WHEREAS, OWNER(S) hold fee simple title to the following described real property in Okeechobee County, Florida, to wit: LOT 6 OF BLOCK 143, CITY OF OKEECHOBEE, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 5, PAGE 5, PUBLIC RECORDS OF OKEECHOBEE COUNTY, FLORIDA. WHEREAS, the OWNER(S) desire to make certain improvements in the form of a business monument sign whose overall dimensions are a width of eight -feet, eight- inches, and height of six -feet, eight- inches, to be located at the commercial business office, whose address is 210 Northeast 3rd Avenue, and placed partially within the right -of -way of Northeast 3rd Avenue, which is an open and improved right -of -way, which is owned by the CITY; and WHEREAS, due to the OWNER(S) having only a six -foot front setback from the structure to the property line, it is not feasible to erect a visible sign within this small area, further, there is twenty -four feet seven inches from the property line to the Easterly edge of the CITY right -of -way line; and WHEREAS, the CITY Code of Ordinances, particularly Section 90- 580(a) prohibits sign placement within a CITY right -of -way, unless otherwise approved by the City Council; and WHEREAS, based on the uniqueness of this issue, whereby the building is located in a transitional area going from residential to commercial offices; it was originally built as a single family home, which has been remodeled multiple times to serve for various types of offices; combined with the lot dimensions and layout of the aforementioned Plat dedicated in 1914; and WHEREAS, after careful consideration on September 16, 2014 and October 21, 2014, the City Council agreed to enter in to an agreement as stipulated and set out herein. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth herein, the parties agree as follows: 1. That the conditions of the approval by the City Council include that OWNER(S) agrees that not more than 50 percent of the proposed eight -feet, eight- inches wide by six -feet, eight- inches high sign may encroach into the CITY right -of -way. 2. That the sign will comply with all applicable Codes within the CITY for design, size, lighting, or other regulation excepting only that contained in Section 90- 580(a). 3. That OWNER(S) will at all times maintain the sign, including the area within the CITY right -of -way adjacent to the sign. 4. The CITY hereby grants this revocable license for use of the right -of -way with the understanding the CITY will maintain the right -of -way, swale and drainage areas, except those immediately adjacent to the sign itself, and should it ever become necessary to remove the sign or any portion thereof, or any improvement thereon, in order to allow either the installation, or maintenance of water, sewer, or other utility lines, drainage improvements, or any other type of installation or construction, for purposes of public safety, or for any other reason chosen by the CITY, the sign or any improvement thereon, will be removed by the OWNER(S) or their agents and /or assigns at the OWNER(S) expense within seven days of receipt of written request by the CITY for such removal, without recourse, claim or demand by OWNER(S). Should the CITY, for valid reasons, require the Page 1 of 2 removal of the sign or any improvements thereon, less than seven days notice, the OWNER(S) agrees to exercise reasonable efforts to comply with such requests. 5. OWNER(S) agree to contact their insurance company and require a rider be added to their insurance policy with a certificate furnished to the CITY showing that the CITY right -of -way adjacent to the property of OWNER(S) at Northwest 3rd Avenue, and Lot 6 of Block 143, City of Okeechobee, as herein described, to be used by them, insures the CITY against any liability arising out of alleged injuries or other activities which may occur within the right -of -way. In any event, OWNER(S) agree and shall hold the CITY harmless for any and all action, suit, claim, injury or cause of action of any nature arising out of OWNER(S) permissive use, and indemnify CITY for such, including costs and attorney fees. 6. That OWNER(S) agrees to furnish a copy of the Certificate of Additional Insured to the City annually upon renewal with their insurance carrier. 7 That OWNER(S) shall not, by such improvements made to that described right - of -way, obstruct, close or otherwise restrict access to the right -of -way for travel thereon by the CITY or the general public. 8. That the OWNER(S) agree that this License is non - assignable without the express written consent of the CITY; excluding only a transfer to a corporate identity in which Shaun C. Penrod, Sr., is majority owner, and if transferred, the covenants herein shall bind the corporate entity to the same extent as OWNER(S). 9. At first glance, I would direct you to City Code Section 90 -571 (Ch 90, Art 4, Div 5), Freestanding monument signs. Sec. 90 -571. Freestanding monument signs.:;;~ Freestanding monument signs are permitted within all commercial and industrial zoning districts provided that; (1)The sign area for each multiple occupancy complex and each occupant not located in a multiple occupancy complex shall not exceed 64 square feet in area, or eight feet in height. (2)No development shall have more than one freestanding monument sign. (3WThev are located consistent with all applicable set back requirements and are not located in a public right-of-way As you can see, monument signs are expressly prohibited on City R -O -W, however the construction of any sign or structure, for that matter, encroaching on City R -O -W is beyond what the building department could issue a permit for. Even in the event of a setback encroachment, not that this is the case here, a permit may be issued but only after a variance is granted, for good cause, from the Board of Adjustments /Appeals. Having mentioned the above, I've been apprised of Code Section 90 -580. Placement standards Sec. 90 -580. Placement standards. (a)Supports for signs or sign structures shall not be placed in or upon a public right -of -way or public easement, except under the terms of a lease between the owner of the easement or right -of -way, and the owner of the sign, or with the written approval of the City of Okeechobee. Bldg Permit for Monument Sign on City ROW - C. Penrod Page 1 (b)No sign or sign structure shall be erected that impedes the use of any fire escape, emergency exit or standpipe. (c)All signs on private property shall be located in conformance with the minimum yard regulations of the district in which the sign is located, except that signs in street yards shall comply with the following requirements and limitations: (1)No part of any sign shall be located closer than one foot to the property line; and, (2)For signs on corner lots and located within the visibility triangle, the bottom of the sign shall be at least ten feet above the crown of the adjacent road, or the top of the sign shall be less than two feet, six inches above the crown of the adjacent road. I've consulted with the City Attorney, who concurred that in light of the Code provisions mentioned herein, the Building Official cannot issue a permit for placement of the sign in the right of way. However, an applicant always has an opportunity to appeal administrative decisions to the City Council. With the above in mind and upon your request, the City staff is deferring the decision to allow an encroachment onto City R -O -W, as contemplated in the building permit application, to the City Council. The next scheduled City Council meetings are September 16 and September 30.
