The City Council of the City of 0keechobee, Florida, convened in regular
session at the City Hall on the 9th day of December, 1975 at 7:00 P.M. with the
following present: President Russell V. Domer, Councilmen: E. H. Hunt, Edward W.
Douglas, Lavon Bass and Clif Betts, Jr. Also in attendance were: City Clerk,
Sandra Bennett, Attorney David Conlon, Director of Public WorkS~ L. C. Fortner, Jr.
Chief of Police, Edward Chisholm, Fire Chief 01en Godwin and Building Official,
Richard B. Spray.
President Domer opened the meeting with prayer.
Vouchers on the following funds were approved.
General Fund $ 45,141.80
Water & Sewer Operation and Maintenance Fund D3,947.68
Water & Sewer Revenue Fund $ 35,902.32
Water & Sewer System Revenue Fund 1,865.66
Minutes of previous meetings held October 2nd and 7th and November
11th and 17th, 1975, were approved on a motion by Councilman Hunt, seconded by
Councilman Bass and carried.
It being the hour of Seven O'Clock and pursuant to Notice of Letting-
Invitation to bid on one new Diesel Tractor and one new heavy duty 72 inch lift
type mower, bids were received, opened and read from the following:

The Council requested Director Fortner to tabulate the bids and
return a recommendation, afterwhich Director Fortner returned and stated that
Pippen Tractor and Equipment, Inc. had the.lowest bid and recommended they be
awarded the contract. Councilman Douglas moved to award the bid to Pippen
Tractor and Equipment, Inc., seconded by Councilman Bass and carried.
President Domer announced the regular Council meeting dates to be as
follows:
January 6 and 20, 1976
February 10 and 24, 1976
March 9 and 23, 1976
The Clerk was asked for her items of business. The announced a meet-
ing scheduled with the County Commissioners"Thursday, December 11, 1975 at
11:00 A.M. regarding the "2Q8" Water Resourses Plan. '-~
Building Official Richard Spray was recognized. He stated that he
had contacted the men the Council had chosen for appointment to the Board of
Adjustments and Appeals and they had agreed to serve on the Board. Councilman
Betts moved to appoint the following to serve as members of the Board of
Adjustments and Appeals as of January l, 1976, seconded by Councilman Douglas
and carried.

Lytle Raulerson One year term
Richard Johnson One year term
Attorney Conlon was questioned about City Charter Section 14-4 prohib-
iting dancing in a bar or any room connecting with a bar. He stated that the
City Charter regulating dancing in bars was enacted in 19DO due to being"
injurious to health and morals" He remarked that said Section was unemforcea-
ble and if Council desired, any further regulation could be done in the future.
Chief Chisholm was instructed to not enforce the Ordinance.
Mr. Reuben Thomas of NW 10th Street was recognized. He described a
problem w~ich resulted after building his home in 1960 directly on the property
line. He requested the City to donate to him part of the City's right-of-way
to build a front porch. Council informed Mr. Thomas that the City could not
give him city property.

Mr. Gary Eubanks was recognized. He informed the Council that a ditch
had been dug in front of his house at 1004 S.W. 3rd Ave. that Was approximately
three feet deep and questioned why the ditch had been dug that deep. Street
Supervisor Frank Bennett was asked to report. He stated that the ditch was dug
three feet due to a culvert under the street. Councilman Douglas was requested
to investigate.
An application for taxi license was p~sented on Nipper's Taxi for the
Council's approval. The Clerk informed the Council that all regulations had
been complied with. Councilman Douglas moved to approve the application,
seconded by Councilman Bass and carried.
The Council discussed other taxi's that hasn't complied with the new
City Ordinance. Attorney Conlon stated that the City could be liable in case
of injury if taxi owners doesn't have insurance. Councilmen Hunt and Douglas
both commented that they felt a ten day extension should be given. Councilmen
Betts and Bass felt that they had enough time After other recommendations and
suggestions President Domer asked for a straw vote to inform taxi owners that
hasn't complied with new regulations to cease operations. Councilmen Hunt and
Douglas voted no, Councilmen Betts and Bass voted yes. To bread the tie vote,
President Domer voted yes as he felt they had been given adequate time The
Council directed Chief Chisholm to notify taxi owners of the Council's decision.
Councilman Betts reported a request for a street light at the inter-
section of 7th and 19th Street in Woodland Park. He stated that the Police
Department had received three calls in the area with complaints of prowlers.
The Council requested Councilman Douglas to contact the Florida Power and Light
to put up the light.
Director Fortner presented the Water, Sewer and Street report for the
month of November 1975.
Included in the report was a notice to The City of 0keechobee, from
the Department of Transportation of a Public Hearing, State Project, State Road
70 from State Road 700 to Northwest 8th Ave. And from NE 5th Ave. to State Road
710, City of 0keechobee at the 0keechobee High School Lecture Hall on January
6, 1976 at 7:30 P.M. The hearing is being conducted to afford interested
persons the opportunity of expressing their views concerning the four laning
State Road 70.
Also included in the report was a letter from E.S. Roth, Development
Manager of Industrial Chemical Division informing Director Fortner that hydrogen
peroxide is not approved by EPA for use in drinking water.'
Memorandum Number 2-Parts for ditching machine $1,O15.50. Councilman
Hunt moved to authorize the purchase of the parts for the repairs, seconded by
Councilman Bass and carried.
Director Fortner requested permission to have Engineers, Robert E. Owen
and Associates, Inc. to draw up specifications for the aerator for the sewer
department. Councilman Hunt moved to authorize Engineers to draw up the specifica-
tions to advertise for bids, seconded by Councilman Douglas and carried.
Director Fortner presented an Employee Performance Evaluation on
William Pokusa in the water department recommending a salary increase of .20¢
per hour due to his obtaining his class c operators license. Councilman Hunt
moved to increase Pokusa's salary, seconded by Councilman Betts and carried.
Fire Chief Godwin presented the Fire report for the month of November.
He also presented specifications on two walkie talkies for the Council's approval.
Councilman Betts moved to approve specifications and advertise for bids, seconded
by Councilman Bass and carried.

Sealed Bids will be received by the City Council of the City of
0keechobee, Florida, at City Hall, until 7:00 O'Clock, P.M.,
January 6, 1976, at which time the bids duly submitted will be
opened and read, for the purchase of the following equipment:

Police Chief Ed Chisholm presented the Activity Report for the month
of November and the feed bill for prisioners for November.
Councilman Betts moved to increase Building Official Spray's salary
$400.00 through the merit incentive moneys budget in the 75-76 budget, seconded
by Councilman Councilman Bass. Mr. Sp~ay remarked that he refused the raise,
as he didn't receive it when he needed it. Councilmen Hunt and Douglas voted

Clerk Bennett requested authorization to give Shirley Williams, student
working through the Title 11 Manpower Program, in the Clerk's office a $15.00
Christmas bonus. Councilman Botts moved to authorize the bonus, seconded by
Councilman Douglas and carried. Councilman Hunt voted no and remarked that he
felt $10.00 would be sufficient.
There being no further business, the Council adjourned.

The City Council of the City of 0keechobee, Florida, convened in regular
session at the City Hall on the 23rd day of December, 1975 at 7:00 P.M. with the
following present: President Russell Domer, Councilmen: E. H. Hunt, Edward W.
Douglas and Lavon Bass. Councilman Clif Betts was absent.
A rezoning application was received from Edward W. Douglas, requesting
that Lots 18 and 19, Block 163, Original Town of 0keechobee, be rezoned from
Residential (R-2) to Commercial. Councilman Bass moved to advertise Notice of
Public Hearing to consider the rez0ning, seconded by Councilman Hunt and carried.
Councilman Douglas refrained from voting, due to conflict of interest.
NOTICE OF INTENTION TO AMEND CITY ZONING ORDINANCE #271
NOTICE is hereby given that the City Council of the
City of 0keechobee, Florida, a m~nicipal corporation, will
consider rezoning from Residential (R-2) to Commercial and
to amend accordingly the Comprehensive Zoning Ordinance #271
adopted November 21, 1955, the following described real
property, situate, lying and being within the corporate
limits of the City of 0keechobee, Florida, to-wit:
Lots 18 and 19, Block 163, Original Town of
0keechobee
and that a public hearing in relation thereto will be held
at 7:00 P.M. on the 20th day of January, 1976, in the City
Council room, City Hall, 0keechobee, Florida, at which time
all parties in interest and citizens shall have an opportunity

Police Chief Chisholm presented an outstanding employee performance
evaluation on Patrolman Marion Stafford in the Police Department and
that he be promoted to Sergeant 11 with an increase in salary of $200.00.
Councilman Douglas moved to promote Stafford to Sergeant 11 and increase his salary
$200.00, effective immediately, seconded by Councilman Hunt and carried.
