768.28 concerning an accident that occurred on April 24, 1995 at
SR -70 entering the 100 block of N.W. 6th Street, City of
Okeechobee, Florida.
Dear Sir:
As you know, we represent Alice M. Hays for personal injuries
arised from an accident that occurred on April 24, 1995 on SR -70
entering the 100 block of N.W. 6th Street, City of Okeechobee,
Florida.
The Claimant was handcuffed and forcefully placed in a patrol car,
but apparently the rear back door was never closed and when the
vehicle turn left at such a high speed, Ms. Hayes rolled to her
right and exited the vehicle head first. She struck the pavement
with her right shoulder.
As result of this act the claimant was transported to Raulerson
Memorial Hospital Emergency Room where she was X -rayed and
released. Follow up care with Dr. Sweda, Dr. Platt and Dr. Peter
Stephens.
CERVICAL SPINE X RAYS:
A loss of cervical lordosis with some degenerative changes along
the anterior body of C5 -C6. (Any pain associated with rigidity is
substantiated by objective clinical findings but associated
demonstrable degenerative changes (3 %).
MRI OF THE LUMBAR SPINE (02/23/96 Raulerson HospitaL1.
Herniated disc localized in the mid line of L3 -L4 level. (Herniated
invertebral disc single vertebral level, not surgical treated, with
resolution of objective neurological findings (7%).
The presence of these problems involves future medical care and
attention, which will cause the cl.aiinant to severe limitations for
her normal activities of daily living, including particularity her
earning capacities.
Information from both medical and nonmedical sources may be
provided to you with detailed descriptions of the iniiividual's
actions. This information can be provided to you by neighbors and
family members, who have knowledge of the claimant's function.
The results and the advancement of this lawsuit will be placed at
a solution level, and to better clarification of the problem we
will furnish all the available information that we have.
The assessment of our investigation, and the authorization of our
client, leaded us to settle this case for Two Hundred Thousand
(200,000.00) Dollars for a complete settlement..
