1976-05-25 Regular 1975- SECOND REGULAR MEETING TUESDAY, MAY 25, 1976 The City Council of the City of 0keechobee, Florida, convened in regular session in the Council Chambers at City Hall, 0keechobee, Florida, Tuesday May 25, 1976, at 7:00 P.M., President Russell V. Domer presiding. Councilmen E. H. Hunt, Edward W. Douglas, Lavon Bass and Clif Betts, Jr. were present. Others present were: Sylvia Christian, Deputy Clerk; L. C. Fortner, Jr., Director of Public Works; Edward Chisholm, Chief of Police; Richard B. Spray, Building Official and David Hunter, Humane Officer. The invocation was offered by Councilman Edward W. Douglas. BUBLIC HEARING ORDINANCE NO. 271-(114) - REZONING Pursuant to a public notice published May 6, 1976, the meeting was opened as a public hearing to consider the request of Louis R. DeMicco to amend the zoning map by changing the zoning from Agricultural to Commercial on property located at "Begin 397 ft. S. of the N.E. corner of Section 28, Township 37S, Range 35E and run W 150 ft. to P.0.B.; thence continue W for a distance of 211 ft.; thence S 130 ft.; then E 211 ft.; thence N 130 ft. to the P.0.B., Original Town of 0keechobee." No objections were heard or filed. President Domer read the Ordinance, whereupon Councilman Douglas moved the adoption of Ordinance No. 271 - (114) which was seconded by Councilman Bass and unanimously passed. PUBLIC HEARING ORDINANCE NO. 384 - 0KEAIRC0~ INC. - CABLE TELEVISION Pursuant to a public hearing published May 6, 1976, the meeting was opened as a public hearing to consider adopting Ordinance No. 384, an Ordinance further amending Ordinance No. 357, being entitled 0keAirCo, Inc. Cable Television of 0keechobee franchise Ordinance by modifying Section 22 dealing with duration of franchise upon condition of partial construction. ~o objections were heard or filed. President Domer read the Ordinance whereupon Councilman Bass moved the adoption of Ordinance No. 384, was seconded by Councilman Douglas and passed unanimously. DRAINAGE DITCH President Domer read a letter from MrS Ruth Wilson informing the Council of a city ditch dug on her property at S.W. 3rd ave. He advised the Council that Councilman Hunt, Director Fortner and himself had viewed the area and finding no property stakes had measured the lots to the best of their ability and found a miximum of three feet eroded into the lot for a distance of 25 feet. The Council approved contacting Mr. ~ilson by letter, advising her that if she wishe~ to have a survey made, it would be simple to ascertain the exact amount of erosion to her property made by the ditch. 1976 STREET LIGHT President Domer read a letter from the Florida Power & Light advising the Council that ~he Company was making application to the Department of Transporta- tion for a permit to construct an overhead power line and street light on State Road 7© at N.W. 9th Ave., Okeechobee, Florida. There were no objections by members of the Council. REZONING ORDINANCE - INTRODUCTORY AND FIRST READING President Domer presented on first reading amended Ordinance rezoning from Agricultural to Industrial for property described as" unplated land of City, all that part of N 668.71 ft. of E½ of SW~ of SE¼, Section 15, Township 37S, Range 35E. 5.06 acres, Original Town of 0keechobee" Requested by Charles E. and Myrna D. Farmer. Attorney Conlon advised the Council to delary on the request until the City adopts a new zoning plan. Following discussion, it was moved by Councilman Betts, secnnded by Council- man Bass and vote carried that the Ordinance be approved on first reading and notice of a public hearing to be held June 22, 1976 be advertised. BID PURPOSAL ON ~tANITORIAL SERVICE A purposal from Kissimmee Janitorial Service for cleaning the City Hall for $60.00 per week and window cleaning for $125.00 was submitted. Following discussion, the Council agreed to consider the services in the 76-77 budget year. It was moved by Councilman Betts, seconded by Councilman Bass and vote carried to authorize the expenditure of funds to have the City hall windows and screens cleaned. VOLUNTEER FIREMEN REPORT Larry Williams, President of the Volunteer Fire Department appeared, submitting a yearly report of equipment ~he Department and Auxiliary donated to the City. President Domer complimented the Department for their work and donation to the 0keechobee Fire Department. NO BURNING BAN Mr. Louthan Ager, 802 S.W. 5rd Ave., appeared requesting the Council not to lift the burning ban in the City of 0keechobee for health problems. He intro- duced Mr. George J. Humbert, Chemist of the Department of Envirmental Regula- tions of Ft. Pierce. Mr. Humbert submitted to the Council copies of Rules of the Department of Pollution Control Chapter 17-5 and Rules of the State ~reasurer and Insurance Commissioner as State Fire Marshall Chapter 4A-28, pertaining to' open burning and frost protection fires. He recommended the Council enforce these rules and offered his services to the City. Following discussion, the Council assured Mr. Humbert that the City would not pass a l~w permitting fire burning. I977 33 ~ CITY OCCUPATIONAL LICENSE Deliquent City Occupational licenses were discussed. Attorney Conlon reported that 0rdinanee No. 162,Section 12-20 of the City Code provides a penalty for violation of the Code. He recommended sending a certified letter advising them of the violation and giving them seven days to purchase a license or a warrant will be issued within 48 hours. Following discussion, the Council directed the Clerk 4o send a certified letter to each person or business that has not purchased a license. WATER DEPARTMENT - CONTRACTOR OVER CLORANATING WATER LINES President'Domer reported a pboblem that occured while Contractor, Tommy Markham, over cloranated a city water line and had failed to close the main valve or to notify the city of his action. Attorney Conlon advised that the Contractors will have to notify the City in the future before cloranating or wont be able to do any work on the lines. Director For~ner informed the Council that a cost of $492.50 was expended during this time on labor and 275,000 gallons of water used to flush out the lines. Following discussion, the Council directed Director Fortner to bill Tommy Markham for the cost. David Hunter, Dog Warden, appeared reporting on his activities of informing ~i~a~owners within the city limits to have their animals inoculated for rabbies. Chief Chisholm reported the 1966 truck used by the Dog Warden had deterior- ated beyond repair. The Council requested Councilman Bass and Chief Chisholm to get bids on ae~e~e~ c~ru ck. V~I~CE 0N PROPERTY FOR CITY LICENSE Building Official Spray informed the Council that the Board of Adjustment and Appeals had agreed to make a variance on Teddy Greenberger's request for a City Occupational lic~se in a residential area to sell flowers. RENOVATING CITY CLERK' S OFFICE Director Fortner submitted prices on revovating the City Clerks and water department offices. It was moved by Councilman Douglas~ seconded by Councilm~ Bass and vote carried to remodel the front and west office, items one through 6. DONATION 0F CONCRETE POLES T0 0.C.R.A. Councilman Betts discussed donating unused concrete poles to the 0keechobee County Recreational Association for lighting new te~is courts at the ball park and furnishing a tap fee and water service for a fountain. It was moved by Councilman Betts, seconded by Councilman Bass and vote carried to donate the concrete poles and to furnish a tap fee and water service 1.978 to the 0keechobee Citizens Recreation Association. 0KEECHOBEE COUNCIL ON AGING Fran Kerce, Director of Okeechobee Council on Aging, appeared reporting a shortage in the budget and requesting a donation. It was moved by Councilman Betts, seconded by Councilman Bass to donate $500.00 to the Council of Aging. Motion carried with Councilman Hunt voting no. Domer presiding. Councilmen E. H. Hunt, Edward W. Douglas and Clif Betts, Jr. were present. Councilman Lavon Bass was absent. Others present were: Sandra M. Bennett, City Clerk; David Con, on, City Attorney; L. C. Fortner, Jr., Director of Public Works; John M. Bennett, Water Supervisor; Edward Chisholm, Chief of Police and Richard B. PUBLIC HEARING ORDINANCE NO. 271-(1~5)- REZONING Pursuant to a public notice published May 20, 1976, the meeting was opened as a public hearing to consider the request of Wayne M. Pharr to amend the zoning map by changing the zoning from Residential (R-l) to Commercial on property located at Lots 10, 11 and 12, Block 122, Original Town of 0keechobee. No objections were heard or filed. President Domer read the Ordinance, whereupon Councilman Douglas moved the adoption of Ordinance No. 271-(115) which was seconded by Councilman Hunt and unanimously passed. REZONING ORDINANCE-AMENDING ORDINANCE NO. 271-INTRODUCTORY AND FIRST READING An application for rezoning was submitted by the City Clerk from Thelma McFarland. President Domer presented on first reading amended Ordinance rezoning from Agricultural to Commercial on property located at "Beginning 500 ft.
