The invocation was given by Reverend Emmaline Harris, of Jesus Holy Ghost Crusade Church; the Pledge of Allegiance was led by Mayor Kirk. Council Member O'Connor nominated James E. Kirk to serve as Mayor. No other nominations were offered. Council Member O'Connor moved to appoint nominee James E. Kirk to serve as Mayor, term being January 6, 2015 through January 4, 2017; seconded by Council Member Ritter. Mayor Kirk thanked the Council for their support and confidence in him. i 1 1 AGENDA IV. Requests for the addition, deferral or withdrawal of items on today's agenda. VI. PROCLAMATIONS AND PRESENTATIONS - Mayor A. Proclaim the month of January 2015 as "National Mentoring Month." VII. MINUTES - City Clerk A. Motion to dispense with the reading and approve the Summary of Council Action for the December 16, 2014 Regular Meeting. JANUARY 6, 2015 - REGULAR MEETING - PAGE 2 OF 6 337 COUNCIL ACTION - DISCUSSION - VOTE VOTE KIRK - YEA RITTER - YEA CHANDLER - YEA WATFORD - YEA O'CONNOR - YEA MOTION CARRIED. Mayor Kirk asked whether there were any requests for the addition, deferral or withdrawal of items on today's agenda. The approval of the December 16, 2014 Minutes were deferred to the next meeting. New Business Item B.6 was withdrawn, and New Business Item B.12 was added. Ms. Sabrina Seme, Case Manager for Big Brothers Big Sisters of St. Lucie, Indian River and Okeechobee Counties was present to receive the proclamation and thanked the Mayor and Council for this recognition, support and extended an invitation to all to be a mentor. Mayor Kirk read the proclamation in its entirety as follows: "WHEREAS, every day Big Brothers Big Sisters works to provide children facing adversity with strong and enduring, professionally supported one -to -one relationships that change their lives for the better forever; and WHEREAS, mentoring is a proven, effective strategy that helps children by matching them with a caring, responsible adult who can provide guidance and direction, and build their confidence; and WHEREAS, research shows that mentoring has beneficial and long -term effects on youth by increasing their academic engagement and decreasing the likelihood of substance abuse and other risky behaviors; and WHEREAS, many of Okeechobee children are in need of a caring adult mentor in their lives, and closing this mentoring gap will take more investment, partnerships, and volunteers ready to make a difference in a child's life; and WHEREAS, the City of Okeechobee recognizes that our success depends on helping every child reach their full potential in life, and realizes that young people need a solid foundation of support that will help them become well- educated, confident, and productive citizens. NOW THEREFORE, 1, James E. Kirk, by virtue of the authority vested in me as Mayor of the City of Okeechobee, do hereby proclaim the month of January 2015 as "National Mentoring Month" in Okeechobee, Florida and urge all citizens to look for opportunities to serve as mentors in their communities, and to observe this month with appropriate activities and programs." This item was deferred to the January 20, 2015 meeting. 338 AGENDA VIII. NEW BUSINESS A. Motion to award the purchase of a new Morbark M12R Trailer Mounted Brush Chipper in the amount of $32,590.00 to Nortrax John Deere Company under the Florida Sheriff's Association purchasing process - David Allen (Exhibit 1). B. Consider two -year appointments of the Mayor and Council Members to serve as the City Liaison to various Boards /Committees: 1. Two members for the Central Florida Regional Planning Council 2. Two members for the Tourist Development Council 3. One member for the Juvenile Justice Council 4. One member for the Treasure Coast Council of Local Governments 5. One member for the Okeechobee County Healthy Start Coalition 6. One member for the Workforce Regional Development Board 7. One member for the Okeechobee Main Street Board JANUARY 6, 2015 - REGULAR MEETING - PAGE 3 OF 6 COUNCIL ACTION - DISCUSSION - VOTE Motion and second by Council Members O'Connor and Watford to award the purchase of a 2015 Morbark M12R Trailer Mounted Brush Chipper in the amount of thirty -two thousand, five hundred ninety dollars ($32,590.00) to Nortrax John Deere Company under the Florida Sheriff's Association State Bid Award. Council Member Watford asked whether the local vendors were contacted, to which Director Allen replied they were, but did not submit any bids. Council Member O'Connor asked whether the old chipper could be sold and what was the expected date of delivery for the new one. Director Allen answered the old one will be taken to the auction and delivery is unknown. VOTE KIRK - YEA RITTER - YEA CHANDLER - YEA WATFORD - YEA O'CONNOR - YEA MOTION CARRIED. Mayor Kirk asked the Council to review the current appointed boards /committees list and express their willingness to continue to serve or request another board /committee. The following appointments were made for a term of two years: Central Florida Regional Planning Council: Council Member O'Connor was moved to serve as the regular member and Council Member Ritter was appointed as alternate. Tourist Development Council: Council Member Chandler was appointed and Council Member O'Connor was reappointed. Okeechobee County Juvenile Justice Council: Mayor Kirk was reappointed. Treasure Coast Council of Local Governments: Council Member Watford was reappointed. Okeechobee County Family Health /Healthy Start Coalition, Inc: Council Member Ritter was appointed. The Workforce Regional Development Board is officially removed from the list. Okeechobee Main Street Board: Council Member O'Connor was reappointed. Treasure Coast Regional League of Cities: Council Member Watford was reappointed. Battle of Okeechobee Re- enactment Committee: Council Member Watford was reappointed. Shared Services of Okeechobee Executive Roundtable: Mayor Kirk was reappointed. Chamber of Commerce of Okeechobee: Council Member O'Connor was appointed. Clerk Gamiotea will notify the appropriate person for each organization listed of these appointments. Clerk Gamiotea distributed a memorandum prior to the meeting explaining after advertising for multiple vacancies on several citizen boards, one application was received for consideration for the Firefighters Board of Trustees' Retirement Fund, one that can only be considered for the Code Enforcement Board, and four applications to be considered for the Planning Board /Board of Adjustment/Design and Review Board. Council Members Watford and O'Connor moved to appoint Ms. Judy Douglas as the City's appointee to the Firefighters Retirement Fund Board of Trustees, term ending 9/30/2017, (replacing Gary Ritter). VOTE KIRK - YEA CHANDLER - YEA O'CONNOR - YEA RITTER - YEA WATFORD - YEA MOTION CARRIED. Council Member O'Connor made a motion for the Code Enforcement Board, to move Mrs. Lynn Boak from alternate to regular member, term being 1/7/15 to 4/30/17, (replacing Dennis Murphy); and appoint Mr. Abney as an alternate member, term being 1/7/15 to 4/30/17, (position has been vacant since 9/18/13, when Mr. Murphy was moved from alternate to regular); seconded by Council Member Ritter. AGENDA VIII. NEW BUSINESS CONTINUED C. Consider Citizen Board Appointments continued. RECESS REGULAR MEETING - Mayor IX. CLOSED EXECUTIVE SESSION - Mayor A. Discuss pending litigation, Case No. 2013CA000424, State of Florida Department of Transportation vs. City of Okeechobee and the Hamrick Trust - City Attorney. JANUARY 6, 2015 - REGULAR MEETING - PAGE 5 OF 6 COUNCIL ACTION - DISCUSSION - VOTE VOTE KIRK - YEA RITTER - YEA CHANDLER - YEA WATFORD - YEA O'CONNOR - YEA MOTION CARRIED. An alternate member remains vacant on the Code Enforcement Board (remaining term of Mrs. Boak, ending 4/30/16). Council Member Watford made a motion for the Planning Board /Board of Adjustments /Design Review Board, to move both alternates to regular members, being Mr. John Creasman (replacing Terry Burroughs), for a new term 117115 to 4/30/2016, and Mr. Mac Jonassaint (replacing Gary Ritter) for a new term 1/7/15 to 4/30/2015; and appoint as alternate members, Mr. Elbert Batton, term being 1/7/15 to 4130/15, and Mr. Bobby Keefe, term being 1/7/15 to 4/30/17; seconded by Council Member O'Connor. VOTE KIRK - YEA RITTER - YEA CHANDLER - YEA WATFORD - YEA O'CONNOR - YEA MOTION CARRIED. The Council wanted the other applicants to know they appreciated their interest and their applications will be kept on file for future considerations, and express to those appointed their gratitude for their willingness to serve. Mayor Kirk recessed the Regular Session of the meeting at 6:26 P.M. and announced, based on the request of Attorney Cook, the Council will enter into a Closed Executive Session in order to discuss pending Litigation, Case No. 2013CA000424, State of Florida Department of Transportation vs. the City of Okeechobee and the Hamrick Trust. Only those listed in the advertisement may remain during the Executive Session: Mayor James E. Kirk, Council Members Noel Chandler, Mike 'Connor, Gary Ritter, and Dowling R. Watford, Jr., Administrator Whitehall, Attorney John R. Cook, City Clerk Lane Gamiotea, and Court Reporter Deborah Dew from Atlantic Reporting. MAYOR KIRK OPENED THE CLOSED EXECUTIVE SESSION AT 6:27 P.M. The discussion was limited to settlement negotiation and /or strategies relating to Case No. 2013CA000424. Those present were noted above, a court reporter is required by Florida Statute for this portion of the meeting. The full transcript will be submitted to the City Clerk's Office, and remain sealed until the final judgement of the litigation is signed. It will then be made part of the public record. Council Member Chandler made a motion to approve the Mediation Agreement of December 19, 2014, with language to be amended as legal counsel deems appropriate; seconded by Council Member Ritter. VOTE KIRK - YEA CHANDLER - YEA O'CONNOR - YEA RITTER - YEA WATFORD - YEA MOTION CARRIED. Mayor Kirk is authorized to execute the Agreement. It was noted that the litigation is still active. All materials, excluding the Agreement remain confidential, as well as refraining from discussing the matter.
