The City Council of the City of 0keechobee, Florida, met in regular
session on Tuesday, January ~0, 1976 at 7:00 P.M. with the following present:
President Russell V. Domer, Councilmen: E. H. Hunt and Clif Betts, Jr. Council-
men Lavon Bass and Edward Douglas were absent. A~o in attendance were: City
Clerk Sandra Bennett, Director of Public Works, L. C. Fortner, Jr., Captain
Larry Mobley and Building Official Richard B. Spray.
It being the hour of Seven O'Clock and pursuant to a Notice published
in The Okeechobee News regarding a public hearing to consider rezoning of Lots
18 and 19, Block 165, Original Town of 0keechobee from Residential (R-2) to
Commercial. President Domer asked if there were any objections to the requested
rezoning. No objections were heard of filed. Councilman Betts moved to rezone
the above described property as requested and to amend Ordinance Number 271,
seconded by Councilman Hunt and unanimously adopted.

ORDINANCE ESTABLISHING ZONING REGULATIONS FOR
THE CITY OF 0KEECHOBEE, FLORIDA, AND PROVIDING
FOR THE ADMINISTRATION, ENFORCEMENT AND AMEND-
MENT THEREOF PURSUANT TO THE PROVISIONS OF

WHEREAS, application has been made by Edward W. Douglas
requesting this Council to rezone from Residential (R-2) to
Commercial.

WHEP~EAS, notice of intention to amend City Zoning
Ordinance No. 271, regarding said application was duly
published according to law, and
WHEREAS, on the 20th day of January, 1976, a public

After tabulating the bids, the Council postponed action on awarding the
bid until a full council were present.
Mr. E. J. Strickland, was first on the agenda. He requested 300 feet
of Street right-of-way opened on Lots ],2 and 3, Block 42, S.W. Second Street.
Mr. Strickland remarked that he intended to build his home on the three lots
but needed the street opened. Director Fortner was recognized. He presented
prices on the clearing of the street from H. Spencer Kirton for $1,850.00 and
Rock-A-Way, Inc. for $880.00. Councilman Betts moved to open the street and to
accept Rock-A-Way's purposal to do the clearing, seconded by Councilman Hunt
and carried.
Mr. Cecil Newman was recognized. Mr. Newman described a problem with
smoke incurred by trash burning from First Federal, Mr. Charles Elders and Dr.
James R. Ternuiswood. He inquired if the City had any Ordinances regulating
trash burning within the City limits. He stated that he had reported the
incident to the Fire Department but no action had been forthcoming. President
Domer informed Mr. Newman that the Department of Pollution Control prohibits
any open burning. Councilman Betts informed the Council that he had talked with
an officer of First Federal~ about the problem and had been assured that they
would cooperate in any way the Council decided. After more discussion, the Council
instructed Captain Mobley to talk with Dr. Tenniswood and Mr. Elders about the
Department of Pollution Control regulations
Captain Mobley requested authorization to purchase an Olympia Electric
45 Typewriter for $344.25 for the Police Department and repair the Standary
Typewriter for the Fire Department. Councilman Betts moved to authorize the
purchase of the typewriter and repair the Standard for the Fire Department,
seconded by Councilman Hunt and carried.
Building Official Spray presented the quarterly Building report for
October, November and December. He also presented the total cost of $3,150.76
for the construction of the fire building. The Council Commended Mr. Spray for
his work and for keeping the amount under the $5,000.00 budgeted.
Director Fortner presented the Water, Sewer and Street Department report
for the month of December.
Included in the report was Memorandum #1 - Estimated cos~ per gallon
of water in clearwell for December, 1975.
Director Fortner also presented prices from Rock-A-Way~ Inc. for
$560.00 and Spencer Kirton for $485.00 for clearing alley behind the U.S. 441
and S.E. 5th Street located behind the Eastern 0il Station. He stated that this
amount will be paid by the owner of the Burger Queen as cost for installing the
sewer extne~sion line. Councilman Hunt moved to accept Spenker Kirton's pHoposal
of $485.00, seconded by Councilman Betts and carried.
He stated that Engineers Robert E. Owen and Associates, Inc. wanted to
know if the City was planning to use Federal monies for the purposed 24" water
main and intake pump as there might be certain rules to comply with. The

Council in~truc~ed Director Fortner to advise the Engineers that only Federal
Revenue Sharing monies would be used.
An agreement for professional services from Robert E. Owen & Associates~
Inc. to prepare plans, specifications and contract documents for approval for
the installation of air diffusers and air supply to convert the sewage treatment
plant sludge digestor to an aerobic facility. Action was postponed for further
investigation.
Councilman Betts moved to waive the second reading of Ordinance Number
377, An ordinance amending Ordinance Number 348, Code of Ordinance, City of
0keechobee, Florida, by providing an increase of water service, tappage fees
and further providing for increase in water consumer account deposits and Ordin-
ance Number 378, An Ordinance amending Ordinance Number 355, SectionS, by provi-
ding an increase in rates to be charged for water service, seconded by Council-
man Hunt and carried.
An application for taxi license was presented on Adrian's Taxi for the
Councils approval. The Clerk informed the Council that the Police Department
had reported that all regulations had been complied with. Councilman Betts
moved to approve the application, seconded by Councilman Hunt and carried.
President Domer informed the Council that the State of Florida License
Bureau Division had requested a waiver on the City's required $30.00 water
deposit. Action was postponed for City's Attorney investigation on the legality.
A rezoning application received from Mr. Louis DeMicco December 4, 1975
requesting that Lots 1, 2, 4, 5 and 6, Block 29, McMullins Woodland Park,
Original Town of 0keechobee from Residential (R-l) to Residential (R-2) was
approved to advertise upon a motion by Councilman Hunt, seconded by Councilman
Betts and carried.

of 0keechobee, Florida, a municipal corporation, will consider
rezoning from Residential (R-l) to Residential (R-2) and to
amend accordingly the Comprehensive Zoning Ordinance #271
adopted November 21, 1955, the following described real

An application for a city occupational license from Mr. Lee Sullivan
to sell doughnuts , coffee and soft drinks from a trailer at 100 S.E. 8th Street.
The Clerk informed the Council that the Health Department had approved Mr.
Sullivan's trailer. After discussion, the Council referred the matter to the
Building Official to advise Mr. Sullivan of the City's Ordinance on trailers in
the City limits.
The Clerk announced that a meeting with the City Auditor, Mr. Lee
Thomas, was scheduled for Tuesday, January 27, 1976.
Councilman Betts inquired of Director Fortner what action had been
taken to correct the depth of a ditch at the intersection of S.W. 3rd Avenue
and S.W. ]0th Street. He stated that he had been informed that children were
playing in the ditch. Director Fortner remarked that the County owns the right-
of-way but that the ditch is inside the City limits, the street was originally
a part of the state secondary road system but was turned over to the County
for maintenance. After discussion, Councilman Hunt moved to authorize Director
Fortner to take the elevation of the ditch and take whatever action needed,
seconded by Councilman Betts and carried.
