In the absence of Reverend Stewart, the invocation was offered by Council Member Watford; the Pledge of Allegiance was led by Mayor Kirk. In honor of Mrs. Martha Conely's 100`h Birthday, Mayor Kirk presented her with a proclamation encouraging all fellow residents, family and friends to pay her tribute and wished her health and happiness. MARCH 17, 2015 - REGULAR MEETING - PAGE 2 OF 9 COUNCIL ACTION - DISCUSSION - V "WHEREAS, Mrs. Martha Godard Conely was born on March 17, 1915, in Quincy, Florida, and is celebrating her 100th birthday this year; and WHEREAS, Mrs. Conely was one of three children born to Dr. Robert F. and Mrs. Susie Davis Godard; growing up she attended the Florida State Girls School where she developed a love of teaching; and WHEREAS, Mrs. Conely moved to Okeechobee in 1932, and married her loving husband, Thomas W. Conely, Jr., on June 19, 1938, where they spent 31 wonderful years together until Tom was called home to the Lord in 1969. They were blessed with three children: Thomas,111(Tom -Tom), Fain, and Martha Sue, and fortunate to have two grandchildren: Kim and Thomas, IV; and WHEREAS, Mrs. Cone ly began her teaching career with the Okeechobee County School System as the first Home Economics teacher. Mr. Conely, an attorney, served as Mayor of Okeechobee City from 1924 -1927, and as one of the longest sitting County Judges in the County's history, having served 25 years in that capacity; and WHEREAS, throughout her life she has devoted her time to taking care of her family and serving her Lord as a Sunday School teacher for 35 years at the First Baptist Church of Okeechobee, until her se birthday when she retired. She was a member of Chi Omega Sorority and enjoyed sewing, crocheting, knitting and crafts, and made some of the finest baked goods around; and WHEREAS, Mrs. Conely, has been a blessing to all she has come in contact with over the past 100 years and is joined by friends and family today to celebrate this exciting milestone in her life. NOW THEREFORE, 1, James E. Kirk, by virtue of the authority vested in me as Mayor of the City of Okeechobee, do hereby wish Mrs. Martha Conely a very happy 100th birthday and may she continue to share her love and joy with others. FURTHERMORE, 1 do hereby encourage all fellow residents, family and friends to pay tribute to Mrs. Conely on her 100"' birthday and wish her health and happiness in all her days to come." Mrs. Conely was accompanied by her son Tom and daughter -in -law Mae Conely, daughter Martha Sue, and son -in -law Jim Vensel. Her family thanked the Mayor and Council for this honor and tribute. CENTENNIAL UPDATE A. Monthly update from the Centennial Celebration Ad Hoc Committee Chair - J.D. Mixon (Exhibit 1). Motion and second by Council Members Watford and Chandler to approve the February 2015 Warrant Register in the amounts: General Fund, three hundred forty -three thousand, four hundred twenty -five dollars and fifty cents ($343,425.50); Public Facilities Improvement Fund, eighteen thousand, four hundred ninety -seven dollars and seventy - six cents ($18,497.76); Appropriations Grant Fund, one thousand, one hundred twenty -five dollars ($1,125.00); and Law Enforcement Special Fund, fifty dollars ($50.00). There was no discussion. VOTE KIRK - YEA RITTER - ABSENT CHANDLER - YEA WATFORD - YEA O'CONNOR - YEA MOTION CARRIED. Centennial Celebration Ad Hoc Committee (CCAHC) Chairperson, Mr. J.D. Mixon, presented the monthly update to the Council as outlined in Exhibit One: The CCAHC requested the City obtain quotes for photographers and/or videographers for the purpose of documenting all the Centennial events; two were received. Mr. Joe Allen, a local photographer of Allen's Photographs, was awarded the project, with the exclusion of the 'posed' photographs at the Gala. He is donating his service and only asking $100.00 to cover fuel costs for the year. The videographer position will be rebid since the only one received was not within the budgetary constraints. The CCAHC members and Clerk Gamiotea volunteered their time, participating at the following events: the Battle of Okeechobee Re- enactment, the County Fair, and the Speckled Perch Festival, which resulted in sales of sponsorships and all of the second order of Centennial Tumblers, (totaling 200 tumblers sold to date). A third order for 200 has been placed. The Historical Bus Tour tickets are also selling well, and can be obtained at the City Clerk's Office and /or the Chamber of Commerce. The April 11 tour has sold out, with the next available tours being: June 20, September 19, and October 17. It was noted that the only way to obtain the Commemorative Post Card Book is by purchasing a ticket for a bus tour or a sponsorship. The front walkway Capital Improvement Project to commemorate the Centennial is underway with the website in its final stages of development, and then the sales of the brickpavers may commence. There has not been any progress on the Centennial Park. The General Federation of Women's Club (GFWC) hosted their Centennial Movie in the Park featuring, Dr.Seuss' The Lorax ", on March 14. The next movie will be "Big Hero 6" on April 11, and due to daylight savings time, showtime will be at 8 P.M. The March of Dimes Walk is scheduled for March 28. Centennial Events are: the Mayors Centennial Gala is to be held April 18, with tickets only being available through the purchase of a sponsorship, at this time only 32 tickets are left. The catering and decorating for the event has been awarded to 1 -Stop Party Shop. The Street Talk Orchestra has been reserved, as well as the Silver Palms RV Resort. 368 VIII. CENTENNIAL UPDATE CONTINUED A. Monthly update from the Centennial Celebration Ad Hoc Committee continued. IX. OPEN PUBLIC HEARING - Mayor A. Motion to approve a Pre - annexation Agreement with OHCF Properties, LLC - City Attorney (Exhibit 2). MARCH 17, 2015 - REGULAR MEETING - PAGE 4 OF 9 The Centennial Birthday Bash, will be held June 13; the Centennial Heritage Festival, will be held October 10; the Tree Lighting Celebration and Centennial Time Capsule Ceremony, is to be held December 1. The Centennial Frolic Street Dance and Barbeque is to be held December 11. The CCAHC is partnering with existing events throughout 2015, some featuring Centennial Contests, others will be participation; April 4, Kiwanis Easter Pancake Breakfast; Participation at the July 4 FOR Okeechobee, Inc., Independence Day Celebration; Centennial Float in the September 5 -7 OKMS Labor Day Festival and Parade; Centennial Paddle Decorating Contest, October 3, at the Adam Bryant Minimal Regatta; and a Centennial Float in the December 12 OKMS Lighted Christmas Parade. The Centennial flag and banners are available for use at rodeos /parades and festivals. The Centennial banners on the light poles should be on display soon throughout downtown and the parks. No official action was necessary. The Council thanked the CCAHC for their tremendous undertaking with the Celebration. MAYOR KIRK OPENED THE PUBLIC HEARING AT 6:18 P.M. Motion and second by Council Members O'Connor and Watford to approve a Pre - annexation Agreement with OHCF Properties, LLC. The pre- annexation agreement addresses a voluntary annexation of two unplatted parcels within the unincorporated area of Okeechobee County, which are adjacent and contiguous to the limits of the City, for the expansion of the current nursing home /assisted living facility. The first parcel is identified as the "East Parcel," located east of and contiguous to the existing Okeechobee Health Care Facility and west of Taylor Creek. The second is identified as the "North Parcel," located to the northeast of the existing Health Care Facility, east of Raulerson Hospital, and west of Taylor Creek. The Council expressed the health care facility has been a great asset to the community and City, and thanked the owner for considering this annexation. The agreement spells out the procedures needed to Rezone, change the Future Land Use Classification, and obtain a Special Exception on the annexed parcels, as well as a Rezoning for a third parcel, within the City Limits and located to the west of the existing nursing home, to construct a parking lot for the facility. Approval of all items are required in order for the annexation to be completed. Mayor Kirk asked whether there were any questions or comments from the public. There were none. Motion and second by Council Members O'Connor and Watford to read by title only, and set May 19, 2015, as a final public hearing date for proposed Ordinance No. 1120, Voluntary Annexation Petition No. 10, Okeechobee Health Care Facility Expansion. The tentative time -line of the annexation procedure was reviewed, approval is predicated upon the following petitions and applications being adopted: On April 16, 2016, the Planning Board and Board of Adjustment will consider these items: Rezoning Petition No. 15- 001 -R, requesting to rezone a vacant unplatted 1.628 acre parcel of land from Commercial Professional Office (CPO) to Heavy Commercial (CHV), for the purpose of constructing a parking lot to service the existing and expansion health care /assisted living facility. Rezoning Petition No. 15- 002 -R, requesting to rezone the two vacant unplatted parcels being annexed, from Okeechobee County Zoning Neighborhood Commercial - Two (NC -2) and Agriculture (AG), to City CHV. Future Land Use Map Amendment Application No. 15- 001 -SSA, reclassifying the same two vacant unplatted parcels being annexed from Okeechobee County Urban Residential Mixed Use (URMU) to City Commercial (C). Special Exception Petition No. 15- 002 -SE, to allow an adult family care home and/or assisted living facility as defined in Florida Statute 429.02, and a nursing home within a CHV Zoning District, Reference Code Book Section 90- 283(21) and (22), for the two vacant unplatted parcels being annexed. 370 MARCH 17, 2015 - REGULAR MEETING - PAGE 6 OF 9 IX. Consider a request to authorize an independent parking study for the City of Okeechobee - Hoot Worley, Economic Council of Okeechobee (Exhibit 4). ITEM ADDED TO AGENDA: Motion to terminate the Florida Department of Transportation Contract No. AM859, Highway Lighting, Maintenance and Compensation Agreement - City Administrator (Exhibit 7). On May 5, 2015, the City Council will consider Application No. 15- 001 -SSA for final adoption at a Public Hearing, and first readings for Petitions No. 15 -001 -R and 15- 002 -R. On May 19, 2015, the City Council will consider Petitions No. 15- 001 -R, 15 -002 -R together with this proposed ordinance, for final adoption at a Public Hearing. Mayor Kirk asked whether there were any comments or questions from the public. There were none. VOTE KIRK - YEA CHANDLER - YEA O'CONNOR - YEA RITTER - ABSENT WATFORD - YEA MOTION CARRIED. MAYOR KIRK CLOSED THE PUBLIC HEARING AT 6:25 P.M. This item was withdrawn from the agenda with anticipation to be readdressed at the April 7, 2015 meeting. Council Member Watford moved to terminate FDOT Contract No. AM859, (Project No. 413552- 1- 78 -01), Highway Lighting, Maintenance and Compensation Agreement (as recommended by City Staff, effective June 30, 2016); seconded by Council Member O'Connor. Director Allen explained, FDOT requested the City and County consider opting out of their agreements, which will then allow FDOT to transfer responsibility for all maintenance of their street lights along US Highway 441 and State Road 70 to an approved maintenance contractor (129 street lights are within the City Limits). The Board of County Commissioners selected to relinquish their maintenance responsibilities at their February 12, 2015, meeting. The current agreement provides the City an annual compensation of $29,178.25 to maintain the street lights for FDOT. However, the costs the City incurs to maintain them is much more than the compensation. Costs incurred are an annual utility bill of approximately $71,249.00, plus costs for an electrician, equipment and the manpower of three to four Public Works employees and a Police Officer each time repairs or replacements are conducted. FDOT advised the City that the utility costs for the street lights would be included with the new maintenance contracts being bid out. Meaning the City would not have maintenance nor the utility bill for the street lights. This option seems too good to be true, but should the new contract contradict what they are proposing, then the underlying existing contract will prevail. VOTE KIRK - YEA CHANDLER - YEA O'CONNOR - YEA RITTER - ABSENT WATFORD - YEA MOTION CARRIED. MARCH 17, 2015 - REGULAR MEETING - PAGE 7 OF 9 371 X. NEW BUSINESS CONTINUED B. Okeechobee Utility Authority (OUA) Board Appointments - City Administrator (Exhibit 5). The City received two applications for consideration to fill the vacant position on the Okeechobee Utility Authority (OUA) Board of Directors. Additionally two current members, Mr. Nelson and Mr. Fadley, would like to be considered for reappointment, as both have conveyed their interest to remain on the board. There were 52 OUA meetings held between 2011 through 2014, Mr. Nelson attended 37, and Mr. Fadley attended 34. Council Member O'Connor moved to reappoint as the City's representatives to the OUA Board, Mr. Steve Nelson as the Regular Member, term ending March 1, 2019, and Mr. Jeff Fadley as the Alternate Member, term ending March 1, 2017; seconded by Council Member Watford. The Mayor and Council noted their appreciation for their willingness to serve. VOTE KIRK - YEA CHANDLER - YEA O'CONNOR - YEA RITTER - ABSENT WATFORD - YEA MOTION CARRIED. Addressing the vacant position, the two applicants for consideration are Mr. Clay and Mr. Munson. Council Member Chandler moved to appoint Mr. Tommy Clay as the City's representative to the OUA Board as a Regular Member, term ending March 1, 2017 (replacing Noel Chandler); on third call, the motion was seconded by Council Member O'Connor. Mayor and Council Members expressed the difficulty in this situation, as both applicants would be suitable. Council Member Watford noted he was unsettled with the circumstances surrounding Mr. Clay's resignation as the County's representative to the OUA Board, and subsequent application to be appointed by the City. Stating, he trusts there will not be any animosity on the Board due to this appointment. Council Member O'Connor asserted, his goal when selecting is to choose someone who will have the best interest of the City. Attorney Cook added that Council Member Ritter, although absent, requested the record to reflect his support for Mr. Clay's appointment. This is not, in any manner considered a vote. VOTE KIRK - YEA RITTER - ABSENT CHANDLER - YEA WATFORD - YEA O'CONNOR - YEA MOTION CARRIED. The Council wanted Mr. Munson to know they appreciated his interest and his application will be kept on file for future considerations, and express to Mr. Clay their gratitude for his willingness to serve. 372 X. NEW BUSINESS CONTINUED C. Consider approval of a Worker's Compensation Supplemental Payment 90 -day Extension for City Employee, Lt. Phil Conroy - Fire Chief Smith (Exhibit 6). D. Annual Evaluation for City Administrator Whitehall - Mayor. E. Annual Evaluation for City Attorney Cook - Mayor. MARCH 17, 2015 - REGULAR MEETING - PAGE 8 OF 9 Motion and second by Council Members O'Connor and Watford to approve a 90 -day extension of Workers' Compensation Supplemental Payment of 100 percent of salary for Fire Lieutenant Phil Conroy, first 90 days was from December 8, 2014 through March 8, 2015, the extension will be March 9, 2015, up to June 7, 2015, or until he is released to return to duty. The initial 90 calendar days was fulfilled on March 8, 2015. Should he return to full working capacity prior to June 7, 2015, the benefit will end. Lieutenant Conroy continues to recover from an on- the -job injury that took place on December 8, 2014. He obtained his Fire Inspector Certification and is cleared for light duty. The hours he is eligible to work will be used in combination with the supplemental time. VOTE KIRK - YEA RITTER - ABSENT CHANDLER - YEA WATFORD - YEA O'CONNOR - YEA MOTION CARRIED. Administrator Whitehall's employment services contract provides for an annual evaluation of his employment performance by the Mayor and Council. Mayor Kirk received the evaluations and calculated an average score of 4.78 out of 5.0. Council Member Ritter did not complete an evaluation and conveyed it would not be fair due to the short amount of time he has worked with Mr. Whitehall. Mayor Kirk thanked Administrator Whitehall for the service he provides to the City. Administrator Whitehall thanked the Council for their confidence in him. The evaluations were forwarded to the City Clerk for final processing and retention. The positive review allows eligibility for the Salary Step Increase on his anniversary date June 1, 2015, in addition to the 1.6 percent cost of living (COLA) increase approved for all employees, implemented October 1, 2014. As provided in Attorney Cook's employment services contract, each year the Mayor and Council Members complete an evaluation on his employment performance. Mayor Kirk received the evaluations and calculated an average score of 4.28 out of 5.0. Council Member Ritter did not complete an evaluation and conveyed it would not be fair due to the short amount of time he has worked with Mr. Cook. Mayor Kirk thanked Attorney Cook for the service he provides to the City. Attorney Cook thanked the Council for their confidence in him. The evaluations were forwarded to the City Clerk for final processing and retention. The positive review allows for the contract to renew for another year. The contract provides basic payment to be increased annually at the same percentage increase as general employee pay increases. During the Fiscal Year 2014 -15 budget adoption, the Council approved a 1.6 percent across the board COLA increase, therefore, Mr. Cook's annual compensation was increased the same, as of October 1, 2014. Conely, Jr., on June 19, 1938, where they spent 31 wonderful years together until Tom was called home to the Lord in 1969. They were blessed with three children: Thomas, III (Tom -Tom), Fain, and Martha Sue, an . fortunate to have two grandchildren: Kim and Thomas, IV; and WHEREAS, Mrs. Conely began her teaching career with the Okeechobee County School System as the first Home Economics teacher. Mr. Conely, an attorney, served as Mayor of Okeechobee City from 1924 -1927, and as one of the longest sitting County Judges in the County's history, having served 25 years in that capacity; and WHEREAS, throughout her life she has devoted her time to taking care of her family and serving her Lord as a Sunday School teacher for 35 years at the First Baptist Church of Okeechobee, until her 90th birthday when she retired. She was a member of Chi Omega Sorority and enjoyed sewing, crocheting, knitting and crafts, and made some of the finest baked goods around; and WHEREAS, Mrs. Conely, has been a blessing to all she has come in contact with over the past 100 years and is joined by friends and family today to celebrate this exciting milestone in her life. NOW THEREFORE, I, James E. Kirk, by virtue of the authority vested in me as Mayor of the City of Okeechobee, do hereby wish Mrs. Martha Conely a very happy 100th birthday and may she continue to share her love and joy with others. WITNESSETH: WHEREAS, OWNER owns two adjacent parcels of real property which are located to the east and to the north of the CITY limits, identified as the "East Parcel," and the "North Parcel" (collectively the "PROPERTY"), legally described on Exhibit A attached hereto and incorporated herein; and WHEREAS, the East and North Parcels are within the unincorporated area of Okeechobee County, Florida ( "COUNTY "), but adjacent and contiguous to the limits of the CITY. OWNER has notified the CITY of its intention to develop the East Parcel for the expansion of the existing nursing home /assisted living facility located on the adjacent parcel to the west owned by Lifestyles & Healthcare, Ltd., (the "Health Care Facility Parcel "); and WHEREAS, the East and North Parcels have a COUNTY Future Land Use designation of Urban Residential Mixed Use, the East Parcel has a COUNTY Zoning of Neighborhood Commercial -2 (NC -2), and the North Parcel has a COUNTY Zoning of Agricultural (AG); and WHEREAS, OWNER has filed a Petition for Voluntary Annexation with the CITY to annex the PROPERTY, and the CITY desires to annex the PROPERTY into its municipal boundaries and will promptly initiate the process required by law to enact an ordinance adopting a Petition for Voluntary Annexation of the PROPERTY into the CITY, pursuant to Section 171.044(2), Florida Statutes ( "ANNEXATION "); and WHEREAS, the PROPERTY proposed to be annexed adjoins properties to the west located within the municipal boundaries of the CITY, one being the Health Care Facility Parcel, with the attached parking lot, owned by Seniors "R" Able, Inc. (the "Parking Lot Parcel "); which ownership interests are intertwined with the ownership interests of OWNER; and; Page 1 of 7 Okeechobee County, Florida, more particularly described in "Exhibit A," attached hereto and made a part hereof by reference; together with approximately 2.960± acres and described as the "North Parcel," being located east of State Road 15 (US Highway 441 North), west of Taylor Creek and being in Section 10, Township 37 South, Range 35 East, Okeechobee County, Florida, more particularly described in "Exhibit A," attached hereto and made a part hereof by reference, to be annexed, and agree to support and cooperate with CITY'S efforts to annex the PROPERTY into the CITY in accordance with the provisions hereof and subject hereto. 3. The CITY, despite the representations herein, must proceed with public hearings and approval of ordinances to complete the annexation, and nothing in this agreement shall be construed by OWNER, its successors or assigns, to constitute a binding agreement, vested interest or contract by the CITY to approve requested annexation, Future Land Use classification, Rezoning, and Special Exception. By the same token, OWNER shall not be bound by actions of the CITY pertaining to the land use, rezoning, special exception, and Technical Review process, if final approval by the CITY to annex the PROPERTY does not take place on May 19, 2015, in which event this AGREEMENT shall have no force and effect and the ANNEXATION shall not occur. The parties agree the Annexation is expressly contingent upon the concurrent approval of the requested Future Land Use, Rezoning and Special Exception applications. Excepted from this provision is the re- zoning of the Parking Lot Parcel (Parcel Identification No. 2- 09- 37- 35 -0A00- 00010- A000), of Seniors "R" Able, Inc., which the CITY is pursuing and which will be required to be completed regardless of any provision to the contrary herein. 4. The CITY agrees that the use of the PROPERTY for nursing home /assisted living facility, is an appropriate use of the PROPERTY, in that the Health Care Facility Parcel, adjacent to and contiguous with the East Parcel and presently within the limits of the CITY, is zoned Heavy Commercial (CHV) and designated as Commercial on the Future Land Use Map. The East Parcel, upon which additional commercial construction and use is contemplated, is presently within unincorporated COUNTY, and is zoned Neighborhood Commercial -2 (NC -2) on the COUNTY Zoning Map and Urban Residential Mixed Use on the COUNTY Future Land Use Map. Further, although the North Parcel is also to be annexed, which is zoned Agricultural (AG) on the COUNTY Zoning Map and Urban Residential Mixed Use on the COUNTY Future Land Use Map, no improvements are planned at this point in time, and this parcel, once annexed, will also be designated with the same commercial land use and zoning classification as the East Parcel. CITY acknowledges that OWNER is relying upon CITY'S representations as to its authority to enter into and perform its obligations under this AGREEMENT, and that the CITY has complied with all procedural and substantive conditions precedent to doing so. 12. The invalidity of any provision hereof shall in no way affect or invalidate the remainder of this AGREEMENT. 13. This AGREEMENT may be executed in one or more counterparts, each of which shall be deemed an original, but all of which shall together constitute one and the same instrument. 14. This AGREEMENT shall constitute a Petition for ANNEXATION into the CITY subject to the terms and conditions of this AGREEMENT. A study would determine the supply and demand of parking within the City, using current occupancy levels and existing land uses, as well as outline strategies to prepare the City for future development needs. Data collection is an important part of the study and would include an inventory of parking spaces, occupancy and turnover. Existing land use type, intensity and usage for the area would be recorded and underutilized areas would be identified. It is important that community outreach is included through stakeholder interviews and a community workshop. Specific recommendations would then be developed to focus on shared parking opportunities, possible reductions in parking requirements, and policies that support growth and development in keeping with our community's vision. A study of this sort is estimated to cost in the range of $25,000 to $35,000, an expense that is a worthy investment for our current and future businesses to ensure the best possible plan is put into action. Re: 90 Day extension request for fire department employee in relation to workers compensation benefits This request is in reference to a fire department employee who was injured (back) while working on the scene of a motor vehicle accident. The Firefighter is approaching the conclusion of the initial 90 days provided by the City for the supplemental compensation to the workers compensation benefits. The firefighter is improving and is enthusiastic to return to employment but the doctors have indicated that he cannot return to full firefighting duties at this time. The firefighter obtained his Fire Inspector Certification recently and will be returning to the fire department to assist in that capacity in order to meet the restrictions /limitations imposed upon him by the phycians. The employee will be utilized in a part-time (as needed) basis at this time to assist with meeting his work hours alongside with the supplemental workers compensation. The Department Head requests approval to continue the supplemental benefit supplied by the City of Okeechobee in order for the firefighter to receive full pay as provided for in the Personnel Code of the City. Respectfully, Herb Smith Fire Chief JOB CONNECTED INJURY BENEFITS The City provides Worker's Compensation Insurance benefits to any employee injured as a result of job duties_ The City will secure immediate medical attention for an injured employee and furnish competent medical services. The insurance plan provides for complete payment for medical services, hospital charges and related therapy or.treat -meat. The City will pay the employee's regular weekly salary less applicable deductions the first seven (7) days an employee has been temporarily disabled. Worker's Comp - ensation will pay benefits for periods exceeding seven (7) days. The employee will receive the difference between what the Worker's Compensation benefit pays and his/her normal salary equaling one hundred percent (100 %) of his/her normal salary if the injury is attributable to the employee's occupation in the City and is considered as such under the Workers' Compensation Statute of the State of Florida and its rules and regulations. This difference in workers compensation benefits and normal salary shall be provided up to ninety (90) days from the date of injury. Extensions beyond 90 days may be made by the City Council, in increments up to ninety (90) days. The employee will reimburse the City if the amount paid exceeds one hundred percent (100 %) of normal salary. This may be accomplished by the employee making a cash payment to the City. Specific details can be provided by the Finance Department. An employee who is injured as a result of job duties and is classified permanently totally disabled by Worker's Compensation will be entitled to leave with full pay, commencing from the date that the employee is so classified by the State, which will be reduced by the benefits paid to the employee by the insurance carrier for a maximum of ninety (90) calendar days. The paid disability leave must be recommended by the employee's Depart-ment Head and authorized by the City Council. An employee who remains permanently totally disabled after the allowed maximum disability leave may elect to receive weekly payments charged first to accrued sick leave then to accrued annual leave account. These amounts will be reduced by the disability benefits paid to the employee by the insurance carrier, or an employee classified as permanently totally disabled may elect to immediately cash out any accrued sick leave or annual leave. Steve Nelson and Jeff Fadley terms expired 3/1/15 (I was under the impression it was 3/31/15). This matter was inevitably taken care of by Atty Conely when he rendered the opinion that the two will continue to serve in a `de jure' status until the City's 3/17/15 meeting w/ all the voting rights, etc 2. OUA member John Creasman has been given an opinion from Atty Conely that he may not serve on both the City Planning Board and the OUA Board. With the resignation of Noel Chandler the City is saddled w/ designating a replacement. Until the County decided to place John Creasman as a voting member and relegate Tommy Clay to an alternate position, the City had one applicant, Dr. John Munson, 1410 SE 21st St. However, immediately upon learning that he was relegated to an alt position, Mr. Clay resigned the County appointment and submitted a new application to the City to be considered as a regular voting member, giving the council two applications of which to choose from. Background: Currently, the City has a State Highway Lighting Maintenance and Compensation Agreement with FDOT for the ongoing maintenance of street lights within the city that are located on FDOT ROW. The current agreement was executed on July 1, 2014. Each year FDOT and the City execute a work order that compensates the City on a per street light basis. For the fiscal year 14/15 the amount of compensation is $29,178.25 based on 129 lights at a rate of $251.23 at a reimbursement rate of 90 %. This is adjusted annually by the CPI. FDOT is giving the City as well as the County the option to have FDOT take back the maintenance and responsibility for the street lights. If the City chooses to relinquish the responsibility, FDOT will include the maintenance of the lights in the maintenance contract which is being bid by FDOT for other on -going maintenance activities in the area. FDOT has expressed a preference to have a constant response from the City and County, i.e. either the City and County relinquish responsibility to FDOT or both retain the responsibility but that is not a requirement. The County has selected to relinquish maintenance responsibilities of the street lights in the county to FDOT at their February 12`h meeting. Relinquishing the light to FDOT will have a net positive impact on the City. As stated previously, the City currently receives $29,907 annually for the maintenance of the lights. Review of the Florida Power and Light utility bills for the lights in question shows that the City pays approximately $71,249 in energy costs for the calendar year of 2014. In addition to the energy costs, the City incurs ongoing maintenance costs which vary from year to year. Examples of the tasks include bulb replacement, replacement of poles damaged due to accidents. Most of the maintenance tasks performed require utilization of an outside contractor to supply an electrician and lift truck with the capacity to reach the lights as well as 3 -4 Public Works employees and typically a city Police Officer to perform Maintenance of Traffic (MOT) duties. The current hourly rate that the city pays for the services of a bucket truck and electrician is $118.55 per hour. Given the internal and external equipment and labor costs as well as materials, a typical Tight bulb replacement would cost from $75.00 for a simple bulb change to over $600.00 if the entire light head requires replacement. Replacement costs for a light pole struck by a vehicle is typically approximately $4,000 for materials and labor. Costs associated with replacement of a pole damaged by an accident are typically but not always recovered through insurance. From time to time additional repairs are needed. For example the city recently needed to repair the wiring across SR70 for the lights on US 441 at a cost of $3,275. The energy and maintenance costs associated with the lights in question far exceed the reimbursement received from FDOT. Additionally, review of the performance measures for the maintenance contract shows that the level of service will not be negatively impacted by the switch and potentially will be improved. Under the proposed contract, the contractor will face penalties for the following conditions are not met: • If the contactor does not respond to an emergency sight within one hour of initial notification • If any component of the lighting system is found to be damaged, not secure, or missing • If lighting outage for the contract service area exceeds 10% • If damaged poles are not replaced within five (5) works days, seven (7) if a new foundation is required • If damaged poles that require immediate action to protect public safety of the traveling public are not removed within one hour Given the associated cost reduction along with either maintaining or improving the level of service provided, it is my recommendation that the City accepts the opportunity to opt out of the current Street Light Maintenance Agreement. (REV 12 -4 -14) (1 -15) The following is a new Section added at the end of Section 715: 715 -50 -1 Description. The highway lighting system consists of overhead, underdeck, and sign lighting. Maintain the highway lighting system with a minimum of 90% of highway lighting (including Overhead, Underdeck and Sign Lighting) operational. 715 -50 -2 Requirements. 715- 50 -2.1 General: Supply a Journeyman Electrician to supervise all electrical work covered under this contract. Comply with all local licensing requirements and ordinances governing performance of the work. Perform all work in accordance with the laws of the State, all municipal ordinances, all regulations and requirements of the Public Service Commission, the National Electrical Code, the National Electrical Safety Code, the current edition of the Manual of Uniform Traffic Control Devices, the Florida Department of Transportation Design Standards for Design, Construction, Maintenance and Utility Operations on the State Highway System cunent at the time of the contract letting, and Department Standard Specifications. Employees will be familiar with and apply all appropriate safety practices during the life of this Contract. Training in the application of "Occupational Safety and Health Standards" (reference 29 of the Code of Federal Regulations, Part 1910.333) relating to "lockout and tagging" procedures will be MANDATORY for all persons employed on this Contract. Materials may be temporarily stored on the right -of -way outside of the clear recovery zone (excluding medians) for a period not to exceed twenty -four - hours, if approved by the Engineer. 715- 50 -2.4 Emergency Work: Be responsible at all times, including after normal work hours and weekends, for the immediate removal of downed poles or mast arms impeding traffic or threatening the public. When a vehicular crash causes damage to any Department Lighting Facility, the Department authorizes the Contractor to pursue claims against the responsible party for reimbursement of expenses incurred. Repair the electrical system in a way that prevents electrical shock to the public, the Department's and Contractor's work force. Secure or replace any inspection plate, access panel cover or pull box cover that is not properly secured in place, damaged or missing. Provide an Emergency Supervisor per Standard Specification 5 -8.3 which will be required to respond, by telephone within fifteen (15) minutes of being called or paged, have qualified personnel report to the emergency work site location(s) and to report to emergency work site location(s) within one hour after being notified and take immediate action to protect the safety of the traveling public. 715- 50 -2.6 Theft of Materials: Be aware that vandalism and burglaries do occur and desirable materials targeted by thieves do exist within the limits of this contract. Be responsible for all repairs related to theft/vandalism. Employ methods to guard against theft of equipment and department materials. Strongly consider installing anti -theft devices to discourage theft. The Department authorizes the contractor to pursue third -party recovery of costs due to theft or vandalism repairs. The Contractor is economically responsible for up to a cumulative 15% of the annual contract amount (reset each year on the contract anniversary date) for non - recovered theft/vandalism impact; beyond that, the Department will compensate the Contractor for non - recovered costs due to theft/vandalism. 715 -50 -3 Performance Measures. The Department may perform highway lighting system inspections (Review of five percent of the lighting, and a minimum of ten). The following performance measures will be used in determining the reduction to each monthly invoice. If, in any Department inspection, the performance measures are not met. If the overhead, underdeck or sign lighting outage (individually or combined) exceeds ten percent (10 %). Reduction of $2,500.00 each occurrence Failure to comply with any requirements outlined in Section 715- 50 -2.1 Reduction of $1000.00 per occurrence If any component of the lighting system is found to be damaged, not secured, or missing Reduction of $250.00, each occurrence If it is determined that the Contractor does not respond to an emergency site within one hour of initial notification.
