The reason for requesting the rezoning is to put a retail girder center and flower shop on the .89 acres, which fronts State Road 71r Chairman Williamson expressed concerns for safety of vehicles enteri,, and exiting the property. Giles explained, he owns the adjoining property which already has an entrance and an exit. He will need to cut another road 150 feet south of this road in order to make a U drive. There were no letters and no questions or comments from the audience. After all factors were considered, Dan Delegal made a motion to Recommend Approval. Seconded by Roger Jones. The vote was unanimous to Recommend Approval. PETITION # 239 -R - J.B. W00DHAM - AC to RSF Mr. Mac Worrely come before the Board to represent the Petition. Mr. Worrely stated that the property is located on the west side of S.W. 28 Ave. and 660 feet south of Old Dixie. Mr. Worrely explained that he is proposing a 10 lot subdivision facing a 40 foot County Road Right of -Way. The lots are 125 feet deep and 145 feet wide. The request is to change the zoning from Agriculture Conservation (AC) to Residential Single Family (RSF). Chairman Williamson questioned possible problems with the drainage. Mr. Worrely stated, he felt that there would be no trouble with the drainage since there is very good drainage to the south. There were no letters and no questions or comments from the audience. After all factors were considered, Roger Jones made a motion to Grant Approval. Seconded by Jerry Bryant. The vote was unanimous to Recommend Approval. PETITION # 240 -R - MR. L.E. FERRELL - AC to CII Mr. Ferrell came before the Board to represent the Petition. Chairman Williamson noted that the property was located on State Road 78 and S.W. 16 Ave. Mr. Ferrell would like to rezone this parcel to Commercial II- (C-II) in order to sell the property to perspective buyers, who want to build a convience store on said property. There was no site plan to present to the Board as it was not completed. He stated that they feel there is adequate road access and egress, There will be a road on the east, west and south side of the store. There was some discussion on an error in the easement that is adjacent to the Shrine Club. Mr. Ferrell stated they are aware of the error in the easementI s going to be present- ed to the Board of County Commissioners at their next Meeting. Seconded by Dan Delegal. The vote was unanimous to Recommend Approval. Mr. Scherrer came before the Board, to represent the Petition. He pre- sented a folder to each of the Board Members, which contained pictures of the property located on S.W. 2nd Ave. He also presented a Petition of Agreement and consent for the rezoning with fifteen neighborhood re- sident signatures. (A copy of whish is attached.) He explained the reason for rezoning to Commercial II (C -II) is to put a retail antique gift shop on said property. Jerry Bryant asked Mr. Taylor if is is possible to grant C -I instead of C -Ii? Mr. Taylor stated it could be handled as a Special Exception, strickly as a gift shop under item #2 in C -I. 1, • 4 ittele,v Jerry Bryant suggested granting Mr. Scherrer C -I in lieu of C -II and he could still accomplish his goal. Mr. Scherrer agreed on C -I in lieu of C -II. There were no letters and no comments from the audience. Chairman William- son stated that the Board of Adjustment would review Mr. Scherrer's Special Exception tonight. Mr. Taylor advised the Chairman in order to file an application for a special exception, there is a $75.00 fee that is to be collected. County Attorney Curren stated that Mr. Scherrer would not have to pay the $75.00 fee. There was some discussion on a special except- ion number. County Attorney Curren said to reference the special excep- tion to the zoning application number. THE BOARD OF ADJUSTMENT CONVENED DIRECTLY THEREAFTER SEPTEMBER 131988 County Attorney Curren read the factors for the Board to consider in each of the following Special Exception Applications as found in Sect- ion 13 (3). It was the consensus of the Board to interrupt the agenda and start with Mr. Scherrer's Application first, so that he may not have to wait any longer. Ui 440:NUMBER , MR.
