Council Member O'Connor asked for clarification of Section Three, relating to uses of a Private club or night club, and whether adult entertainment would be considered under this definition. Attorney Cook answered, an adult entertainment club is restricted to only be permitted within the Industrial Zoning District and requires a Special Exception. MAYOR KIRK CLOSED THE PUBLIC HEARING AT 6:10 P.M. 362 VII. CENTENNIAL UPDATE A. Monthly update from the Centennial Celebration Ad Hoc Committee Chair - J.D. Mixon (Exhibit 1). FEBRUARY 17, 2015 - REGULAR MEETING - PAGE 4 OF 6 UN_ iCUSSION Centennial Celebration Ad Hoc Committee (CCAHC) Chairperson, Mr. J.D. Mixon, presented the monthly update to the Council as outlined in Exhibit One: the Scavenger Hunt Contest continues with great enthusiasm by the 42 registered teams, and will run through June 4, the winning team will be announced at the Birthday Bash with each team member receiving $100.00. The Tervis Tumblers are a success with 82 of the first 100 sold, the second order of 100 has been placed which was approved at the February 9, CCAHC meeting. The historical bus tour is doing well as the second tour, April 11, has already sold out, the next tours available are June 20, September 19 and October 17. The front walkway Capital Improvement Project to commemorate the Centennial is at a standstill until a rendering of the pathway design is produced, there has not been any progress on the Centennial Park. Organizations that have partnered with the Centennial for cross advertising and support: The newest organization is the Okeechobee High School Band. They are incorporating a Centennial theme within their 2015 marching show entitled "1915 Our Town Remembered." The idea will feature what built this community, focusing only on 1915, using "period" music from composer Aaron Copland plus original works, and scenery of oversized photographs depicting local areas and buildings. It will showcase our town to areas throughout Florida at band marching competitions. The Guard flags will feature cattle brands from local ranches and farms. They also obtained permission to use the Centennial logo for a t- shirt/hat fundraiser to purchase band uniforms. The General Federation of Women's Club (GFWC), is hosting a Centennial Movie in Park 4, on the second Saturday of each month. They hosted their first one this past Saturday with approximately 25 -30 people in attendance. There will be a Centennial booth at the Battle of Okeechobee Re- enactment, February 28 to March 1. The March of Dimes Walk, March 28, Administrator Whitehall has been asked to spearhead the formation of a City Team. The Okeechobee Retired Educators Association is selling commemorative Centennial Christmas Ornaments for $15.00 each, featuring the City Seal. The Tantie - Quilters will be selling raffle tickets for a Centennial Quilt. Centennial Events are: the Mayors Centennial Gala is to be held April 18, with tickets being only available through the purchase of a sponsorship at this time,13 Pioneer and 14 Settler sponsorships have been sold. The catering and decorating for the event has been awarded to 1 -Stop Party Shop. The 'Street Talk Band' has been reserved, as well as the Silver Palms RV Resort. The Centennial Birthday Bash, will be held June 13; the Centennial Heritage Festival, will be held October 10; the Okeechobee Community Theater will perform a Special Okeechobee play in coordination with the Heritage Festival; the Tree Lighting Celebration and Centennial Time Capsule Ceremony, is to be held December 1. The Centennial Frolic Street Dance and Barbeque is to be held December 11, at the area around the historic Okeechobee County Courthouse, the main entrance, the streets between the courthouse and the Methodist Church, anticipating to celebrate 100 years of music, starting with an old fashioned square dance, and progressing through the evening with more modern music, and ending with contemporary music. 1 1 VII. CENTENNIAL UPDATE CONTINUED A. Monthly update from the Centennial Celebration Ad Hoc Committee Chair continued. FEBRUARY 17, 2015 - REGULAR MEETING - PAGE 5 OF 6 363 Centennial Events continued: They are seeking local musicians and singers to volunteer to perform music from various eras, and help lead dances from the different eras. Participants will be encouraged to come in their choice of period dress such as pioneer days, the roaring 20's, WWII, 1950's, 1970's, etc., and Centennial Historic Prints Art Display will be featured in the gallery area inside the Historic Courthouse. The CCAHC had requested the City to obtain quotes for photographers and /or videographers for the purpose of documenting all the Centennial events, in which two were received. One was an out of town company, and the other local. Consideration of awarding the project is slated for the February 23, CCAHC meeting. Administrator Whitehall added that he will invite the local photographer to the meeting to present a portfolio. For Informational Purposes: The CCAHC is also partnering with existing events throughout 2015, some featuring Centennial Contests, others will be participation. Not all are listed as many events still need CCAHC coordinators: Centennial Team in the February 21, FOR Okeechobee, Inc., 5K Ribbon Run; Centennial Float in the March 14 -15 Okeechobee Main Street (OKMS) Speckled Perch Festival & Rodeo, (Clerk Gamiotea is working with Firefighter Rodriguez to get volunteers and build a float); April 4, Kiwanis Easter Pancake Breakfast; Participation at the July 4 FOR Okeechobee, Inc., Independence Day Celebration; Centennial Float in the September 5 -7 OKMS Labor Day Festival & Parade; Centennial Paddle Decorating Contest, October 3, at the Adam Bryant Minimal Regatta; and a Centennial Float in the December 12 OKMS Lighted Christmas Parade. Reminders and Other Information from City Departments: the Centennial Flag is available for use at rodeos and parades. Public Works Director Allen has purchased Centennial Decals for vehicles. Centennial Stickers have been ordered by Administration. Police Officers are sporting their new Centennial badges. The Centennial banners should be on display soon throughout downtown and the parks. Council Member Watford suggested the Palm Beach Post be notified of events /activities as they have on Wednesday's, a Community Section featuring Historical write -ups. The direct contact information will be forwarded to the City Clerk's Office. Council Member Watford also asked whether the Florida League of Cities has been contacted for exposure in their Quality Cities publication. Administrator Whitehall has contacted them, and it is evolving. No official action was necessary. The Council thanked the CCAHC for their tremendous undertaking with the Celebration. 364 IX. Residents typically stay for one to six months. Auction house (indoor) means an establishment where objects of art, furniture. and other goods are offered for sale to persons who bid on the object in competition with each other. This definition does not include outdoor or open -air auctions where vehicles. farm and construction equipment and the like are auctioned. Convenience store means a retail establishment offering for sale prepackaged food products, beverages. household items. newspapers and magazines, sandwiches and other freshly prepared foods for consumption off the premises. Convenience store with fuel pumps means a convenience store providing motor vehicle fules, and which may also stock within the principal structure and offer for sale prepackaged motor oil and other small prepackaged automotive - related accessories. Group home means a building designed or used as permanent or temporary living quarters for six or more unrelated persons in which individual cooking facilities are not provided. Included in such designation, but not limited to, are such facilities as residential facilities and comprehensive transitional education programs under F.S. ch. 393; domestic violence centers under F.S. ch. 415; community residential homes in excess of six persons under F.S. ch. 419; and such similar facilities as authorized by law, and for which licensing is first required by law, and for which licensing is first required by the state department of children and families and /or the agency for health care administration, or other state or federal agency. This definition specifically excludes alcohol and drug rehabilitation /detox centers, and recovery centers /sober homes. Motel means an establishment containing sleeping accommodations for transient guests, which has individual entrances from the outside to serve each room, generally with no provisions made for cooking in individual rooms, and which may have a restaurant and indoor recreation as accessory uses. Recovery centers /sober homes are not motels. Pet grooming means an establishment providing for the hygienic care and cleaning of a domestic pet, usually dogs. cats, and sometimes birds, and includes the preparation or enhancement of a pet's physical appearance for "showing" or other tvpes of competition. Recovery center /sober home means a facility, used by addicts recovering from substance abuse, which serves as an interim environment between rehabilitation and a return to their former lives. These facilities provide a safe and supportive place in which people can live while they are in recovery and are primarily meant to provide housing for people who have just come out of rehabilitation (or recovery centers) and need a place to live that is structured and supporting for those in recovery. A recovery center /sober home is not a group home because it is not licensed by a state or federal agency. Taxidermist means an establishment wherein the act of reproducing a life -like three - dimensional representation of an animal for permanent display is undertaken. In some cases. the actual skin (including the fur, feathers or scales) of the specimen is preserved and mounted over an artificial body. In other cases, the specimen is reproduced completely with man -made materials." Temporary portable storage containermeans a self - contained storage unit designed to be delivered to a site by a separate vehicle where it is removed from the vehicle and left at the site. Once on the site, it is used as temporary, short-term storage shelter. It may also be loaded with material and then transported by separate vehicle to an off -site storage location for longer periods of time." Use, temporary means an outdoor use or activity which is permitted only for a limited time such as promotional events, tent sales. charity events, craft or art fairs, car shows, or other similar uses. The School District (Nov '14) and the County (Dec '14) adopted ordinances that terminated the impact fee process. Again, we will present something official prior to June 30th. • Parking lot downtown —As part of the Dunkin Donut discussion we mentioned the downtown pkg issue. As soon as I get time, I'II start Investigating the acquisition of properties. • FDOT Signal Maint Agreement — We are analyzing the Agreement and will forward to the Council thereafter. I expect they will prepare a new Agreement anyway after each community in the State adds their influence, which is what happened the last time they did this. The City approved the annual Agreement in June 2014. In Oct, we passed a modified Agreement that described the State's and the City's responsibilities more thoroughly...we felt it was not too intrusive. In Aug we rec'd $9000 in reimbursement. For comparative purposes, for example, we rec'd — 2007 - $7200, 2011 - $8300. • Nursing home expansion — While we do not have a formal application it's expected that the nursing home will be annexing property to the east and installing a new parking area in front, along 441 N. It will require some rezoning and special exception work. • FEMA flood map. As you are aware, FEMA has been in the process of developing a new Flood Plain map and along with that, they will expect each local government to adopt new regulations that coincide w/ federal guidelines. Without the city's compliance, the Nat'l Flood Insurance Program will not be available to those in the flood zone. I have a sample ordinance (online) but am relying on the county (considerably more educated on the matter) to prepare the doc and thereafter we will use it. FEMA indicated that the Flood Insurance Rate Map (FIRM) will be sent soon. The City needs to have the ordinance in place by July 16, 2015 and prior to adoption FEMA will have to approve the document assuring that it meets their minimum requirement. FDOT for grant - $96,492.71. • GRANT APPROVED - Canals - Legislative Grant $100k - Agreement w/ DEP — Executed the Grant Agreement for the water conveyance project. The gratn expires Nov5th. The City requested $450k but was only funded to the $100k. For the 2015 legislative requests, the City again requested $450k. • GRANT — Canals — SFWMD grant — On 11/18/14 submitted a grant ( "cooperative funding Program CFP ") application for additional funding ($185k) to assist the City in completing the canal cleaning project. The Part 1 applications /projects will be presented to our Governing Board to determine which projects should be further considered for FY2016 cost - sharing in Part 2. Applicants reaching Part 2 will be requested via a second application to submit detailed project information, timelines, funding commitments and benefit quantifications. Prior hereto I reported that they expected a Feb 12 evaluation, but that has been delayed to some extent. • GRANT APPROVED $57,750 - Small County Outreach Program (SCOP) program street reparation (& storm sewer) at SW 2nd Av & 8th St — FDOT has only advised that the funding agreement will be forthcoming and not to incur additional costs as they won't be reimbursable. The Engineering Agreement with Culpepper & Terpening was executed as per last meeting. • GRANTS - Taylor Creek Park/Centennial Park grant applications — FWC — submitted two grant applications, in mid Nov, to the Fish & Wildlife Commission (long and short forms) for infrastructure improvements at the proposed park. Mentioned that we had met w/ FWC officials at the park last Nov. I spoke to Steve Gornak, FWC Habitat Conservation, a few weeks ago he indicated the apps are in review, which will take `til the end of February. It's my understanding that they have completed their conversion to natural gas...at least they were able to produce `hot mix' for us to use. • GRANTS - Taylor Creek Park/Centennial Park grant applications — FL DEP — As reported prior hereto the City rec'd rejection letters from the FL DEP for both the TMDL (total max daily load) and Sect'n 319 grants. I rec'd a completed draft that we anticipate submitting. The new application info was prepared after a conf call w/ Connie Becker, DEP. Unfortunately, with the initial failure of the TMDL grant and the Sect'n 319 grant, I'm a bit disillusioned about the timeliness of the Taylor Creek/Centennial Park development...these two grants were to be used for that purpose. The new TMDL grant funding, if approved, will have a timeline of something like this: 2015 summer — award notification 2015 Sept — EPA approval of plans 2016 early - City advertise /award 2016 July — construction commence 2016 Dec, 2017 Jan — figure 6 months to complete construction Of course the timetable can be expedited here 'n there, but that is what Stef has on the application. I'm going to have to conference w/ Stef Matthes, Culpepper & Terpening and figure out what is the most cost effective way to at least start the park, without duplicating what would be grant eligible expenses. I know the Centennial committee wants to 'dedicate' the park as some point this year, so I need to coordinate some construction immediately thereafter. Councilman O'Connor has always led the interest in the park and solicited donations for improvements. Those solicitors are anxious to get it going too. The City established a Committee to move the park along and that group, along with the city council approved various amenities back in 2012. The City had designated 'assigned' dollars ($300k) to the park and then for the last two years we used the assigned number as matching monies for two grants. This f/y we moved the funds over to the budget (vs assigned) in hopes of expending. Now we are looking at rebudgeting for next fiscal year. Not to editorialize too much, but I'm starting to get the feeling that chasing grant funding just isn't folding into the park plans very well. Background: On June 27th Culpepper & Terpening sent an application to DEP for a second grant, TMDL Water Quality Grant App for $367, 260 of which requires a 50% match ($183,630). As you might recall, we applied for a Section 319 in May. That grant calls for a $367k grant and a $147,052 (40 %) match. North Park Street and South Park Street The existing signs for North and South Park are incorrect. The existing signs, NE Park St, SE Park St, ... would be correct if there was a single "Park St" that was in four separate quadrants of the city, NE, NW, SE, SW. The platted for the city has two separately named streets, North Park St and South Park Streets. Here is an example of how the signs would look if they were correctly labeled. NW 9th Ave/ Dean avenue The city council minutes are clear for this example. The motion clearly states that "Dean Avenue" should be placed below NW 9th Ave on the street signs. Given the intent of the MUTCD guidelines, treating W 5t Ave similarly to NW 9th Ave would add consistency and simplicity to the signs. "Please refer to Question 4." According to the Applicant, the prior day care use had about 99 students and the Applicant expects about the same. With regard to traffic, using the Institute of Traffic Engineers (ITE) 8th Edition traffic generation rates, we estimate that traffic during the peak hour will approximate 64 trips. While this is a significant level of traffic, it does not meet the City's threshold of 100 trips per peak hour that triggers the need for a traffic analysis. This is just over one per minute, presumably during the peak morning and afternoon pick -up and drop -off times. Depending on how the two circular driveways are used one might expect some back up onto SW 2nd Avenue. We expect this would not be appreciably different from that having occurred when the property was previously operated as a daycare center. Further, there does not appear that there was any deterrent to the development of adjacent property. We agree. (6) The use may be required to be screened from surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. (7) "The daycare use should not pose a nuisance or hazard to adjacent uses. The children will be inside the facility for the majority of the day, with short outside play times. The area where the children will play is fenced, and therefore they will not be entering upon adjacent property and will not be a hazard to such adjacent properties or property owners. At Least one side of the property currently has an opaque fence for screening; at this time, there are no plans to install additional fencing." We agree. The use will not create a density pattern that will overburden public facilities such as schools, streets, and utility services. "There will be some traffic at drop off and pick up, but it will not be extreme. There is a paved circular drive in front of northernmost building and an unpaved circular drive in front of the southernmost building, that will eliminate (or substantially reduce) cars from parking and /or idling on the road during these times." Density is not an issue with a commercial use and no increase in commercial intensity is envisioned that would have a negative effect upon public services or facilities. No outdoor construction is anticipated at this time and therefore, re- establishing this use should not cause flooding or drainage problems. Providing a daycare facility for the community will actually help families to keep their young children safe and cared -for, rather than cause public safety problems. We agree that neither will traffic congestion be increased nor traffic safety be compromised by the operation of a daycare center on the property at a level of intensity approximating that which previously operated on the property. Since there is no physical change to the structure or other improvements on the property, drainage will remain essentially the same as previous.
