Regular Meeting Tuesday, May 11, 1976
The City Council of the City O6u~k~&chobee, Florida, convened in regular session
in the Council Chambers at City Hall, Okeechobee, Florida, on Tuesday, May 11,
1976 at 7:00 p.m., President Russell V. Domer presiding. Councilmen E. H. Hunt,
Edward W. Douglas, Lavon Bass and Clif Betts, Jr. were present. Others present
were: Audley Dunham, Mayor; Sylvia Christian, Deputy Clerk; David Conlon, City
Attorney; L. C. Fortner, Jr., Director of Public Works; Edward Chisholm, Chief
Of Police , Richard B. Spray, Building Official and City Clerk Sandra Bennett.
The invocation was offered by Councilman Edward W. Douglas.
PUBLIC HEARING
ORDINANCE NO. ~7~ -(1,13,) - REZONING
Pursuant to a public hearing published April 22, 1976, the meeting was
opened as a public hearing to consider the request of Spencer Kirton to amend
the zoning map by changing the zoning from Residential (R-2) to Residential
on property located at Lots 5 and 6, Block 106, Original Town of 0keechobee.
No objections were heard or filed.
President Domer read the Ordinance, whereupon Councilman Douglas moved the
adoption of Ordinance No. 271-(~13) which was seconded by Councilman Betts and
unanimously passed.
PUBLIC HEARING
ORDINANCE NO. 38~ - FLORIDA POWER & LIGHT FRANCHISE
Pursuant to a public hearing published April 22, 1976, the meeting was
opened as a public hearing to consider ~dopting Ordinance No. 383, an Ordinance
amending Ordinance No. 376, which granted to Florida Power & Light Company, its
successors~and assigns an electric franchises, and imposing provisions and
conditions relating thereto, by amending Section 6 thereof to provide tax revenues
from I~dustrial customers within the corporate limits of the City of 0keechobee.
No objections were heard or filed.
President Domer ~ead the Ordinance, whereupon Councilman Hunt moved the
adoption of Ordinance No. 383, was seconded by Councilman Bass and passed
unanimously.
PUBLIC HEARING
ORDINANCE NO. 382 - HOUSE TRAILERS
Pursuant to a public hearing published April 22, 1976, the meeting was opened
as a public hearing to consider adopting Ordinance No. 382, an Ordinance abolish-
ing Ordinance No. 318 and amending Ordinance No. 315 by abolishing Section D,
being an Ordinance permitting house trailers in any zoning district on a
temporary basis up to six months duration in hardship cases.
No objections were heard or filed.
President Domer read the Ordinance, whereupon Councilman Douglas moved the
adoption of Ordinance No. 382, seconded by Councilman Bass and passed unanimously.

REZONING ORDINANCE AMENDING ORDINANCE NO. 271 - SECOND READING
President Domer submitted on second reading by title only~ an Ordinance
amending Ordinance No. 271 to amend the zoning map by changing the zoning from
Agricultural to Commercial for property described as "Begin 597 feet South of
the N.E. corner of Section 28, Township 57S, Range 55E and run W 150 Ft. to
P.0.B.I thence continue W for a distance of 211 ft.; thence S 150; thence E
211 ft.; thence N 150 ft. to the P.0 B , Original Town of 0keechobee " requested
by Louis R. DeMicco.
It was moved by Councilman Bass, seconded by Councilman Betts and vote
carried that the Ordinance be approved on second reading.
CONTRACT AWARDED - WATER MAIN EXTENSION TO MIDDLE SCHOOL
A letter was read from the 0keechobee County School Board recommending
the City accept the low bid of $16,752.50 from Richmond Construction Company
of Belle Glade, Florida for construction of the 8" water main extension from
U.S. 441, West on 27th Street to the new junior high scbJ3ol site.
A letter was also read from Engineer, Don M. Shepherd, recommending the
City award the contract to the lowest responsible bidder - Richmond Construction
Company.
It was moved by Councilman Douglas, seconded by Councilman Botts and vote
carried to award Richmond Construction Company the contract in the amount of
$16,752.5O.
COMPLAINTS RE: PRODUCE STANDS
Mr. William Krattiger, Hwy 4~1 S, appeared reporting a traffic hazzard
created by a produce stand on East SR 70 and their use of a trailer which he
questioned the legality according to City Ordinances on,uses of trailers within
the city limits.
Following ~£:ssussion, the Council referred the matter to Police Chie~
Chisholm for investigation and Attorney Conlon for research.
RESOLUTION - REVOKING RESOLUTION NO. 405 - FIRE BUPd~ING
President Domer submitted a Resolution revoking Resolution No. ~05 which
banned all open burning within the City limits of the City of 0keechobee,
Florida.
Fire Chief Godwin requested the Council to postpone action for another
month as they were still averaging a fire a day.
Following discussion, the Council agreed to table the adoption of the
Resolution until the next City Council meeting.
CITY ~UPATIONAL LICENSE APPLICATION
The City Clerk presented an application Xo~ a city occupational license
from Frances Grooms to sell fruit and vegetables &.~ her home which is a
residential area at 800 S.W. 2nd Ave.
The Council denied request as it was in a residential area.

CITY OCCUPATIONAL LICENSE APPLICATION
An application was presented for Councils consideration for a city occupa-
tional license from Teddy Greenberger for a retail florist business at
S.W. 4th Street.

REZONING ORDINANCE - AMENDING ORDINANCE NO. ,271 - INTRODUCTORY AND FIRST READING
The City Clerk submitted an application for rezoning from Wayne M. Pharr
for the Councils consideration. President Domer presented on first reading
amended Ordinance rezoning from Residential (R-l) to Commercial on property
located at Lots 10, 11,and 12, Block 122, Original Town of 0keechobee
It was moved by Councilman Bass, seconded by Councilman Douglas and vote
carried that the Ordinance be approved on first reading and notice of public
hearing to be held June 8, 1976 at 7:00 P.M. be advertised·
TRAILER PERMIT REQUESTED
Letters were read from the Okeechobee General Hospital requesting permission
to place a 24' x 60' double wide trailer at the west side of the hospital to be
used as a hospital laboratory and from Indian River Community College to place
a trailer at the 0keechobee site at 105 S.W. 2nd Ave. for two semesters, to be
used for the Man Power Training Lab.
Following discussion, it was moved by Conncilman Hunt, seconded by Council-
man Douglas and vote carried to decline to act upon the application from the
School Board for authorization to place a mobile home at the hospital property
until such time as the application is amended to comply with Ordinance No. 374.
It was moved by Councilman Bass, seconded by Councilman Betts and vote
carried to approve by Resolution, granting Indian River Community College
permission to place a trailer at the site for two semesters.
GENERAL REVENUE SHARING
The General Revenue Sharing Planned Use Report for the seventh entitlement
period July 1, 1976 through December 31, 1976 was presented by the City Clerk
in the amount of $49,612.00.
Councilman Hunt moved to designate the full amount of $49,612.00 for Water
System Improvements, seconded by Councilman Douglas and vote carried.
PURPOSALS - CONCRETE SLAB
President Domer reported that two purposals had been received for the
construction of concrete slab behind the new fire building.
It was moved by Councilman Hunt, seconded by Councilman Bass and vote
carried that the low bidder, Breland Marine Construction be awarded the contract
in the amount of $340.00 and to construct a slab under the siren tower for the
Police Department's emergency generator.
EMPLOYEE PROMOTION - POLICE DEPARTMENT
Chief Chisholm submitted an above satisfactory employee evaluation on
Richard P. Lamb and recommended he be advanced to Sergeant 11 for a six months
probation period.
It was moved by Councilman Bass, seconded by Councilman Douglas and vote
carried to promote Patrolman Lamb to Sergeant 11 with an increase of ~200.00
salary per year for a six months probationary period
POLICE DEPARTMENT REPORT
Police Chief Chisholm presented the Police Department Activity report for
the month of April 1976.
EMPLOYEE PROMOTION - POLICE DEPARTMENT
Chief 6hisholm submitted a satisfactory employee evaluation on ~ispatcher
M±ke Brown and recommended he be promoted to Patrolman 11, May 22, 1976.
It was moved by Councilman Bass, seconded by Councilman Betts and vote
carried to promote Brown to Patrolman ll, effective May 22nd, with a six months
probation period.
SEMINAR - POLICE DEPARTMENT
Chief Chisholm reported that 0heMay 26, 1976, the Attorney General's office
is having a seminar in Kissimmee on the new Supreme Court rullings for Law
Enforcement officials. He requested authomization for Captain Mobley and one
of the Sergeants to attend.
It was moved by Councilman Bass, seconded by Councilman Betts and vote
carried to authorize two of the City's P&lice Officers to attend the seminar
FIRE DEPARTMENT REPORT
Fire Chief Godwin presented the Fire Department report for the month of
April 1976.
CHURCH STORM DRAIN
Chief Godwin reported a request from the First Baptist Church for the
Fire Department to use their fire hose to unstop their storm drain.
After discussion, the Council denied the request with regret until it is
established that the Church has exhausted every means of cleaning the drain.
WATER~ SEWER AND STREET DEPARTMENT
Director Fortner presented the Water, Sewer and Street Report for the month
of April, 1976.
1. BIG FOUR CONSTRUCTION C0~PANY CONTRACT - WATERWORKS IMPROVEMENTS
MAINTENANCE WARRANTY WORK
It was moved by Councilman Hunt, seconded by Councilman Douglas and vote
carried to accept Big Four $],000.O0 Maintenance Bond for a six months period
on the accelator unit.
2. WATER BILLS ADJUSTED -'~
It was moved by Councilman Betts, seconded by Councilman Betts and vote
carried to adjust water bills as listed on Memorandum #2 due to change on meter
sizes.

WATER PLANT STAIRS IMPROVEMENT
Director Fortner reported that the stairs leading to the Water Plant up-
stairs, are two steep and requested authorization to redo them for a cost of
$~5o.oo.
It was moved by Councilman Betts, seconded by Councilman Bass and vote
carried to authorize Director Fortner to redo the steps at the water plant.
4. WATER INTAKE PUMP AND PLANT IMPROVEMENTS APPLICATION PERMIT
Director Fortner submitted an application for execution by the City from the
Department of Environmental Regulation for permit to construct a new intake
pump and plant improvements.
Attorney Conlon stated that the application was in order afterwhich President
Domer ~xecuted the application.
COUNCIL MINUTES
The City Clerk requested authorization to send copies of the Council
minutes to each Councilman for approval instead of the past policy of readin~
the minutes at the meeting.
It was moved by Councilman Douglas, seconded by Councilman Betts and vote
carried to authorize the Clerk to make copies of the minutes to send to each
Council member instead of the reading at the meeting.
BEARD'S WATER COMPANY
Mr. William Beard appeared requesting the Councils decision on his pur-
posal to sell his water company for $20,000.00 to the City.
The Council declined Mr. Beards purposal by a roll call vote: Hunt-na~;
Douglas - nay; Bass - nay and Betts - nay.
FINANCIAL REPORT
The Clerk presented a six months financial report on the General and Water
and Sewer Funds to the Council.
TRAILER PERMIT REQUESTED
Bob Oliver~ Lab Supervisor of the 0keechobee General Hospital appeared in
regards to the City permitting the hospital to place a trailer at the site.
President Domer informed Mr. Oliver of the Council's action.
DISBURSEMENTS
The following vouchers were approved:
General Fund $26,272.47
Watera~udd Sewer Revenue Fund 18,182. 13
ADJOURNMENT
There being no further business, President Domer declared the
meeting
