The meeting was called to order at 10:00 a.m. by Chairperson Whitehall. II. STAFF ATTENDANCE — Secretary. Fire Chief Smith moved to dispense with the reading and approve the November 21, 2013, regular meeting minutes; seconded by Building Official Newell. Motion carried unanimously. IV. NEW BUSINESS — Chairperson. A. O'Reilly Automotive Stores, Inc. 14- 001 -TRC. Application was submitted by Jeremy Bass, Project Administrator, on behalf of the property owner, O'Reilly Automotive Stores, Inc., in regards to the construction of a new 7,650 square foot auto parts store located at 203 S. Parrott Avenue, Okeechobee, FL - Senior Planner. City Planning Consultant Brisson explained to the Board that the applicant is proposing to construct a new single story, 7,650 square foot retail auto parts store with onsite parking, landscaping and stormwater management feature. From a planning perspective, the applicant did a good job on their site plan. Mr. Brisson recommended approval noting a few minor stipulations. First, the easternmost parking space on the north side of the parking aisle parallel to Southeast 3rd Street is eliminated or the lot is reconfigured so as to provide adequate room for vehicles to safely back out of this space. Mr. Brisson stated that there was more than sufficient parking provided for on the site plan so eliminating a space would not cause a problem. Second, one more tree is added to the southern parts of the frontage along Parrott Avenue and along Southeast 2nd Avenue. Third, a sidewalk is added along the property's frontage on Southeast 3rd Street, should it be required by the Technical Review Committee. Lastly, that the Applicant submits a photometric lighting plan for the parking area, meeting the requirements of Sec. 78- 71(a)(5). TRC - May 15, 2014 - Page 2 of 4 IV. NEW BUSINESS CONTINUED. A. O'Reilly Automotive Stores, Inc. 14-001-TRC continued. Mr. Tom Rose, with Cardno TBE and as Site Project Engineer on behalf of the property owner, O'Reilly Automotive Stores, Inc., stated that he had no issues with the contingencies. He explained that the image of the trash pad on the site plan shows the doors open for location purposes. A six inch bump out has been provided for to allow a person to maneuver in and out of that parking space. There would be no problem in removing the parking space should it still be requested as he could see the potential for someone backing straight through those doors should they not be paying attention. There would be no problem with adding the additional tree. In regards to the sidewalk installation, he was not sure what the distance from back of curb to right of away line was. There could be a potential issue with a storm water grate near the intersection of Southeast 2nd Avenue and 3rd Street. Lastly, he stated he had received a photometric lighting plan so it would be no problem to provide that. Administrator Whitehall concurred that should there be no objection with the Committee, they would prefer to have the parking space by the trash pad removed. For clarification, one more tree was needed for each Parrott Avenue and Southeast 2nd Avenue. The sidewalk was an absolute and needed to be five feet wide and six inches thick. Public Works Director Allen was asked to meet with Mr. Rose to try to find a solution to the space issues. Mr. Whitehall told Mr. Rose that the Board appreciates the conciseness of the plans that were submitted and that the City is very excited about a new business coming to town. Comments from the Departments: County Environmental Health Department: Mr. McCoy mentioned that due to the age of the site, when construction starts, especially in the area where the retention pond is proposed, it is possible that an old septic tank could be dug up. Should this happen, just contact their department and they will take care of it. There could also possibly be some monitoring wells in the Southwest corner of the lot that are for a gas station that was located on the property where the prior U -Save grocery store was, Legal: Lots 1 through 12, Block 184, Barber's Replat. Secretary Burnette was asked to provide the previous owners' phone number to Mr. Rose to contact and see if this could be verified. OUA: Mr. Hayford had several items. Referring to sheet C1 of the site plan under General Notes, Number 16, any reference made to Southwest Florida Water Management Districts (SWFWMD) should be corrected to South Florida Water Management District (SFWMD). Under General Utility Notes, Number 1, Okeechobee Utility Authority (OUA) does not agree with the notation all utilities interfering with construction shall be removed, relocated, or adjusted by their owners, at their expense. Mr. Hayford stated that there is a preexisting water main running through the property that has been there for a number of years and prior to purchase. OUA is not in the position to move it for the sole reason of placing a building on the parcel. He further stated that OUA and O'Reilly are working on an agreement although it has not been finalized. On sheet C6, there is a minor issue with the placement of the sign in the Southwest corner of the parcel. The sign would be located right on the edge of the property line where OUA is proposing to install the water main. He suggested possibly moving the sign to the North about five feet. Building Official Newell stated that there would not be a problem with this placement as long as a parking space was not eliminated. Mr. Brisson interjected that should the sign be moved further North and a parking space need to be eliminated, this would not cause a problem as the parking spaces provided are well over the requirement needed. Mr. Newell also suggested Mr. Rose contact FDOT to check into what their sign guidelines were and whether permitting was necessary. Mr. Rose indicated FDOT had been contacted regarding a driveway connection to a State road so he would mention the pole sign to confirm there were no issues with the visibility triangle. On sheet C8, a new water main is shown being installed under Parrott Avenue by OUA. OUA is currently working on an easement agreement with O'Reilly to be able to run the new water main on the North side of Southeast 3rd Street abutting their property instead. The plans also show a hydrant being installed at the corner of Southeast 3rd Street and 2nd Avenue and OUA is proposing to install the hydrant at the corner of Southeast 3rd Street and Parrott Avenue. O'Reilly Automotive Stores, Inc. 14- 001 -TRC continued. removed and the existing hydrant located mid -block on Southeast 2nd Avenue will be relocated to the east side of the road to the new water main being installed as part of OUA's 2nd Avenue project. O'Reilly would like OUA to run a new water service line up to the new building, though OUA cannot do this as this is private property. O'Reilly would need to take care of this by hiring a plumbing contractor. Administrator Whitehall asked how OUA was going to accommodate a hydrant since the installation of the water main would not be installed across Parrott Avenue. Mr. Hayford responded that the preexisting water main on the east side of Parrott Avenue runs parallel to Parrott Avenue and they would tie into that existing 10" water main and continue down Southeast 3rd Street. The only other concern was on sheet L1 of 4, planting new trees right over the top of the new water main being installed down Southeast 3rd Street. Due to the scaling of the drawings, the plantings may be offset though he would like to have some assurance of that. There will be a new sewer line installed going over to the building down Southeast 2 °d Avenue and plantings are also shown for here as well. Mr. Rose responded that the trees along Parrott Avenue could be moved south a couple of feet within their property and the preexisting 8" tree labeled as #10 on this sheet could be moved north a little. In light of this discussion, Administrator Whitehall asked whether there were any existing overhead power lines that would need to be relocated. Mr. Rose responded that sheet C5 showed existing overhead power and poles to be removed and relocated. Mr. Hayford also mentioned a concrete pad that is located in the Southwest corner and going east down Southeast 3rd Street that is on top of the water main. Discussion followed regarding the best course of action to take since OUA would not be able to take the old main out of service until the new one is installed. Once OUA has an agreement in place with O'Reilly, it takes a month for them to get the new main. They would be able to cap the old and leave it there until O'Reilly hired someone to remove the pad. Then they could remove the old main and install the new. This was the agreed upon action. Building Official: Mr. Newell suggested Mr. Rose check with the Florida Department of Transportation (FDOT) regarding any special permitting or regulations they have regarding signs on State roads. He inquired as to whether Mr. Rose had checked on what the FDOT distance requirement was for the west entry cut on Southeast 3rd Street. Mr. Rose said he had been working with FDOT due to applying for a driveway connection to the State road and it was his understanding that FDOT would not have any issues with non DOT roads, that it would be up to the Municipality. It was agreed that FDOT specifications should prevail. Mr. Newell's other concern dealt with the storm water retention area. He understands that this is dry retention, not wet, and even though fencing is only specifically addressed in our Code for subdivisions, suggested fencing the entire area and landscaping it due to possible liability issues. He said this also looks better as normally tall grasses grow up. He will speak with the City Attorney to discuss whether the City can require this. Mr. Rose said he would relay this information and have someone email back their decision. Public Works: Director Allen stated again for the record that a 5' wide 6" thick sidewalk would be required along Southeast 3rd Street. He asked for copies of all FDOT, Department of Environmental Protection (DEP) and SFWMD permitting approvals. Police Department: No issues were received. Fire Department: Chief Smith inquired as to whether there would be any auto repair work on site. Mr. Rose responded that there would only be sales of auto parts, no repair work. Chief Smith commented that should there be storage of any type of hazmat materials, he would need to know the amount and an additional area inside the building may need some fire separation. Mr. Rose is not aware of any though he will keep this in mind during construction. TRC - May 15, 2014- Page 4 of 4 IV. NEW BUSINESS CONTINUED. A. O'Reilly Automotive Stores, Inc. 14- 001 -TRC continued. Fire Chief Smith moved to approve Application No. 14- 001 -TRC to construct a new 7,650 square foot auto parts store located at 203 S. Parrott Avenue, with the following contingencies: The easternmost parking space on the north side of the parking aisle parallel to Southeast 3rd Street by the trash pad is eliminated. One tree is added to the southern parts of the frontage along Parrott Avenue and along Southeast 2nd Avenue. Trees and landscaping on the site will be planted in a fashion so as to avoid any conflicts with utilities. A 5' wide 6" thick sidewalk is added along the property's frontage on Southeast 3rd Street. The applicant submits a photometric lighting plan for the parking area, meeting requirements of Sec. 78- 71(a)(5). Copies of all required permits from OUA, FDOT, DEP and SFWMD are received by the City; seconded by Public Works Director Allen. Motion carried unanimously. V. ADJOURNMENT— Chairperson. The Applicant should obtain a letter from the Okeechobee Utility Authority (OUA) stating that it has adequate capacity to serve the proposed use. Solid Waste Disposal: On a number of occasions the County has confirmed a consi- derable level of excess capacity available to serve the solid waste disposal needs of other developments in the City. It appears reasonable that the volume of solid waste associated with a development of this size can also be accommodated within the capa- city of the County's Solid Waste Facility. Traffic: According to the 8th Edition, ITE Trip Generation Manual, an auto parts sales business (ITE Code 843) could be expected to generate the proposed 61.91 trips per day on a weekday per 1,000 square feet of floor area and 5.98 trips per 1,000 square feet of floor area during the PM peak hour. Therefore, one could expect the average weekday traffic associated with O'Reilly Auto Parts to be about 474 trips and just under 48 trips during the during the PM peak hour. Drainage: In the event of any increase in the amount of impervious surface on the site will require that the Applicant meet all standards required by the City of Okeechobee and the South Florida Water Management District and Florida Department of Environmental Protection.
