Chairman Frank Williamson, Jr. presided with the following members present: Chris Hooker, Robert Hoover, and Roger Jones. Also present were County Attorney Ed Curren, Zoning Administrator Walter Taylor, and Secretary Norma Williams. Robert Hoover made a motion to accept minutes of the regular meeting of April 12, 1988. Seconded by Chris Hooker. The vote was unanimous to accept the minutes as drafted. Chairman Williamson asked the Board members to take note of a letter received from the City of Okeechobee. (A copy of the letter follows.) He pointed out that the Board works for both the City Council and the Board of County Commissioners and should have the desire to do their job as well as can be done. He explained that at the beginning of every meeting the 16 factors are read which the Board considers on each petition. He stated that when a petition is recommended for denial the Board should carefully state the reasons for denial. After a discussion concerning the action needed when making a decision on any petitions, County Attorney Curren stated that their decision should be based on the consistency with the County Ordinance. It was the concensus of the Board that at all future meetings the members should be supplied with a copy of the factors to be considered. County Attorney Curren stated that the Board does not have a copy of the minutes of the Council's April 19, 1988 meeting to understand more clearly the reasoning behind the letter from the City. County Attorney Curren ready the factors in Section 16 (5) for the Board to consider in each of the following rezoning petitions. Old Business: PETITION #228 -R - ROBERT R. HOOVER - AC to RSF DRAITI A letter of withdrawal was submitted. It was the concensus of the Board to accept the letter of withdrawal. New Business: PETITION #229 -R - CARL & MARY WEIDLING, JACKY & LISA REDIKER, and THOMAS J. SCHMIDT, Et Al - RG -1 to C -II w /Sp.Ex. Mrs. Mary Weidling came before the Board and explained that she is repre- senting all of the subject property owners. The subject property faces industrially developed property which is a determining factor for the sales of it. She explained that a few years ago she had paid for and developed a road in front of the lots at her expense. The road had been then dedicated to the City to be maintained. She explained that she felt the proper zoning for the subject property would be the request- ed C -II zoning due to the location next to Hwy. 441 North. If approved it would be a good buffering zone between the RG -1 and Industrial zoning d...L L iT She presented photos of the subject property for the Board's review. There was a discussion concerning the location in the city at Northeast 10th Street, directly behind the office of Dr. Aragon. There were no letters and no audience discussion. Ms. Weidling explained that Leslie Summerford would like to be able to conduct his business from the subject property which would involve the storage of his equipment and materials. Chairman Williamson explained that part of the application will be handled during the Board of Adjustment. After a discussion concerning Mr. Summerford, County Attorney Curren reminded the Board to take note of the 16 factors when making a decision. After all factors were considered Roger Jones made a motion to Recommend Approval of the requested petition. Seconded by Chris Hooker. The vote was unanimous. The Planning Commission was adjourned. bP44 PP THE BOARD OF ADJUSTMENT CONVENED DIRECTLY THEREAFTER MAY 10, 1988 County Attorney read the factors for the Board to consider in each of the applications for a Special Exception. New Business: PETITION #218 -S - WEIDLING /REDIKER /SCHMIDT - SPECIAL EXCEPTION - Allow building trades contractor with yard on premises for storage of equip. & materials within requested C -II zoning ., ` A Mrs. Mary Weidling explained that she wanted the Special Exception on lots 19, 20, 21, and 22 only. She stated that Leslie Summerford wishes to conduct his business from the subject property and he has some equipment and materials which would be stored outside. Ms. Weidling stated that Mr. Summerford is aware that the Board can place conditions on the subject property and he is fully aware that he will have to abide by them. The Board discussed the following conditions which they felt were needed if approved: Fencing with a type of screening and hours of operation. After discussing all factors to be considered Robert Hoover made a motion to grant approval with two stipulations. County Attorney Curren reminded the Board of the factors to be considered. He explained that in Section 13.3 (e) (5) it states a requirement for screening and buffering. Robert Hoover amended his motion to state granting approval on Lots 19, 20, 21, and 22 only with the following conditions: (1) Fencing to include screening and buffering in order to preserve and improve compatibility and harmony of use and structure. (2) No night time activity which would create noise or smell. Chris Hooker seconded the motion. The vote was unanimous to grant approval County Attorney Curren read the factors to be considered in the following application for a Variance. 2 F. OPEN PUBLIC HEARING FOR REZONING PETITION: 1. Consider petition No. 229 -R for rezoning of property currently classified as RG -1 (Residen- tial General) to C -II with special exception. Subject property is located between N.E. 10th and llth Streets, west of N.E. 3rd Avenue - Exhibit 1 (City /County Planning and Zoning Commission recommended approval). CLOSE PUBLIC HEARING G. New Business 1. Motion to approve the appointment of Lynette Lowe as a customer service clerk assigned to the Pub- lic Utilities - Director of Public Utilities. COUNCI LMEMBER S /ACTION Motion by Councilman Thomas seconded by Council- man Rubin to uphold the City /County Planning and Zoning Commissions decision to approve the re- quest for rezoning of Petition # 229 -R. Discussion: Public input relative to the hear- ing included comments from Mr. Summerford, Mrs. Mary Weilding and Director of Public Utilities Fortner. Director Fortner informed Council there is only a 2" water line in the area. Other stipu- lations of the petition are: 1) Fencing to include screening and buffering in order to preserve and improve compatibility and harmony of use and structure. 2) No night time activity which would create noise or smell.
