Burk M~ERS OF THE CITY COUNCIL CITY OF OKEECHOBEE OKEECHOBEE, FLORIDA The meeting was called in due form in accordance with Charter and upon written notice si~ned by each Councilman, the City Council of the City of 0keechobee, Florida, met in a special session at the City Hall on the above date at 1:00 P.M. with the following present: President Donald L. Burk, Councilmen: G!~ff Betts, Jr., Edward W. Douglas, Mayor Audley Dunham, Attorney J. Edward Curren and City Clerk, Sandra Bennett.,Councilman Russell V. Domer. President Burk advised that the purpose of the meeting was to dis~cuss the resignation of the Human~ Officer . Mayor Dunham advised the Council that he had received a letter of resignation from the Dog Warden, David Vau~hn, effective as of June 21, 197~ and recommended that the resignation be accepted. ~e Council accepted the resignation upon recommendation of Mayor Dunham. Mayor Dunham reported on David Vaughn's two months unpaid telephone bill and two weeks vacation pay. After discussion the 'Council authorized the Clerk to issue a check to Vaughn for his two week~ vacation pay and to deduct the unpaid telephone bill from his salary or request a paid receipt of the bill. The Council went into recessed meeting scheduled at the June l~th meeting. Attorney Curren read Ordinance number 371 being entitled an Ordinance amending Ordinance Number ]~2 which established a pension and retirement system for employees of the City of Okeechobee, Florida; by adding subsections to Section 2 thereof to provide for an additional election period for e!i~ible employees; requiring participation by all employees becoming eligible on January 1, 1975 and thereafter; and making participation in the pension and retirement system a condition of employment. Councilman Betts presented the following ordinance and moved its adoption and upon being seconded by Councilman Domer was put to a vote and duly passed by affirmative vote of the four councilmen present which constitutes the enactive of said Ordinance by no less than the required two-thirds vote of the City Council to enact an emergency Ordinance. ORDINANCE NUMBER 371 AN ORDINANCE AMENDING ORDINANCE NUMBER 352 WHICH ESTABLISHED A PENSION AND RETIREMENT SYSTEM FOR EMPLOYEES OF THE CITY OF OKEECHOBEE, FLORIDA: BY ADDING SUBS~.CTIONS TO SECTION 2 THEREOF TO PROVIDE FOR AN ADDITIONAL ELECTION PERIOD FOR ELIGIBLE EMPLOYEES: REQUIRING PARTICIPATION BY ALL EMPLOYEES BECOMING ELIGIBLE ON JANUARY 1, 1 975 AND THERFAFTER: AND ~KING PARTICIPATION IN THE PENSION AND RETIRt~tENT SYSTEM A CONDITION OF EMPLOYMENT. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. That Ordinance Number 352 of the Code of Ordinances, City of Okeechobee, Florida, which established a Pension and Retirement System for employees of the City, 'o ~.o hereby amended by adding three subscetions to Section"2 thereof, to be numbered 2(a), 2(b) and 2(c), which said sub- sections read as follows: 2 Ca) - Any eligible employees who did not elect to become included in the City of Okee- chobee Pension Plan on January 1, 1972, or any anniversary date thereafter, are granted one additional opportunity to join the retirement system so long as they elect to do so prior to June 30, 1972. Any eligible employee failing to do so shall be forever barred from participation in such plan. 2 (b) - AIl employees who shall become eligible to be included in the retirement system on January 1, 1975, and all subsequent anniversary dates, shall become participants in the plan ~without election to do so, and will commence contribution into the Pension and Retirement System. It is the intention hereby that from and after the date of this Ordinance all municipal employees, e×cept those previously excluded by non-election, shall be participants in the Pension and Retirement Sys t em. 2 (c) - Participation in the Pension and Retirement System is hereby declared to be a condition of employment for all municipal employees. SECTION 2. Ail ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 3. This ordinance shall take effect in~nediately upon its passage by the City Council and its approval by the Mayor. SECTION ~. This Ordinance was proposed, considered, and adopted under the provisions of Section 166.O21 (3) (b) Florida Statutes, and was enacted by no less than a two-third vote of the City Council. I I 'I I" " 17 7 Councilman Domer reported that the Police D~epartment was short of help due to employees on vacation and moved to promote Marion Stafford, who was experienced in law work, from Radio iDis~atcher to ?atrolman 1 at $7,300.00, seconded by Councilman Betts and carried. Mayor Dunham recommended that the fee for qualifying be changed from $25.00 to $50.00 for persons qualifying for an office. Attorney Curren informed the Council that the only requirement according to Citys Ordinances is that the person qualifying be a resident of the State of Florida for twelve months and of the City of Okeechobee for six months. An application for employment for Dog Warden fromDavid Hunter was presented by Mayor Dunham for the Councils consideration. After discussion, Councilman Douglas moved to employ David Hunter as !!Dog Warden at $7,000.00 per year, seconded by Councilman Douglas and carried. TT~on motion the Council adjourned. PRESIDIal?
