ORDINANCE NO. 402 - (10 ) ORDINANCE AMENDING ORDINANCE NO. 402, BEING THE COMPRE- HENSIVE ZONING ORDINANCE WHICH ESTABLISHES ZONING REGULATIONS FOR THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDES FOR THE ADMINISTRATION, ENFORCEMENT, AND AMENDMENT THEREOF. AMENDMENT CHANGES CLASSIFICATION OF SPECIFIED LAND FROM HOLDING TO RESIDENTIAL, MOBILE HOME, AND PROVIDES FOR AN EFFECTIVE DATE. WHEREAS, application has been duly made to change the zoning classification as hereinstated, and WHEREAS, all public notices have been duly published accord- ing to law, and WHEREAS, public hearings have been held as required by Ordinance 402, and WHEREAS, after consideration of the requirements of Ordinance 402 and the land use plan of the City of Okeechobee and the public interest, it is deemed to be in the best interest of the City of Okeechobee to change the zoning classification of the land lying within the limits of the City of Okeechobee as hereinstated; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA. SECTION 1. That the following described real property is hereby rezoned from Holding to Residential, Mobile Home, to -wit: PARCEL 4: Commencing at the NW corner of the SW4 of Section 22, Township 37 South, Range 35 East, for the POINT OF BEGINNING, and bear S 0 °21'51" W along the West line of said Section 22 a distance of 162 feet; thence bear S 89 °42'56" E a distance of 1348.81 feet to the East line of the NW4 of SW4 of said Section 22; thence bear S 0 °20'27" W along the East line of the NW4 of SW).-4 of said Section 22 a distance of 442.55 feet more or less, to the top of a bank of Taylor Creek; thence bear N 17029'00" E along the top of said bank a distance of 641.21 feet, more or'less, to the North line of the SW,, of said Section 22; thence , bear S 890 59'14" W along the North line of SW4 of said Section 22 a distance of 1537.77 feet to the POINT OF BEGINNING. SECTION 2. That the application requesting this Amending. Ordinance, and proof of publication for any and all public hear- ings in connection herewith shall be attached to this Ordinance. SECTION 3. The City Clerk shall make the appropriate change on the city zoning map in accordance with this Ordinance. SECTION 4. This Ordinance shall become effective immediately upon final passage. CHARLES ALLEN ROBERTSON With the passage of the Ordinance Amendment, Charles Allen Robertson request- ed water and sewer hook -up for the expansion of the mobile home subdivision. Director Fortner noted the addition would be within the capacity of the sewer plant. However, there is the problem of being some distance from the sewer. The lines will have to be extended. It should be studied and determined what size main should be used. After discussion, Council postponed a decision on this matter until Director Fortner is able to research the cost to the City. LLOYD CHARTIER, PORT SALERNO REALTY Mr. Lloyd Chartier of Port Salerno Realty and Lyle Thornton of Arch W. Roberts' Company of St. Petersburg appeared before the Council to request water and sewer service for Block 71, City of Okeechobee. Mr. Thornton informed the Council his firm wishes to build twenty -one (21) townhouse rental units for the citizens of Okeechobee. The project will be funded by Farmers Home Association (F.H.A.). Mr. Thornton described in detail the plans for construction and noted that if by July, 1980, Federal funding has not been approved, he would return and drop the commitment for water and sewer so there would be no expense to the City. Attorney Conlon suggested Mr. Thornton deliver a site plan, in turn Conlon will draft an agreement with time limitations, capacity, etc., for Council approval. Council concurred. BRUCE KOEBE - MORMAN CHURCH LEASE Attorney Bruce Koebe appeared before the Council representing the Morman Church in regard to a ninety -nine (99) year lease of an alleyway. Mr. Hoel, also representing the Morman Church, elaborated on the plans and reasons for requesting a lease. The land is behind ours, and our land fronts on Highway 441. The land the owners wish to have rezoned is a little over a block from 441, on the water, in the heart of Okeechobee, and is among the finest and most sought after in the city. To use this choice property for a mobile home subdivision, would we feel, decrease the value of our property in front of it, In fact, if our family property was cleared, you could see the mobile homes from Highway 441. Our family has always said that when we sell our land on 441, it will be for buildings that enhance the beauty of Okeechobee. To put mobile homes behind us will seriously limit our ability to do this. We feel this choice waterfront property in the heart of Okee- c obee is worthy of more than mobile homes. It could be used as r'cre_ttional or commercial property, or single family residences, a 1 of which would be an asset to the city, but more mobile homes, NO1 Therefore, we would urge all involved to uphold the city ordinance requiring 15 acres for a mobile home development with no exceptions, and reject this request for rezoning.
