1976-08-19 Recessed 1.999 CITY'S RETIREMENT SYSTEM The Council approved to set Thursday, September 9, 1976 at 3:00 P.M. to meet with Mr. Marvin Clayton, Assistant Director of the Municipal Police and Fire Retirement Fund to discuss the City's Retirement Plan. President Domer presiding. Councilmen E. H. Hunt, Edward W. Douglas, Larch Bass and Clif Betts, Jr. were present. Others present were: Sandra Bennett, City Clerk; David Conlon, City Attorney and Richard B. Spray, Building Official. PUBLIC H~ARING ORDINANCE NUMBER 271 - (118) - REZONING Pursuant to a Public Notice published August 5, 1976,. the meeting was opened as a public hearing to consider the request of William W. Burton to amend the zoning map by changing the zoning from Agricultural to Commercial on property described as "South 100 Feet of Fractional East one half of Block 217, First Addition to 0keechobee, Original Town of 0keechobee, as shown in Plat Book 1, Page 11." No one appeared to speak for or against the Ordinance. President Domer read the Ordinance, whereupon Councilman Douglas moved the adoption of Ordinance Number 271-(118) which was seconded by Councilman Bass and vote carried. PUBLIC H~ARING ORDINANCE NUMBER 271 - (119) - REZONING Pursuant to a Public Notice published August 5, 1976, the meeting was opened as a public hearing to consider the request of Buford Warf to amend the zoning map by changing the zoning from Agricultural to Commercial on property described as "Lots 4, 5 and 6, Block 3, 0r~ginal Town of 0keechobee". No objections were heard or filed. President Domer read the Ordinance, whereupon Councilman Betts moved the adoption of Ordinance Number 271-(119) which was seconded by Councilman Douglas and vote carried. 2000 PUBLIC HEARING ORDINANCE NUMBER 271-(120) - REZONING Pursuant to a Public Notice published August 5, 1976, the meeting was opened as a public hearing to consider the request of Zollie and Vineta Aldridge and Allen H. Aldridge to amend the zoning map by changing the zoning from Agricultural to Commercial on property described as "Lots 5 and 6, Block 14, Original Town of Okeechobee." No objections were heard or filed. President Domer read the Ordinance, whereupon Councilman Douglas moved the adoption of Ordinance Number 271-(120) which was seconded by Councilman Betts and vote carried. PUBLIC HEARING ORDINANCE NUMBER 271-(121) - REZONING Pursuant to a Public Notice published August 5, 1976, the meeting was opened as a public hearing to consider the request of W.C. Sherman, Executor of Roscoe L. Markham, Sr., Estate to amend the zoning map by changing the zoning from Residential (R-J) to Commercial on property described as "First Addition to the City, Lots ]0, 11 and 12, Block 220, Original Town of 0keechobee" No objections were heard or filed. President Domer read the Ordinance, whereupon Councilman Douglas moved the adoption of Ordinance Number 271-(121), which was seconded by Councilman Hunt and vote carried. PUBLIC HEARING ORDINANCE NUMBER 271 - (122) - REZONING Pursuant to a Public Notice published August 5, 1976, the meeting was opened as a public hearing to consider the request of Wallace W. Norton to amend the zoning map by changing the zoning from Residential (R-l) to Commercial on property described as "Lot 6, Block 143, Original Town of 0keechobee." No objections were heard or filed. President Domer read the Ordinance, whereupon Councilman Bass moved the adoption of Ordinance Number 271-(122) which was seconded by Councilman Betts and vote carried. ORDINANCE NUMBER 385 DESIGNATING AND ESTABLISHING THE CITY COUNCIL AS IT'~; LOCAL PLANNING AGENCY - SECOND READING. President Domer submitted on second reading by title only, an Ordinance designating and establishing the City Council as its' local Planning Agency. No objections were heard or filed. It was moved by Councilman Betts, seconded by Councilman Bass and vote ~carried that Ordinance Number 385 be approved on second reading. WATERWORKS IM~ROVE~NTS - 56' RAW WATER INT~E LINE Mr. A. F. Meeks and Mr. Robert E. Owen, Engineers of Robert E. Owen & Associates, Inc. were present submitting their certified bid tabulations on the 56' raw water intake line and water plant improvements and recommended the low bidder~ Layne-Atlantic Company of Orlando, Florida, be awarded the contract. President Domer read a letter from Mr. Lo,an Cashman, Vice President of Webb General Contracting, Inc. stating that on Section B, they were low bidder by $20,416.00 compared to Singer-La~e. They had been informed by Mr. Meeks of Robert E. Owens and Association, Inc. that the bid was for one contract and that beth Sections A and B of the bid will be awarded to the low bidder; also having two contractors on the same project would cause problems. Mr. Logan did not consider it in the best interest of the City to award one contract. Mr. Meeks informed the Council that the reason he recommended a single bid was because the bid was for one contractor. Attorney Conlon stated that the bid is worded such, that someone could ar~e that the bid relates to each of the two jobs, Section A and B. Mr. Owens stated that it would be difficult to have two contractors work on the job~ because of electrical ~d other connection problems. If the bid had been intended to be awarded to two contractors, it would have been clearly specified as to precise duties to each contractor. The bids last paragraph reads~ "The bid if made will be to the lowest ~d most satisfactory resp6nsible bidder." He pointed out that it wouldn't be feasible to have two contractors work on the job as one Company might cause problems with the other in the electric and raw water line projects. To award the bid to the most satisfactory responsible bidder.~ Following considerable discussion, the Council requested Attorney Conlon .to investigate the legalities and advise the Council. WATER MAIN EXTENSION TO MIDDLE SCHOOL President Domer informed the Council of Final Release of Lien from Richmond Company on the 8" water main extension from U.S. 441 West on 27th Street to the new 0keechobee Middle School site. Fortner, Jr., Director of Public Works; Edward Chisholm, Chief of Police; 01eh Godwin, Fire Chief and Bobby Dean, Assistant Fire Chief. FLORIDA DEPARTMENT OF TRANSPORTATION President Domer read two letters from The Florida Department of Transportation proposing to construct a highway lighting system on State Road 70 from N.E. 5th Ave. to Hamrick Street and questioning if the City is desirous of maintaining the system once it is constructed. Also advising the City that the proposed improvement on State Road 70 may requi~e relocation or adjustment of the City's utilities. Following discussion, Director Fortner was authorized to contact the Florida Power and Light Company regarding maintenance of the lighting system and to request a copy of the agreement from the Department for study. .SPECIFICATIONS - REPAIR AND PAINTING WATER TANKS Director Fortner submitted specifications for cleaning and painting the City's two 250,000 gallons elevated water tanks for the Councils approval to be opened October 5, 1976. It was moved by Councilman Betts, seconded by Councilman Bass and vote carried to approve the specifications as submitted and authorized the advert- ising to be published.
