1976-11-18 Recessed RECESSED MEETING THURSDAY, NOVEMBER 18, 1976 The City Council of the City of Okeechobee, Florida, convened in recessed session in the CoUncil Chambers at the City Hall, 0keechobee, Florida, on Thursday, November 18, 1976 at 7:00 P.M. President Russell V. Domer presiding. Councilmen E. H. Hunt, Edward W. Douglas and Clif Betts, Jr. were Present. Councilman Lavon Bass was absent. Others present were: Sandra Bennett, City Clerk; David Conlon, City Attorney; L.C. Fortner, Jr., Director of Public Works; Donald M. Shepherd, Engineer and Mr. Charles Royal of Royals, Inc. ROYAL ' S SHOPPING CENTER - UTILITY EASEMENT Donald M. Shepherd, Engineer explained to Mr. Charles Royal that the City needs a 10 foot utility easement adjacent to the south right of way of Highway 710 crossing the shopping center property to be able to provide sewer service to Kelly's and Ward's Trailer Parks. Mr. Charles Royal questioned if the City would consider accepting the water line at the shopping center in exchange of a utility easement. He stated that in the event a water line broke he would agree to repair the pavement. Following considerable discussion, Councilman Betts moved that the billing for the shops at the shopping center will be on the 18 exising meters connected to individual shops and there won't be any billing to Mr. Royal for a difference between the accumulated total of those meters and the master reading. In exchange for this the City agrees that to accept Mr. Royal's offer for a utility easement for sewer line and accepts a dedication of the water line and the maintence thereon upon the condition that Royals will be responsible for repairing any pavement that is disturbed due to repairs or maintence of the system that is accepted. Council- man seconded the motion which was passed unanimously. POLICE CHIEF President Domer reported that it was time for the City Council to re-hire the present Chief of Police and questioned if the Council desired to give the Chief a uniform allowance as the Patrolmen and Dispatchers are receiving. Councilman Betts moved to re-appoint Edward Chisholm as Chief of Police for two years commencing January 1, 1977 and authorized a $50.00 per month uniform allowance retroactive October 1, 1976. Councilman Douglas seconded the motion which was passed unanimously. DISABILITY INSURANCE The City Clerk reported that Bankers Life Disability Insurance had informed the City that , there would be a rate increase of approximately $30.00 per month effective December 1976. --~ Councilman Douglas moved to approve the rate increase. Counci]r~n Betts seconded the motion and vote carried. CAPITAL DEVELOPMENT AND INVESTMENT ACT - PUBLIC WORKS ACT President Domer read a letter from Donald M. Shepherd regarding the Public Works - Capital Development and Investment Act of 1976 informing the City that 0keechobee City would be eligible for funds as in regards to their water plant expansion or any other needed municipal improvements and since the allocation of funds by the Federal Government are apparently grants available to those who stand most ready to proceed immediately, the City may well consider the applications for such funds as may be available to supplement the water works improvement program now under contract. Following discussion, Councilman Douglas moved to authorize Donald Shepherd , Engineer -I I" I i ii: . to make application for the grant through the Capital Development and Investment Act. Countil- man Betts seconded the motion which was passed unanimously. CAPITAL DEVELOPMENT AND INVESTMENT ACT - PUBLIC WORKS ACT - POLICE STATION President Domer read a letter from Donald M. Shepherd, Engineer regarding the extimated cost of a propos~ed Police Department building for applying for a grant through the Capital Development and Investment Act. ~ Following discussion, Councilman moved to approve authorization for Mr. Shepherd to submit an estimate and clarification of the application for a grant to build a Police Station. LOCAL GOVEP4~MENT COMPREHENSIVE PLANNING ACT President Domer read a letter from Ernest R. Bartley, Planning Consultant, requesting his first billing in the amount of $579.64 and requesting the Council to set up some workshops with the Council in the very near vuture to go over the zoning ordinance. Councilman Betts suggested the meetings be set up after the December 7, 1976 election ~ to allow the two new councilmen to sit in on the meetings. · It was moved by Councilman Betts, seconded by Councilman Douglas and vote carried to authorize the payment of $579.64 to Mr. Bartley and requested the Clerk to notify him of their decision to wait until after the election to set up the workshop meetings. President Russell V. Domer presiding. Councilmen E. H. Hunt, Edward W. Douglas, Lavon Bass and Clif Betts, Jr. were present. Others present were: Sandra Bennett, City Clerk; David Conlon, City Attorney; L. C. Fortner, Director of Public Works; Edward Chisholm,Chief of Police; Olen Godwin, Fire Chief and Richard B. Spray, Building Official. The invocation was offered by Councilman E. H. Hunt. PUBLIC HEAR!. NG OKEAIRCO CABLEVISION REQUEST FOR RATE INCREASE Pursuant to a public notice published November 23, 1976, the meeting was opened as a public hearing to consider the request of 0keAirCo Cablevision for a rateincrease for the following: a.) $15.00 installation fee through th~ first year of operation. b.) $25.00 installation fee may be charged for all installations or hook-ups after the first year of operation. c.) No installation fee before or during installation of the system. d.) Single family units - $85.25 per year for a one service outlet to be paind in advance. The customer may elect to pay the yearly fee at $7.75 per month, hence paying a total fee of $93.00. The difference of $7.75 per year represents additional costs of book- keeping and billing.
