CALL TO ORDER — Chairperson. The July 17, 2014, Technical Review Committee meeting was called to order at 10:00 a.m. by Chairperson Whitehall. 11. STAFF ATTENDANCE - Secretary. MINUTES — Secretary. A. Building Official Newell moved to dispense with the reading and approve the June 19, 2014, regular meeting minutes; seconded by Public Works Director Allen. Motion carried unanimously. IV. NEW BUSINESS — Chairperson. A. Dunkin Donuts 14- 003 -TRC. Application was submitted by Mr. Albert Zakhary, on behalf of the property owner, First Bank of Indiantown /Harbor Community Bank, in regards to converting an existing 5,000 square foot former bank building into a Dunkin Donuts restaurant with drive - through service located at 205 EN Park Street, Okeechobee, Florida. City Planning Consultant Brisson explained to the Committee that the applicant recently received approval from the Board of Adjustments for a Special Exception No. 14- 001 -SE, for a drive - through service associated with the restaurant. The site plan indicates the operation of an eat -in, take -out, and drive - through service. The customer service and kitchen areas of the restaurant will occupy 1,000 square feet of floor area. The remaining 4,000 square feet will be used as central warehouse /storage area for cleaning supplies, excess signage, unused ovens/tables, etc. for other Dunkin Donuts stores which the applicant is looking to build within a 30 to 50 mile radius. Mr. Zakhary also stated that should he receive approval for additional parking in a manner allowed under the City's Land Development Regulations, the warehouse /storage space may be converted to other uses in the future. Mr. Brisson presented his findings, contained in the Planning Staff Report, commenting that the potable water and sanitary sewer demand is not expected to materially exceed that of the former bank use. However, a letter from the Okeechobee Utility Authority stating there is adequate capacity to serve the proposed use should be provided. TRC - July 17, 2014 - Page 2 of 3 IV. NEW BUSINESS CONTINUED. A. Dunkin Donuts 14- 003 -TRC continued. The County has confirmed in the past that there is a considerable level of excess capacity available to serve the solid waste disposal needs of other developments therefore, it appears reasonable that the volume of solid waste associated with this use can be accommodated. In regards to traffic impact, no significant increase in peak hour traffic is expected as a result of this proposed use. The proposed site plan indicates two access points to the parking lot, one from East North Park Street, the second, from North East 2nd Avenue, both are existing curb cuts. The drive - through access would be from Northeast 2nd Avenue only. The exit from the parking lot and drive - through would be onto East North Park Street only. The traffic analysis prepared by Calvin, Giordano & Associates concluded that the drive - through allows for storage of eight vehicles, as shown on the site plan, will accommodate the expected patronage without spillback into Northeast 2nd Avenue. Planner Brisson noted his concern for safety and convenience of vehicles entering via Park Street, combined with those exiting the parking lot and drive- through. In regards to drainage, the site is almost 100 percent impervious and no changes are proposed that increase the size of the building or other impervious surfaces. The existing storm water system will remain intact. Seventeen parking spaces are provided one being handicapped. Mr. Brisson pointed out that the spaces on the south side of the building measure 19 feet instead of the required 20 feet deep. The three parallel parking spaces measuring 11 feet by 22 feet are of adequate size. Given their location on the east side of the drive aisle, it would appear they are intended to be used by persons entering from the Park Street entrance. However, access to the northernmost parallel space is questionable, given its proximately to the curve along the drive - through aisle unless the space immediately to the south is unoccupied. Access to this space would be more convenient and safe if it were designated as a compact space. Continuing, Mr. Brisson added, it appears the drive - through is also being used as the loading space. Doing so, would cause the drive- through to be closed during deliveries. He does not consider this to be in compliance as the City code requires the loading space to be "designed to permit access without moving another vehicle." There are existing sidewalks along Park Street and Northeast 2nd Avenue. A photometric lighting plan should be submitted and no dumpster location is shown on the plans. Based on Mr. Brisson's analyses, he recommended approval providing the applicant can adequately remedy the following deficiencies or explain why no changes are necessary. First, vehicles exiting the drive- through must be restricted from attempting to exit onto Northeast 2nd Avenue. Second, resolve the potential for conflict between vehicles exiting the drive - through, entering into the parking lot and those backing out of parking spaces on the south side of the building. Third, resolve the concern over the ability of exiting drive- through vehicles to adequately set up for the right -hand turn onto Park Street. Fourth, ensure that all parking spaces are at least 20 feet deep. Fifth, ensure that the northernmost parallel parking space adjacent to the drive - through lane is easily accessible when the space to the south is occupied, or designate it as a compact space. Sixth, designate a loading space that meets the ode requirements and does not interfere with vehicles using the drive - through lane or any other points of internal circulation, access or egress. Seventh, provide a photometric lighting plan meeting the code requirements, (Section 78- 71(a)(5)) and eighth, provide an acceptable location for a dumpster. County Environmental Health Department: Mr. McCoy was unable to stay for the entire meeting, leaving at 10:37 a.m., although he relayed to Administrator Whitehall that he had no issues to report. OUA: Mr. Hayford was unable to attend the meeting and he relayed to Secretary Bumette that he had no issues to report. TRC - July 17, 2014 - Page 3 of 3 IV. NEW BUSINESS CONTINUED. A. Dunkin Donuts 14- 003 -TRC continued. Building Official: No issues were received. Public Works: No issues were received. Police Department: No issues were received. Fire Department: No issues were received. Mr. Stephen Dobbs, of Steven L. Dobbs Engineering, LLC, was present on behalf of the property owner, and applicant, together with Mr. Jankristof Devastey, P.E. of Calvin, Giordano & Associates, Inc. After considerable discussion of issues identified, a modified site plan was presented. Fire Chief Smith moved to approve the site plan for Application No. 14- 003 -TRC, as modified during the meeting, in regards to converting an existing 5,000 square foot former bank building into a Dunkin Donuts restaurant with drive- through service for Lots 7 to 9 of Block 153, City of Okeechobee subdivision, and located at 205 EN Park Street, Okeechobee, FL; with the following stipulations: Vehicles exiting the drive - through must be restricted from making a right turn and attempting to exit onto Northeast 2nd Avenue as recommended by the Applicant's Traffic Engineer; the issue of the potential for conflict between vehicles exiting the drive through and indoor customers pulling into or backing out of parking spaces located on the south side of the building was resolved by acceptance of the Traffic Engineers explanation as how the arrangement is acceptable under normal traffic engineering practice; the driveway fronting on Park Street will be identified by signage as a "exit only" and all vehicles entering the property will do so via Northeast 2nd Avenue; there will be a minimum of 17 parking spaces, all parking spaces to the east of the drive through will be converted to angle parking meeting the minimum dimensions required; the perpendicular spaces at the south side of the building will be at least 20 -feet deep and will be permitted to overlap up to one (1) foot over the sidewalk adjacent to the building, provided the sidewalk continues to meet ADA standards; the drive aisle serving exiting drive- through customers will be widened to at least 24 feet; the loading space will be permitted to be located in the drive- through aisle provided loading and unloading operations are only conducted between the hours of 11 p.m. and 5 a.m.; and the dumpster location is within East/West alley to the North of the property seconded by Police Chief Davis. Motion carried unanimously. V. ADJOURNMENT— Chairperson. Considerable discussion was held among the TRC members and between the TRC regarding all topics of substance identified in the Staff Report and /or brought up by the individual members of the TRC. At the end of the meeting, a motion was made, seconded, to approve the site plan as modified during the meeting with the following stipulations that were stated and accepted by the Applicant during the discussions and /or specifically included in the motion: 11. Vehicles exiting the drive - through must be restricted from making a right turn and attempting to exit onto NE 2nd Avenue as recommended by the Applicant's Traffic Engineer. 2. Purpose: The purpose of this report is to provide the City of Okeechobee and the Florida Department of Transportation with the calculations and documentation to demonstrate that the proposed modifications to the existing structure and site for Dunkin' Donuts complies with applicable state and local requirements. Existing Conditions: The site is 0.49 acres in size and is located in Sections 15, Township 37 South, Range 35 East. It is located in the City of Okeechobee, on the northeast corner of SR 70 and NE 2 "d Avenue, on the following parcel (Parcel ID 3- 15 -37 -35 -0010- 01530- 0070). The site is currently fully developed with an existing 5,000 sf building and ancillary parking. At the May meeting of the City of Okeechobee Appeals and Adjustments Board, a special exception for a drive thru was granted to the parcel. The current drainage onsite is directed toward an exfiltration system and no changes are proposed for this existing system, which apparently work adequately. Proposed Proiect: This request is for a construction permit to modify the parking to accommodate a drive thru restaurant. The drive thru is planned to access from NE 2 "d Avenue and either complete a u turn in the parking lot back to NE 2 "d Avenue (the preferred route) or continue to the access on SR 70, where a right out only will be the access to SR 70. Approximately 14 parking spaces will be removed to accommodate the modification and three added to the existing 14 onsite parking spaces. The handicapped parking area will be moved to the south of the building, closer to the front door since it will be eliminated by the drive thru lane. Potable water and wastewater service is provided by OUA and no change is proposed. Parking: Please see attached Parking Calculation Drainage Considerations: The site is currently almost 100% impervious and no changes are proposed and as stated earlier the existing stormwater system will remain intact. Off -Site Drainage: There is off -site drainage anticipated as there are no site modification proposed that will alter the existing flow. Construction Recommendations: Runoff and/or any water generated by short -term dewatering during construction will be contained on -site within the existing stormwater system. Conclusions: In my professional opinion, the proposed construction should have no impact to existing drainage patterns off -site and should have no impact on off -site areas. The recommendations above should be followed during and after the site work until such time as the ground surface has been adequately stabilized to prevent the off -site transport of any soil or suspended solids. The proposed modification is to convert some of the existing space allocated to parking to a drive - through window. The project location is on SR -70/NE Park Street between NE 2nd Avenue and NE 3`d Avenue with access though two (2) ingress /egress driveways: one (1) driveway abutting NE Park Street and one (1) driveway abutting NE 2nd Avenue. The purpose of this analysis is to ensure that traffic circulation on -site will not be negatively impacted as a result of the proposed modification. Trip Generation A comparison of the existing and proposed configurations was perfonned to determine the anticipated number of trips generated on -site by the addition of the drive - through. Vehicular trips were calculated for the peak period of an average weekday using trip generation rates from Institute of Transportation Engineers (ITE) Trip Generation Manual (9th Edition). Since the generation rate for the AM Peak period is the most conservative, the analysis was only completed for the AM Peak period. The results of the trip generation analysis for the proposed development are presented in Table 1. The queuing analysis was performed using a single - channel waiting line model with Poisson arrivals, exponential service times and finite queues. The analysis is based on the coefficient of utilization (p) which is the ratio of the average arrival rate of vehicles to the average service rate. The service rate corresponds to the average time it will take a drive- through attendant to process an order before moving on to the next vehicle. The average service rate of 50 seconds per vehicle was utilized in this analysis based on input from the applicant. A queuing report from another Dunkin' Donuts Drive- Through showing the average service times is presented in Attachment A. The queuing analysis yielded an average queue of 6 vehicles and a 26.78% probability of having more than 8 vehicles in queue. Based on the results of the queuing analysis, the proposed drive - through configuration provides sufficient storage to accommodate the traffic generated as a result of the modification without spillback into the public right -of -way. It should be noted that the processing rate utilized in the analysis was derived from another Dunkin' Donuts with one (1) register and one (I) sandwich maker. Based on input from the applicant, this Dunkin' Donuts is operating with two (2) registers and two (2) sandwich makers which will increase the processing rate at the drive - through and further reduce the probability of spillback into the public right -of -way. The queuing exhibit and queuing calculations are provided in Attachment B. Auto -Turn Analysis An analysis was performed using Auto -Turn analysis software to determine if the turning radii provided on -site are sufficient to accommodate the vehicles without encroaching on parking stalls and /or curbs. The Auto -Turn analysis follows guidelines from the American Association of State Highway and Transportation Officials' ( AASHTO) Geometric Design of Highways and Streets Manual. The design vehicle utilized for the analysis is AASHTO Code P which is a 19 foot passenger car with a 21 foot centerline turning radius. Based on the results of the analysis, the radii provided are adequate to accommodate the different turning movements on -site with the exception of vehicles exiting the drive - through attempting to access the NE 2 "d Avenue driveway. This letter is to express some direction to you about what appears to be an inevitable Technical Review Committee meeting. As you know, we have considerable experience in reviewing plans, but, it is not the responsibility of the TRC, or our planner, to prepare what needs to be a formal analysis of the proposed traffic pattern and parking area associated with the facility. I think you would concur that it is also outside of your expertise. Therefore, it's incumbent upon the Applicant to have a certified traffic engineer or transportation planner prepare the analysis and, in order to be useful, the report should include at a minimum, the following: 1. Whether or not the proposed site plan provides for safe and convenient internal circulation and ingress and egress to /from the site. It should also address whether or not the alley, as the primary source of access to the drive- through facility, is capable of handling the current vehicular demands from those that now use the alley as well as the additional traffic that will be generated associated with day -to -day demands of Dunkin Donuts' customers. 2. The report should also state to what extent the driveways on SR 70 and NE 2nd Avenue and the alley will be used for deliveries of materials to the business. 3. Finally, the report should also address whether or not the alley can continue as a two -way service alley handling the current traffic and that expected from the Dunkin Donuts' operation. With the above in hand, in addition to the standard items that need to be addressed during the TRC's review of a site plan, I think we can make a constructive review based on an educated approach rather than on assumptions and guesswork that could jeopardize the decision. Or, even worse, have the applicant invest considerable resources that result in constant traffic /parking issues that require additional resources to correct or result in customer dissatisfaction or compromised safety for years to come. It appears reasonable that the volume of solid waste associated with a development of this size can also be accommodated within the capa- city of the County's Solid Waste Facility. Traffic and Interior Circulation: Traffic Generation: In the application for the Special Exception the Applicant indicated that based on ITE's 8th Edition ITE Trip Generation Report the former First Bank of Indiantown traffic generation was estimated at just under 61 trips during the weekday peak hour. Using the traffic generation factors included in the traffic analysis prepared by Calvin, Giordano & Associates (CGA), a 1,000 square foot coffee /donut shop could be expected to generate about 64 trips during the weekday peak hour. Consequently, we agree that there will be no significant increase in peak hour traffic as a result of the proposed use. Access and Egress: Access and egress for indoor customers will be provided via a right - in and right -out on NE Park Street (SR 70) and, presumably a left and right in and right out on NE 2nd Avenue. Drive - through customers will be limited to entering by either a left or right in from NE 2nd Avenue and exiting only via a right -out onto NE Park Street (SR 70). Interior Circulation: The CGA analysis concludes that the drive - through facility allowing for storage of eight vehicles, as shown on the site plan, will accommodate the expected drive - through patronage without spillback into the public right -of -way. The CGA report also recommends that vehicles exiting the drive - through be restricted from making a right turn and attempting to exit onto NE 2nd Avenue. We are concerned over the potential for conflict between vehicles exiting the drive - through and indoor customers pulling into, and particularly those backing out of, the two spaces immediately west of the handicapped space on the south side of the building. We feel it would be important to have the Applicant's traffic expert explain, in his opinion, if and how this arrangement is acceptable. We also have doubts about the ability of exiting drive - through customer vehicles to adequately set up for the right -hand turn onto SR 70. The CGA Autoturn Exhibit (provided on page 10 of this report) shows this maneuver and we are not sure that this provides for a safe and convenient exit from the property onto SR 70. This may be due, in part, to the fact that the existing drive aisle in this area looks to be only about 20 or 21 feet wide rather than 24. Consequently the existing stormwater system will remain intact. Comparison of Proposal with Dimensional Standards, CBD Zoning Regulation Required Provided Minimum Parcel Size and Width, Setbacks, Lot Coverage, Impervious Surface Coverage and Landscaping Requirements: Since the use is being introduced into an existing building with no significant modifications to the build- ing or increase in impervious surface coverage, none of the above requirements need be considered. Off- street Parking One space per 75 sq. ft. of restaurant space: (1,000 _ 75) = 13.3 One space per 1,000 sq. ft. of warehouse /storage space 4,000 _ = 4 Total spaces required = 17 At least one of the required spaces must be designated for the handicapped. Parking spaces must be at least 9 feet by 20 feet; and handicapped spaces must be 12 feet by 20 feet with a five -foot wide handicap aisle. 17 spaces are provided one of which is designated for the handicapped. As noted in the Interior circulation section, we are concerned over the potential for conflict between vehicles exiting the drive - through and indoor customers pulling into, and particularly those backing out of, the two spaces immedi- ately west of the handicapped space on the south side of the building. We feel it would be important to have the Applicant's traffic expert explain, in his opinion, if and how this arrangement is acceptable. The detail sheet shows parking spaces being 20 -feet deep; but the spaces on the south side of the building clearly scale in at only 19 feet. All other perpendicular spaces are at least 9' x 20', as required. The three parallel parking spaces (11' x 22') are of adequate size. Given their location on the east side of the drive aisle, it would appear they are intended to be used by persons entering the property from the SR 70 entrance. How- ever, it appears that ability to access the northernmost parallel space is questionable, given its proximately to the curve in the drive - through aisle unless the space immediately to the south is unoccupied. Vehicles exiting the drive - through must be restricted from making a right turn and attempting to exit onto NE 2nd Avenue. 2. Resolve the potential for conflict between vehicles exiting the drive - through and indoor customers pulling into, and particularly those backing out of, the two spaces immediately west of the handicapped space on the south side of the building. 3. Resolve the concern over the ability of exiting drive - through customer vehicles to adequately set up for the right -hand turn onto SR 70. 4. Ensure that all parking spaces are at least 20 -feet deep. 5. Ensure that the northernmost parallel parking space adjacent to the drive - through lane is easily accessible when the space to the south is occupied, or designate it as a compact space. 6. Designate a loading space that meets the LDC requirements and does not interfere with vehicles using the drive - through lane or any other points of internal circulation, access or egress. 7.
