NOTICE OF LETTING - INVITATION TO BID
Sealed Bids will be received by the City Council of the City
Of 0keechobee, Florida, at City Hall, until 7:00 O'Clock P.M.,
June 11, 197h$ at which time the bids duly submitted will be opened
and read for furnishing and delivering various sizes of sign faces
made with Scotchlite Brank R flective Sheeting or Scotchcal Brand
Non-Reflective Film as needed by the City of Okeechobee during the
next twelve (12) months following receipt of bids.
The City Council of the City of Okeechobee reserves the right
to reject any or all bids or the accept the proposal deemed most
advantageous to the City.

Improving the telephone system for the Mayor, s office, City Clerk's office, Building Officiall
office and ?~blic Works office by installing key telephone system with intercom was discussed.
Director Fortner was instructed to investigate cost of new system and report at a workshop meeting.
Attorney Curren requested a workshop meeting to discuss amending Ordinance number 3~2,
The Pension and R~'tirement System for employees of the City, by adding that the plan be manditory
for all employees, revising the election, of City Clerk to appointive and the possibility of
abloshing the City Court.
Fire Chief Olen Godwin presented the Fire Report for the month of April. Chief Go~in
requested permission to attend the State Fire Convention in Melbourne, Florida May l~th through
the 18th. Councilm~n Douglas moved to authorize Chief Godwin to attend the Convention, seconded by
Councilman Hunt and carried.
A re-zoning application was received from D. R. Daniel requesting Lot 10, Block 170,
Original Town of Okeechobee, be rezoned from Residential (R-I) to Commercial. Councilman Hunt
moved to publi sh notice of public hearing to consider rezoning the above described property,
seconded by Councilman Douglas and carried.

NOTICE is hereby given that the City Council of the City of Okeechobee,
Florida, a municipal corporation, will consider rezoraing from Residential (R-~)

to ommercmal and to amend accordingly the Comprehensive Zoning Ordinance #27~
adopted November 21, 19~, the following described real property, situate,
lying and being within the corporate limits of the City of Okeechobee, Florida,
to-wit:

and that a public hearing in relation thereto will be held at 7:00 P.M. on the
9th day of July, 1972, in the City Council room, City Hall, Okeechobee, Florida,

A letter was read from H. H. Raulerson, Chairman of the Board of County Commissioners,
requesting the City to submit their budget requests to the Board of County Commissioners for the
fiscal year 1974-75 on or before May 23, 1974. Matter referred to Councilman Betts.
A letter was read from sixteen citizens residents living in the area between The Record
Ranch and the Tastee Freez on U.S. 441 South informing the Council about a noisy and disorderly
crowd that distrubed the peace. After discussion the Council agreed to discuss the matter with
Police Chief Staats.
A discussion on General Revenue Sharing planned use report was heard. It was the consensus
of the Council to designate the entire Federal Sharing Fund of $130,748.00 for water system improvement
Councilman Douglas instructed Director Fortner to present specifications on street sweeper
at next meeting.
Director Fortner requested authority to have a survey made at Hensell Viers at 311 S. W.
17th Street and west of 3rd Ave. for a water line extension easement. The Council instructed i~
Director Fortner to investiEate cost of survey and report at next meeting.
Chief Godwin expressed his appreciation to the Council for the Volunteer firemen's __~
uniforms. Chief Godwin stated that there were now 17 complete uniforms.
Increasing the City Clerks salary from $7,200.00 to $8,000.00 was discussed. Councilman
Betts moved to increase the salary to $8,000.00 retroactive October 1, 1973, seconded by Councilman
Hunt and carried.
Minutes of the meeting held March 12th was read and approved as read upon motion of
Councilman Douglas, seconded by Councilman Hunt and carried.
The Clairfier at the water plant was discussed. Director Fortner informed the Council
that Westinghouse Electric Corporation Infilco Division and City Engineers were attempting to work
out a solution to the problem.
Upon motion the Council recessed to Tuesday, May 14th at 6:00 P.M.

The City Council of the City of Okeechobee, Florida met in recessed session at the City --~
Hall on the above date at 6:00 P.M. with the following present: President Donald L. Burk, Councilmen $
E. H. Hunt and Russell ¥. Domer, City Clerk Sandra M. Bennett, Attorney, J. Edward Curren and
Director of Public Works, L. C. Fortner, Jr.
A letter was read from B. Jay Baraff, Attorney for UltraCom, Inc., regarding clarification
of "gross subscriber revenues" and enclosing "Clarification of the Cable Television Rules and
Notice of Proposed Rulemaking and Inquiry" paragraphs 91 through 104 which deal _with franchise fees,
released by the Federal Communications Commission, requested by the Council at April 30th meeting.
After reading and discussing the rulings, Attorney Curren read the revised ordinance. The Council
called a recessed meeting May 17th, 1972 at 1:00 P.M. to sign ordinance.
The City Clerk presented the Council with an employee performance evaluation on Bernice
Elders, Clerk 1 in the Water Department for authorization to raise her to Clerk 11 at the salary
of $6,000.00 as July 1, 1972. Councilman Domer moved to authorize the Clerk to promote Elders to
Clerk 11, seconded by Councilman Hunt and carried.
An application for employment was presented by Director Fortner on Martin B. Handshaw for
water plant operator for the Councils consideration. After reviewing the application, Councilman
Hunt moved to authorize Director Fortner to employ Handshaw, seconded by Councilman Domer and carried.
Upon motion the Council recessed to Friday, May 17, 1972 at 1:00 P.M.

The City Council of the City of Okeechobee, Florida, met in recessed session at the City
Hall on the above date at 1:00 P.M. with the following present: President Donald L. Burk,
Councilmen: E. H. Hunt, Edward W. Douglas, Russell V. Domer, Clifford C. Betts, Jr. and City Clerk
Sandra Bennett.
President Burk read Ordinance number 370 amending Ordinance number 357 being entitled
Okee Air Co., Inc. Cable Television of Okeechobee Franchise Ordinance, by adding new sections 27
relating to completion of system, section 28 concerning maintenance of local office and complaint
procedure, by adding new subsection 9 (e) providing a construction time performance bond and
modification of Section 12, 12 and 22. Councilman Domer presented said Ordinance and moved its
adoption under the provisions of Section 166.O21 (b) Florida Statutes. Upon being seconded by
Councilman Betts was enacted by no less than a two-thirds vote of the City Council.

AN ORDINANCE AMENDING ORDINANCE NUMBER 3~7 OF THE CODE OF ORDINANCES,
CITY OF 0KEECHOBEE, FLORIDA, BEING ENTITLED OKE AIR CO., INC. CABLE
TELEVISION OF OKEECHOBEE FRANCHISE ORDINANCE, BY ADDING NE~ SECTIONS
27, RELATING TO COMPLETION OF SYST~, SECTION 28 CONCERNING MAINT-
EN~2~CE OF LOCAL OFFICE AND COMPLAINT PROCEDURE, BY ADDING NEW
SUBSECTION ~ (e) PROVIDING A CONSTRUCTION TItlE PERFORMANCE BOND
AND MODIFICATION OF SECTION 12, 12 AND 22.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA:
1. That Ordinance Number 317 as modified by Ordinance Number 367 of the Code
of Ordinances, City of Okeechobee, Florida, being entitled Oke Air Co., Inc. Cable
Television of Okeechobee Franchise Ordinance, be and the same is hereby amended by
adding thereto and inserting therein, the following sections to be numbered 27 and
28, which said sections read as follows:
"Section 27. Completion of System. Oke Air Co. shall complete construction of
the system on the following schedule; within one (1) year after FCC approval to
construct the system, not less than 60 percent of the system shall be completed,
with energized trUnk line to be extended to not less than 10 percent of the system in
each of the ensuing four (2) years."
"Section 28. Local Office and Complaint Procedure. Oke Air Co. shall maintain a
local office or a~ent, with a phone number available to take any subscriber complaints,
which shkll be as speedily resolved as is possible under the state of the art and
capacity to obtain parts where required. Any subscriber complaint not so resolved
may be reported by the subscriber to the Mayor of the City of Okeechobee, who shall
receive and act on such complaints and make report to the City Council for further
action where resolution is not achieved."
Section 5 is amended to include a new subsection (e), which said subsection
shall read as follows:
"Section 5 (e). Construction Performance Bond. The Company shall furnish a Bond
to the City in the sum of $5,000.00 to guarantee performance of Section 27 of this
Ordinance as amended."
Section 12 is clarified as follows: Any rate increases will be subject to prior
approval by the City, which will not act until appropriate public proceedings affording
due process have been held.
Section 12 is modified to make clear that the 3 percent payment to the City shall
be 3 percent of '~ross subscriber revenues", except, however, that this franchise fee
base shall change to "gross revenues" automatically in the event the FCC changes its
rule s.
Section 22 is amended to state specifically that there will be only one ten year
renewal option and before it is approved by the City, the City Council will review the
qualifications of the franchise holder, including its continuing legal, technical,
character and financial qualifications, and will also review its past operations to
ascertain that they have been totally satisfactory.
2. This Ordinance shall take effect immediately upon its passage by the City
Council and its approval by the Mayor.
3. This Ordinance was proposed, considered and adopted under the provisions of
Section 166.021 (3) (b) Florida Statutes, and was enacted by no less than a two-thirds
vote of the City Council.
