1974-04-30 Recessed NOTICE OF INTENTION TO AMEND CITY ZONING ORDINANCE #271 NOTICE is hereby given that the City Council of the City of Okeechobee, Florida a municipal corporation, will consider rezoning from Residential (R-1) to Commercial and to amend accordingly the Comprehensive Zoning Ordinance #271 adopted November 21, 1955, the following, described real property, situate, lying and being within the corporate limits of the Cil~y of Okeechobee, Florida, to-wit: Lots 2 and 3, Block 220, Original Town of Okeechobee and that a public hearing in relation thereto will be held at ?:00 P.M. on the ?th day of May, 197h, in the City Council room, City Hall, Okeechobee, Florida, at which time all parties in interest and citizens shall have an opportunity to be heard. After reviewing the application, Councilman Douglas moved to employ Nelson, seconded by Councilman Betts and carried. Director Fortner requested permission to increase Cleveland Palmer Lambe salary as he had been with the City for six months during the time ha had been injured on the job and in the hospital. The Council granted permission to increase Lambs salary. Councilman Douglas reported that he had discussed the drainage problem ~thMr. ~ltobello at the A & P's parking area and that Mr. Altobello had remarked that he would pay one half of the cost of 'repair. The Council recessed to meet at 6:00 P.M., Tuesday, April 30, 197h. PRESIDENT CITY COUNCIL CITY CLERK April 30, 197h The City Council of the City of Okeechobee, Florida, met in recessed session at the City Hall on the above date at 6~00 P.M. with the following present: President Donald L. Burk, Councilman E. H. Hunt, Russell V. Domer, Edward W. Douglas, Director of Public Works, L. C. Fortner, Jr.~ Attorney J. Edward Curren and City Clerk Sandra Bennett. Mr. Donald R. Atwell, President of UltraCom, Inc. requesting the Council to consider amending Ordinance Number 357 by adding new sections 27 relating to completion of system, Section 28 concerning maintenance of local office and cor~olaint procedure and modification of Sections ~' 12, l~ and 22 to assure complete compliance with the Federal Communications Commission rules and " regulations. Councilman Domer asked Mr. AtOll about the performance bond ~hat had been cancelled. ,~ Mr. Atwell assured Councilman Domer that he had instructed his company to issue a new bond. ' [P~esident Burk asked Mr. ^twell if F.C.C. doesfi~t gTant the waiver would UltraCom still plans to go i!ahead with the construction, Mr. Atwell stated that they would. ~ncreasing the performance bond was ildiscussed. Mr. Atwell had no objections. It was agreed to continue the $1,000.00 performance bondd ~and to stipulate a $~,000 construction bond in the amended ordinance. The Council requested Mr. Atwell to furnish the City with a letter with the new regulations from F·C.C. Mr. Sam Vaughn's request for water line extension to Hector Feed Mill at 1000 N.W. 9th $~reet !iwas discussed· It was agreed to place a meter at the nearest fire hydrant for their use The specifications on the new police car was presented for the Councils approval and re- ilquested permission to advertise for bids. Less Trade In: one (1) 1972 Ford Custom 500 - Four Door, two tone paint, heater, air condition, radio, tinted glass, power steering, power disc brakes, vinyl trim interior, 200-2V cubic inch motor, ll9 inch wheel base, three speed hydromatic transmission and hydraulic valve lifters. Said bids will be opened in the Council chamber at the City Hall in Okeechobee, Florida at 7:00 P.M. on June 11, 1972. Councilman Hunt requested the Council to consider paying Mr. Charles Harvey for clearing City Street. Attorney Curren reported that on Monday, April 8, 1974, President Nixon signed into law the Fair Labor Standards Act Amendments of 1974 which, for the first time, extends coverage of the minimum wage law to state and local employees effective ~ay l, 1974. Public safety employees remain 'exempt from the overtime pay provisions of the law until January l, 1975. The law states: No !i employer shall employ any of his employees who in any workweek is engaged in commerce or in the i! production of goods for commerce, for a workweek longer than forty hours unless such employee i receives compensation for his employment in excess of the hours above specified at a rate not less than one.:and one-half times the regular rate at which is is employed. This mliminates the utilization of compensatory time as a method of compensating employees for overtime work. Except for public safety personnel, these provisions apply to all municipal employees on ~ay l, 1972. This ~. provision does not, however, prohibit carrying beyond May 1, 1972, accrued compensatory time build up before that date. Needed improvements at the old water plant building were discussed. Councilman Domer reported that the existing chlorine room on the South side of the building be removed, a door installed and a concrete slab poured for the new ton chlorine tanks and a shed constructed over the door and tanks. The Council voiced their approval of the improvements. Director Fortner reported receiving a utility easement from Mr. L. M. Pearson that was requested by the City at February 5th meeting in regards to a water line extension to Lucy Island. Director Fortner stated that the easement did not allow enough room for utility lines or did not include the bill of sale. After discussion the Council referred ,matter to Attorney Curren for investigation and clarification. Broken glass caused by a car accident was reported at the corner of N. Park Street and S.W. 5th Ave. Matter referred to Director Fortner. Director Fortner was also instructed to clean up area around water plant. Upon motion the Council adjourned. ~/,~_~ ~~ ?
