AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF OKEECHOBEE,
FLORIDA; AMENDING APPENDIX A BEING THE COMPREHENSIVE ZONING ORDINANCE
OF THE CITY OF OKEECHOBEE WHICH ESTABLISHES ZONING REGULATIONS AND
FOVIDES FOR THE ADMINISTRATION, ENFORCEMENT AND AMENDMENT THEREOF;
PROVIDING FOR A CHANGE IN THE CLASSIFICATION OF SPECIFIED LAND FROM
HCLDING TO INDUSTRIAL.
WHEREAS, application has been duly made to change the zoning classification as
hereinstated, and
WHEREAS, all public notices have been duly published according to law, and
WHEREAS, public hearing have been held as required by Appendix A, the Comprehensive
Zoning Ordinance of the City of Okeechobee, and
WHEREAS after consideration of the requirements of the Comprehensive Zoning Ordinance
and land ::;e plan of the City of Okeechobee as set out in the City of Okeechobee
Comprehensive Plan and further after consideration of the public's interest it is
deemed to De in the best interest of the City of Okeechobee to change the zoning
classifi.ution of the land lying within the limits of the City of Okeechobee as

SECTION 1. 1 -,a; the following described real property is hereby rezoned from Holding
to :industrial.

Norhwest Addition.
SECTION 2, That the application requresting this zoning change and proof of publi-
cation for any and all public hearings in connection herewith shall be attached to
and become a part of this ordinance.
SECTION 3. The Zoning Administrator shall make the appropriate change on the City's
zoning map in accordance with this ordinance.
SECTION 4. This ordinance shall become effective immediately upon its adoption.

REGULAR MEETING
TUESDAY, MAY 7, 1985
The Planning Board /Board of Adjustments and Appeals met in regular session on May 7,
1985, at City Hall in the Council Chambers, Okeechobee, Florida, at 7 :00 o'clock P.M.
Members present were: Jim Wright; Lula Worthen; Darrell Ferneau; and Frank Altobello.
Member Brenda O'Connor was absent.
Others present were: Building and Zoning Administrator, Mallette Westbrook; Attorney,
Jerry Bryant, and Secretary, Beatrice Castorina.
BOARD OF ADJUSTMENTS AND APPEALS
Vice Chairman Wright called the meeting into session.
APPROVAL OF MINUTES
There being no corrections or additions to the minutes of April 2, 1985 meeting, Member
Ferneau moved the minutes stand approved as presented. Seconded by member Worthen. Motion
carried.
FRANK AND FAYE FINLEY - REQUEST FOR SPECIAL EXCEPTION AND VARIANCE
John Cassels, representing Mr. and Mrs. Finley's application requesting a variance
on lots 5 and 6, Block 17 and a special exception on lots 11 and 12, for off - street parking.
Mr. Cassels Stated they are planning to build a Dairy Queen on South Parrott Avenueandlots
11 and 12 would need a special exception being they are zoned residential single family
to be used for off - street parking. A 20' rear setback is required for Commercial property
abutting RSF zoned property, therefore, a variance is needed for lots 5 and 6 because of a
cooler in the rear of the Dairy Queen :wilding. Discussion ensued.
Vice Chairman Wright asked if anyone in the audience objected to the request. There were
no objections from the audience , or in writing. The board went over the findings for a
special exception. Member Altobello moved to grant the special exception with construction to'
begin with in six months. Seconded by member Ferneau. Motion carried. The board then went
over the findings for a variance. With no objection to the findings member Altobello moved
to grant the variance with construction to begin in six months. Seconded by member Worthen.
Motion carried.
CHAMBER OF COMMERCE - REQUEST FOR SPECIAL EXCEPTION
The Chamber of Commerce has filed application for a special exception to have a mobile
home on their property to be used as an office for the Chamber until the construction is com-
pleted. There were no objections to the request. Member Altobello moved to grant the special
exception for, six months and to include the findings and despence with reading of the findings.
Seconded by member Worthen.
Motion carried.
OPAL SMITH; HOWARD LIGHTSEY; THELMA GAYLARD; AND ADELLE HARDEN - REQUEST FOR SPECIAL EXCEPTION
John Cook, Attorney for request, was present to represent the applicants for a special
exception on lots 7 and 8, Block 126, City of Okeechobee. This property is zoned C.P.O. and
would need a special exception for a beauty shop to go on this property. There were no ob-
jections to the request. The board went over the findings for a special exception. Member
Worthen moved to grant the special exception request with a six months time limit Seconded by
member Altobello. Motion carried.
ADJOURNMENT
There being no further business to come before the board, member Ferneau moved to adjourn.
Seconded by member Worthen. Motion carried.
PLANNING BOARD
Vice Chairman Wright called the Planning Board into session.
Member Worthen advised the board, she would have to restrict herself from serving on the
Planning Board because she is an adjacent home owner of the application to come before the
board, and would like to serve as a member of the audience.
APPROVAL OF MINUTES
There being no correction or additions to the minutes of April 2, 1985 meeting, member
Altobello moved the minutes stand approved as presented. Seconded by member Ferneau. Motion
carried.
ALLEN RUCKS REQUEST FOR REZONING
Attorney) Lester Jennings was present to represent Mr. Rucks on the rezoning application.
They are asking lots 1 through 20 in Blocks 1,2,3,4,5,6,7, and 8 North West Addition be rezoned
from Holding to Industrial. Mr. Jennings stated Mr. Rucks have entered into a contract with
Madray Enterprises to buy this property contingent on the rezoning. Madray Enterprises wants
to build a housing manufacturing plant, which would employ approximately 400 to 1000 employees.
Mr. Jim Horton, representing Madray Enterprises explained the working of the manufacturing
plant. Mr. Horton stated that it is a clean operation.
Vice chairman asked if there were anyone in the audience wishing to comment on this
request. Lula Worthen, a home owner stated she was against the rezoning and she was speaking
for the home owners of Dean's Court. They are asking the board to deny the rezoning request
because of heavy traffic and no property to build houses on in the future.
Patricia Ervin Gillman stated she owned 6 lots on 9th street andwanted to know what the rezonin,
would do to the property taxes. Mr. Jennings stated he didn't see where it would affect the
taxes. Discussion ensued.
Florence Harris stated if the citizens don't have money, then the plant would be right there
for jobs. She stated she was handicapped and in the job training program and the plant is a
way of bringing more taxes into the community.
John Cassels stated there is already property zoned industrial in combination to the property
in question. Something could come in)in which no one knew about and it seems it would be
better to have Madray come in knowing what he has than to have something come in and set up
with out asking in which no one could do anything about; also the City would have a place
where the young people could get a job instead of leaving the city, which most of the young
people do now.
Lucille Howard of 914 N.W. 10th street stated she didrzot want the rezoning application granted.
Vice Chairman Wright stated if there were anyone in the audience opposing this rezoning to
please state their name for the records.

to put the plant on. Mr. Horton stated as far as he knew there was not another piece of
property in the City of Okeechobee large enough to handle their manufacturing facility.
Andy Rubin stated he was for industry coming into the City and also for the people.
The Board members went over the findings for a rezoning. After finding some objections to
the findings; member Ferneau moved to recommend City Council deny the rezoning request, due
to the objection of the citizens and due to the traffic it would create inthe area.
Seconded by member Altobello. A vote was taken with members Ferneau and Altobello voting aye
and Vice Cha.sirman Wright voting in favor of the rezoning.
ADJOURNMENT
There being no further business to come before the board, member Altobello moved to adjourn.
Seconded by member Ferneau. Motion carried. Meeting adjourned.

RE: Rezoning request by Allen Rucks to rezone lots 1 through
20 inclusive of the following Blocks 1,2,3,4,5,6,7, & 8,
Northwest Addition, from Holding to Industrial.
REQUEST: Rezoning to enable a housing manufacturing plant
on this property.
DISCUSSION: Lula Worthen representing herself and residence
of the Dean's Court area asked the rezoning
be denied.
ACTION TAKEN: Board members reviewed the sixteen require-
ments with some objections to the findings.
Member Ferneau moved to deny the request for
rezoning because of the objections from the
residence of Dean's Court. The motion was
seconded by member Altobello. Members Ferneau
and Altobello voted to deny the request and
Member Wright voted against the denial. Member
Worthen abstained from being on the Planning
Board and stepped down into the audience.
Member O'Connor was absent. The Rezoning was
denied by the Planning Board. Mr. Allen Rucks
is asking to go before the City Council to
appeal the decision of the Planning Board.

Dear
Allen Rucks has filed a request for a rezoning with the Planning
Board of the City of Okeechobee, Florida. Granting of this rezoning
request would permit a manufacturing plant for homes on the following
described property:
Lots 1 through 20 inclusive of the following Blocks 1,2,
3.4.5.6.7. & 8, Northwest Addition.
According to zoning ordinance #402 we are required to notify all
property owners within 500 feet of the property in question. Records
show you to be the owner of the following:
This is to advise you of a public hearing on this matter to be
held in the Council Chambers at City Hall at 7 :00 P.M.. Tuesday,

MEETING IN COUNCIL CHAMBERS, 55 SOUTHEAST THIRD AVENUE, OKEECHOBEE,
FLORIDA, AT 2:00 P.M.
CHAIRMAN OAKLAND R. CHAPMAN CALLED THE MEETING TO ORDER WITH THE
FOLLOWING COUNCILMEN PRESENT:

THE PURPOSE OF THE MEETING IS TO DISCUSS THE RE- ZONING OF LOTS
1 -20 INCLUSIVE OF THE FOLLOWING BLOCKS 1,2,3,4,5,6,7 AND 8 NORTHWEST
ADDITION FROM HOLDING TO INDUSTRIAL.
ADMINISTRATIVE DIRECTOR L.C. FORTNER READ THE OUTLINE FROM THE
MAY 7, 1985, MEETING WHICH STATED THERE WERE OBJECTIONS FROM THE
RESIDENTS OF DEANS COURT.
MAYOR CHAPMAN REQUESTED A MOTION TO BE MADE THAT THE ORDINANCE BE
READ BY TITLE ONLY AND THEN DISCUSSION TO FOLLOW BEFORE A FINAL
VOTE.COUNCILMAN DOUGLAS MADE THE MOTION THAT THE ORDINANCE BE READ BY
TITLE ONLY AND COUNCILMAN THOMAS SECONDED THE MOTION. MOTION CARRIED.
THE MAYOR ASKED IF ANYONE FROM THE AUDIENCE WISHED TO ADDRESS THE
COUNCIL.ATTORNEY LESTER JENNINGS ADDRESSED THE COUNCIL ON BEHALF OF THE
RUCKS FAMILY. HE EXPRESSED THE FEELING THAT A FAVORABLE IMPACT ON THE
COMMUNITY WOULD RESULT UPON APPROVAL OF THE PROPOSED REZONING REQUEST
AND HOPED THAT THE CITIZENS OF THE COMMUNITY REALIZED THAT IT WOULD BE
BENEFICIAL TO THIS COMMUNITY. MR. JACK HAINES, A MADRAY REPRESENATIVE,
ASKED TO BE RECOGNIZED AND ALSO GAVE A FAVORABLE VIEW IN REGARD TO THE
PROPOSED REZONING.HE ALSO MENTIONED THAT THE OPPOSITION HAS DWINDLED AND
CITIZENS ARE NOW REALIZING HOW BENEFICIAL THE PLANS WILL BE FOR THE
COMMUNITY.
THE MAYOR READ THE ORDINANCE BY TITLE ONLY AND ASKED FOR
DISCUSSION BY THE COUNCIL OR THE AUDIENCE. COUNCILMAN RUBIN ASKED IF
MADRAY ENTERPRIZES WAS PLANNING TO CONSTRUCT A DAY CARE CENTER.MR.
HAINES REPLIED THAT A PLAYGROUND HAD BEEN DISCUSSED AS A FUTURE PROJECT
THAT MADRAY ENTERPRIZES MAY BE INVOLVED WITH BUT THERE HAD NOT BEEN ANY
PLANS AS FAR AS A DAY CARE CENTER WAS CONCERNED.
COUNCILMAN THOMAS MADE THE MOTION THAT THE PROPERTY BE REZONED
FROM HOLDING TO INDUSTRIAL AND THE MOTION WAS SECONDED BY COUNCILMAN
DOUGLAS. MOTION CARRIED.
COUNCILMAN RUBIN REFRAINED FROM VOTING ON THE MOTION DUE TO
CONFLICT OF INTEREST.MAYOR CHAPMAN ASKED COUNCILMAN RUBIN TO STATE THE
REASON. COUNCILMAN RUBIN REPLIED THAT (HE PREFERRED NOT TO STATE) WHY HE
WAS NOT VOTING. CITY ATTORNEY BRYANT EXPLAINED THAT THE REASON FOR
COUNCILMAN RUBIN'S REFUSAL TO VOTE WAS NOT A CONFLICT OF INTEREST BUT
BECAUSE OF MR. RUBINS INVOLVEMENT AT THE PLANNING BOARD MEETING.I.IOTION
CARRIED.
MAYOR CHAPMAN READ THE ORDINANCE CONCERNING THE STREET CLOSING.
MR. FORTNER EXPRESSED CONCERN OVER NORTH FOURTEENTH STREET ALONG THE
CITY LINE BECAUSE OF THE LARGE DRAINAGE DITCH ALONG THE LINE FOR FUTURE
CLEANING ACCESSIBILITY BY THE CITY OR THE COUNTY.HE SUGGESTED THAT THE
MAINTENANCE OF THAT DITCH BE CONSIDERED AT THIS TIME.
SECTION THREE OF THE ORDINANCE WAS DISCUSSED AMONG THE
CQUNCILMEMBERS AND THE CITY ATTORNEY AS TO ITS' INTERPRETATION.

MAYOR CHAPMAN ASKED DIRECTOR FORTNER IF HE NEEDED AN EASEMENT IN
ORDER TO CLEAN THE DITCH IN QUESTION.ADMINISTRATIVE ASSISTANT L.C.
FORTNER REPLIED THAT THE COUNTY COULD CLEAN THE DITCH FROM THE NORTH
SIDE SINCE THAT PROPERTY WAS OWNED BY THE COUNTY. COUNCILMAN THOMAS MADE
THE MOTION TO READ THE ORDINANCE IN ITS ENTIREITY WITH THE PROPOSED
CHANGES INCLUDED. COUNCILMAN RUBIN SECONDED THE MOTION. MOTION CARRIED.
ATTORNEY BRYANT READ THE ORDINANCE WITH PROPOSED CHANGES.
CO NCILMAN COLLINS MADE THE MOTION TO ADOPT THE ORDINANCE AS READ BY
CI Y ATTORNEY BRYANT. THE MOTION WAS THEN SECONDED BY COUNCILMAN THOMAS.
