1974-07-09 Regular Councilman Domer reported that the Police D.epartment was short of help due to employees on vacation and moved to promote Marion Stafford, who was experienced in law work, from Radio 'l~Disoatcher to Patrolman 1 at $7,300.00, seconded by Councilman Betts and carried. Mayor Dunham recommended that the fee for qualifying be changed from $25.00 to $50.00 'for persons qualifying for an office. Attorney Curren informed the Council that the only requirement according to Citys Ordinances is that the person qualifying be a resident of the State !iof Florida for twelve months and of the City of Okeechobee for six months. An application for employment for Dog Warden fromDavid Hunter was presented by Mayor Dunham for the Councils consideration. After discussion, Councilman Douglas moved to employ David Hunter as iiDog Varden at $7,000.00 per year, seconded by Councilman Douglas and carried. TTpon motion the Council adjourned. Pursuant to notice published in The Okeechobee News regarding a public hearing to consider re-zoning of Lot 10, Block 170, Original Town of Okeechobee, from Residential (R-1) to Commercial, President Pro-Tem Domer asked if there were any objections to the requested re-zoning. No objections were heard or filed. ORDINANCE NO. 271 - (1 01 ) ORDINANCE AMENDING ORDINANCE NO. 271, BEING AN ORDINANCE ESTABLISHING ZONING REGULATION FOR THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDING FOR THE ADMIN- ISTRATION, ENFORCEMENT AND AMENDmeNT THEREOF PURSUANT TO THE PROVISIONS OF CHAPTER 176, FLORIDA STATUTES, 1953. WHEREAS, application has been made by D. R. Griffen for Police Patrolman was presented for the Councils consideration. After reviewing the application, Councilman Betts moved to employ Griffin at $6,000.00, seconded by Councilman Douglas and carried. Obtaining a loan for the proposed sewer expansion project was discussed. Attorney Curren was instructed to investi,~ate. The Fire Department report for the month of June was presented by Chief Godwin. He reported --~ the need of a shelter for the new fire truck. Several suggestions were discussed but no definite dec~_~sion was made. The Council postponed action until further study could be made. Chief Godwin requested authorization to purchase 100 ~al. tank of Akron UHX Style 999 Foam at $8,00 per ~Ta[. for the new Ford Fire Truc~ to be used on ~asoline fires resulting from accidents on the highways. Council~an Betts moved to authorize Chief Godwin to purchase the 100 gal. foam, seconded by Councilman ~)ouglas and carried. Chief Godwin also reported the new Ford fire truck wasn't fully equipment as per specifi- cations, but had been informed by American LaFrance that the equipment was in the process of being shipped. ~pon the request of Chief Godwin, the Council agreed to authorize the Fire Department to respong to fires caused b~ authomobile accidents in the County when there was a need for foam. A request for holiday pay was discussed. Attorney Curren pointed out that under the Fair Labor Standards Act Amendments of 197~, the utilization of compensatory time as a method of compensating employees for overtime work was eliminated. Attorney Curren further reported that the [97~ Amendments manda~e the payment of time-and-a-half to all employees covered under the law who work in excess of ~O hours in a work~eek. The C~ty Clerk 'was instructed to search the minutes for the Councils action on the past --~ ~olicy of a thre~ week vacation for employees employed by the City for 1~ or more years. Chief God~i~ requested a signal light be installed at East Park Street and S.E. 3rd Ave. to be controlled by the Fire Department when needed. ~he Council instructed Attorney Curren to contact the De~artm~n+~ ~ ~ of Tran~.~oortation, requesting approval to install a signal light and ~or information regarding what the City could do to protect the Fire Department vehicles and warning traffic to .yield ~o emergiency vehicles for immediate alternative. Mr. W. I. Rooks was recongni~ed from the audience. He presented the Council with a plot plan of Block 2~h, First ~ddition to Okeechobee and requested rezoning from Residential (R-2) to Residential (R-3). ~r. Rooks stated that he intended to construct ~8 units on the property with parking spaces. The Council tabled action of the re-zoning and advised Mr. Rooks to check with M~. Spray, Building Official, about the square footage area required for ~8 units. Mr. Rooks also re~.uested S. E. 3rd S?~ree'~ be closed between S. E. 3rd Ave. and S.E. ~th Ave. and S. Shevin, Attorney General, requesting an o~inion on the effect of House Bill 1110, if any, as passed by the Florida Legislature 197~ on the t~xibility of all property, inctud~flg Homestead, in a municipality for support of that City's General obligation refunding bonds which refunded ori~inal bonds issued prior to the adoption in 193h of Constitution 188~ Article !0, Section 7. He further stated that he had notified Bill Sherman, Tax Assessor of Okeechobee County and J. ~ Straughn, ?.xecutive Director, Department of ]Tf I Revenue of the request to the ^ttorney General. Attorney Curren also reported on abolishing the elective office of City Clerk and provide that the City Clerk be appointed by the City Council. He stated that the Home Rule Act can be changed by adoption of an ordinance amending Section 32 of the Charter Laws and submitting to the electors the proposed amendment to its Charter to a vote at aspecial election. He further stated that after discussin~ the special election with ~owena Parkerson, Supervisor of Elections, it was best decided the date for the elction would be October 8, 1972. Attorney Curren read Ordinance 372, an Ordinance amending Section 32 of the Charter Laws of the City of Okeechobee, Florida, 'to provide that the City Clerk shall be appointed by the City Council and ~etting forth the duties of such appointed City ler; to further provide that the amendment of the Charter as set forth herein be submit%ed to the electors of the City of 0keechobee at a special election called for such purpose. Councilman Hunt moved to adopt Ordinance #372 upon the first re~din~, seconded by ouncmlman Betts and carried. Mayor Dunham reported a request for a City Occupational license to peddle rabbits and chickens. He stated that the Ordinance book doesn't list a license in that category. Attorney Curren read and explained Charter Laws Section 12-1~. After discussion, the Council instructed the party that due to City Ordinance and State laws they would be unable to purchase a license. The Building report for the 2nd quarter was presented. Mr. Spray reported a request from the Okeeehobee General Hospital for the Councils consideration in an exception to the City code regarding placing a mobile Home within the City limits, so that a~mobile home could be placed at the hospital to be used as an office and sleeping quarters for the hospital emergency medical service Department. He further stated that a same request for a mobile Home in the city limits for office soace by the Drivers License Examiners for the Division of Drivers License. After discussion, '!',he Council instructed Mr. Spray to contact the Division of Drivers License and the Okeechobee ~neral Hospital requesting a written application of their request. Mr. Spray presented the Council with a copy of.The__ Southern Standard Swimming Code Bbok .furnish each Councilman with a copy of the code for further study. Mr. Spray thanked the Council for their consideration during his illness. Sergeant Mobley was present requesting information on accumulative compensatory time. The Council informed Sergeant ~lobley that the Department head specified when-the time could be taken. He also reported on a bend fender on the police car. The Council instructed Sergeant F~obley to contact Tommy Gaughn at The Okeechobee Insurance Company. Director Fortner presented the Water, Sewer and Street report for the month of June. Memorandum I - Material for under ~round drainage along the right of way in dilcox Shores at a price of $1 ,770.00. Director Fortner explained that Mr. gern Huf£man, Contractor, in the process of construting several houses in the area, had filled up the drainage ditch. The Council postponed action and instructed Director Fortner to contact Mr. Huffman requesting a meeting Friday, July 12 at t:00 P.M. to discuss the situation. Memorandum II - Material needed to up date church Directory sign at a cost of $~10.06. Director For~;ner reported that he had received a reply from sixteen Churches agreeing to pay $2~.00 for u¢-dating the sigms. Councilman Betts moved to instruct Director Fortner to proceed with the project ~.~ith the churches that had a~reed with plan, seconded by Councilman Hunt and carried. Memorandum III - Culverts needed for new streets at $86~.0~. Councilman Douglas moved to authori~.e Director Fortner to purchase culverts at $86~.0~, seconded by Councilman Betts and carried. Memorandum IV - One model #8232 Lawn Boy Mower at $t 38.71, for the ~ater Department. Councilman Hunt moved to authorize Director Fortner to purchase the mower, seconded by Councilman Betts and carried. Also included in the report were specifications for a three wheel type street sweeper for the Councils consideration. I~e Council postponed action until the next regular meeting for further stud~. Director Eortner informed the Council that Mr. Vern Evans had fill dirt that he would sell to the City at .2~¢ per yard. Councilman Douglas moved to authorize Director Fortner to purchase the fill dirt as needed, seconded by Councilman Betts and carried. Director Fortner reported a need for a shelter for a wo~¢ area and for the chlorine tanks.e He further stated that Mr. Martin Handshaw, 'I~ainee at the Sewer Plant would furnish the labor. Councilman Hunt moved to authorize Director Fortner to build the shed, seconded by Councilman Douglas and carried. A letter was read from ,~. M. Bost~ck, Jr., Regional Sanitary Engineer of the Division of Health infor~ng the City that he had been informed that Mr. L. C. Fortner, Jr. planned to leave the City in August. He state5 in the letter that it was imperative a qualified replacement be found for ~'ir. Fornter as required by Chapter ]OD-~ of the Florida Administrative Code and due to the complexity ~ of the plant, water treatment and chan~in~ raw water quality he felt it was essential the City gain ~the services of a least a Class "B'' operator who had sufficient chemistry background, to handle treat- ment problems. After discussion, the Council instructed Director Fortner to advertise in The American Water Works Association J~:.urnal for a Class Sewer Plant Operator. Director Fortner agreed 'to assist the City at the request of the Council, until an operator was employed. It was reported that the air conditioner in the City Clerks office was not working. Council- man Hunt moved to purchase an air conditioner ~th a heating unit at State price, seconded by Council- man Betts and carried, fhe Air conditioner in 'the Police Department was also reported not working~ Councilman Domer to investigate. Director Fortner reported that he was having trouble with the pump at the lift station at N.E. 6th Ave. and N.F. Park St.. He stated that the pump should be updated or a bigger pu~ be installed on groud level. 'Fhe Council agreed to consult with the Engineers. Director Fortner presented the Council with an unsatisfactory performance evaluation on William Robert Jenkins in t~.he 'Water Department and recommended that Jenkins be terminated. After questionin~ Director Fortner further on Jenkins performance, Councilman Hunt moved to terminate Jenkins upon Director Fortner recommendation, seconded by Councilman Betts and carried. Director Fortner also presented an application for employment from William Pokusa for Trainee in the Water Department for the Council~ approval. After reviewing the application, Councilman Hunt moved to employ Pokusa at $6,000.00, seconded by Councilman Douglas and carried. An application was also presented for employr.~'~ent in the Water Department for ramnee from Forrest Douglas Wyatt, Jr. Councilman Hunt moved to employ Douglas Wyatt, seconded by Councilman Betts and carried. President Pro-'£e~ Domer reported receiving a complaint from Mary Drago on a drainage problem and requested S. E. 17th Street be cleaned. Councilman Douglas stated that he would survey the site and investigate i~' ditch was dedicated right of way and report~.at next meeting. The Clerk was asked for her items of business. She informed the Council that a letter had been receive(] from Arthur B. J~.nes, Manager of the Insurance Services, Office of Florida in regard to the revision of the Fire Insurance rates for the City of Okeechobee to the better protection Class B, and that the new insurance rates have been mailed to the interested agents. President Pro-Tem Domer discussed Marion Stafford salary he received for Radio Dispatcher when he had been promoted to Patro~man and should have received Patrolman's salary. Councilman Hunt pointed out t~at Stafford was working as radio dispatcher at the time due 'to the Department being short of help . After discussion, Councilman Betts moved to authorize the Clerk to pay Stafford t~e difference. The motion died for a lack of a second. Minutes of the previous meetings on March 21, 27, April 9, 16, 30 and May 7, 197h were read and approved on a motion by Councilman Betts and seconded by Councilman Douglas and carried.
