[~ey presented a petition to vacate an alley that runs through Block 69. After discussion, the ouncml postponed action and requested Mr. ~lark to submit to the Council the orooosed pi_ams for study and evaluation. Mr. W. I. Rooks ~.;as recognized. He informed the Council that he wanted to withdraw his reeuest to close S. E. 3rd Street between S. E. 3rd Ave. and S. E. hth Ave., but still requested that ~:S. E. 3rd Ave. between S.E. 2nd Street and S.E. ~th Street be closed, and block 2~ be rezoned from ,,Residential (R-2) to Residential (R-3). Action was postponed for further investigation. Richard B. Spray, Building Official was reco~onmized. He presented each of the Council with icopy of the Southern Stand~.~rd Swi~nin~ l~ool Code for tenative approval and review. Mr. Spray recomar,- ~ended the City adopt the code book for the protection of the public health, safety and welfare. !Councml advised Mr. Spray that they would study the book and report at next meeting. Police C~ef, Dew:itt Staats was recognized. He presented the Council with the Police iD~partment report for the month on traffic arrests and collections. Chief Staats reported that l[Franklin Griffin, Radio Dispatcher had resigned and presented the Council with an employment ' I ....I '- ! I[ '! ]70 aoplication on Perry Lamb for P~dio Dispatcher for the Councils consideration. After reviewing the !application, i]ouncitman Betts moved to employ Lamb, seconded by Councilman Douglas and carried. Chi~f Staats also stated that due to money being collected for fines over the week ends, i~e requested a safe in the Police D partment. Chief Staats was instructed to see if the safe in the ~ity Clerk' ~ ~ffice would meet his need. Chief Staats also requested that the new Ply~outh recently purchased for the police Department be used for investigation purposes and leave it white. Action !~abled. Fire Chief Godwin presented the fire report for the month of July. The Council instructed ~hief Godwin to send the County Co~missioner a copy of each f'ire report Chief Godwin reported that i~e had signed a satisfactory certificate on the new fire truck. Atterney Curren read Ordinance 372 for the third and final reading and reported that it had i~een duly published the required time. Councilman Betts presented said Ordinance and moved its ~d~ption, seconded by Councilman Douglas and carried. Councilman Douglas opposed. OP~INANCE NL~,~ER. 372 AN ORDINANCE AMENDING SECTION 32 OF THE CHARTER LAWS OF THE CITY OF OKEECHOBEE, FLORIDA, TO PROVIDE THAT THE CITY CLERK SHALL BE APPOINT- ED BY THE CITY COUNCIL AND SETTING FORTH THE DUTIES OF SUCH APPONT - ED CITY CLERK: TO FURTHER PRO¥IDE THAT THE ~2~tE~DI~flSNT OF THE CHARTER AS SET FORTH HEREIN BE SUBMITTED TO THE ELECTORS OF THE CITY OF OKEECHOBEE AT A SPECIAL ELECTION CALLED FOR SUCH PURPOSE. BE iF ORDAIN~ BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. AUTHORITY. This Ordinance is adopted pursuant to the provisions of Section 166.03~ Florida Statutes, and other applicable provisions of law. SECTION 2. FINDI~G. It is necessary, desirable and in the best interest of the City of Okeechobee, Florida, and its inhabitants that the Charter of the City of Okee- chobee be amended to abolish the elective office of City Clerk and provide that the CitM Clerk be appointed by the City Council. SECTION .~. PROCEDURE. The City Council of the City of Okeechobee, by adoption of tlzis Ordinance, submits to the electors of said municipality the proposed amend- men~, to its Charter; and such proposed amendment shall be submitted to a vote of the electors at a special election calied for such purpose prior to November, 197h. SECTION h. AMENDMENT. That Section 32 of the Charter Laws of the City of Okeechobee, Florida, which provides for an elective City Clerk and sets forth the duties of such clerk, is hereby amended in its entirety to read as follows: SECTION 32. CITY CLERK: DEPUTIES: DUTIES (1) CITY CLERK. There shall be a City Clerk, who shall be appointed by the City Council. The City Clerk shall furnish such bond as required by law or ordinance. (2) DEPUTY CLERK. A Deputy Clerk, or Deputy Clerks, may from time to time be appointed, and when appointed shall have the same powers and authority as the City Clerk. Such Deputy Clerks shall work under the direction and supervision of the City' Clerk. (3) DUTIES. The City Clerk shall perform the following duties: (a) Attend all meetings of the City Council and keep minutes of its proceedings, the correcness of which proceedings shall be certified to by his signature and by the signature of the presiding officer of the City Council of such meeting; and the official minuLes of the City Council, when duly signed by the ~,lerk and the presiding officer of such meeting shall be prima facie evi~ence of the facts and happenings stated therein. He shall furnish certified copies of the minutes as required. (b) Administer any oath required by law or the ordinances of the City. (c) Be the official custodian of the seal of the City and of all records and ~apers of an official character pertaining to the affairs of the municipality; and whenever an official seal is required on any official document of the City of Okeechobee, same shall be affixed by the City Clerk or ~eputy Clerk. (d) Sign all ordinances and resolutions and record in full in books kept for said purposes all ordinances and resolutions; and furnish certified copies as ree~aLred. (e) Perform any other duties required of the City Clerk by Charter or Ordinance and any duties delegated to the Clerk or applicable and proper to be per- formed by a City SECTION ~. !!~FECTIVE DATE. This Ordinance shall to effect immediately upon its --~ final Passage in accordance with the procedures set forth in Sec+' 166.021, . _vmon Florida Statute s. SECTION 6. SPECIAL ELECTION. After the effective date of this Ordinance the Charter Amendment set forth herein shall be submitted to a referendum vote of the electors of the City of Okeechobee, Florida, at a Special Election to be held on October 8, 1972, or as clo~e thereto as same can be held. Audle~y Dunham Mayor City of Okeechobee, Florida Attorney Curren presented an 6r~inance amending Ordinance No. 292 (Chapter 19) of the Code of Ordinances of the City of Okeechobee, Florida, which prohibits House trailers within the City except as set forth therein, to add a new section ~ (Section 19-2 of Chapter 19) to enable the City Council upon proper allication to permit Governmental units to locate house trailers (or other mobile housing units) on Governmental prooerty for temporary Governmental purposes, by resolution setting forth the time limit, use permitted and other conditions, for the Councils consideration. Action tabled for i further study. Councilman Betts moved to instruct Mayor Dunham to publish a proclamation giving notice that a special referendum election will be held and to instruct the City Clerk to publish notices in the Okeechobee News ~ving notice to the public that to be elegible to vote they must be a registered elector of the City of Okeechobee, seconded by Councilman Domer and carried. Director Fortner reported on a meeting with Engineer Donald L. Sheppherd and H. B. 'Dastafson, Consulta~f :i~ter and Waste Treatment from Tucson, Arizona regarding problems with the Westinghouse Clearifyer . Director Fortner stated that the plant was operating satisfactorily but that the Lake water had changed an~ did not expect it to stay operating satisfactorily when it chan{ed back. Director Fortner presented the Council with the Water, Sewer and Street monthly reports. Memorandum ~. Stock items at the water plant, total cost $~ ,397.70. Councilman Hunt moved to authorize Director Fortner to purchase items as listed, seconded by Councilman Betts and carried. Memorandum ]~. 1 model 8232 lawn boy mower at $~38.7~. Councilman Hunt moved to authorize Director Fortner to purchase the lawn mower, seconded byCouncmlman' Douglas and carried. Also included in the report was two letters from Donald L. Shepherd recommending certain improvements to put the plant on a more ideal working situation, and recommending improvements to the digester at the waste treat~~ent plant. Council requested Director Fortner to request a meeting ~ith the~n~neero ~ ' ~ for discussion on the suggested improvements. Also included in the report was an invitation to bid on one new self-propelled 3 wheel type street r:~.~eeper for the councils consideration. Action tabled for Further investigation, Director Fortner reported receivin~ a letter from Mr. Wallace W. McCormick, County Supervisor o~TM the Farmers Home Administration requesting the City to advise him when the Citys En~ineers anticipate the construction to be completed on the water plant. An application for employment was presented by Director Fortner from Forrest Gainer in the ~treet Department. After reviewing the application, Councilman Douglas moved to en~oloy Gainer, seconded by Councilman Hunt and carried. An application on Jimmy Phillips was also presented for employment in the ~7ater Department. Councilman Hunt moved to employ Phillips, seconded by Councilman Douglas and carried. Director Fortner reported sewer extension requests from Dr. Garcia for a clinic on Lots 1 through 12, BLock 121, N.~. 2nd Ave. and from The Okeechobee Missionary Baptist Church. The Water Com~ttee to investigate. Ale, tter was read from F~dwin H. }Ta.~an, Mayor of Brooksville regarding the Florida League of Cities beco~Lin~ more a:~d more oriented -towards the larger municipalities with very little, if any, thought .~iven to the smaller municipalities and requested if the City of Okeechobee would be interested '.mn participating in a small lea.~ue of Cities. No action taken. The City Clerk presented an application from Valerie Ann Harvey, for part time office help in the City CLerks office. After discussion, the ounczl postponed action for further investigation. ~finutes of the previous meetings held on May, Ih, 17th, June 11, 13 and lhth were approved on a motion by Councilman Beths and seconded by Councilman Douglas and carried. Dira. ctor Fortner presented an above satisfactory employee performance evaluation on Danny Hetton, Trainee and reco~.~nended a salary adjustment from $6,000.00 to $6,600.00. After discussion, Councilman Dou~las moved to raise Helton's salary, seconded by Councilman Betts and carried. Director Forbner also requested 3~6 hours over-time pay in the amount of $1,993.60 for 'the months of Dece~ber 1973 through May 197~. He stated that much of the over-time was spen~ at the water plant during the time when he was having problems with the clairfier.
