LICENSE AGREEMENT
THIS AGREEMENT, BY AND BETWEEN THE CITY OF OKEECHOBEE, FLORIDA, a Florida Municipal orporation
(hereinafter "CITY"), and RAYMOND A. ARRANTS, (hereinafter "OWNER(S) "), dated this c /i`t- day of

WHEREAS, OWNER (S) hold fee simple title to the following described real property in Okeechobee County, Florida,
to wit:
Lots 15 and 16 of Block 20, and Lots 1 to 4 of Block 25, WOODLAND PARK, 4titsje=of-
Olteeehaises according to the Plat thereof recorded in Plat Book2, Page?$, public records of
Okeechobee County, Florida; and
WHEREAS, the OWNER(S) desire to keep improvements in the form of a driveway, located within the rights -of -way
of Southwest 18th Street and 4th Avenue, which is an open, unimproved rights -of -way, which is owned by the CITY.
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth herein, the parties agree as
follows:
1. The CITY hereby grants this revocable license for use of the rights -of -way with the understanding the
OWNER(S) will maintain the rights -of -way and should it ever become necessary to remove the driveway, or
any improvement thereon, in order to allow either the installation, or maintenance of water, sewer or other
utility lines or any other type of installation or construction, or for any other reason chosen by the CITY, the
driveway, or any improvement thereon, will be removed by the OWNER(S) or their agents and /or assigns at
the OWNER(S) expense within seven days of receipt of written request by the CITY for such removal. Should
the CITY, for valid reasons, require the removal of the driveway, or any improvements removal of the
driveway, or any improvements thereon less than seven days notice, the OWNER agrees to exercise
reasonable efforts to comply with such requests.
2. OWNER(S) agree to contact their insurance company and require a rider be added to their insurance policy
with a certificate furnished to the CITY showing the portion of Southwest 18th Street located South of Lots 15
and 16 of Block 20 and a portion of Southwest 4th Avenue located between Lot 16 of Block 20 and Lots 1 -
2 of Block 25 and West of Lots 3 - 4 of Block 25, as herein described, to be used by them, insures the CITY
against any liability arising out of alleged injuries or other activities which may occur within the rights -of -way.
In any event, OWNER(S) agree and shall hold the CITY harmless for any and all action, suit, claim, injury or
cause of action of any nature arising out of OWNER(S) permissive use, and indemnify CITY for such,
including costs and attorney fees.
3. That OWNER(S) shall not, by such improvements made to the described rights -of -way, obstruct, close or
otherwise restrict access to the rights -of -way for travel thereon by the CITY or the general public.
4. That the OWNER(S) agree that this license is non - assignable without the express written consent of the CITY;
and if transferred, the covenants herein shall bind themselves, their heirs and assigns, and said covenants
shall run with the land.
5. The City Clerk shall cause this agreement to be recorded in the public records of Okeechobee County, Florida.

•
THIS AGREEMENT, entered into by and between CITY OF
OKEECHOBEE, FLORIDA, a municipal corporation under the laws of the
State of Florida, (City), and MATTHEW SEDER and LINDA SEDER, his

wife, (Seder), dated this 15th day of December , -,
for good and valuable consideration, the sufficiency of which is
herein acknowledged, it is agreed as follows:
WHEREAS, Seder has requested that the City permit them to
extend an unused street or right -of -way within the City, known as
Southwest 18th Street from Lots 16 in Block 20, WOODLAND PARK, City
of Okeechobee, to Lots 2 and 3, Block 25, WOODLAND PARK; and
WHEREAS, the streets or rights -of -way designated on the Plat
in this area are not presently opened, or in use within the City;
the right -of -way is heavily wooded; and various neighbors have
signed a petition noting that as the rights -of -way are not in use,
that the trees in the entire right -of -way should not be removed at
this time; and
WHEREAS, the City typically would require any landowner
seeking the use of such a street to fully open, at the expense of
the landowner, the entire right -of -way, but that the Seder
situation is somewhat unique in that none of the streets in this
area are open, and are not anticipated to be opened in the near
future; and
WHEREAS, Seder has expressed an intent that were they given
the right to use a portion of S.W. 18th Street to obtain access to
their residence, that in the future if the City ever sought to

fully open this street, or the adjacent unopened street known as
S.W. 4th Avenue at its intersection with S.W. 18th Street, that
Seder would agree, at their own expense, to complete the opening of
S.W. 18th Street; and
WHEREAS, as the City agrees that in this particular situation
such an agreement would be in everyone's best interests at this
time; it is therefore,
AGREED by and between the parties as follows:
1. THAT Matthew and Linda Seder, their heirs, executors,
assigns and grantees are herein granted the right and use of the
street or right -of -way at S.W. 18th Street, WOODLAND PARK, City of
Okeechobee, from Lot 16, Block 20, to Lots 2 and 3, Block 25, for
use as an entrance or right of ingress and egress to and from their
residence in Block 25, WOODLAND PARK.
2. THAT the City will not at this time cause or require the
Seders to fully open the street, or incur any other expense, other
than their own costs in making the right -of -way suitable for access
to and from their residence.
3. THAT in return, Matthew and Linda Seder, their heirs,
executors, assigns and grantees agree, and shall upon demand of the
City, perform the following:
a. In the event, in the sole discretion of the City,
that it would be in the Public Interest to fully open S.W.
18th Street, then Seder, et al., shall bear the expense of any
clearing and grading that portion of S.W. 18th Street from Lot
16, Block 20, WOODLAND PARK, to Lots 2 and 3, Block 25,

WOODLAND PARK.
b. That Seder, et al., shall be solely responsible,
unless and until said street is fully opened for use by the
Public, for the maintenance and improvements of that portion
of S.W. 18th Street as needed by Seder for ingress and egress
to their residence.
c. That Seder, et al., shall hold the City harmless,
and indemnify the City, including fees and costs, for any and
all accident, injury, claim, suit demand or cause of action of
every nature sustained by Seder, their family, guests or
invitees, that may arise by the use of this portion of S.W.
18th Street by Seder, their family, guests or invitees.
d. That the City reserves the right to dictate any
improvements as the City deems necessary, at the expense of
Seder, for purposes of proper drainage along the north side of
this portion of S.W. 18th Street.
e. That the City reserves the right at any time to use
said right -of -way for municipal purposes, including surveying,
clearing, installation of utilities, above or below ground, or
any other legitimate Public purpose, and if said use by the
City in any way causes or requires movement, alteration or
damage to the right -of -way as it exists, that Seder shall be
solely responsible for repairing same for their own use.
4. That this agreement shall run with the land, and be
binding on subsequent assignees, heirs, executors or grantees of
Seder.

Dear Mr. Seder:
While recently conducting audits on our files it was discovered that the City
hasn't been receiving a Certificate of Insurance relating to a Use of Street
Agreement for Block 20 & 25. This is just a friendly reminder that one of the
covenants of the agreement between you and the City for the use of street
requires you to provide the City with proof of liability insurance protecting the City
from liability for injuries arising out of the use of the street as stipulated in the
agreement. This notification to the City must be kept on a current basis as your
insurance policy is renewed.
Please provide the City with the renewed proof of insurance as required. If you
have any questions or the status has changed since you entered into this
agreement please call this office and advise us of any changes. With best

Dear Mr. & Mrs. Arrants:
While recently conducting audits on our files it was discovered that Mr. Matthew
J. Seder signed an agreement with the City to utilize a portion of Southwest 18th
Street and a portion of 4th Avenue as a private drive. The City Attorney has
advised that since the agreement with Mr. Seder wasn't recorded it doesn't follow
the property to you as the new owner. The City would like to afford to you the
same arrangement in order to allow the continued use of the City's rights -of -way.
Enclosed is an agreement for you to review, execute, and return to my office by
May 7, 2009. Please call me with any questions you may have.
