Fortner, Jr. President Domer opened the meeting with prayer by Councilman Douglas. He informed the Council that due to a death in his family he would be out of town for sever&l days. He stated that Police Chief St&ars would answer any emergency calls~. Mr. Hunter informed the Council that the County was leaving animals at the pound without contactlng him of the condition of the animal. Councilman Bass was requested to contact Milton Rhoden to notify the City when leaving animals at the pound. Wi11xam Gore, owner of "Games People Play" at 118 E. $. Park Street was re- cognized. Mr. Gore discussed problems he had encountered in applying for and obtaining a: City OccupatiOnal License. He stated that he had received permission from the Building Official to open and had been informed the license would be mailed to him. With this endorsement, he had opended his establishment with $40,000.00 worth of equipment. Mr. Gore informed the Council that at a later date Mr. Spray and Chief St&ars had closed his business for lack of restroom facilities. Un, er these circumstances, Mr. Gore felt inclined to begin suit against the City, Mr. Spray and Chief St&ars. Attorney Conlon stated that his busxness was closed for violation of the sanltary code and could re-open if he corrects t~e situation which involves installing another bathroom. That he had been informed at the beginning that only meles would be allowed to use the sxngle bath- room but that agreement had been violated. Mr. Gore inquired if the Council was aware of other businesses in Okeechobee which were in violation of the Sanitary Code. Attorney Conlon stated that since there is a pending lawsuit, no co~ents would be made regarding the matter. Councilman Bass moved to pursue the case in court, seconded by Councilman Betts and carried. Mr. Patrick D. Greeley was recognized. Mr. Greeley requested an occupatzonal license for a mobile garage. President Domer lnquired to what extent of repairs would , he be making. Mr. Greeley stated that most of his repairs would be for Commercial Bussinesses and any extensxve repair for individuals would be made at his home at Rt. 4-9 Lemon Street. The Cler~ was authorized to issue Mr. Greeley an occupational license for a mobile garage. President Domer reported that due to some property owners in Ckeechobee purchas- ing their fire insurance from out of town companies, the excise tax was credited to other 1 ......... '! Vereen, Director of Municipal Police and Fire- men's Retirement Trust Funds had written that a number of cities have 9one to the.ir property owners asking for their assistance in increasing their tax contributions to the retlrement fund by making sure the property owner uses a City of Okeechobee mailing address on their insurance policy. President Domer stated that with the members of the Councils approval, he would contact property owners by letter asking them for their assistance. . The Council voiced their approval of said action. Councilman Douglas moved to accept the bid from Rockwell International, seconded by Councilman Bass and carrled. ; A letter from Motorola Communications. and Electronics, Inc. was read requesting the City to update their maintenance agreement. The Council requested Chief Staats to inves riga te. A mailgram from J. Robert Hunter, Federal Insurance Administration was read reminding the City that there are 90 days remaining before the Sanctions of Section 202 of the Flood Disaster P~otection Act of 1973 will begin to take effect in your communi~. After discussion the Council instructed the Clerk to complete the application and to contact t~e Regional Flood Insurance Specialists at the HUD Regional Office if there are any questions. Pursuant to Notice of Proposed Ordinance #374 advertised in the Okeechobee News President Domer asked if there were any objections to the adoption of said Ordinance. ORDINAN(]$ NUMBER 374 AN ORDINANCE A~)ING ORDINANCE NO. 294 (CHAPTER 19) OF THE CODE OF ORDINATES OF THE CITY OF OKEECHOBEE, FLORIDA, WHICH PROHIBITS HOUSE T~AILERS WITHIN THE CITY EXCEPT AS SET FORTH THEREIN TO ADD A NEW SECTION 5 (SECTION 19-4 of CHAPTER 19) TO ENABLE THE C~EYgiIOUNClL UPON FROPER APPLICATION TO PERMIT GOVERNMENTAL UNITS TO LOCATE HOUSE TRAILERS ( OR OTHER ~0~ILE HOUSING UNITS) ON GOVERN~$NTAL PROPERTY FOR TEMPORARY GOVERN~NTAL PURPOSES, BY RESOLUTION SETTING FORTH THE Tim LIMIT, USE PERMITTED AND OTHER CONDITIONS. BE IT ORDAINED BY THE NAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE~ FLORIDA: SECTION 1. That Ordinance Number 294 and Chapter 19 of the Code of Ordinances of the City of Okeechobee~ Florida, which prohibits House Trailers within the City except as set forth therein, is hereby amended by adding a new section thereto, to be numbered Section 5 of Ordinance Number 294, and Section 19-4 of Chapter 19 of the Code of Ordinances, which said new section shall read as follows: Sec. 19-4. S~me--Go~ernmental Use. Upon application to the City Council by a unit of Federal~ State or Local government, or any agency or entity thereof, citing that a temporary emergency or critical situation exists, or that a temporary need exists based upon economic or 1832 practical consider&txons, necessitating the use of one or more house trailers (or other mobile housin9 units by whatever name) as portable offices, portable classrooms, temporary e~ergency facilities, temporary emergency housing in case of natural disaster, or other temporary govermaent~l applications, the City Council may permit such use by Resolution. Such temporary uses shall be limited to governmental real property sites, except in the case of temporary emergency housing in case of natural disaster. Such Reso- lution shall set forth the length of time such temporary use shall be permitted, and -- other conditions and lxmitatlons as ~ay be warranted under the circumstances. SECTION 2. This Ordinance shall take effect iam~iately upon its passage by t~e City Council and its approval by the ~ayor. SECTION ~. This Ordinance was proposed, considered, and adopted under the provisions of Section 166.041 (3) (b) Florida Statutes, and was enac~d by no less than a two-third vote of the entxre C~ty Council. Afterwhich Director Fortner returned and recommended the bid from Barney's Pumps, Inc. be awarded the bid. Upon recommendation of Director Fortner, Councilman Bass moved to accept the bid from Barney's Pumps, Inc. of Lakeland, Florida for the purchase of two sewage pumps, seconded by Councilman Betts and carried. The proposals for Hospitilization Group Insurance were discussed. President Domer recommended the Department Heads review the proposals and present their recommendatiol to the Council. Building Official Spray p~esented the Building Department quarterly report for J&nu&~y, February and ~rch. He also presented a copy of Glades County Construction Industry Licensing Board Policies and recommended the City adopt the same regulations. The Council requested ~r. Sp~&y to mak~ copies £oz the Councils to zevxew and to give a copy to ~tr. Clayton ~hite, County Building Official. Police Chief St&ars presented the &ctivXty report for the month of ~arch. An application for employment was also p~esented on Jo Ann Eide for Radio Dispatcher fo~ the Councils consideration. After reviewing the application, Councilman Bass moved to employ Bide at $6,000.00, seconded by Councilman Douglas and carried. Robert N. Gernheuser, Sr. Distributor for Kirby Vacuum Cleaners was recognized. He informed the Council that he had previouslF &pplied for a Peddler~$ License but since that time he decided to ch&nge it to & merchants license. President Domer stated that he could re-apply in t~e Clerk, s office. Edmond Reutebuch~ Fire Chief As$istant~ was recognized. He presented the fire report for the mont~ of March. He informed the Council that the Fire will participate in a mock Disaster drill conducted b~ the Civil Defense May 15th. The eligibility age to participate in the City's Retirement System wa$,~ dis- cussed. Fireman Reu~ebuch informed t~e Council t~at ~o of the employees in the Fire Department was under 18 ~e&rs of &ge~ Therefore they weren't eligible. The Council commended Mr. Re~ebuch on his work durin9 the absence of Chief Godwin. The Water, Sewer and Street Department report for March was submitted by Director Fortner. Included in the report was & copy of a letter to Director Fortner from John Wilson~ District Traffic Operations Engineer informin9 him that a representative will investigate the parkin9 problem on State Road 70 & 15. Director Fortner reported that the Street Department was in the process of moving tree stumps from the Park. President Domer stated t~at he had discussed replacing trees in the park with Live OakS~ with M~. Van Murphy, of the Division of Forestry, but at the present they wouldn't have any available for a year. The Council instructed Director Fortner to investigate nurselies for prices on Live Oak trees. The Council discussed setting two regular meetings per month to cut down on the special sessions. Councilman Bass aoved to set up two regular meetings a month, seconded by Councilman Hunt and carried. President Domer reported the following schedule for regular City Council meetings to be published in The Okeechobee News : April 22, 1975 ~ay 6th and 20th, 1975 June 10th and 24th, 1975 Councilman Bass reported that Officer Lamb would like to sell his office furniture to The City for $400.00. Action postponed for investigation. Councilman Bass also reported receiving request from several members of the Methodist C~urch for a light in the alley behind the Methodist Church. Action postponed for investigation. President Domer reported that the meeting set up for Tuesday, April 1 at 8:00 P.M. to ~eet with ~tr. Donald Atwell of Oke Air Co., Inc. had been re-scheduled for Thursday, April ~rd. Preszdent Domer stated that at that tame, ~r. Atwell had not appeared. The Council recognized ~r. Jim Dykes. Mr. Dykes requested a steer light at S.W. 7th Ave. and 8th Street. The Council informed ~tr. Dykes that his request would be added to tne list. ~linutes of maetinDs held March 6 and 11, 1975 were read and approved by a motion by Councilman Bass, seconded by Councilman Douglas and carried. The Council reviewed Robert B. O~en & Associates, Inc. evaluation for a new raw water intake with pu~ps and improvements for the City's water works an~ evaulated proposal by Beach Water Associatzon for water service. The Council instructed Director Fortner to set up a meeting with Don Shepherd, Engineer, for Tuesday, April 15, 1975 at 3:00 P.M. to d~scuss the evaulation. An agreement for professional services on preliminary cost estimate for new raw water intake and pumps for City waterworks was presented for execution. The Council delayed execution for further investigation. ~ayor Dunham reported that he had contacted the F~ood Control Department garding opening the gate at Taylor Creek. He stated that they w~uld take it under con- sidera2ion. There being no further business, the Council adjourned to meet in a recessed session on April 10, lg75 at 6:~0 P.M.
