LETTER OF UNDERSTANDING
THIS AGREEMENT, BY AND BETWEEN THE CITY OF OKEECHOBEE,
FLORIDA, a Florida municipal corporation (hereinafter "CITY ") and Deloris E. Bowen, John
Bowen Trustee (Life Estate), (hereinafter "OWNER "), dated this /84k. day of r} 1 ,
1999. 1
WHEREAS, OWNER hold fee simple title to the following described real property in
Okeechobee County, Florida, to wit:
Lots 9 and 10, Block 106, City of Okeechobee, according to the Plat thereof
recorded in Plat Book 1, Page 10, Public Records of Okeechobee County,
Florida; and
WHEREAS, OWNER has certain improvements in the form of a fence located on Lots 9
and 10 which encroaches in the Public easement in said Block 106, which is owned by the CITY, and
WHEREAS, the parties desire to amicably resolve the problem of the encroachments.
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth
herein, the parties agree as follows:
1. The CITY agrees to forgo any action to compel the OWNER to remove the existing
encroachments from the public property so long as the OWNER abides by the terms of this
agreement. The forbearance by the CITY shall not constitute a waiver of any rights in and to the
public property affected nor shall it be deemed as acquiescence to a claim of adverse possession or
of prescriptive easement by the OWNER.
2. The OWNER agrees that they shall not expand the encroaching portions of the fence nor
shall they upgrade or improve said fence, other than necessary maintenance to preserve the existing
design and construction of the fence.
3. The OWNER agrees that they shall, at their expense, remove the encroaching fence,
including any portion within any required set back areas, within seven days of receipt of written
request by the CITY for such removal. Should the CITY, for valid reasons, require the removal of
the fence on less than seven days notice, the OWNER agrees to exercise reasonable efforts to comply
with such requests.
IN WITNESS WHEREOF, the parties hereto set their hands and seals on the aforesaid date.

While recently conducting audits on our files it was discovered that the City
hasn't been receiving a Certificate of Insurance relating to a Use of Street
Agreement for Block 106. This is just a friendly reminder that one of the
covenants of the agreement between you and the City for the use of street
requires you to provide the City with proof of liability insurance protecting the City
from liability for injuries. arising out: of the use of the street as stipulated in the
agreement. This notification to the City must be kept on a current basis as your
insurance policy is renewed.
Please provide the City with the renewed proof of insurance as required. If you
have any questions or the status has changed since you entered into this
agreement please call this office and advise us of any changes. With best
