1975-09-09 Regular1880 The Clerk was asked for her items relating to the budget. She stated that Mr. Bill Sherman, County Property Appraiser, had certified that a tax rate of $4.49 per $1,000 valuation will bring in the same amount of tax revenue as that of last year. 1974 was $4.59 per $1,000 valuation. Also, she stated that as there is a accumalation of funds in the debt fund, the Council could decrease the mill from $1.65 per $1,000 valuation, including homestead to $1.11 mills. Leaving the millage as last year at $4.59 per $1,000 valuation, in the General fund will bring in an additional $12,000.00. She also stated that if the City Council agreed to leave the millage as last year, the City would have to advertise their intentions to exee4 certified millage and hold a public h~ring before they could adopt the desired millage. The following vote for 1975-76 millage was taken: Councilman Douglas voted for leaving the millage at $4.59 and Debt Service at $1.11 Councilman Hunt voted for leaving the millage at $4.59 and Debt Service at $1.11 Councilman Bass voted for leaving the millage at $4.59 and Debt Service at $1.11 Councilman Betts voted for leaving the millage at $4.59 and Debt Service at $1.11 The Council instructed the Clerk to proceed with the advertising. Salary for Captain Mobley was discussed. Councilman Betts moved to increase Mobley's salary to $9,800.00, seconded bM Councilman Bass and carried. Clerk Bennett reported that Attorney Conlon advised the Council against donating any money to the Chamber of Commerce in the 1975-76 budget due to Attorney General's opinion. Audl ey DuD_ham Mayor A letter from Mr. Van Duncan submitting a proposal to pick up abandoned and.junked vehicles was read. The Council instructed the Clerk to contact Mr. Duncan by letter, informing him that his proposal will be considered when the Council takes action on the matter. Councilman Betts reported that Mr. Frank Hogan had inspected Marvin Wherrell's building which is Adrian's Grocery at S.W. North Park Street and will forward his opinion to the City during the week. Councilman Bass reported that he has received several complaints re- garding the Labor Day festivals. The Complaints consisted of horses riding in the park and hay scattered over the park area. The Council agreed to discuss these problems with the Chamber before the next festival. President Domer gave a brief progress report on his contacting agents regarding F.H.A. new regulations on septic tank installations. He stated that he had made several calls to help modify the regulation. He also stated that other County ~fficials and other individuals had contacted Washington also. He felt as if HUD will take action in obtaining relief from the directive for Okeechobee. Police Chief Chisholm presented an application for employment on Jonathan Earl Rucks, Jr. in the Police Department for the Councils consideration. Chief Chisholm reported that Rucks was certified and had been employed by the 0keechobee County Sheriff's Department and recommended the Council employ Rucks as Patrolman 11. Councilman Bass moved to employ Rucks as Patrolman 11 at $7,700.00, seconded by Councilman Betts and carried. Pursuant to Notice published in The Okeechobee News regarding a Public Hearing to consider rezonin¢ from Residential (R-J) to Commercial, Lots 1, 2 and 6, Block 1, South 0keechobee and Lots 1 through 4, Block 238, Original Town of 0keechobee. President Domer asked if there were any objections to the requested rezoning. No objections were heard or filed. Mr. Charles Allen was recognized. He stated that Mrs. Scharsfchwerdt planned to sell the property to McDonald Restaurant.'~Councilman Douglas moved to rezone the above described property as requested and to amend Ordinance Number 271, seconded by Councilman Bass and was unanimously adopted. Amdl ey Dunham MAYOR Councilman Betts stated that he felt the Council should donate the $2,000.00 requested by Mr. Dan Sherman for the 0keechobee Citizens Recreation Association for the insurance premiums. No action taken. Councilman Bass moved to finalize the General 1975~1976 Budget, seconded by Councilman Hunt ~nd'carried. The Council authorized the Clerk to advertize the · Public Hearing on adopting the General budget October 2~ 1975 at 7:00 P.M. Director Fortner presented the Water, ~ewer and ~treet Department ~wport for the month of August. 1884 Included in the report was a letter from Donald M. Shepherd, Engineer of Robert E. Owen and Associates, Inc. Mr. Shepherd stated that since it is probable that the City will be required to relocate the present sewage treatment plant and increase its capacity he recommended the City get in the waiting line for 75% grant money before it stands the chance of reducing to a 55% grant in the "201 Plan". This would mean going a head jointly with the County on "Step 1" of the Plan and doing a complete preliminary engineering report in hopes that steps two and three could be combined. Mr. Shepherd suggested that the Council might consider the status of counties near 0keechobee. Polk, Hardee and DeSota Counties are involved in a "208" basin study for the Peace River. 0ceola, Orange and Lake are joined in a similar combined effort.. 0keechobee could join them or remain independent and retain control of 0keechobees own situation. After discussion, the Council agreed to meet jointly with the County Commissioners to discuss the "201 Plan." A letter from John Wilson, District Traffic Operations Engineer of the Florida Department of Transportation regarding State Project No. 91070-1514 requesting the City pass a Resolution regulating no parking on State Road 70. Action was postponed for investigation on how businesses would be affected by this regulation. A letter from Donald M. Shepherd, Engineer of Robert E. Owen and Assoc. Inc. was also included in the report advising the City of a study conducted by Owen and Associates on ozone and/or Peroxide for combating tastes and/or odors in drinking water. Memorandum No. 1 - One Emerson Air Conditioner, 18,000 BTU for $280.00, for the sewer plant lab. Director Fortner stated that the present air conditioner in the lab could not be repaired. Councilman Hunt moved to approve Memorandum No. 1 and authorized the air conditioner at $280.00 be purchased, seconded by Councilman Bass and carried. Mr. Don Laughran of McDonald Restaurant Food Chain Company was recognized. He displayed several drawings of McConalds Restaurm~ts and graphically the land surrounding the Restaurants. Director Fornter inquired about obtaining an easement through Re property for sewer line extension. Mr. Laughran stated that he will have to get in contact with the office and work it out in the future. He requested vacating the meander line running across tho property. I~ was pointed out that in the past~ a quick claim deed was all that was necessary to vacate the meander lines. The Council advised Mr. to contact their attorney regarding this matter. Building Official Richard B. Spray was recognized. He reported that State Law regulatee the tying down of trailers and the City will have to comply by enforcing all owners of trailers to comply with regulations. He stated that 0keechobee County was already enforcing this law. Mr. Spray requested authorization to enforce journeymen plumbers and Electricians to purchase competency cards for 75-76 at $5.00 per card. He stated the 0keechobee County is already requiring this regulation. Councilman Betts moved to authorize Mr. Spray to require Journeymen Electricians and Plumbers to purchase Competency cards at $5.00 for 75-76, seconded by Councilman Bass and carried. Police Chief Chisholm reported that he had attended Indian River Advisory Council and was advised that the City hasn't paid $471.69 for the quarter of July, 1975 to October 1, 1975. Councilman Bass moved to authorize payment of the $471.69, seconded by Councilman Betts and carried. The Police Department Activity report for the month of August 1975 was presented. The Fire Department report for the month of August 1975 was presented. President Domer announced the regular Council meetings dates to be as follows: October 7 and 21, 1975 November 11 and 25, 1975 December 9 and 25, 1975 The Council recessed to meet Thursday, September 11, 1975 at 6:30 P.M. Councilman Bass moved to authorize the purchase of a chain saw, seconded by Councilman Betts and carried. The Council entered into budget session. Increasing water and sewer rates for 1975-76 was discussed. The Council discussed and agreed to budget funds for a telephone key system that would combine all telephone numbers and telephones in the City Hall except the Police Department into one large system.
