27, 1977 were
approved upon a motion by Councilman Douglas and seconded by Councilman Raulerson
motion passed unanimously.
0RDINANC~ NUMBER 396 - ALCOHOLIC BEVERAGES - SECOND READING
The City Attorney introduced for a second reading, Ordinance number 396,
being an Ordinance amending section one of Ordinance Number 280, which prohibits
the sale of alcoholic beverages within the limits of the City of 0~eechobee,

Florida, between twelve o'clock midnight Saturday and seven o'clock A.M. Monday,
by changing the hours prohibiting the sale.of beer and wine beverages to between
twelve o'clock midnight Saturday and one o'clock P.M. on Sunday.
President Domer stated that this was only the second reading of the Ordinance
and on March 22 at 7:00 P.M. a public hearing will be held. Interested parties
may appear at the meeting and be heard with respect to the enactment of said
Ordinance.
Reverend William L. Spann, Pastor of the Trinity Assembly of God~ presented
a petition signed by fourteen residents in opposition to the said 0rdinance.~
Mrs. Lynn Nasr, Mr. Mose Joiner and Reverend Clifford Kilgore, Pastor of the
Church of God, spoke in opposition to the Ordinance.
ANTIRECESSION FISCAL ASSISTANCE
Attorney Conlon discussed the anti-recession funds received from the Depart-
ment of the Treasury office of Revenue Sharing at length. He stated that the
funds can not be used for construction or to acquire supplies and equipment unless
necessary to maintain basic services. He informed the Council that the funds must
be appropriated or obligate payments received under the act before the end of the
six month period~ which begins the day following receipt of a payment. President
Domer requested that Attorney Conlon make inquiries from Washington for clarifi-
cation of the use of the funds and report at the next meeting.
FEDERAL REVENUE SHARING
Attorney Conlon stated that the law requires a recipient government to hold
a public hearing on how Revenue Sharing Funds are to be used in relation to its
entire budget before the budget is finally enacted.
ROYAL'S SHOPPING CENTER - UTILITY EASEMENT
Attorney Conlon presented the agreement between ROYAL'S OK LUNCH, INC., and
THE CITY OF 0KEECHOBEE, agreeing to the following:
1. ROYAL'S will grant to CITY two easements:
(a) A blanket easement over its property to permit CITY to operate and
maintain the existing potable water supply mains and appurtenances
as now laid out and in use as reflected by Exhibit "A" attached
hereto.
(b) An easement over the north 10 feet of its property for the construct
ion, installation maintainance and operation.~of a sewerage force
main.
2. CITY shall assume responsibility for the operation and maintenance of the
said existing potable water supply mains and appurtneances up to the meter.
~. Any expenses of resurfacing pavement or damages to any other surface due
to or resulting from maintenance of said potable water mains and appurtenances up
6o the meter, Therefore, shall be the sole responsibility of ROYAL'S and CITY
shall not be hold liable or responsible for the payment thereof.
President Domer read the agreement and upon a motion by Councilman Douglas
seconded by Councilman Raulerson the motion was passed unanimously that President
Domer execute the agreement.

FIRE DEPARTMENT
Fire Chief, Olen Godwin, presented the following for approval:
EMPLOYMENT APPLICATION
An employment application from Sam Thomas, Jr. was submitted for the
Councils approval.
Councilman Raulerson moved that Thomas be employed on a six months pro-
bation period seconded by Councilman Douglas motion passed unanimously.
CITY CLERK
City Clerk Sandra Bennett submitted the following items for discussion:
1. REZONING APPLICATION
Clerk Bennett, presented a rezoning application from Channel Properties,
Inc., requesting the Council to rezone Lots 5, 6, 11 and 12, of Block 41, Origin-
al Town of 0keechobee, from Residential (R-l) to Commercial.
Councilman Douglas moved to instruct the clerk to proceed with notification
to the owner and to advertise public hearings seconded by Councilman Raulerson.
Motion passed unanimously.
2. REZONING APPLICATION
Clerk Bennett, presented a rezoning application from John S.W. Davis,
requesting the Council to rezone Lots 25, 24, 25 and 26 of Block 200, Original
Town of Okeechobee, from Residential (R-l) to Commercial.
Councilman Raulerson moved to insturct the clerk to proceed with notifica-
tion to the owner and to advertise public hearings seconded by Councilman
Douglas and passed.
5. REZONING APPLICATION
Clerk Bennett, presented a rezoning application from Herbert L. Robert-
son, requesting the Council to rezone Lot 26 of Block 3, Original Town of 0kee-
chobee~ from Industrial to Commercial.
Councilman Raulerson moved to instruct the Clerk to proceed with notificatio~
to the owner and': to advertise public hearings seconded by Councilman Douglas and
passed.
4. STATEMENT ON CLEANING AND PAINTING WATER TANKS
Clerk Bennett submitted a request for payment from Inter-State Con-
tracting & Coating Company, Inc., for cleaning and painting of Water Storage
Tank for approval.
Subject to final approval by Director Fortner, Councilman Douglas moved
to approve payment, seconded by Councilman Raulerson and passed.
5. AETNA INSURANCE - GENERATOR
Clerk Bennett, presented a letter from Aetna Insurance which recommended
that a back-up generator be installed within the sewer utility company complex,
so that in case of power failure, proper sewage facilities can be provided to
the community to reduce the possibility of back-up, and possible infiltration of
sewage affluent, overflow into the adjacent canal.

Director Fortner stated that he was investigating prices for a generator.
6. LAYNE - ATLANTIC COMPANY
President Domer read a letter from Robert E. Owens & Associates, Inc., for
the first payment to Layne Atlantic Company for 1976 Waterworks Improvements.
Councilman Douglas moved to authorize payment seconded by Councilman
Raulerson motion passed.
?. LICENSE APPLICATION
Clerk Bennett, presented a license application from Hungry Caboose, Inc.,
for a City 0ccuaptional License for a mobile food truck.
After discussion the Council authorized the clerk to issue the license.
DEPARTMENT OF TRANSPORTATION
Councilman Domer read a letter to the Department of Transportation request-
ing a survey of the traffic situation in the City of 0keechobee.
Followin~ discussion the Council agreed to request a survey by letter.
SHOWER STALL IN JAIL
President Domer reported that the space previously used for the jail is to
be used for storage and the Sheriff's Department had offered to take the shower
facilities.
Councilman Raulerson moved to use %he jail area for storage and give the
Sheriff's Department the shower facilities seconded by Councilman Douglas and
carried.
JAIL CELLS - FOR STORAGE - CENTRAL AIR AND HEAT
Director Fortner discussed the central air and heat for the holding cell in
the Police Department. Following discussion council agreed to central air and
heat the jail cells and informed Director Fortner to advertise for bids on the
unit.
MAYOR
Mayor Dunham suggested making the driveway at the north east corner of the
City Hall to be entrance only.
Following discussion, Councilman Raulerson moved to have a sign erected for
entrance only which was seconded by Councilman Douglas. Motion passed unanimousl--.
ADJOURNMENT
There being no further business, President Domer declared the meeting rec-
essed at 9:00 P.M., unti~ 7:00 P.M., Thursday, March 3, 1977.
