AN ORDINANCE AMENDING THE CRDINANCE CODE OF THE CITY OF OKEECHOBEE,
FLORIDA; AMENDING APPENDIX A BEING THE COMPREHENSIVE ZONING
ORDINANCE OF THE CITY OF OKEECHOBEE WHICH ESTABLISHES ZONING
REGULATIONS AND PROVIDES FOR THE ADMINISTRATION, ENFORCEMENT AND
AMENDMENT THEREOF; PROVIDING FOR A CHANGE IN THE CLASSIFICATION OF
SPECIFIED LAND FROM RESIDENTIAL SINGLE FAMILY TO COMMERCIAL.
WHEREAS, application has been duly made to change the zoning classification as
hereinstated, and
WHEREAS, all public notices have been duly published according to law, and
WHEREAS, public hearings have been held as required by Appendix A, the Comprehensive
Zoning Ordinance of the City of Okeechobee, and
WHEREAS after consideration of the requirements of the Comprehensive Zoning
Ordinance and the land use plan of the City of Okeechobee as set out in the City
Or Okeechobee Comprehensive Plan and further after consideration of the public's
interest it is deemed to be in the best interst of the City of Okeechobee to change
the zoning classification of the land lying within the limits of the City of Okeechobee
as herein stated; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA.
SECTION 1. That the following described real property is hereby rezoned from
Residential Single Family to Commercial.
Lots 7, 8 & 9, Block 16, South Okeechobee
SECTION 2. That the application requesting this zoning change and proof of
publication for any and all public hearings in connection herewith shall be attached
to and become a part of this Ordinance.
SECTION 3. The Zoning Administrator shall make the appropriate change on the
city's zoning map in accordance with this ordinance.
SECTION 4. This Ordinance shall become effective immediately upon its adoption.

DATE: SEPTEMBER 7, 1983
RE: Rezoning request for Phil Berger to be rezoned from Residential
Single Family to Commercial, lots 7, 8 and 9, Block 16, South
Okeechobee. These lots are located on South West 2nd Avenue
and are behind lots 1,2, and 3, which are already zoned commercial.
Request: Rezoning wanted to build a Captain D's fast food restaurant.
Discussion: There were no objections voiced. Mr and Mrs Murrary of
the Tropic Motel stated they were in favor of the rezoning.
Action Taken: Board members reviewed the sixteen requirements with
no objections to the findings. Member Altobello moved
to recommend to the City Council to grant the rezoning
request from Residential Single Family to Commercial
with the condition that a six months limitation according
to plans be attached,and if a permit is not obtained in
the six months period it will revert back to the original
zoning of Residential Single Family. Seconded by member
O'Connor. Vote unanimous.

TUESDAY, SEPTEMBER 6, 1983
The Planning Board /Board of Adjustments and Appeals met in regular session on
Tuesday, September 6, 1983, at City Hall in the Council Chambers, Okeechobee, at 7:00P.M.
Members present were: Jim Wright, Brenda O'Connor, Darrell Ferneau, and Frank
Altobello. Member Jim Kirk has resigned from the Planning Board
Others present were: Building and Zoning Admirlistrator, Mallette Westbrook;
City Attorney, David Conlon; Secretary, Bea Castorina.
BOARD OF ADJUSTMENTS AND APPEALS
Vice Chairman Ferneau called the Board of Adjustments and Appeals into session.
APPROVAL OF MINUTES
Ther being no additions or corrections to the minutes, Vice Chiarman Ferneau
advised that the minutes of July 5, 1983 stand approved as presented.
PHIL, & SUSAN BERGER
A request for consideration for recommendation to council to reduce distance of
700 feet to 300 feet from a church or school for consumption of alcohlic beverages.
Mr Westbrook advised the board this part of the request has been withdrawn on
behalf of Phil and Susan Berger.
Attorney Conlon asked Mr. Westbrook if he wanted the board to make a recommendation
to Council to change the Ordinance. Mr Westbrook stated yes. Attorney Conlon further
advised the board is only compelled to make recommendations to council on Ordinance #402.
Discussion ensued. Attorney Conlon advised the board they could look into making re-
commendations to council on other ordinances besides #402.
Member Wright stated he would like some input on the matter before acting on it.
After a lenghty discussion Vice Chairman stated the matter will be tabled until the
next meeting.
ADJOURNMENT
Member Wright moved to adjourn, seconded by member Altobello. Motion carried.
PLANNING BOARD
Vice Chairman Ferneau called the Planning Board into session.
APPROVAL OF MINUTES
There being no corrections or additions to the minutes, vice chairman Ferneau
advised if no objections the minutes of July 5, 19$3, meeting be approved as presented.
PHIL AND SUSAN BERGER - REQUEST FOR REZONING
Phil Berger appeared before the board to request a rezoning from Residential
Single Family to Commercial lots 7,8, and 9, Block 16, South Okeechobee.
Mr and Mrs Murray, owners of the Tropic Motel, were in the audience and stated
they were for the rezoning.
The board went over the findings for a rezoning. Discussion ensued. Member
Altobell moved to recommend City Council grant the rezoning with the condition that
a six months 1[imitation according to the plans be attached, and if a permit is not
obtained within the six months period it will revert back to the original zoning of
Residential Single Family. Seconded by member O'Connor. Vote unanimous.

Mr. Westbrook advised the board, that advertisement for a new board member was
in process, but no response as of yet.

There being no further business to come before the board, member Altobello
moved to adjourn. Seconded by member O'Connor. Meeting adjourned.

Chairman Douglas called for approval of the minutes of the regular meeting of October 17,1983
and the minutes of the special meeting of October 26, 1983.
Councilman Knight made a motion to approve the minutes, Seconded by Councilman Thomas.
Motion carried.
83 -34 AGENDA ITEM IA/ - LANDSCAPING CONTRIBUTIONS
Councilman Knight presented certificates of appreciation to the following individuals for
their help inthe beautification needs of the City: Kathy Vandermolen of Beta Signa Phi Sorority;
John Leggett of the Rotary Club; James Vavra of the Lions Club; and George Tsismandsis of the
Kiwanis Club.
Councilman Knight then presensted to the City Clerk a check in the amount of $1400.00 from
the Flagship Bank of Okeechobee, for the landscaping of the medians.
83 -87 AGENDA ITEM #VI - PAY PLAN UPDATE PROPOSAL BY LONG & ASSOCIATES
Chairman Douglas introduced Dor. & Carolyn Long of Long & Associates who gave a presentation I
to the Council relative to lb improvements and updating of the City's y pay plan and classification
system.
There was some discussion about the type of studys performed and the cost for the service.
83 -17 AGENDA ITEM #VII - BERGER INSURANCE AGENCY - DIVIDEND CHECK
Mr. Phillip Berger presented a dividend check to the City Clerk in the amount of $7,360.00,
recognizing the excellent safety record established by the City during the previous fiscal year.
Chairman Douglas then thanked the Department Heads for their cooperation in seeing to the
safety of the employees.
83 -79 AGENDA ITEM #VIII - FINAL HEARING - RSF TO C., CAPTAIN "D'S" RESTAURANT
Chairman Douglas read the Ordinance by title only:

Chairman Douglas opened the floor for discussion and stated that it was recommended for
approval by the Planning and Zoning Board.
After a lengthy discussion, Councilman Thomas made a motion to uphold the recommendation of
the Planning and Zoning Board, motion was seconded by Councilman Chapman. Chairman Douglas asked
for a vote, all Councilmen were in favor of the rezoning. Motion carried.

Chairman Douglas brought up for discussion the alleyway of Captain "D's ". He stated
he was in favor of a quit claim deed to trade property for the alley, and then opened the
floor for discussion.
Attorney Conlon stated that a quit claim deed could be done tonight, since the attorneys
for Captain "D's" had all the necessary paperwork already completed with them, if this was the
Council's wish.
Chairman Douglas asked for any further discussion.
All Councilmen stated they had no particular problems with the exchange of property.
Councilman Knight made a motion to proceed with a quit claim deed on the existing 15 feet.
Motion Seconded by Councilman Thomas.
Chairman Douglas called for a vote on the motion. All Councilmen approved.
Motion carried.
83 -74 AGENDA ITEM #IX - APPOINTMENT OF A CODE ENFORCEMENT BOARD MEMBER
Chairman Douglas brought up for discussion the appointing of a member on the Code Enforce-
ment Board inthe place of Vangela McFarland.
Councilman Chapman made a motion to appoint Richard Nick Collins. Motion was seconded
by Councilman Thomas. Motion carried.
83 -51 AGENDA ITEM #X -BIDS - PAINTING EXTERIOR OF CITY HALL
Chairman Douglas noted the receipt of the two bids for the painting of the City Hall.
Clerk Thomas presented the two bids to the Council. Clerk Thomas stated that she would
like to recommend for the Council to accept Bid "B" for $4,800.00 which has a five (5) year
^uarantee.
After discussion, Chairman Douglas asked Council's vote.
Councilman Thomas made a motion to allocate $1,800.00 from the $7,360.00 check from
Phillip Berger. Motion was seconded by Councilman Knight. Motion carried.
AGENDA ITEM #XII - MAYOR TO CALL ON AUDIENCE
Citizen Andy Rubin stated he would like to see more participation by everyone on Veteran's
Day, November 11, 1983.
AGENDA ITEM #XIII - MAYOR TO CALL ON CITY CLERK, CITY ATTORNEY, CITY ADMINISTRATOR AND CITY
COUNCILMEN FOR REPORTS AND /OR REQUESTS
CITY CLERK - WARRANT REGISTERS
Clerk Thomas presented the Warrant Registers f6r approval.
83 -84 CITY ADMININSTRATOR - HOLIDAYS
Administrator Fellows stated that he had the information as requested by Councilman Knight at
the previous meeting on Holidays.
After discussing the issue, Councilman Thomas made a motion to go with the ten (10)
holidays, same as the County. Employees now get 7 Holidays and the 3 days requested were
Good Friday, 1 additional day at Thanksgiving and Christmas.
There was further discussion on employees having their birthdays off instead
of Good Friday.
Chairman Douglas asked for a vote on the motion, Councilmen Knight, Chapman and
Thomas voted "Yes ", Councilman Watford voted "No ". Motion carried.
- RESOLUTION - BEAUTIFICATION OF CITY
At this time, Administrator Fellows pointed out that the Resolution on Beautification
had not been read yet.
Councilman Knight read the resolution as follows:
WHEREAS, it is the desire of all citizens to live in a clean and attractive community; and
WHEREAS, the new construction of U. S. 441 south of the city with the subsequent land-
scaping improves the attractiveness of our city for incoming visitors; and
WHEREAS, it is the desire of the City Council to encourage residences and businesses to
fix -up, paint -up and clean -up to improve the looks of our community; and
WHEREAS, a number of civic clubs have become excited about the possibilities inherent in
a beautification andlandscape program,

WHEREAS, public hearings have been held as required by Appendix A, the Comprehensive
Zoning Ordinance of the City of Okeechobee, and
WHEREAS after consideration of the requirements of the Comprehensive Zoning
Ordinance and the land use plan of the City of Okeechobee as set out in the City
Or Okeechobee Comprehensive Plan and further after consideration of the public's
interest it is deemed to be in the best interst of the City of Okeechobee to change
the zoning classification of the land lying within the limits of the City of Okeechobee
as herein stated; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA.
SECTION 1. That the following described real property is hereby rezoned from
Residential Single Family to Commercial.
Lots 7, 8 & 9, Block 16, South Okeechobee
SECTION 2. That the application requesting this zoning change and proof of
publication for any and all public hearings in connection herewith shall be attached
to and become a part of this Ordinance.
SECTION 3. The Zoning Administrator shall make the appropriate change on the
city's zoning map in accordance with this ordinance.
SECTION 4. This Ordinance shall become effective immediately upon its adoption.
Introduced and set for final reading this 12th day of Sep ember, 1983.

AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF OKEECHOBEE,
FLORIDA; AMENDING APPENDIX A BEING THE COMPREHENSIVE ZONING
ORDINANCE OF THE CITY OF OKEECHOBEE WHICH ESTABLISHES ZONING
REGULATIONS AND PROVIDES FOR THE ADMINISTRATION, ENFORCEMENT AND

WHEREAS, application has been duly made to change the zoning classification as

WHEREAS, public hearings have been held as required by Appendix A, the Comprehensive
Zoning Ordinance of the City of Okeechobee, and
WHEREAS after consideration of the requirements of the Comprehensive Zoning
Ordinance and the land use plan of the City of Okeechobee as set out in the City
of Okeechobee Comprehensive Plan and further after consideration of the public's
interest it is deemed to be in the best interest of the City of Okeechobee to change

RE: Rezoning request for Phil Berger to be rezoned from Residential
Single Family to Commercial, lots 7, 8 and 9, Block 16, South
Okeechobee. These lots are located on South West 2nd Avenue
and are behind lots 1,2, and 3, which are already zoned commercial.
Request: Rezoning wanted to build a Captain D's fast food restaurant.
Discussion: There were no objections voiced. Mr and Mrs Murrary of
the Tropic Motel stated they were in favor of the rezoning.
Action Taken: Board members reviewed the sixteen requirements with
no objections to the findings. Member Altobello moved
to recommend to the City Council to grant the rezoning
request from Residential Single Family to Commercial
with the condition that a six months limitation according
to plans be attached, and if a permit is not obtained in
the six months period it will revert back to the original
zoning of Residential Single Family. Seconded by member
O'Connor. Vote unanimous.

NOTICE OF INTENTION TO AMEND CITY ZONING ORDINANCE #402
NOTICE IS HEREBY GIVEN that the City Council of the City of
Okeechobee, Florida, a municipal corporation, will consider rezoning
from Residential Single Family to Commercial and amend accordingly
Ajpendix A being the Comprehensive Zoning Regulation, the following
described real property, situate, lying and being within the corporate
limits of the City of Okeechobee, Florida, to -wit:
Lots 7, 8 and 9, Bloch 16, South Okeechobee
Granting the rezoning will allow a seafood restuarant to be built.
A second and final hearing in relation thereto will be held at 7:00 P.M.
on Oct'ber 17, 1983, in the City Council Room, City Hall, Okeechobee,
Florida, at which time all parties in interest and citizens shall have
an opportunity to be heard.

NOTICE is hereby given that the Planning Board oftheCity of Okeechobee,
